THE SENIOR HIGH SCHOOL


CONSTITUTION OF 2019
PREAMBLE

We, the Senior High School Students of San Beda College Alabang, imploring
the aid of Divine Providence, in the pursuit to establish and preserve a Student
Government that shall uphold our rights and welfare, advance the common
aspirations of the Student Body, foster the development of an inclusive and just
academe by the virtues of freedom, justice, equality and democracy whilst
inculcating the Benedictine principles of prayer, work, peace, community, service
and excellence do hereby ordain and promulgate this Constitution.

ARTICLE I

DECLARATION OF PRINCIPLES

Section 1. All bona fide students of the Senior High School Department of
San Beda College Alabang form the Student Body which shall be under the
jurisdiction of this Constitution. All governmental authority shall emanate from
them.

Section 2. The Prime Directive of the Student Government is to ensure and


uphold the safety, liberty, and the rights of the Student Body at all times.

Section 3. The Student Body shall at all times, adhere to the values of
human dignity, fairness, equality, justice, freedom, mutual development, unity, and
love, initiative and responsibility for country.

Section 4. The Student Body recognizes the right to accessible and quality
education as a sacrosanct.

Section 5. The Student Body recognizes that education is a vital integrant


of social consciousness and national development and a proponent of critical
thinking and informed judgement.

Section 6. The Student Body believes in democracy and shall enjoy its
blessing through a student government.

Section 7. The Student Body shall uphold Benedictine values and ideals
along with its aspirations for the State, the School, and the Student Body.
ARTICLE II

BILL OF STUDENT RIGHTS

Section 1. The right to learn in an inclusive, child-friendly, gender-


sensitive, safe and motivating environment shall be inviolable. Every student shall
be respected in their rights, be reasonably and fairly treated as a student, and as a
person consistent with human dignity.

Section 2. No student shall be denied the right to enjoy responsible


freedom of speech and expression.

Section 3. No student shall be deprived the right to form, join or lead in


such student organizations or associations as may be recognized or authorized to
operate by the school.

Section 4. No policy shall be passed that shall prohibit the right of a


student to conduct and to actively participate in all school activities and programs.

Section 5. The freedom of information shall be inviolable. No program,


project, or decision of the Student Government shall be hidden from the general
public.

Section 6. No student shall be denied the right to suffrage, to apply for a


position, to nominate, exercise other electoral practices, and to be elected into office
not otherwise disqualify as stated by law.

Section 7. All students shall have the right to responsible and independent
operation of the student elections and student publications.

Section 8. Every student has the right to proper representation and


participation in different meetings and assemblies of the school on issues affecting
the welfare of the Student Body.

Section 9. No act, policy, or decision shall deprive the Student Body the
right to recall their Student Government representatives.

Section 10. No student shall be denied the right to due process.

Section 11. No student shall be deprived the right to receive proper and
satisfactory instruction in the course that they are enrolled, in accordance with the
approved educational objectives and standards of the institution.
Section 12. No student shall be deprived of the right to be academically
evaluated based on equal and objective criteria.

Section 13. The right to an open and regular student-teacher and student-
school administration dialogue shall be recognized.

Section 14. The freedom to express the concerns of every student shall be
recognized. Every student has the right to freely and responsibly express their
concerns, views and grievances.

Section 15. Every student has the right to avail the use of school facilities
for their curricular or co-curricular activities as may be authorized by the school.

Section 16. Every student shall have the right to be formally informed of
any complaint against them, to be heard by themselves or counsel, to present
evidence for their defense, to confront and cross-examine witnesses, to be informed
of the decision on their case, and to appeal the decision to the proper authorities,
when appropriate and to redress of grievances against any wrong or injustice
committed against them by any member of the academe in accordance with the
defined channels of authority therein.

Section 17. All other rights as specified in the SBCA SHS Student
Handbook, DepEd Order No. 11 otherwise known as “Additional Guidelines to
DepEd Order No. 47 s. 2014 (Constitution and By-Laws of the Supreme Pupil
Government and Supreme Student Government in Elementary and Secondary
Schools)” s. 2016, DepEd Order No. 40, s. 2012 otherwise known as “DepEd Child
Protection Policy”, Batas Pambansa Blg. 232 otherwise known as “Education Act of
1982”, DepEd Order No. 88, s. 2010otherwise known as “Revised Manual of
Regulations for Private Schools in Basic Education” but are not specified herein are
included as the rights of the students.

ARTICLE III

DUTIES OF A BEDAN STUDENT

Section 1. It shall be the duty of the Bedan Student to uphold, observe and
abide by the laws of the Republic of the Philippines, the prescribed rules and
regulations of the institution, and this Constitution and By-Laws of the Student
Government at all times.
Section 2. It shall be the duty of the Bedan Student to respect proper
authority, whether governmental or institutional.

Section 3. It shall be the duty of the Bedan Student to exercise their rights
responsibly and in good faith.

Section 4. It shall be the duty of the Bedan Student to uphold the


Benedictine values of Prayer, Work, Peace, Community, Service and Excellence
with honesty and integrity.

Section 5. It shall be the duty of the Bedan Student to uphold the academic
integrity of the institution, abide by the academic standards of the institution, and
endeavor to pursue academic excellence.

Section 6. It shall be the duty of the Bedan Student to uphold, preserve


and maintain the aims, ideals and integrity of their Alma Mater.

Section 7. It shall be the duty of the Bedan Student to conduct themselves


in a proper and irreproachable manner in their relations and dealings with all
members of the academe.

