CIRCUIT COURT OF
IN THE CIRCUIT COURT OF MADISON COUNTY, ALABAMA
MADISON COUNTY, ALABAMA
DEBRA KIZER, CLERK

STATE OF ALABAMA §

VS. § CC18-3238

WILLIAM DARBY §

STATE’S RESPONSE

Comes now the State of Alabama, by and through the undersigned Assistant District Attorneys, and
hereby responds to this Honorable Court’s Order:

The State has no opposition to the release of the body cam footage in this case. While before adjudication

pretrial publicity issues were a concern, such is not the case after sentencing.
The State takes no position as to whether the public or media can obtain the body cams from the City.
However, once the footage was admitted as evidence at a public trial, it became a public record, regardless of its

status while in the City’s custody. While certain enumerated exceptions exist to releasing trial exhibits (protected
medical information, exhibits concerning minor children, etc.), none apply to this case.
The State has communicated with the victim’s family in this case. They are in favor of this Court

releasing the body cam footage.

WHEREFORE, the State does not object to the public records request in this case.

Respectfully submitted,

/s/ Tim Gann /s/ Tim Douthit
