    AN ORDINANCE TO REGULATE THE QUARRYING ACTIVITIES WITHIN


    THE TERRITORIAL JURISDICTION OF THE MUNICIPALITY OF
    HON. DANILO T. SORIANO

    NAGUILIAN, PROVINCE OF LA UNION

    WHEREAS, the mushroom-like growth of private persons and entities quarrying


    along the said rivers is very alarming and poses great danger particularly to those barangays
    located along the rivers when flashfloods and heavy downpour occur;

    WHEREAS, there is a need to regulate quarrying activities within the said areas to
    HON. REYNALDO J. FLORES

    safeguard properties and protect the interest of the barangay people concerned, thus
    preventing insurmountable damages to happen in the municipality;

    WHEREAS, if not religiously monitored and regulated, persons abusively conduct


    their quarrying business within the areas as specified, notwithstanding, the present
    condition and set-up of the rivers and its adjacent barangays;

    WHEREFORE, on motion of HONORABLE __________, duly seconded by ALL
    THE OTHER MEMBERS PRESENT,

    BE IT ENACTED BY THE SANGGUNIANG BAYAN OF NAGUILIAN, LA


    UNION DULY ASSEMBLED IN SESSION THAT:

    Section 1. Title. This Ordinance shall be known as the


    _______________MUNICIPALITY OF NAGUILIAN, LA UNION.

    Section 2. Quarrying Activities along:

    Section 3. Quarrying along the riverbanks is strictly banned

    Section 4. Zoning are to be established to guide quarriers and implementors

    Section 5. Officials of the barangays concerned shall be utilized for the


    implementation of this ordinance. They shall assist, check and monitor the quarriers within
    their respective jurisdictions.

    Section 6. Quarriers of any form of quarry materials must coordinate first with
    the Office of the Municipal Mayor and present their quarrying permit before any quarrying
    activity.
    Section 7. Persons or entities found violating this Ordinance shall be penalized,
    as follows

    Section 4. Definition of Terms.

    Section 6. Penalties. Any person who is found violating this Ordinance shall be
    penalized as follows:

    First Offense – a fine of P


    Second Offense – a fine of P
    Third Offense and succeeding offenses – a fine of P

    Section 7. Separability Clause. Should any portion or provision of this ordinance


    be declared unconstitutional or invalid, the other parts or provisions thereof not affected
    thereby shall remain and continue to be in full force and effect.

    Section 8. Repealing Clause. Any provisions of existing ordinances, rules and
    regulations and/or parts thereof inconsistent with the provisions of this ordinance are
    hereby repealed and/or modified accordingly.

    Section 09. Effectivity. This ordinance shall take effect in accordance with law.
