1. NARRATIVE: On April 19, 2022 at about 7:45 P.M. PO3 Riva Flora
who was the desk officer of the day, received a radio call from
informant that Marlon Cinco y Diaz, a homicide suspect with
pending warrant of arrest, was seen drinking liquor at Migs Resto
Bar along San Miguel Heights, Lagonglong Misamis Oriental.

Acting on this information, the undersigned dispatched a team led


by PINSP RAMEER COLUMBRES BUENAVENTURA to serve the
warrant of arrest to the suspect. Accompanied by the informant, the
team arrived at 8:30 P.M. at the place where they saw the suspect
in an apparent altercation with another liquor buddy. Immediately,
they apprehended the suspect who did not resist arrest, and
brought him to this office for proper disposition.

Suspect was booked with no. 23-44563 and was turned over to the
Lagonglong Provincial Jail for detention.

II. MATTERS INVESTIGATED: b Regional Office 5, Lgonglong,


Misamis Oriental.

III. FACTS OF THE CASE:


4. On March 27, 2022 at about 8:00 PM, a vehicular accident
transpired along Alternate Road Fronting PhilHealth Regional Office
5, Lagonglong, Misamis Oriental. Wherein involved vehicle are as
follows;

Vehicle 1 – Honda XRM motorcycle, color Black, bearing plate


no. 3783-EF, under OR no. 545539761, CR no. 5918685-3 owned
and driven by Dindo Lupango y Rosero, 42 y/o, married of EM’s
Barrio, Lagonglong, Misamis Oriental, holder and possessor of LTO
PDL no. EO2-96-0031302 with backride (Wife) one Pinky Lupango
y Mujar, 43 y/o, married of same address.

Vehicle 2 – Honda Wave, color Black and Blue, bearing LTO


plate no. EL-3710 under OR no. 30984814, CR no. 15540978
registered to Jonathan Advento of L4, B5 Height Subd. Rawis,

Lagonglong, Misamis Oriental, driven by Renato Alamo y Canan,
39 y/o married of Brgy. Kauswagan, Lagonglong, Misamis Oriental,
holder and possessor of LTO PDL no. EO2-94-027175.

5. Accordingly, V1 was coming from Tahao Road, Lagonglong,


Misamis Oriental going to EM’s Barrio, Lagonglong, Misamis
Oriental while V2 coming from Washington Drive, Lagonglong,
Misamis Oriental going to Bitano, Lagonglong, Misamis Oriental,
while both V1 and V2 traversing opposite direction along Alternate
Road, Lagonglong, Misamis Oriental upon reaching the above-
mentioned place particularly at PhilHealth Regional Office 5, both
vehicle collided in head-on collision. Thereafter resulted to V1 driver
and her backride and V2 sustained injuries on the different parts of
their body and both vehicle incurred undetermined amount of
damages on the front portion of the motorcycles due to the incident.
The incident was witnessed by SG Ronald Leonardo and SG
Francisco Albalate guard on duty at PhilHealth Regional Office 5,
scene of incident was photograph by PO3 Joel Buen and drafts was
made through rough sketch by SPO1 Amaranto, likewise driver of
V1 and her backride was brought to Aquinas Hospital while driver of
V2 were brought to (Attached hereto excerpt of LCPS CPO Blotter
Entry No. 1646 and 1648 dated March 27, 2022 marked as Annex
“A”)

6. In the affidavit of PO3 Dindo Lupango y Rosero with badge


no. 145328 a bonafide PNP member assigned at Lagonglong
Municipal Police Station designated as MPU-1 driver he averred
that on March 27, 2022 (Attached hereto sworn statement of PO3
Dindo Lupango y Rosero marked as Annex “B”)

7. In the account of Pinky Lupango y Mujar, 43 y/o, wife of PO3


DINDO LUPANGO y ROSERO, a resident of EM’s Barrio,
Lagonglong, Misamis Oriental which was the witness when the
actual incident occurred, she averred that more or less about 8:00
PM of March 27,2022 while she was a backride of her husband, she
saw Vehicle-2 running too fast moving the opposite direction going
to Brgy. Bitano, Lagonglong, Misamis Oriental and upon reaching
on a certain point particularly infront of PhilHealth Regional Office 5
Vehicle-2 [Honda Wave] hit/bumped us resulted to a head-on
collision V-1, turned left and its front wheel encroach to the left lane
as result of the impact.

8. On April 19, 2022 parties involved in the aforementioned


vehicular accident appeared to this office during the course of
confrontation/investigation PO3 Dindo Lupango y Rosero
(driver/owner of Vehicle 1 Honda XRM color Black plate no. 3783-
EF) and Renato Alamo y Canon driver of Vehicle 2 (Honda Wave
color Black and Blue plate no. EL-3710) manifested that they are.
The said was recorded under LCPS-CPO Blotter Entry no. (Excerpt
marked as Annex “C”)

9. Based on the Medical Certificate of PO3 Dindo Lupango y
Rosero reveal diagnosis duly issued by Dr. Joselito B. Rusta MD,
the attending physician at Balingasag Provincial Hospital. He was
treated and confined for fifteen (15) days from March 27, 2022 to
April 11, 2022 and on April 14, 2022 undergone surgical operation
and was discharged April 19, 2022 – (Hereto attached the copy of
Medical Certificate marked as Annex “D” and Radio Message
Transmission for Admin Section – Misamis Oriental PPO)

10. Based on the Medical Certificate of Renato Alamo y Canon


driver of Vehicle-2 (Honda Wave color Black and Blue plate no. EL-
3710) reveal the diagnosis “Moderate Traumatic Head Injury
Secondary to Vehicular Accident duly issued by Dr. Abel Francisco
Ramos II, MD Medical Officer III Department of Surgery BRTH,
Misamis Oriental. He was treated and confined for eighth (8) days
from March 27, 2022 to April 4, 2022. (Hereto attached the copy of
Medical Certificate marked as Annex “E”)

IV. DISCUSSION/CONCLUSION:

11. Due to the mutual agreement of both parties involved to


amicably settle the case, the fault/negligence of either driver of the
involved motor vehicle could not be established since their
respective allegations during the initial stage of the investigation is
unsubstantiated.

