    URGENT MOTION FOR HOUSE DETENTION/ARREST

    Accused, Ruben Balcanao, through counsel, to this Honorable


    Court respectfully avers: That;

    1. On June 28, 2020, joint Trackers team of Pinukpuk MPS,


    Kalinga PIU-DEU and RIU 14 arrested the herein accused at
    Sitio Botol, Apatan, Pinukpuk, Kalinga by virtue of a Warrant
    of Arrest issued by this Honorable Court dated May 10, 2019
    at Pinukpuk, Kalinga.

    2. Accused is now 63 years old and experiencing complicated


    illness and is very weak. After the arrest, accused was referred
    by the arresting officers for check- up because of his illness.

    3. After accused was checked by Dr. Maria Carla Gatbonton, the


    latter advised that the accused will be put under house arrest
    instead of hospital Arrest. The medical certificate is hereto
    attached and marked as Annex “A”.

    4. That for humanitarian consideration and the accused’


    dilapidating condition, accused respectfully pray unto this
    Honorable Court that he be allowed to undergo house arrest as
    advised by his Medical Doctor.

    PRAYER

    WHEREFORE, it is most respectfully prayed of this Honorable


    Court that this motion by the accused will be granted.

    until such time the penalty for indirect contempt is
    served.

    Accused, Victoriano Balcanao, through counsel, to this


    Honorable Court respectfully avers: That;

    1. On July 2, 2020, joint Trackers team of Pinukpuk MPS


    arrested the herein accused at Sitio Botol, Apatan, Pinukpuk,
    Kalinga by virtue of a Warrant of Arrest issued by this
    Honorable Court dated May 10, 2019 at Pinukpuk, Kalinga;

    2. The accused was then detained at the Pinukpuk Municipal


    Police Station Detention Facility from arrest up to present;

    3. Accused is now 60 years old, weak and suffering from Urinary


    Tract Infection. His Medical Certificate is hereto attached and
    marked as Annex “A”;

    4. As a sexagenarian, accused is prohibited from


    strenuous activity cause it would trigger medical
    complications;

    5. Due to the above-mentioned medical diagnosis of the


    accused, he is requesting this Honorable Court to let
    him remain in the custody of the Pinukpuk MPS until
    such time that the penalty for indirect contempt be
    served for humanitarian purposes.

    PRAYER

    WHEREFORE, it is most respectfully prayed of this Honorable


    Court that this motion by the accused will be granted.