Section 8. It shall be the duty of the Bedan Student to observe at all times,
inside or outside the institution, the accepted principles of proper decorum and good
behavior.

Section 9. It shall be the duty of the Bedan Student to meet promptly their
financial and property obligations to the institution.

Section 10. It shall be the duty of the Bedan Student to strive as a proactive
member of society participating in civic affairs to impart in its aspiration of being
just, inclusive, compassionate, dynamic and orderly society.

ARTICLE IV

SUFFRAGE

Section 1. Suffrage may be exercised by any member of the Student Body.


No other requirements shall be imposed that shall limit the Student Body in the
exercise of Suffrage.

Section 2. No policy shall be enacted that shall impose mandatory voting.


ARTICLE V

THE STUDENT GOVERNMENT

Section 1. The Student Government shall be the governing student body of


the Senior High School Department comprising of the Central Student Government,
Strand Governments, Executive Commissions, Strand Commissions, Special
Commissions, Class Governments, and the General Assembly of Student Leaders
which shall be autonomous guided by the principles of participatory democracy.
Authority shall emanate from the Student Body.

Section 2. The Student Government shall ensure the rule of law in all
sectors of the Student Government, Student Body, and the Administration of the
Senior High School Department of San Beda College Alabang.

Section 3. The Student Government shall adopt and adhere to the


principles of Prayer, Work, P`eace, Community, Service, Excellence, and other
fundamental Benedictine philosophies as its standard of character in leadership.

Section 4. The Student Government shall foster solidarity, social


consciousness, mutual development and patriotism in the pursuit of contributing to
society in nation-building.

Section 5. The Student Government shall pursue and maintain at all


times, honesty and integrity in public service and renounce all forms of graft and
corruption whilst taking positive and effective measure against it.

Section 6. The Student Government shall not infringe upon the rights of
the students, nor shall it enact any policy that violates it.

Section 7. The Student Government shall adopt an objective and fair


representation of interest between the Student Body and the Administration.

Section 8. The Student Government shall provide assistance and


representation in administrative cases and hearings involving the Student Body.

Section 9. The Student Government shall promote an open communication


and dialogue with the Student Body, student organizations, movements and other
sectors of society not inconsistent with its principles and purposes.
Section 10. The Student Government shall be transparent in all its
endeavors and disclose information involving public interest not otherwise contrary
to law.

Section 11. The Student Government shall guarantee equal access to


opportunities for public service.

ARTICLE VI

THE CENTRAL STUDENT GOVERNMENT

Section 1. The Central Student Government shall be the highest governing


student body of the Student Government of the Senior High School Department of
San Beda College Alabang.

Section 2. Executive Power shall be vested upon the President.

Section 3. The President shall have the power to give executive issuances
necessary to fulfill the functions of the Student Government.

The executive issuances are as follows:

(1) Executive Orders - Acts of the President issuing a policy applicable to


the Student Body which must be observed.

(2) Proclamations - Acts of the President announcing an important date,


event, or declaring a status involving public interest

(3) Memorandums - Acts of the President relaying messages to the


Student Government and/or the Student Body

Executive Orders and Proclamations shall be subject to the approval of the


Principal, Vice Principal for Academics, Vice Principal for Student Discipline and
Formation, and Vice Principal for Student Activities. Memorandums may be subject
to the approval of any office that is concerned therewith.

Section 4. The Central Student Government shall be composed of the


Central Executive and the Executive Commissions.

Section 5. The Central Executive shall be composed of the President, Vice


President, Executive Secretary, Deputy Executive Secretary, Executive Treasurer,
Executive Auditor, two (2) Grade 12 Level Representatives, and two (2) Grade 11
Level Representatives.
Section 6. No person may be elected into the Office of the Central Student
Government unless they meet the following standards:

(1) Must be a bona fide student and be of good moral character

(2) Must have a General Weighted Average not lower than 80 in their
previous semestral grade or any equivalent thereof

(3) Must have no failing grade in any subject

(4) Must have no previous/pending disciplinary sanction from the Student


Discipline and Formation Office

(5) Must not have a failing conduct rating of “Not Observed” in their
previous semestral grade or any equivalent thereof

(6) Must not hold any other elective position in the Student Government
and be the head or any equivalent thereof of an organization/club in the Senior High
School Department

Section 7. No residency shall be required of the candidates for the elective


positions of the Central Student Government.

Section 8. All officers of the Central Executive shall be elected directly by


the Student Body for a term of one (1) academic year which shall begin upon their
oath of office, a week after the conclusion of the Student Government elections
unless otherwise stated by law.

Section 9. All officers of the Central Executive shall receive academic


and/or extra-curricular incentives as compensation with the consent of the Central
Student Government Adviser.

Section 10. The President shall perform the following duties and functions:

(1) Act as the official representative of the Student Body at any function,
meeting, assembly on or off the campus

(2) Call and preside meetings of the Student Government or any part
thereof

(3) Administer the affairs of the entire Student Government and ensure
its functionality and efficiency
(4) Act as the official head of the General Assembly and preside over all its
proceedings

(5) Form commissions, committees, and other special working bodies


necessary to fulfill the functions of the Student Government

(6) Serve as an ex-officio member of all Executive Commissions

(7) Has the power to veto the decisions of the General Assembly of
Student Leaders, Strand Governments, Class Governments, Commissions or any
part thereof except the Special Commission on Student Justice

(8) Perform other functions inherent and incidental to his/her office

Section 10. The Vice President shall have the following duties and
functions:

