J-1-4 Minimum Unit Performance

For the two key guaranteed parameters tabulated below of the LICENSED UNIT, a minimum guarantee is associated to the corresponding guarantee. The guarantees and the
associated minimum guarantees are summarized in the following table.

The LDs defined in Section J apply to the deviation between guarantee and minimum guarantee. In the case, for a given parameter of the above table, after the last
possible PERFORMANCES TEST PERIOD, any of the above minimum guarantees is not met, the LICENSOR at its own cost shall make all studies and/or basic
engineering work to correct the deficiencies of the UNIT to reach the minimum guarantee associated to the parameter.
The total cost to LICENSOR of the obligation under this Schedule, excluding the above mentioned studies and/or basic engineering work, shall not exceed 50% of the
sum paid and/or payable by LICENSEE to LICENSOR for CONSIDERATION.
