LEGAL NOTICE

Sir,

Under specific instructions to act on behalf of my client, Mr. Ankit


Khare Director of <<Company/_name>> having its office at
<<company_address>> ereinafter referred and addressed as “my
client”, hereby, notify you through this instant legal for your
immediate compliance within the stipulated time as stated in this
Notice. Henceforth it is submitted as follows:

1. That my client is engaged in the business of digital media and


you the noticees deals with your concerned business through
the noticee no. 2 and 3, who are the Directors of the noticee
no. 1 and are liable for day to day business transactions of
notice no. 1 and are jointly and severally liable for the acts
done in accordance.

2. That you noticees have been the Clients for my Client and
have maintained one running account with my client and for
the payment of the mentioned transaction, you the noticees
............................
Office: 682, Sector21-E, Gurgaon, Haryana 122016
have issued three cheques wherein the first bearing the
number 502493 dated 25/01/2019 for Rs 3,24,000/-(Three
Lacs twenty four thousand) drawn on Axis Bank Bangalore,
got dishonoured when presented for encashment at ICICI
Bank having its branch at Gurugram Haryana vide returning
Memos dated 17/04/19 with the remarks “Funds Insufficient”.

3. The two other cheques, bearing no.502494 dated 25/02/2019


for Rs 3,24,000/-( Three Lacs twenty four thousand) and
bearing no.502495 dated 25/03/2019 for Rs 3,24,102(Three
Lacs twenty four thousand one hundred and two), both drawn
on Axis Bank Bangalore, Karnataka towards discharge of
your liability for the business transaction as mentioned, both
got dishonoured when presented for encashment at ICICI
Bank having its branch at Gurugram Haryana vide returning
Memos dated 24/05/19 with the remarks “Funds Insufficient”.

4. That the above stated facts make it abundantly clear that you
have intentionally issued the aforesaid cheques with ulterior
designs and instructed my client to present the same for
encashment, knowingly fully well that the said cheque would
not be honoured on presentation on account of insufficiency
of funds in your account or that it would exceed the amount
arranged to be paid from the account.

5. That by getting the aforesaid cheques dishonoured, you the


Noticees have inter-alia committed the offence punishable

under section 138 of the Negotiable Instrument Act, as
amended up-to-date.

6. That apart from the above, you have also inter-alia have
allegedly committed the offence punishable under section 420
of the Indian penal code. You, the Noticees by wilfully
inducing and deceiving my Client, have also caused wrongful
loss to my Client and wrongful gain to yourself. Further, you
have issued the above said cheques with the intention to not to
honour the same.

In view of the aforesaid and by virtue of this notice, I, on behalf of


my aforesaid Client, do humbly call upon you respectfully ,to pay
the amount of Rs.<<claim_amount>>/-
(<<loan_amount_words>>), in respect of the aforesaid
<<due_amount>>, within the statutory period of 15 days from the
date of receipt of this notice. You may be further liable to pay
interest @ 12% per annum to my client as you have deprived him
from its legitimate use and enjoying of his money by illegally
withholding the same failing which my Client shall be constrained
to initiate Civil as well as Criminal proceedings including criminal
proceedings as contemplated under Section 25 of payments and
settlements Systems Act 2007 against you noticees before the
appropriate court of law, holding you responsible for all costs and
consequences which you may kindly note.
