RA 3846

An Act Providing for the Regulation of Radio Stations and Radio Communications in the
Philippine Islands and for Other Purposes
Section 1

No one shall operate a radio station within the country without first obtained a franchise from the
Philippine Legislature. [1]Exceptions

Section 2

Construction/installation needs a permit granted by the Secretary of Commerce and Communications.


Licences expires.
Renewals: submit an application to the Secretary of Commerce and Communications at least 2
months before expiration. Licences last for a maximum of 3 years.

Section 3 Powers of Secretary of Commerce and Communication

Regulate radio stations and radio comms and transmissions.


Additional powers:

1. Classify radio stations and prescribe services rendered by each class.


2. Assign call letters and frequencies of licensed stations
3. Make rules preventing interference between stations; give station a hearing before
4. Establish areas/zones to be served by stations.
5. Establish rules and regulations on chain broadcasting

6. make rules requiring records of


1. traffic handled

2. distress
3. frequency watches

4. programs
5. transmissions of energy

6. communications or signs

7. Conduct investigations regarding radio


8. Prescribe rules/courses/methods of instruction of training schools

9. Prescribe rates of charges for inspection/licensing of stations and operators

10. Approve/disapprove renewal of license. Disapproving renewals require a hearing


11. Bring criminal actions against violators of radio law; suspend/revoke station or operator license;
refuse to renew licenses; or reprimand offenders.
12. Approve station location/power/kind/type of apparatus used.

13. Prescribe rules on distress calls.

Section 4

Licenses non-transferrable without authority of Secretary of Commerce and Communications.


Licenses granted only to US or Ph citizens
No license granted to companies with 20% stock owned by aliens (ooOOoo00)

Section 5

No exclusivity on privileges granted in any station license

Section 6

The President of the US or the Governor-General of the Philippine Islands can close/repossess any radio
station in times of war/public peril or disaster.

Section 7

No divulging of messages passed for transmission to unauthorized person. No unauthorized person shall
intercept messages and divulge to other people.
Exception being transmission by amateurs or use for the general public or distress signals.

Section 8

Allows the Secretary of Commerce and Communication to create a Radio Regulation Section, Division or
Office under his/her supervision.

Section 9

This Act shall not apply to radio stations uncer the US and PH government. They are subject to
International Radiotelegraph Regulations.

Section 10

Duties of the Director of Posts are transferred to the Secretary of Commerce and Communication.

Section 11

Repealing RA 3275

Section 12

Any person violating any pvovision in this act: Maximum fine of P300 (?) or imprisonment of max 3
months or both for each and every offense.

Section 13

Any company violationg any provision in this act: fined max P1,000 for each offense.

Section 14

This act shall take effect 3months

1. broadcasting stations, amateur stations, experimental stations, training stations, stations onboard a
mobile vessel, train or aircraft, or a private staion w/o any means of communication. ↩