(1) Act as the secondary official representative of the Student Body at any
function, meeting, assembly on or off the campus

(2) Assume the duties and functions of the President in his/her absence

(3) Assist the President in all matters necessary to fulfill the functions of
the Student Government

(4) Oversee the institutional, interdepartmental and organizational


relations of the Student Government

(5) Supervise the Student Government in the fulfillment of its functions

(6) Serve other functions which may be designated unto him/her by the
President

Section 11. The Executive Secretary shall perform the following duties and
functions:

(1) Act as the official primary clerk of the Central Student Government

(2) Oversee the clerical affairs of the Student Government Secretaries

(3) Document, compile and maintain records of the meetings and


proceedings of the Student Government

(4) Receive and corroborate pertinent documents submitted to the Central


Student Government
(5) Maintain the Office of the Student Government

(6) Serve other functions which may be designated unto him/her by the
President

Section 12. The Deputy Executive Secretary shall perform the following
duties and functions:

(1) Act as the official secondary clerk of the Central Student Government

(2) Assist the Executive Secretary in performing clerical affairs

(3) Oversee the dissemination of pertinent information and promote the


agendas of the Student Government through its media platforms

(4) Maintain the public relations of the Student Government

(5) Serve other functions which may be designated unto him/her by the
President

Section 13. The Executive Treasurer shall perform the following duties and
functions:

(1) Oversee the budgeting of the Student Government Fund and its
disbursement

(2) Administer the affairs of the Strand Treasurers and Class Treasurers

(3) Document and compile financial records and all transactions of the
Student Government

(4) Prepare an accurate and transparent monthly financial report of the


Student Government which shall be made accessible to the public

(5) Formulate pertinent financial guidelines for the Student Government

(6) Serve other functions which may be designated unto him/her by the
President

Section 14. The Executive Auditor shall perform the following duties and
functions:

(1) Assist the Executive Treasurer in preparing the monthly financial


report of the Student Government

(2) Audit all expenditures of the Central Student Government


(3) Certify the legitimacy of the disbursement of funds

(4) Maintain and update the inventory records of the Central Student
Government

(5) Serve other functions which may be designated unto him/her by the
President

Section 15. The Level Representatives shall perform the following duties
and functions:

(1) Act as the official representatives of their respective levels in all


meetings and proceedings of the Student Government

(2) Act as the official head of their respective Level Assemblies of Student
Leaders and preside over all its proceedings

(3) Administer all issues and concerns of their respective levels

(4) Implement the directives of the Student Government in their


respective levels

(5) Ensure the welfare of their respective levels

(6) Serve other functions which may be designated unto him/her by the
President

ARTICLE VII

THE STRAND GOVERNMENTS

Section 1. The Strand Governments shall be the official representation of


the respective strands of the Senior High School Department and shall maintain
executive powers therein. They shall be the ABM Government, the GAS
Government, the HUMSS Government, and the STEM Government.

Section 2. The Strand Governments shall be composed of the Strand


Executive and the Strand Commissions.

Section 3. The Strand Executive shall be composed of the Governor, Vice


Governor, Strand Secretary, Strand Treasurer, Strand Auditor, Strand Public
Relations Officer, Grade 11 Strand Chairperson, and the Grade 11 Strand Vice
Chairperson.
Section 4. No residency shall be required of the candidates for the elective

any Class Government part thereof

(3) Administer the affairs of their respective Strand Government and


ensure its functionality and efficiency
(4) Ensure the welfare and advance the interests of their respective strand

(5) Serve as an ex-officio member of all their Strand Commissions

(6) Implement the directives of the Central Student Government

(7) Serve other functions which may be designated unto him/her by the
Central Executive

Section 9. The Strand Vice Governor shall perform the following duties
and functions:

(1) Act as the official secondary head of his/her respective strand in all
Student Government meetings and proceedings

(2) Assume the functions and duties of the Governor in his/her absence

(3) Assist the Strand Governor in all matters necessary to fulfill the
functions of their Strand Government

(4) Oversee the institutional, interdepartmental, organizational relations


of their Strand Government

(5) Supervise their Strand Government in the fulfillment of its functions

(6) Serve other functions which may be designated unto him/her by the
Central Executive or their Strand Governor

Section 10. The Strand Secretary shall perform the following duties and
functions:

(1) Act as the official primary clerk of their Strand Government

(2) Document, compile and maintain records of the meetings and


proceedings of their Strand Government

Strand Government

(4) Maintain the Office of their Strand Government

(5) Serve other functions which may be designated unto him/her by the
Central Executive or their Strand Governor

functions:

Government

(5) Serve other functions which may be designated unto him/her by the
Central Executive or their Strand Governor

Section 13. The Strand Public Relations Officer shall perform the following
duties and functions:

(1) Dissemination of pertinent information to their Strand

(2) Maintain a credible image for their Strand Government and maintain
its relations with their respective Strand

(3) Serve other functions which may be designated unto him/her by the
Central Executive or their Strand Governor

Section 14. The Grade 11 Strand Chairpersons shall perform the following
duties and functions:

(1) Act as the official Grade 11 representatives of their respective Strand


in all meetings and proceedings of the Student Government
(2) Assist the Grade 11 Level Representatives in administering all issues
and concerns specific to their Strand

(3) Implement the directives of the Student Government in their


respective Strand

(4) Serve other functions which may be designated unto him/her by the
Central Executive or their Strand Governor

Section 15. The Grade 11 Strand Vice Chairperson shall perform the
following duties and functions:

(1) Act as the official secondary Grade 11 representative of their


respective Strand in all meetings and proceedings of the Student Government

(2) Assume the functions and duties of the Grade 11 Strand Chairperson
in his/her absence

(3) Assist the Grade 11 Strand Chairperson in all matters necessary to


fulfill the functions of their Strand Government

(4) Serve other functions which may be designated unto him/her by the
Central Executive or their Strand Governor

ARTICLE VIII

CLASS GOVERNMENTS

Section 1. The Class Governments shall be composed of elected officials


emanating from each Class in both the Grade 11 and 12 levels.

