MEMORANDUM OF AGREEMENT
KNOW ALL MEN BY THESE PRESENTS:
This Agreement is entered into by and between:

The LOCAL GOVERNMENT OF QUEZON CITY, a public corporation created
pursuant to Commonwealth Act No. 502, as amended, in relation to Republic
Act no. 7160, as amended, with principal address at Quezon City Hall,
Quezon City, represented by its Mayor, HON. HERBERT M. BAUTISTA, and
hereafter referred to as “LGU-QC”.
and

The OPTICAL MEDIA BOARD, a government entity created under Republic

Act No. 9239 and principal address at #35 Scout Limbaga St., Barangay
Laging Handa, Quezon City, duly represented by its Chairman and Chief
Executive Officer, ATTY. ANSELMO B. ADRIANO, herein referred to as the
City Mayor
“OMB”.
WITNESSETH:
WHEREAS, it is declared policy of the State to ensure the protection and
promotion of Intellectual property rights;
WHEREAS, the OMB is created, by virtue of Republic Act No. 9239, to
regulate the manufacture, mastering, duplication, replication, importation
and exportation of Optical Media and Magnetic Media. Specifically, OMB is
given the mandate to evaluate the qualifications of, and issue licenses to,
any individual, establishment or other entity to engage in the Optical and
Magnetic Media Business;
WHEREAS, LGU-QC, under Republic Act No. 7160, is given the authority to
regulate businesses within its respective territory including the issuance of
business permits;

WHEREAS, RA 9239 provides that the licenses issued by the OMB are
conditions precedent for securing the necessary business permits, licenses,

or registration from the appropriate authorities. This is reiterated in the

Department of the Interior and Local Government (DILG) Memorandum
Circular NO. 2011-056 addressed to all local government units nationwide;
WHEREAS, both the LGU-QC and the OMB are given mandates to keep a
registry/record of all business registrations, licenses and permits issued;
WHEREAS, to effectively implement the mandates under the law to regulate
the Optical and Magnetic Media Business and apprehend violators, there is a
need to coordinate efforts, through information sharing, between LGU-QC
and OMB;
NOW THEREFORE, for and in consideration of the foregoing premises, and
the terms and conditions herein set forth, the parties hereby mutually agree
as follows:
ARTICLE I
OBJECTIVE
The Parties hereby establish a coordinative reporting and information
sharing endeavor with the objective of strengthening the regulation of
activities involving optical and magnetic media such as importation,
exportation, acquisition, sale or distribution, possession, mastering,
duplication, manufacture or replication as well as manufacturing equipment,
parts and accessories.
ARTICLE II
RESPONSIBILITIES AND OBLIGATIONS
A. Role of Both Parties

City Mayor
The LGU-QC and the OMB shall:
1. Keep its registry/record of registrations, licenses and/or permits issued

available;
2. Submit quarterly reports to reconcile records and address issues;
3. Coordinate on matters of issuance of registrations, licenses and/or
permits;
4. Share information and act, within their respective mandates, on
possible violations under R.A. 9239;
5. Cancel or revoke any registration, license and/or permit granted to a
business establishment found to be in violation of R.A. 9239;
6. Formulate rules and regulations to implement this MOA;
7. Collaborate on efforts and measure to ensure that establishments and
businesses in Quezon City comply with R.A. 9239; and

8. Perform such other tasks to regulate the optical and magnetic media
businesses in the city.
B. Role of LGU-QC
The LGU-QC shall, through its Business Permit and Licensing Office (BPLO,
require establishments engaged in business covered by R.A. 9239 to secure
a license or accreditation from the OMB prior to and as a condition for the
grant and/or renewal of business licenses and permits in Quezon City.
C. Role of OMB
The OMB shall streamline its registration, licensing and accreditation

procedures to businesses engaged in optical and magnetic media under R.A
9239.
ARTICLE III
AMENDMENTS
Any modifications on this MOA or any part hereof, shall be upon the
execution of a written instrument duly signed by both parties. Should the
circumstances necessitate the revision of this MOA, the concerned party
shall, prior to the revision, be granted a reasonable period for
implementation.
ARTICLE IV
EFFECTIVITY AND TERMINATION
This Memorandum of Agreement shall take effect immediately upon its
execution and will remain in force until revoked or terminated by both
parties.
This MOA may be terminated, without prejudice to the mandate of the
parties under R.A. 9239, upon the agreement of both parties.