V. RECOMMENDATION

12. Respectfully recommend that this case be (dropped and


closed.)

FACTS OF THE CASE:

(Robbery with Homicide and Rape) Diana Ang, 20 years old,


married but estranged to her husband, reported about the incident happened
to them on March 27, 2022 at around 11:00 o’clock in the evening with her
boyfriend of six months, Eugenio Calaykay, 32 years old, in the Municipality of
Lagonglong, Misamis Oriental that they are being unlawfully and feloniously
attacked and assaulted with intent to kill by the two accused identified by
Diana Ang as Pedro Coranez and Jesse Tapales. She narrated that the
accused take without their consent the wrist watch, brown wallet and
undetermined money of Eugenio Calaykay and her parker ballpen valuing
P10.00 and then shot Eugenio Calaykay twice and stabbed him on the chest
with balisong knife. In the furtherance of their conspiracy, the said balisong
knife and fiearm, which they were holding then at the time, succeed in having
sexual intercourse with her, one after the other all against her will and
consent.

The Blotter Excerpt is issued upon request of the interested party for
whatever legal purpose it may serve.

SUBJECT : SPOT REPORT in Robbery with Homicide and Rape

DATE : April 27, 2022

1. Please be informed that on March 27, 2022 at around 11:00 o’clock


in the evening a robbery with homicide and rape incident happened
at the middle of Lumbo bridge in the Municipality of Lagonglong
wherein the victims Diana Ang, 20 years old, married but estranged
from her husband, Valentin Katigdas, was with her boyfriend of six
months, Eugenio Calaykay, 32 years old, was being unlawfully and
feloniously attacked and assaulted with intent to kill by the two
accused identified by Diana Ang as Pedro Coranez and Jesse
Tapales.

2. The investigation revealed that the accused take without their


consent the wrist watch, brown wallet with undetermined money of
Eugenio Calaykay and Diana Ang’s parker ballpen valuing P10.00
and when the taxi reached the Fire Department at Lagonglong,
Eugenio shouted for help and in an instant Eugenio was stabbed in
the chest using balisong knife by Coranez and shot by Tapales
twice. In furtherance with their conspiracy , the said accused
threatened to stab and kill the said Diana Ang y Navales with said
balisong knife and firearm, which they were holding them at the
time, succeed in having sexual intercourse with her, one after the
other all against her will and consent.

3. The motive of he incident is undetermined and the case is still


under a further investigation.

SUBJECT : Progress Report on Shooting Incident that Resulted to


Death of Federito Armateo

DATE : May 4, 2022

1. References:
a. Incident Record Form with Blotter Entry No. 696969
dated March 21, 2022. Report received OOA 7:48 PM
dated March 21, 2022;
b. Spot Report received via Skype on 9:58 AM of even date;
and
c. Progress Report on IOC OOA 10:06 AM of March 29,
2022.

2. On or about 2:30 in the morning of March 20, 2022 a shooting


incident transpired at Barangay Lanipao, Lagonglong, Misamis
Oriental wherein one victim Federito Amateo Jr. 47 years old, a
member of PNP Special Action Force, married, and a resident of
Lanipao, Lagonglong, Misamis Oriental, was shot by suspect Peter
Gallaza, 32, victim’s brother in law, a security guard, and a resident
of the same place, as a result thereof, the victim sustained gunshot
wound on his chest and was rushed to Don Salvador Benedicto
Memorial Hospital in Balingasag, Misamis Oriental for medical
treatment but was pronounced dead on arrival by attending
physician thereat. The suspect was arrested at the crime scene
where he surrenders himself. Investigator PSSG Ismael S.
Mahadun requested for SOCO team to conduct crime scene
processing, two (2) .45 caliber pistol with live ammunition, two (2)
fired bullet, one (1) gun recoil spring was recovered and collected
by the SOCO team, while the weapon used in the commission of
the crime was not recovered after the suspect thrown it to the rice

fields and he is now under the custody of this station for
investigation and proper disposition.

3. On or about 4:50 in the afternoon of April 25, 2022 the case was
filed against the suspect Peter Gallaza for Homicide under section
11 with NPS Docket number IX-69-IHK-69J-016969 and was
handle by Assistant Municipal Prosecutor Atty. Ero Maron N.
Mondejar. Suspect avail his fifteen (15) days waiver of Article 125 of
Revised Penal Code for preliminary investigation.

2. Per above references, a case of violation of RA 7659 (Homicide)


was filed against Peter Gallaza, 32 years old, Lanipao, Lagonglong,
Misamis Oriental docketed under NPS Docket No. IX-69-IHK-69J-
016969 dated April 25, 2022 before the City Prosecutor’s Office
assigned to Atty. Eru Maron N. Mondejar, Assistant Municipality
Prosecutor. That after careful evaluation of the pieces of evidences
on records, the Inquest Prosecutor finds that there is reasonable
ground to believe that the subject person committed the offense as
charged and that he is probably guilty thereof, with criminal case
no. 69696 under RTC Branch 15 with bail bond recommended of
P200,00.00 for his temporary liberty.

3. Subject person did not post bail bond and was committed at
Lagonglong Municipal Reformatory Center during the pendency of
his case.
