CATERING AGREEMENT

This is a Catering Agreement (hereinafter referred to as “Agreement”, for


brevity), executed this ___ day of __________ 2017, in the City of Baguio,
Philippines, entered into by and between:

“THE MANONG CATERING”, with principal address at 4016


Kias, Baguio City, represented by ALGIE MEL POYATOS BAUTISTA,
of legal age, Filipino citizen, married, with the same principal address,
hereinafter referred to as the “CATERER”;

- and -

__JESTER CORPUZ__, of legal age, Filipino citizen,


single/married, with postal address at ____________________ hereinafter
referred to as the “CLIENT”;

WITNESSETH:

WHEREAS, the Client will have an event/function described as follows:

WHEREAS, the Client is of the opinion that the Caterer has the necessary,
qualifications, experience and abilities to provide services to the Client for the
above-described event/function;

WHEREAS, the Caterer is agreeable to providing such services to the


Client under the following terms and conditions:

1) Services: Food/Service Requested by Client is provided in the final


Catering Invoice attached hereto as Annex “A”;
2) Payment & Deposit: For the above-described services, the Client
agrees to pay Caterer the amount due indicated in the final Catering Invoice
stated in the next preceding paragraph in the following installments: ten
percent (10%) of the total amount shall serve as a non-refundable deposit
payable at the time of the execution of the instant agreement. Unless other
arrangements have been made, such deposit shall serve as a guarantee and
reservation of the services of the Caterer in favor of the Client on the event
date and will be deducted from the total final payment. Final Payment will
be due and demandable, at least 5 days prior to the event date, unless
otherwise agreed upon;

3) Menu: The Client may provide his own preferred menu or choose
from the Caterer’s Pre-Selected Catering Menu. In all instances, the menu
must be confirmed and finalized at least seven (7) days prior to the event
date;

4) Payment Method: All payments shall be made strictly in cash;

5) Time: The Caterer shall be present in the subject event for a


maximum of three (3) hours, exclusive of 1-2 hours set up and 1-2 hours
set-down;

6) Service & Off-site Charge: If the Client requires wait/server staff


during the subject event and/or necessitates deliveries beyond a 4-km radius
from the city business district, an additional ten percent (10%) service
charge shall be paid to the Caterer;

7) Guest Count: The Client must confirm the final number of guests for
the subject event with the Caterer at least seven (7) business days prior to
the event. The number of guests given by the Client shall be used as the
basis of the total amount demandable from the Client. Likewise, the
number given will be used to estimate the costs for the purchase of fresh
ingredients for kitchen production, the extent of preparation for equipment
and staff for the subject event. Any increase in guest count will be subject to
additional costs at a fixed rate of ____________________ pesos
(PhP__________.00) per additional guest. However, the amount fixed
cannot be reduced in the event that the number of guests in the actual date of
the subject event shall be less than the final guest count given by the Client;
8) Food Quantity: The Caterer will prepare between 5% and 10%
overage based on the final guest count provided by the Client. Incorporated
in this overage shall be the staff/or service providers, which shall not be
included in the amount payable by the Client;

9) Leftovers: The Client or the Caterer, per request of the Client, may
pack up all leftovers that are deemed not reusable by the Caterer. The
Client is responsible for providing appropriate containers for leftovers to be
given to guests;

10) Cancellation: All prior payments will be returned in full if the


event is cancelled by the Client, 30 days or more from the event date, with
the exception of the non-refundable 10% deposit;

If the event is cancelled within 30 days of the event, all payments are
forfeited in favor of the Caterer.