Section 2. The electoral positions in a Class Government shall be composed


of the Class Mayor, Class Vice Mayor, Class Secretary, Class Treasurer, Class
Auditor, Class Public Relations Officer and two (2) Class Peace Officers.

Section 3. All officers of a Class Government shall be directly elected by


the Class for a term of one (1) semester which shall be administered by the Class
Adviser within the first two (2) weeks of a semester.

Section 4. No person may be elected into the Office of the Class


Governments unless they meet the following standards:

(1) Must be a bona fide student and be of good moral character


(2) Must have no previous/pending disciplinary sanction from the Student
Discipline and Formation Office

(3) Must not hold any other elective position in the Student Government

Section 5. The Class Governments may establish and maintain a Class


Fund which shall be used to finance and sustain the collective priorities of the Class
which shall be subject to the limitations, procedures and authorizations of
competent school authorities.

Section 6. No Class Government shall be recognized unless an official list


of its elected officers shall have been duly certified by their Class Adviser and the
Commission on Elections within three (3) school days after its elections.

Section 7. The Commission on Elections shall review the official list of the
Class Government Officers to satisfy the standards and qualifications of a Class
Government Officer stipulated in this Constitution.

Section 8. The Class Mayor shall perform the following duties and
functions:

(1) Act as the official head of his/her respective Class

(2) Call and preside meetings of the Class whenever necessary

(3) Ensure the welfare of the entire Class

(4) Advance the interests and address the concerns of his/her Class
through the General Assembly of Student Leaders

(5) Implement the directives of The Student Government

(6) Serve other functions which may be designated unto him/her by the
Student Government

Section 9. The Class Vice Mayor shall perform the following duties and
functions:

(1) Act as the official secondary head of his/her Class

(2) Assume the functions and duties of the Mayor in his/her absence

(3) Assist the Mayor in performing his/her duties and implementing


policies directed to the Class
(4) Serve other functions which may be designated unto him/her by the
Student Government or the Class Mayor

Section 10. The Class Secretary shall perform the following duties and
functions:

(1) Document and compile records of the meetings and proceedings of the
Class

(2) Monitor the attendance of the Class

(3) Serve other functions which may be designated unto him/her by the
Student Government or the Class Mayor

Section 11. The Class Treasurer shall perform the following duties and
functions:

(1) Oversee the Class Fund and its disbursement

(2) Document and compile financial records and transactions of the Class

(3) May prepare an accurate and transparent monthly financial report

(4) Serve other functions which may be designated unto him/her by the
Student Government or the Class Mayor

Section 12. The Class Auditor shall perform the following duties and
functions:

(1) Assist the Class Treasurer in preparing the monthly financial report

(2) Audit all expenditures of the Class Fund

(3) Certify the legitimacy of the disbursement of funds

(4) Serve other functions which may be designated unto him/her by the
Student Government or the Mayor

Section 13. The Class Public Relations Officer shall perform the following
duties and functions:

(1) Dissemination of pertinent information to the Class

(2) Serve other functions which may be designated unto him/her by the
Student Government or the Mayor
Section 14. The Class Peace Officers shall perform the following duties and
functions:

(1) Maintain peace and order within the premises of the Class

(2) Serve other functions which may be designated unto him/her by the
Student Government or the Mayor

ARTICLE IX

THE GENERAL ASSEMBLY OF STUDENT LEADERS

Section 1. There shall be a General Assembly of Student Leaders that shall


represent and preserve the collective interests and welfare of the Student Body. It
shall be divided into two assemblies, the General Assembly and the Level
Assemblies; the Grade 12 Level Assembly, and the Grade 11 Level Assembly.

Section 2. The General Assembly shall be composed of the elected Class


Mayors of the Grade 12 and 11 levels. The Level Assemblies shall be composed of
the Class Mayors in their level only.

Section 3. The General Assembly of Student Leaders shall be the official


forum for proposals, dissemination of information, consultation and the resolution of
predicaments of the Student Body.

Section 4. The General Assembly shall convene once every semestral term
and in circumstances that call for its necessity by the President.

Section 5. The Level Assemblies shall convene once every two (2) months
and in circumstances that call for its necessity by the President or their Level
Representatives.

Section 6. Members of the General Assembly of Student Leaders may


initiate activities and policies of the Student Government through a proposal which
shall be filed at least ten (10) school days prior to the regular session of their
Respective Level Assemblies to their respective Level Representatives. It shall be
discussed and presented thereafter in their respective Level Assembles.

There shall be four (4) classifications of proposals in the Level and


General Assemblies.

(1) Level Strand Exclusive Proposal, which shall be proposals concerning a


strand, exclusive only on a certain level;
(2) Strand Exclusive Proposal, which shall be proposals concerning a
strand, that shall encompass both levels;

(3) Level Exclusive Proposal, which shall be proposals concerning a


certain level;

(4) General Proposal, which shall be proposals concerning both levels and
is inclusive of all strands.

Only those members of the General Assembly affected by the policy


shall have the right to vote on matters concerning them.

