    AFFIDAVIT

    THAT I, NOEL LANTAYA FULMARAN, of legal age, Filipino, married, and a


    resident of barangay Magatas, Sibulan, Negros Oriental, after having been duly sworn to
    in accordance with law, do hereby depose and manifest:

    That last January 22, 2019, I was going back to Dumaguete City coming from the
    Municipality of Bacong delivering copra to DUCOM driving along one (1) Isuzu Dumb
    Truck, color green, registered in the name of ALBERTO MIRANDA SR., which is more
    particularly described as follows:

    SERIAL /CHASSIS NO.: SLR 350-1761417 OR NO.: 1467679544


    MOTOR NO.: DH100-45441 PLATE NO.: GAT-619
    CR NO.: 0600467 MV FILE NO.: 7C-34690

    That while I was driving along National Highway, Barangay Banilad, Bacong, I
    over took one motor vehicle van on the left side lane while going to Dumaguete City.
    Thereafter, the motorcycle behind me overtook the same motor vehicle van on the right
    side lane. Then suddenly I noticed that the above-mentioned motorcycle bumped the rear
    part of my vehicle car. As a result, the driver of the motorcycle lost his balance and was
    hit by the vehicle car I was driving causing his death.

    That this affidavit is executed freely and voluntarily to attest the veracity and
    truthfulness of my statements herein.
