Even if they are renting the entire building, they are prohibited from conducting business therein. Is this claim really based upon conjecture?
Is there no evidence to substantiate the issuance of a CE citation? Wayne and I are only advising as to what our zoning code provides. The
manner in which you decide to go about this from a law enforcement perspective, of course, is up to you.

I know how to do my job.  You need to understand that we have to follow the law.  Citadel has leased the entire building and there are laws
protecting them from government agents entering private property (which this is now considered being they leased the entire building) and
investigating, minus exigent circumstances.

Can we notice the owner of a zoning code violation of a violation that is not observed by anyone, have not received any sworn statements from any
witnesses and is solely based on speculation?  I do not think we can; however I be guided by you.

Thank you Skip.  The commercial use described in the earlier emails (Ken Griffin opening his trading floor for Citadel Securities at the Four
Seasons) is prohibited in the hotel, which is located in the R-D(2) zoning district.  The Town should notice the owner of the zoning code violation via a
Notice of Violation from Code Enforcement.  Thank you.

Gentlemen, this is not an issue of whether a BTR is needed to conduct a temporary business in Town as Nick has cited under the code. The
issue, rather, is whether a business such as that in issue is permitted in the RD-(2) zoning district in which it exists. It is not. It is prohibited.
 Please see section 134-1054 of the Town code which speaks directly to this issue. I have spoken to Wayne Bergman who has confirmed
this.

Our ordinances indicate that Business Tax Receipts are only required for permanent business locations or branch offices within Town.

I don’t think this issue of a business tax receipt applies in this temporary situation or enforceable and certainly not a priority for us at the moment.

couple of calls to  me from people asking if he got a business license for that business. Who at the town could confirm that for me?