The Level Representatives shall preside over their respective Level


Assemblies.

Their respective Level Assemblies shall determine proposals to be


presented in the General Assembly upon the vote of a majority of its
members.

The General Assembly shall forward a proposal to the President for


approval and enactment upon the vote of more than two-thirds of its
members.

ARTICLE X

THE COMMISSIONS

Section 1. There shall be Commissions in the Student Government that


shall serve as the working body of the Student Government, which will be composed
of the Executive Commissions, Strand Commissions and the Special Commissions.

Section 2. The Executive Commissions shall be under the jurisdiction of


the Central Executive and shall be composed of the Commission on Events,
Commission on Finance, Commission on Public Affairs, and the Commission on
Social Action and the Environment.

Section 3. The Commission on Events shall be mandated to design, form


and execute activities that shall be aligned with the objectives of the Student
Government and the aspirations of the Student Body.

Section 4. The Commission on Finance shall be mandated to ensure


monetary transparency of the Student Government Fund and oversee its
appropriation and utilization.
Section 5. The Commission on Public Affairs shall be mandated to promote
the public relations of the Student Government by ensuring open communication
and active engagement of the Student Government with the public through its
media platforms and information outlets.

Section 6. The Commission on Social Action and the Environment shall be


mandated to foster social consciousness within the Student Body, actively engage in
social work and environmental causes, and implement sanitation and cleanliness
programs of the Student Government.

Section 7. The officers of the Executive Commissions shall be composed of


theCommissioner and Deputy Commissioner, whichshall be duly appointed by the
President and subject to the same qualifications and term as the Central Executive.

Section 8. The Commissioner shall have the following duties and functions:

(1) Oversee the affairs, ensure its functionality, and maintain the
efficiency of their Commission

(2) Formulate schemes to implement the mandate of their Commission

(3) Submit end of term accomplishment reports to the President

(4) Serve other functions which may be designated unto him/her by the
Central Executive

Section 9. The Deputy Commissioner shall have the following duties and
functions:

(1) Assist the Commissioner in fulfilling the mandate of their Commission

(2) Assume the duties and functions of the Commissioner in his/her


absence

(3) Serve other functions which may be designated unto him/her by the
Central Executive

Section 10. The Central Executive shall conduct an application and


screening process for the members of the Executive Commissions. They shall have a
term of one (1) academic year.
Members of the Executive Commissions must only be a bona fide
student.

Section 11. The President shall have the authority to create additional or
disband commissions in case of necessity to ensure the functionality and efficiency
of the Student Government.

Section 12. The President shall have the authority to dismiss any appointed
officer and/or member of the Executive Commission. The Commissioner may
recommend the dismissal of any member of their Executive Commission to the
President.

Section 13. The Executive Commissions shall have Committees to pursue its
specific agendas. Committees in an Executive Commission shall be determined by
the Central Executive.

The Committees shall be composed of an appointed Chairperson and Vice


Chairperson whose prime directive is to execute the agenda of the Committee. They
shall be appointed by the Commissioner upon consultation and approval of the
Central Executive.

The Commissioner may recommend to the Central Executive, the creation or


disbandment of a Committee.

Section 14. In case of a shortage of members in an Executive Commission,


the Commissioner shall report to the President and thereafter immediately open
the Executive Commission to conduct a special application and screening process for
new members that shall be subjected to the qualifications stipulated under this
article.

Section 15. The Executive Commissions shall be permanent in the Student


Government and shall not be dissolved.

Section 16. The Strand Governors shall have the authority to determine
their respective Strand Commissions which must not be in accordance with the
functions of the Executive Commissions. They shall have the authority to create
additional or disband commissions in case of necessity to ensure the functionality
and efficiency of the Student Government.

Section 17. The Strand Commissions shall have the same composition and
qualification as the Executive Commissions for its officers which shall be duly
appointed by the Strand Governors. Members of the Strand Commissions shall
undergo an application and screening process conducted by the Strand Executives.
They shall be subject to the same qualifications and terms as the members of the
Executive Commissions.

Section 18. The Strand Governors shall have the authority to dismiss any
appointed officer and member of their respective Strand Commissions. The Strand
Commissioner may recommend the dismissal of any member of their Strand
Commission to their Strand Governor.

Section 19. The Strand Commissions shall have Committees whose


members shall emanate therein to pursue its specific agendas. Committees in a
Strand Commission shall be determined by the Strand Executive.

The Committees shall be composed of an appointed Chairperson and Vice


Chairperson whose prime directive is to execute the agenda of the Committee. They
shall be appointed by the Commissioner upon consultation and approval of the
Strand Executive.

The Commissioner may recommend to the Strand Executive, the creation or


disbandment of a Committee.

Section 20. The Special Commissions shall be the Commission on Elections


and the Commission on Student Justice. They shall be autonomous from the
Student Government.

Section 21. The Commission on Elections shall be mandated to enforce the


Electoral Code and all other laws and regulations concerning the conduct and
affairs of the elections of the Student Government.

The commission may determine its own structure and composition or


otherwise adopt the prescribed composition herein of an Executive Commission.

Section 22. The Special Commission on Student Justice shall be mandated


to determine whether there has been a grave abuse of power, duties, or laws on any
branch or instrumentalities of the Student Government. The Special Commission
along with the Student Discipline and Formation Office shall handle all complaints
and cases of impeachment against any elected officer of the Student Government.

They shall also be obligated to promulgate and protect the rights and welfare
of the Student Body through assistance in resolving concerns of the Student Body
and representation in hearings conducted by the Student Discipline and Formation
Office.

