o What is RA 9262?
It seeks to address the prevalence of violence against women and children (VAWC), abuses on women
and their children by their intimate partners like:
Husband or ex-husband
Live-in partner or ex-live in partner
Boyfriend/girlfriend or ex-boyfriend/ex-girlfriend
Dating partner or ex-dating partner
The Act classifies violence against women and children (VAWC) as a public crime.
Allows women and their children to secure barangay protection order (BPO) and/or temporary or
permanent protection order from the courts.
The BPO - an ex parte Protection Order issued by a Punong Barangay or kagawad under the AntiVAWC
Act to prevent further abuse of or violence and relief from said abuse or violence by ordering the
respondent to stop:
15 days and it cannot be extended but another BPO may be issued if within the 15-day period,
the respondent commits physical violence or threatens to physically harm the woman.
Anyone of the following may also file the protection order in behalf of the victim/s:
a. Parent or guardian
b. Grandparents
c. Children and grandchildren
d. Relatives (aunts, uncles, cousins, in-laws)
e. Local officials like Punong Barangay or Barangay Kagawad and DSWD social workers
f. Police
g. Lawyers
h. Counselors
i. Therapists
j. Health care providers (nurses, doctors, barangay health workers)
k. Any two people who came from the city or municipality where VAWC happened and who
have personal knowledge of the crime.
The barangay official cannot issue a BPO to a person who does not live within the brgy hence,
she should file a petition for Temporary Protection Order and Permanent Protection Order in
the Family Court where she resides.
If this is the case, the barangay official should assist the woman in filing a criminal complaint
with the police and/ or in filing an application for Protection Order in court.
Is proof of physical injuries or Medico Legal Certificate required before a BPO can be granted?
No. But it is advisable that the woman should get one, together with pictures of her
injuries. She might file an application for Protection Order in court or a criminal case and the
evidence will be useful.
What can the woman do if the barangay official failed or refused to issue the BPO within 24
hours from application?
a) She can file an administrative complaint against the barangay official for failure to
perform his/her duties. The complaint must be filed with the Sangguniang
Panglunsod or Bayan.
b) She can go to the police station to complain against the perpetrator.
c) She can go to the Clerk of Court of the Family Court where she lives and request
assistance in filing for a Protection Order
File an independent civil action for damages and criminal action for the violation of anti-VAWC Act.
Children are those below 18 years of age or older but are incapable of taking care of themselves (as
stated in Republic Act 7610). It includes the biological children of the victim and other children under
her care.
o Can women be liable?
Women can also be liable under the law. These are the lesbian partners/ girlfriends or former partners
of the victim with whom she has or had a sexual or dating relationship.
o What if it is the woman who committed violence against her male partner?
The law acknowledges that women who have retaliated against their partners or who commit violence
as a form of self-defense may have suffered from battered women syndrome (BWS).
The law does not allow the offender to have custody of minor children. Their care is still entrusted to the
woman even if she is found to have BWS.
o If the father of a minor child does not give financial support, what criminal cases can be filed
against him?
Violation of Section 5 (e) (2) of the Anti VAWC Act and R.A. No. 7610 (Anti-Child Abuse Law)
o Depriving the wife or threatening to deprive the wife of custody of the minor children is
psychological abuse.
If the courts have proven that the offender is guilty of the crime, he may be imprisoned and will be
obliged to pay P100, 000 to P300, 000 in damages.
The length of imprisonment depends on the gravity of the crime. (parricide, murder,homicide
Deprivation of support; verbal abuse, threats of physical violence)
The offender is also obliged to undergo psychological counseling or psychiatric treatment. Being drunk
or under the influence of prohibited drugs cannot be taken as an excuse for committing VAWC.
