SECTION 1. Amendments. The following Sections of City Ordinance No. 223-19 or “the Masbate City Traffic Management
Code of 2019” is hereby amended as follows:
64. Double Parking shall mean standing or parked vehicle on the roadway side of a vehicle
already parked, stopped or standing.

65. Obstruction shall mean any vehicle that is parked in a way as to obstruct or impede the
passage of any vehicle, nor, while discharging or taking on passengers or loading or
unloading freight, obstruct the free passage of other vehicles on the highway.
66. Parallel Parking means parking a vehicle along or parallel to the side of the road, rather
than facing into the side of the road.
67. Perpendicular Parking means parking the vehicle side by side, facing the sidewalk,
perpendicular to a wall, building or improvements.
68. Rotonda is a roundabout circular intersection or junction in which road traffic is permitted
to flow in one direction around a central island, a priority is typically given to traffic
already in the junction.
69. Non-Conventional Vehicle shall mean any motorized vehicle, gas or electric powered that
is used to transport people, equipment or other goods;

c. For Perpendicular Parking, the following vehicles are allowed to park:
i. Tricycles;
ii. Trimobiles; and
iii. Motorcycles.
d. For Parallel Parking, only four (4)- wheeled vehicles and non-conventional vehicles are
allowed to park;
Article XVII shall now read as, “TRAFFIC APPREHENSION PROCEDURES AND CREATION OF
TRAFFIC DEVELOPMENT TRUST FUND”.

Section 61. shall now read as: “Apprehension Procedures & Remedies” ; while paragraph (a) shall be
deleted, and all other items under this Section shall be renumbered as follows:

(a) Where the violator is not a driver, a written notice or citation to the offending party shall be
issued by the deputized traffic enforcer;
(b) The violator shall have five (5) days from the date of violation within which to redeem his
license and shall be released only upon presentment of OVN and proof of payment of
the appropriate fines. An additional surcharge of five percent (5%) per day of delay, or up
to maximum of fifty percent (50%) of the fine;
(c ) Stalled or illegally parked as a result of engine trouble shall be towed in cases where the
driver deliberately refused to remove his vehicle or cannot move the same due to the
absence of equipment or tools, or due to circumstances beyond his control. In addition,
OVN shall be issued to the driver; and

(d) Illegally parked vehicles that are already clamped to the tow trucks shall not be subject for
intercession by the owner of the vehicle or by the representatives of their company’s tow
truck.
Section 67. Penalty Clause. paragraph (c) shall be deleted, and all other items under this Section shall be
renumbered as follows:
a. For violations of any provisions under this Code not specifically penalized under Section 67 hereof,
the following are the corresponding imposable penalty:

b. For violations of Section 47, on Safety Helmets for Motor Cyclists, the following are the imposable
penalties:

c. For Unregistered Vehicle, for every violation, the driver shall be penalized of a fine of Two Thousand

e. For No Driver’s License for every violation, the driver shall be penalized of a fine of Two Thousand
Pesos (Php2,000.00).

24. Airport Access Road
25. “No Parking” sign is not required and no driver shall park a vehicle, or permit it to stand,
whether attended or unattended, in any of the following places:
1. In front of any private or authorized driveway
2. Within six (6) meters of any intersection
3. Within 4 meters of a fire hydrant
4. On the roadsides of any legally parked vehicle (double parking)
5. On a pedestrians cross walk
6. On the sidewalk, path or alley not intended for vehicular traffic or
parking
7. At the foot or near bridged
8. National road except a designated parking area by the City

-(from corner Post Office Road to Rotonda Crossing)
4. Rosero Street
- (from corner Quezon Street to corner Medina Street)
Appendix IX. Counterlockwise Flow of Traffic. There shall be Counterclockwise flow of traffic along
the following roads:
SECTION 3. Repealing Clause. All previous ordinances, executive orders, rules and regulations or parts thereof
which are inconsistent with this ordinance are hereby repealed and/or modified accordingly.
SECTION 4. Separability Clause. If for any reason any part or provision of this Ordinance is declared invalid or
unconstitutional, any part or provision not affected thereby shall remain in full force and effect.
SECTION 5. Effectivity Clause. This Ordinance shall take effect immediately upon approval and publication on
local newspaper of general circulations.