The Special Commission on Student Justice shall be composed of a


Chairman, Deputy Chairman, and three (3) Student Representatives all of which
are subject to the same qualifications and term as the Central Executive and are
appointed by the President and affirmed by the Student Discipline and Formation
Office.

Members of the Special Commission must be knowledgeable of the SBCA


SHS Student Handbook, the Senior High School Constitution, and the policies of
San Beda College Alabang.

ARTICLE XI

THE STUDENT GOVERNMENT ADVISERS

Section 1. There shall be advisers for the Student Government. One (1) for
the Central Student Government, and four (4) for the respective Strand
Governments.

Section 2. The Student Government Advisers shall have the following


qualifications:

(1) Currently a teacher in the Senior High School with permanent status

(2) Have had participation in at least one of the following:

-Student government, or tertiary level Student government as an


adviser

-School based organizations as member, officer, or both (i.e. Parent-


Teacher Association, Union, etc.)

-Co-curricular or extra-curricular club/organizations as a member,


officer, or both

Section 3. The Student Government Advisers shall have the following


duties and functions:

(1) Oversee and examine all the Student Government’s internal/external


processes and leadership practices
(2) Promote good governance and transparency of the Student
Government

(3) Ensure the academic, social and emotional welfare of the Student
Government Officers

(4) Conduct individual consultations with Student Government officers to


gather feedback on the efficiency and effectiveness of his/her performance as an
officer and/or the overall performance of the Student Government

(5) Propose recommendations for improvement of the Student Government


based from the consultations

Section 4. The advisership of the Central Student Government, the Strand


Governments and the Judiciary shall be equivalent to one (1) teaching load
pursuant to Republic Act No. 4670.

Section 5. Upon the conclusion of the General Elections, the newly-elected


officers of the Central Student Government, Strand Governments shall each
nominate a qualified teacher nominee for their respective advisership positions.
They shall prepare the necessary documents for nominations which shall be
submitted to the Principal for review.

Section 6. The Student Government advisers shall monitor all activities,


programs and meetings of the Student Government.

ARTICLE XII

POLITICAL PARTIES

Section 1. The Commission on Elections shall prescribe the procedures,


guidelines and the system of establishing and accrediting Political Parties as an
independent entity and it shall administer all concerns and proposals thereof.

Section 2. No Political Parties shall be formed unless they satisfy the


following standards:

(1) Must have at least four (4) running candidates for the General
Elections

(2) Must have an organizational structure

(3) Must have a clear and concise platform and plan of action
Section 3. Political Parties may form a roster of candidates for the Central
Student Government and Strand Government elections.

Section 4. The Commission on Elections shall have the authority to


disqualify and disband any Political Party violating the provisions of the Electoral
Code and this Constitution.

ARTICLE XIII

FINANCE

Section 1. The Central Executive shall have complete jurisdiction on


financial matters regarding the Student Government.

Section 2. The Central Executive shall enjoy the freedom to determine


priorities in the disbursement of its funds, provided that it shall be directly used to
support the Student Government’s projects, activities, and functions.

Section 3. TheCentral Executive shall impose a system for the collection


and storage of financial accounts and records.

Section 4. No General Appropriations shall be passed that deprives the


Student Government of the ability to perform its basic function.

Section 5. No money shall be paid out of the Student Government Fund


except in pursuance of an appropriation made by the Central Executive.

Section 6. All financial disbursements and transactions must be recorded


and audited.

(1) There shall be a system of acknowledgement receipts and financial


guidelines that shall be imposed by the Executive Treasurer.

(2) There shall be a system of audit and auditory guidelines that shall be
imposed by the Executive Auditor.

Section 7. The Central Executive, through the Executive Treasurer, shall


submit a monthly financial report of all activities of the Student Government to the
Administration, the General Assembly, the General Public, and the Official Student
Publication.
Section 8. The Executive Auditor shall submit a monthly financial audit of
all activities of the Student Government to the Administration, the General
Assembly, the General Public, and the Official Student Publication.

Section 9. No law shall be passed that shall prohibit the Auditors to


perform his/her function.

Section 10. All proposed appropriations must be approved by the


administration.

ARTICLE XIV

ACCOUNTABILITY OF PUBLIC OFFICERS

Section 1. Public office is a public trust. All public officers and members of
the Student Government shall serve and be accountable to the Student Body at all
times with the highest degree of responsibility, honesty, integrity, loyalty and
efficiency.

Section 2. The officers of the Central Executive and the Strand Executive
may be removed from office through the process of impeachment.

Section 3. No officer of the Student Government may be removed unless


the following grounds have been met:

(1) Culpable violation of this Constitution

(2) Culpable violation of any policy of The Student Government

(3) Violation of school rules and regulations

(4) Graft and corruption

(5) Bribery

(6) Gross misconduct

(7) Insubordination to authority

(8) Negligence

(9) Tampering, forging and/or falsifying any official document of the


Student Government

(10) Unauthorized representation of The Student Government in any


meeting, proceeding and/or occasion
(11) Betrayal of public trust

(12) Non-attendance in both regular and special meetings of the Student


Government for three (3) instances without notice and valid cause

Section 4. Any member of the Student Body may initiate and file a case of
impeachment to the Special Commission on Student Justice against any member of
the Central Executive and Strand Executive.

