    AN ORDINANCE MANDATING PET OWNERS WHOSE PET ANIMALS HAVE
    BEEN FOUND TO HAVE URINATED AND DEFECATED ON ANOTHER
    PERSON’S PROPERTY, AND ON STREETS, SIDEWALKS, AND OTHER
    PUBLIC PLACES, TO COLLECT AND PROPERLY DISPOSE OF THE PET
    WASTE AND PROVIDING PENALTIES FOR VIOLATION THEREOF.

    WHEREAS, Section 16 of the Republic Act (RA) No. 7160, otherwise known as
    the Local Government Code of 1991, provides that “Every local
    government unit shall exercise the powers expressly granted, those
    necessarily implied therefrom x x x and those which are essential to
    the promotion of the general welfare. Within their respective
    territorial jurisdictions, local government units shall ensure and
    support, among other things, x x x promote health and safety
    enhance the right of the people to a balanced ecology x x x
    preserve the comfort and convenience of their inhabitants.”;

    WHEREAS, Pet waste is very toxic—A study by the World Health Organization
    “Animal Waste, Water Quality, and Human Health” published in
    2012, states that “the excreta of mammals … are widespread
    across planet Earth and frequently contaminate water that is used
    for bathing and recreation, that is treated and distributed for
    human consumption, and that is used to irrigate crops.”; the
    United States of America’s Environmental Protection Agency states
    that pet waste provides a nitrogen source for algae blooms, which
    deplete the water of oxygen and can make people and animals
    sick.” Pet waste left on the street is washed down into waterways
    like rivers, bays, and beaches. This can make people sick
    from salmonella, E. coli, and other infections”;

    PET WASTE AND PROVIDING PENALTIES FOR VIOLATION THEREOF.

    WHEREAS, the City Government of Caloocan, is committed to protect


    the health and well-being of its citizens, while at the same
    time ensure that responsible pet ownership and humane
    treatment of animals be practiced by adopting the mandate
    of the Republic Act 8485 or The Animal Welfare Act, and
    Republic Act 9482 or The Anti Rabies Act, and intensify the
    implementation of The Caloocan City Rabies Control
    Ordinance of 2004;

    WHEREAS, the Local Government Code of the Philippines 1991, states that
    the City Veterinarian shall “take the necessary measures to
    eradicate, prevent or cure all forms of animal diseases”;

    WHEREAS, in Republic Act 9482, also known as the Anti Rabies Act, owners
    shall also be responsible for the proper collection and disposal of
    excreta/feces;

    NOW THEREFORE, BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD OF


    CALOOCAN CITY IN REGULAR SESSION DULY ASSEMBLED, THAT:

    SECTION 1. SHORT TITLE - This Ordinance shall be known as:


    CALOOCAN CITY PET WASTE ORDINANCE OF 2016 .

    SECTION 2. SCOPE AND APPLICATION - All Owners of pets or domesticated


    animals residing in Caloocan City, and those who carry, transport,
    convey, and stop with their pets in the territorial jurisdiction of
    Caloocan City.

    SECTION 3. DEFINITION OF TERMS - For the purpose of this Ordinance, the


    following terms are hereby defined as follows:

    a) Pet - any animal which is domesticated or considered


    tamed, restrained, confined, or under the control of its
    owner or the one in possession thereof; whether or not
    registered/licensed by the City Veterinarian of Caloocan
    City.

    OTHER PUBLIC PLACES, TO COLLECT AND PROPERLY DISPOSE OF THE
    PET WASTE AND PROVIDING PENALTIES FOR VIOLATION THEREOF.
    ================================================================================

    b) Owner - any person keeping, harbouring, having custody


    or control of any domesticated animal, or permitting the
    same to habitually remain on, or be lodged or fed within
    his/her yard or premises.

    c) Enclosed Premises - shall mean the house, fenced yard


    or property of the pet’s owner.

    d) Streets, Sidewalks, Public Places - national, and city


    parks, plazas or other places open to the public.

    SECTION 4. Owners of pets shall be responsible pet owners and abide by The
    Animal Welfare Act, The Anti Rabies Act, and The Caloocan City
    Rabies Control Ordinance of 2004;

    SECTION 5. Pet owners whose pets are found to be urinating or defecating or


    have been proven to do so, on another person’s property, on
    streets, sidewalks, and other public places, shall properly collect
    and dispose the excreta left behind.

    SECTION 6. IMPLEMENTING OFFICE AND IMPLEMENTING RULES - The


    Caloocan City Health Department and the City Veterinary Office,
    shall be mandated with the authority of drafting up the
    implementation of the provisions of this Ordinance.

    The Caloocan City Rabies Control Coordinating Committee


    (CRCC) shall undertake the planning, implementation, and
    coordination with other city government agencies and offices for
    assistance and proper implementation of this Ordinance.

    The 188 Barangay Councils of the City of Caloocan, The


    Department of Public Safety and Traffic Management, and duly
    authorized personnel of the City Engineer and the City
    Environmental Management Office (CEMO) are tasked to
    monitor assist and support the local government in enforcing
    the provisions of this Ordinance, especially to monitor and
    ensure the strict compliance by the persons concerned.

    PET WASTE AND PROVIDING PENALTIES FOR VIOLATION THEREOF.

    Section 7. PENALTY CLAUSE - Any violation of this Ordinance shall be


    imposed with the following fines and penalties:

    a. First Offense - FIVE HUNDRED PESOS (P 500.00)

    b. Second Offense - ONE THOUSAND PESOS (P 1,000.00)

    c. Third Offense - TWO THOUSAND PESOS (P 2,000.00)

    SECTION 8. CRIMINAL LIABILITY OF OFFICERS OF PARTNERSHIPS,


    CORPORATIONS, ASSOCIATIONS OR OTHER JUDICIAL ENTITIES - In
    case of violation of this Ordinance by a partnership, corporation,
    association or any judicial entity, the partner, president, director,
    manager, trustee, administrator, or officer who consents to or
    knowingly tolerates such violation shall be held liable.

    SECTION 9. The Caloocan City Health Department and the City Veterinarian
    Office is hereby tasked to implement this Ordinance. These
    units and offices must coordinate with the Office of the City
    Mayor to implement the provision of Section 8.

    SECTION 10. Copies of this Ordinance shall be distributed to all concerned


    individuals and establishments as defined in Section 2, all
    barangay councils, and all concerned law enforcers.

    SECTION 11. SEPARABILITY CLAUSE - If, for any reason, any provision or part
    of this Ordinance shall be declared not valid by a Court of
    competent jurisdiction or suspended or revoked by the
    authorities concerned, such judgment shall not affect or impair
    the remaining provisions, sections or parts which shall continue
    to be in full force and effect.

    SECTION 12. APPLICABILITY CLAUSE - All other related matters not specifically
    provided in this Ordinance shall be governed by the pertinent
    provisions of existing applicable laws and ordinances.

    SECTION 13. EFFECTIVITY CLAUSE - This Ordinance shall take effect after
    publication in a newspaper of general circulation.
