The Claimant, the Estate of Olin L. Coones, appears through its

Administrator, Dee Coones and counsel Branden A. Bell. The State of

Kansas appears through the Attorney General of the State of Kansas

and counsel Terrence Campbell.

The Court makes the following findings of fact based on a

preponderance of evidence:

1. Olin L. “Pete” Coones was arrested for the crime of first-

degree murder on April 7, 2008.

2. Mr. Coones was convicted of first-degree murder, a felony, on

December 17, 2009 in Wyandotte County District Court case

number 2008 CR 594.

3. On November 5, 2020, the Honorable Bill Klapper vacated

Mr. Coones’s conviction and ordered a new trial.

4. On November 5, 2020, the Wyandotte County District

Attorney’s Office moved to dismiss the charge against Mr.

Coones and the court granted that motion.

5. On November 5, 2020, Mr. Coones was released from

incarceration.

6. Mr. Coones was incarcerated for 12 years and 213 days.

7. On November 13, 2020, Mr. Coones filed the present claim

for civil compensation, stemming from his wrongful

incarceration, under K.S.A. § 60-5004.

8. Mr. Coones properly served the Attorney General of the

State of Kansas with his claim.

9. Mr. Coones did not commit the crime of murder.

10. Mr. Coones was not accessory or accomplice to the acts that

were the basis of his conviction for murder.

11. Mr. Coones did not commit or suborn perjury, fabricate

evidence, or otherwise cause or bring about his conviction

through his own conduct.

The Court makes the following conclusions of law:

12. Mr. Coones and the Estate have satisfied the requirements

for compensation under K.S.A. § 60-5004(c)(1)(A)-(D).

13. Under K.S.A. § 60-5004(e)(1)(A), the Estate is entitled to

damages in the amount of $65,000 for each year Mr. Coones

was imprisoned.

14. For the 12 years Mr. Coones was incarcerated, the Estate is

entitled to $780,000 in damages. For the additional 213 days

Mr. Coones was incarcerated, the Estate is entitled to

$37,931.51. The Estate is entitled to combined damages in

the amount of $817,931.51.

15. Under K.S.A. § 60-5004(e)(3)(B), it is in the Estate’s interest

for this amount to be paid in one lump sum.

16. Claimant and the Estate are entitled to reasonable attorney

fees of $8,167.50 and costs of $202.80, incurred in this action

totaling $8,370.30.

Accordingly, judgment is entered in favor of the Estate against the

State of Kansas in the amount of $817,931.51 in damages from Mr.

Coones’s wrongful conviction and incarceration, together with $8,370.30

in reasonable attorney fees and costs, for a total amount of $826,301.81.

Further, the Clerk of the District Court shall send a copy of this

judgment and the certificate of innocence entered in this case to the

Attorney General for the State of Kansas. Pursuant to K.S.A. § 75-

6117(b)(2), payment of this judgment is subject to review by the state

finance council. The Attorney General shall notify the state finance

council of the need to review the judgment and "ensure that payment of

the judgment occurs without unnecessary delay."

Olin L. “Pete” Coones filed an action under K.S.A. § 60-5004. The

Court finds and orders as follows:

1. Officers with the Kansas City, Kansas Police Department

arrested Mr. Coones on April 7, 2008 and Mr. Coones was

charged with first-degree murder.

2. Mr. Coones was convicted of first-degree murder on

December 17, 2009 and sentenced to life imprisonment.

3. Mr. Coones did not commit the crime he was convicted of

and sentenced for.

4. Mr. Coones was not an accessory or accomplice to the acts

that formed the basis of his conviction.

5. Mr. Coones did not commit or suborn perjury, fabricate

evidence, or otherwise bring about the conviction through his

own conduct.

6. The court later vacated Mr. Coones’s conviction and sentence

and dismissed the charge against him.

7. Based on the foregoing, this Court specifically finds that:

 Olin L. “Pete” Coones did not commit the crime of first-

degree murder.

 Olin L. “Pete” Coones was and is innocent of the crime of

first degree murder for which he was mistakenly

convicted.

ORDER OF EXPUNGEMENT
__________________________________________________________________

Olin L. “Pete” Coones filed an action under K.S.A. § 60-5004. The

Court has found that he meets the requirements set out in that statute

and has entered a certificate of innocence. Consistent with K.S.A. § 60-

5004(h)(1), the Court finds and orders:

1. Mr. Coones’s full name was Olin Lawrence “Pete” Coones.

2. Mr. Coones was a white male, born on 8/26/1957.

3. Mr. Coones was arrested for, and convicted of, violating

K.S.A. § 21-3401.

4. Mr. Coones was arrested on April 7, 2008 by the Kansas

City, Kansas Police Department.

5. Mr. Coones was convicted on December 17, 2009 in the

Wyandotte County District Court, case number 2008 CR

594.

6. Mr. Coones’s arrest, conviction, and sentence were a mistake

because he was innocent.

Thus, the Court orders that Mr. Coones’s conviction and arrest

records must be expunged and purged from all applicable state and

federal systems.

The Court further orders the Kansas Bureau of Investigation to

purge the conviction and arrest information from the Criminal Justice

System Information System Central Repository and all applicable state

and federal databases.

The Court further orders the Kansas Bureau of Investigation to

notify the Federal Bureau of Investigation, the Kansas Secretary of

Corrections, and any other criminal-justice agency that may have a

record of the arrest or conviction about this Court’s order.

The Court further orders the expungement of any records,

including profile records, and the destruction of any associated

biological samples given to the Kansas Bureau of Investigation under

K.S.A. § 21-2511.

The Court further orders the Kansas Bureau of Investigation to

provide confirmation of its compliance with this order to the Court.

The Court further orders the Clerk of the District Court to send a

certified copy of this order to the Kansas Bureau of Investigation.