Section 5. The Special Commission on Student Justice shall determine the


plausibility of impeachment in accordance with this Constitution within five (5)
school days from the date of the filing of the case of impeachment by any member of
the Student Body. On the circumstance that the case of impeachment shall proceed,
the accused officer will be informed immediately that a hearing which shall be
arbitrated by the Special Commission on Student Justice with the affected
Government Adviser, shall be done after fifteen (15) school days. The accused officer
shall have the opportunity to defend himself/herself with or without counsel.

Section 6. Any member of a Class Government may be removed from office


through a vote of no confidence initiated by any member of their respective Class.

The President may dismiss any member of a Class Government on the


following grounds:

(1) Culpable violation of this Constitution

(2) Culpable violation and/or non-compliance of any policy of The Student


Government

(3) Violation of school rules and regulations

(4) Graft and corruption

(5) Bribery

(6) Gross misconduct

(7) Insubordination to authority

(8) Negligence

(9) Tampering, forging and/or falsifying any official document of the


Student Government

(10) Betrayal of public trust


(12) Non-attendance in meetings called for by the Central Student
Government and/or Strand Governments for three (3) instances without notice and
valid cause

An investigation shall be conducted by the Central Executive to determine


the plausibility of dismissal of the Class Government officer. Upon sufficiency of
evidence, the Special Commission on Student Justice shall affirm the dismissal of
the Class Government officer and thereafter be dismissed from position within
three (3) school days.

Section 7. Resignation of an elected officer of the Central Student


Government shall be in writing and shall take effect after three (3) school days upon
the approval of the President and the Central Student Government Adviser.
Resignation of the President shall be subject to the approval of the Central Student
Government Adviser.

Resignation of an appointed officer and/or member of the Central Student


Government shall be in writing and shall take effect immediately after the approval
of the President.

Section 8. Resignation of an elected officer of a Strand Government shall


be in writing and shall take effect after three (3) school days upon the approval of
the President, the Strand Governor and the Strand Government Adviser.
Resignation of the Strand Governor shall be subject to the approval of the President
and the Strand Government Adviser.

Resignation of an appointed officer and/or member of a Strand Government


shall be in writing and shall take effect immediately after the approval of the
Strand Governor.

Section 9. Resignation of any officer in a Class Government shall be


directed and be subjected to the approval of the Class Adviser which thereafter
shall take effect immediately.

Section 10. Any vacancy of position in the Central Executive shall constitute
a special election which shall be conducted within twenty (20) school days from the
date of vacancy for the specific vacant position/s which shall be administered by the
Commission on Elections.

The President shall appoint officers-in-charge emanating from the Central


Student Government who shall serve the term and execute the duties and functions
for the vacant position/s in the Central Executive until the conclusion of the special
election which shall not be earlier than ten (10) school days and no later than
twenty (20) school days.

On the circumstance that the position of the President shall be vacant, the
succession of powers shall be as follows: the Vice President, Executive Secretary,
and the Deputy Executive Secretary.

Shall the succession of powers fail to provide a qualified official, the General
Assembly shall convene on a period that shall be no later than three (3) school days,
and determine three (3) nominees within the Student Government and elect its
acting head upon a vote of a majority of the members present.

The acting head of the Student Government shall serve the term and execute
the duties and functions of the President until the conclusion of the special election
wherefore the vacant post/s shall have been occupied.

Section 11. Any vacancy of position in the Strand Executive of a Strand


Government shall constitute a special election which shall be conducted within
twenty (20) school days from the date of vacancy for the specific vacant position/s
which shall be administered by the Commission on Elections.

The Strand Governor shall appoint officers-in-charge emanating from their


Strand Government who shall serve the term and execute the duties and functions
for the vacant position/s in the Strand Executive until the conclusion of the special
election which shall not be earlier than ten (10) school days and no later than
twenty (20) school days.

On the circumstance that the position of the Strand Governor shall be vacant,
the succession of powers shall be as follows: the Strand Vice Governor, and the
Strand Secretary.

Shall the succession of powers fail to provide a qualified official, the members
of the General Assembly affiliated to the affected strand, shall convene on a period
no later than three (3) school days, and determine three (3) nominees emanating
from the members of the Student Government belonging to the aforementioned
strand and elect its acting head upon a vote of a majority of the members present.

The acting head of a Strand Government shall serve the term and execute the
duties and functions of the Strand Governor until the conclusion of the special
election wherefore the vacant post/s shall have been occupied.
Section 12. Any vacancy of position in a Class Government shall constitute
a special election which shall be conducted within five (5) school days from the date
of vacancy for the specific vacant position/s which shall be administered by the
Class Adviser.

Section 13. All members of the Student Body may file a complaint to the
Special Commission on Student Justice against any member of the Central Student
Government and Strand Governments who violates this Constitution, the policies of
The Student Government, and/or the rules and regulations of the institution. The
Special Commission on Student Justice reserves the right to admonish any officer
based on the gravity of the complaint.

Complaints against members of the Class Government shall be filed to the


Class Adviser wherein upon probable cause stipulated in this section, the Class
Adviser, depending on the gravity of the complaint, may reprimand or administer a
vote of no confidence for the accused officer of the Class Government.

ARTICLE XV

ELECTIONS

Section 1. The Student Government shall hold elections no later than sixty
(60) days from the start of the academic year. The Student Government shall hold a
single General Election for the Central Student Government and the Strand
Governments for the academic year on the third Monday of August unless otherwise
prescribed by law.

Section 2. TheCommission on Elections shall oversee and preside over the


Elections, Referendums, and Plebiscites of the Student Government.

Section 3. The Commission on Elections shall provide secrecy and preserve


the sanctity of the ballot.

