MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Memorandum of Agreement is entered into this 12th day of March, 2022 in WEST
PRIME by and between:

The WEST PRIME HORIZON INSTITUTE, INC., a private senior high school organized
and operating under the laws of the Republic of the Philippines with official address at San
Francisco District, Pagadian City, Zamboanga Del Sur, represented by its School Registrar,
MRS. HILDA D. ALCASID, and herein after referred to as “West Prime”;

-And-

The (partner institution/ company/shop where you applied) with official address at
(address of the company and institution) , represented by its (position of the employer),
(name of the employer) herein after referred to as the (partner institution/ company/shop
where you applied).

WITNESSETH: That –

WHEREAS, with the passage of the Enhanced Basic Education Act of 2013 or Republic
Act 10533, the DepEd was tasked to implement the K to 12 Program, essentially adding two (2)
years of specialization within the Basic Educational System;
WHEREAS, the DepEd designed the implementation of RA 10533 within the
framework of increased community involvement in the learner’s experience;
WHEREAS, with this premise, the DepEd, offers venues for various stakeholders to
participate in the implementation of RA 10533 and, the same offer, accepted by the PARTIES
herein; The Work Immersion Program is one of the course requirements for graduation. A SHS
student has to undergo work immersion in a business organization or establishment with work
requirements related to the specialization. Through work immersion, the students are exposed to
and are familiarized with the work-related environment related to their field of specialization.
Specifically, the students are able to:
1. Gain relevant and practical industrial skills under the guidance of industry experts and
workers;
2. Appreciate the importance and application of the principles and theories taught in the
classroom;
3. Enhance their technical knowledge and skills;
4. Prepare them to meet the needs and challenges of employment, entrepreneurship, or
higher education after their graduation.
 NOW, THEREFORE, for and in consideration of the foregoing premises, the PARTIES
hereby agree on and stipulate the following:

A. THE FOLLOWING OBJECTIVES ARE SET FORTH IN THE EXECUTION OF

THIS MEMORANDUM:

1. West Prime Horizon Institute students who will undergo OJT will be assigned and
required to perform duties and functions along their areas of specialization and within the
requirements of their academic program;

2. Under the OJT program and/or activities provided by partner institution/

company/shop where you applied) students undertaking OJT will gain additional knowledge
and skills as they perform their duties and functions;

3. Students undertaking OJT will be able to interact with other students and professionals
and will be exposed to activities related with their areas of specialization; and (partner
institution/ company/shop where you applied), and its relation to the society.

B. WEST PRIME HORIZON INSTITUTE SHALL UNDERTAKE THE

RECOMMENDATION, SELECTION AND ENDORSEMENT PROCESS OF THE
STUDENTS FOR OJT. SPECIFICALLY,

1. West Prime shall identify students qualified to undergo OJT;

2. West Prime shall conduct orientation of students’ general duties and responsibilities
that will be applicable during the period of their OJT;

3. West Prime shall designate an OJT coordinator or point person who will work closely
with (partner institution/ company/shop where you applied), to monitor the actual conduct of
the OJT;

4. West Prime shall endorse participating students (hereinafter referred to as student-

trainees) to (partner institution/ company/shop where you applied), ; and

5. West Prime shall provide (partner institution/ company/shop where you applied),
whatever documents that are required as the student-trainees undertake their OJT.

6. West Prime shall submit to (partner institution/ company/shop where you applied),
Human Resource Department a complete list of the students who are to be part of the training at
the school with their assigned adviser, their schedule of rotations if any shall be subject to
approval of its approval.

7. West Prime and its assigned adviser and the students shall commit to follow and
pursue (partner institution/ company/shop where you applied), goal to deliver quality health
care services. Any act of omission tending to violate the requirements shall be cause for the
cancellation of the MOA by the latter.
C. (partner institution/ company/shop where you applied), UNDERTAKES THE
SCREENING AND ACCEPTANCE OF STUDENT-TRAINEES. SPECIFICALLY,

1. (partner institution/ company/shop where you applied), shall accept student-

trainees by West Prime to undergo the required total 80hours of OJT;

2. (partner institution/ company/shop where you applied), shall assign personnel to

take charge and supervise the student-trainees;

3. (partner institution/ company/shop where you applied),, shall accomplish the

necessary forms required by West Prime in connection with the student-trainees’ OJT

4. (partner institution/ company/shop where you applied),, shall communicate to West

Prime and its student trainees the policies, rules and/or guidelines related to the conduct of the
OJT and to conform to academic and professional standards and practices while undergoing
OJT;

5. (partner institution/ company/shop where you applied), shall ensure that the
student-trainees shall work in an environment conducive to learning and shall not, at any time, be
exposed to any work, project, or activity that may pose an imminent threat or danger to their
safety or well-being;

7. (partner institution/ company/shop where you applied), shall issue certificates of

completion and a corresponding performance rating base on the evaluation tool given by West
Prime to student-trainees who will successfully finish their OJT; and

8. Enforce the rules that will govern the conduct of the student-trainees while inside and
within the premises of (partner institution/ company/shop where you applied),.

D. BOTH (partner institution/ company/shop where you applied), AND WEST PRIME
FURTHER AGREE THE FOLLOWING:

1. Both PARTIES will work together to maintain an environment of quality learning

experiences for the student-trainees. At the request of either party, a meeting may be held to
resolve any problems or develop improvements in the operation of the OJT and other related
programs;

2. The development and implementation of specific activities based on this Agreement

will be separately negotiated and agreed upon between both Parties. Both Parties agree to carry
out these activities in accordance with the laws and regulations and after full consultation and
approval from the other party.

3. It is understood that the implementation of any of the cooperative activities may be

restricted depending upon the availability of resources and funds of the concerned parties.
 4. There will be no employer-employee relationship between(partner institution/
company/shop where you applied),, and the student trainees;

5. For the duration of the OJT, the student-trainees will be solely liable and responsible
for any damage to property or injury that may result to intentional or negligent acts while doing
their duties and functions;

6. (partner institution/ company/shop where you applied), shall hold West Prime free
from any liability for any damage to property or injury caused by the negligent or accidental act
or omission of the student trainee;

7. West Prime shall be responsible in ensuring that the student-trainee will replace or
repair of the property damaged by him/her caused by his/her negligence or inadvertence;

8. (partner institution/ company/shop where you applied),, reserves the right to

discontinue the OJT of the student-trainees upon submission of an appropriate written notice to
the other party;

9. West Prime and its student-trainees shall not use for their own benefit any work,
research, or project, as well as any data, concept or information gathered or obtained during the
OJT without the written consent of(partner institution/ company/shop where you applied),;

10. Should(partner institution/ company/shop where you applied),, allow the use of
any data or information, West Prime and its student trainee shall expressly acknowledge(partner
institution/ company/shop where you applied), as owner or source in the work, research, or
project;

11. This Agreement may be amended or modified by a written agreement signed by the
representatives of both Parties.

12. In the event of an unforeseen incident during collaborative activities, both Parties
agree to negotiate a mutually acceptable solution. As far as practicable, these solutions shall be
incorporated into the specific agreements mentioned in clause 3.

13. This Agreement may, at any time during its period of validity, be terminated by both
Parties, upon prior notice to the other party in writing, at least six months before the termination
date.

14. Should any disagreement arise out of the application, interpretation or

implementation of this Agreement, both Parties shall endeavour to exercise their best efforts to
negotiate the differences.
