Course Description:
The course deals with the different provisions of the civil code falling under the definition of
torts as a source of liability. Emphasis shall be given to the topic on quasi-delict and human
relations as a source of civil liability arising from both intentional and unintentional acts of a
tortfeasor. The subject will also deal with damages focusing on the parameters set by
jurisprudence on the application of the pertinent provisions of the Civil Code.
Course Objectives:
At the end of the course, the student is expected to:
1. Define the concept of torts both in the English concept as well as in Philippine jurisdiction.
2. Enumerate the different sources of laws on torts ad damages
3. Compare quasi-delict as a source of liability against delict and breach of contract.
4. Explain the different provisions of the civil code on Quasi Delict and Human Relations.
5. Explain the concept of vicarious liability and its importance in civil law.
6. Identify the defenses that may be raised in actions for tort.
7. Enumerate the different types of damages and the grounds for the award.
8. Explain court decisions in relation to the civil code provisions on the subject.
