AN ORDINANCE MANDATING PET OWNERS WHOSE PET ANIMALS HAVE
BEEN FOUND TO HAVE URINATED AND DEFECATED ON ANOTHER
PERSON’S PROPERTY, AND ON STREETS, SIDEWALKS, AND OTHER
PUBLIC PLACES, TO COLLECT AND PROPERLY DISPOSE OF THE PET
WASTE AND PROVIDING PENALTIES FOR VIOLATION THEREOF.

WHEREAS, Section 16 of the Republic Act (RA) No. 7160, otherwise known as
the Local Government Code of 1991, provides that “Every local
government unit shall exercise the powers expressly granted, those
necessarily implied therefrom x x x and those which are essential to
the promotion of the general welfare. Within their respective
territorial jurisdictions, local government units shall ensure and
support, among other things, x x x promote health and safety
enhance the right of the people to a balanced ecology x x x
preserve the comfort and convenience of their inhabitants.”;
WHEREAS, Pet waste is very toxic—A study by the World Health Organization
“Animal Waste, Water Quality, and Human Health” published in
2012, states that “the excreta of mammals … are widespread
across planet Earth and frequently contaminate water that is used
for bathing and recreation, that is treated and distributed for
human consumption, and that is used to irrigate crops.”; the
United States of America’s Environmental Protection Agency states
that pet waste provides a nitrogen source for algae blooms, which
deplete the water of oxygen and can make people and animals
sick.” Pet waste left on the street is washed down into waterways
like rivers, bays, and beaches. This can make people sick
from salmonella, E. coli, and other infections”;

WHEREAS, the Local Government Code of the Philippines 1991, states that
the City Veterinarian shall “take the necessary measures to
eradicate, prevent or cure all forms of animal diseases”;
WHEREAS, in Republic Act 9482, also known as the Anti Rabies Act, owners
shall also be responsible for the proper collection and disposal of
excreta/feces;
SECTION 4. Owners of pets shall be responsible pet owners and abide by The
Animal Welfare Act, The Anti Rabies Act, and The Caloocan City
Rabies Control Ordinance of 2004;
SECTION 9. The Caloocan City Health Department and the City Veterinarian
Office is hereby tasked to implement this Ordinance. These
units and offices must coordinate with the Office of the City
Mayor to implement the provision of Section 8.
SECTION 11. SEPARABILITY CLAUSE - If, for any reason, any provision or part
of this Ordinance shall be declared not valid by a Court of
competent jurisdiction or suspended or revoked by the
authorities concerned, such judgment shall not affect or impair
the remaining provisions, sections or parts which shall continue
to be in full force and effect.
SECTION 12. APPLICABILITY CLAUSE - All other related matters not specifically
provided in this Ordinance shall be governed by the pertinent
provisions of existing applicable laws and ordinances.
SECTION 13. EFFECTIVITY CLAUSE - This Ordinance shall take effect after
publication in a newspaper of general circulation.