Section 4. The Commission on Elections shall exercise the following powers


and functions:

(1) Administer and Enforce all regulations relative to the conduct of


elections, referendums, and plebiscites as prescribed in this Constitution or by
manner of law.

(2) Register candidates and their respective parties after the requirements
have been met and their platforms are presented.
(3) Refuse the candidacy of candidates in cases relating to electoral
processes, those who violate the election law or fail to comply with its instructions,
orders, decisions, or rulings.

(4) Exercise exclusive original jurisdiction over all contests relating to the
elections. Decisions, final orders, or rulings of the COMELEC on election contests
shall be final, executory, and not appealable.

(5) Promulgate rules and regulations implementing the provisions of the


electoral code or other laws which the COMELEC is required to enforce and
administer.

(6) Submit to the Student Government, School Administrators, and the


Official School Publication, a transcript of records
Section 5. No incumbent member of the Commission of Election shall be
eligible for any elected or appointed position in the Student Government.

Section 6. There shall be a period of campaigning for all candidates. This


period shall not be earlier five (5) school days and no later than ten (10) school days
from the opening of the registration for candidacy.

Section 7. There shall be a miting de avance to be administered by the


COMELEC for the candidates of every General Election.

ARTICLE XVI

TRANSITORY BODY

Section 1. There shall be a Transitory Body emanating from the Central


Student Government and Strand Governments to ensure the functionality of the
Student Government upon the end of an academic year.

Section 2. Upon the termination of an academic year, the outgoing Central


Student Government President shall designate the remaining Grade 11 elected
Central Student Government officers as officer-in-charge for the period until the
conclusion of the next General Election.

Section 2. Upon the termination of an academic year, the outgoing Strand


Government Governors shall designate the remaining Grade 11 elected Strand
Government officers as officer-in-charge for the period until the conclusion of the
next General Election.
Section 3. Officers-in-charge of the Central Student Government and the
Strand Governments shall perform the following duties and functions:

(1) Oversee and ensure the affairs of the Student Government

(2) Make the necessary preparations for the opening of the new academic
year

(3) Draft and recommend proposals for the new academic year

Section 4. Upon the termination of an academic year, the Student


Government Advisers shall retain their adviserhip positions until the conclusion of
the next General Election whereby a new set of nominees shall be determined by
the newly-elected officers.

Section 5. The Transitory Body shall be dissolved upon the conclusion of


the General Elections.

ARTICLE XVII

AMENDMENTS AND REVISIONS

Section 1. Any amendment, and revision to this Constitution may be


initiated through a session of the General Assembly or a petition that shall
encompass a majority of the Student Body.

Upon the confirmation of the sufficiency of a petition by the Commission on


Elections, the General Assembly must convene no later than ten (10) school days.

Section 2. No Amendment to this Constitution shall be valid unless it has


acquired a two-thirds majority of votes of all members of the General Assembly.

No Revision to this Constitution shall be valid unless it has acquired a


two-thirds majority of votes of all members of the General Assembly.

Section 3. The General Assembly must prioritize an Amendment or


Revision before it can proceed with any other activity.

Section 4. Any amendment, or revision, under Section 1 hereof shall be


valid when ratified by a majority of votes by the Student Body through a plebiscite,
which shall be not earlier than ten (10) school days and no later than twenty (20)
school days.
ARTICLE XVIII

GENERAL PROVISIONS

Section 1. This Constitution shall be known as the “The Senior High


School Constitution of 2019”

Section 2. For the purposes of this Constitution, the following terms shall
have the definition as ascribed to them in this provision.

(1) The Student Government or may be referred to as the TSG, is the whole
governing student body of the Senior High School
(2) Central Student Government or may be referred to as the CSG, is the
highest governing body of the Student Government
(3) Strand Government or may be referred to as the SG (ASG for ABM, GSG
for GAS, HSG for HUMSS, and SSG for STEM), is the local governing
body of the different strands of the Senior High School namely the ABM,
GAS, HUMSS and STEM strands.
(4) Class Government or may be referred to as the CG(Strand, Level, Section-
CG or for ex. A11ACG, G11ACG, H11ACG, S11ACG), is the governing
body of the respective classes of the Senior High School.
(5) SBCA or may be referred to as San Beda College Alabang or institution, is
the school of origin of this Constitution
(6) SHS or may be referred to as Senior High School, is the educational
department of origin of this Constitution
(7) Administration or Administrators shall refer to the Senior High School
administrators
(8) Vacancy exists when the position of a TSG officer has been vacated due to
impeachment, resignation, removal from office through a vote of no
confidence, expulsion, permanent disability due to grave illness/es, and
death.

Section 3. The Student Government shall adopt a general logo and shall
attach it to all official documents. The Central Student Government and Strand
Governments may as well adopt their own distinct logos.
ARTICLE XIX

TRANSITORY PROVISIONS

Section 1. The incumbent Strand Government officers shall retain their


positions until the end of the Academic Year 2019-2020 pursuant to the results of
the May 2019 Referendum, provided that they shall have achieved the
requirements herein.

Section 2. The incumbent Central Student Government officers shall


retain their positions until the election of the first Government.

Section 3. The incumbent Classroom officers shall retain their positions


after the ratification of this Constitution, provided that they shall have fit the
requirements herein.

Section 4. Any order, decision, proclamation, or law that does not


contradict this Constitution shall remain valid and enforceable.

Section 5. This Constitution shall take effect immediately upon its


ratification by a majority of the votes cast in a plebiscite held for the purpose and
shall supersede all previous Constitutions.
