Executive Order No. 13


Series of 2022

AN ORDER EXTENDING THE ALERT LEVEL 2 STATUS OF THE


MUNICIPALITY OF CANDONI UNTIL APRIL 15, 2022

WHEREAS, it is the policy of the State to protect and promote the


right to health of every people and to instill health consciousness among
them.

WHEREAS, pursuant to Republic Act No. 11332, it is the policy of the


State to protect and promote the right to health of people and shall endeavor
to protect the people from public health threats; and the State recognizes
epidemics and other public health emergencies as threats to public health
and national security, which can undermine the social, economic, and
political functions of the State;

WHEREAS, Section 16 of Republic Act No. 7160 of the Local


Government Code provides that the Local Government is in-charge to ensure
and promote health safety and preserve the comfort and convenience of their
inhabitants within their respective jurisdiction;

WHEREAS, Section 444 of the same law provides an authority to the


local chief executive to carry out such emergency measures as may be
necessary during and in the aftermath of man-made and natural disasters
and calamities;

WHEREAS, the same section of the law extends the power to the local
chief executive to issue such executive orders as are necessary for the
proper enforcement and execution of laws and ordinances;

WHEREAS, on September 10, 2021, President Rodrigo R. Duterte


issued Proclamation No. 1218, declaring the extension of the State of
Calamity throughout the country for a period of one (1) year effective
September 13, 2021, until September 12, 2022, unless earlier revoked or
prolonged as circumstances may warrant;

WHEREAS, pursuant thereto, Local Government Units are enjoined to
render full assistance and cooperation and mobilize necessary resources to
undertake critical, urgent, and appropriate disaster response aid and
measures in a timely manner to curtail and eliminate the threat of COVID-
19;

WHEREAS, the Municipality of Candoni was placed under Alert Level


2 from November 1 to 14, 2021, covered by Executive Order No. 41, Series of
2021, which was extended from November 15 to 30, 2021, through
Executive Order No. 42, Series of 2021, which was further extended from
December 01 to 15 through the provisions of Executive Order No. 43, Series
of 2021; and further extended from December 16 to 31, 2021 through the
Executive Order No.44, Series of 2021 and further extended from January 1
to 15, 2021;

WHEREAS, the Alert Level Status of Municipality of Candoni was


escalated to Level 3 from January 15 to 31, 2022 by virtue of Executive
Order No. 03, Series of 2022 and extended until February 15, 2022 through
the provisions of Executive Order No. 04, Series of 2022, and from February
16 to 18 the alert level status was downgraded to Alert Level 2 through the
provisions of Provincial Executive Order 22-04 Series of 2022 and extended
until March 16, 2022 through Executive Order No. 08 Series of 2022 and
further extended until March 31 through Executive Order No. 10 Series of
2022;

WHEREAS, the Municipal Government of Candoni has always been


compliant and cooperative with the alert level status prescribed by the
Provincial Government of Negros Occidental;

NOW THEREFORE, I, CICERO D. BORROMEO, by virtue of the


power vested upon me by law as Local Chief Executive of the Municipality of
Candoni, Negros Occidental, do hereby order the following:

Section 1. EXTENSION OF ALERT LEVEL 2 IN THE MUNICIPALITY OF


CANDONI. In conformity with the Provincial Executive No. 22-13 Series of
2022, the Alert Level 2 Status is hereby declared in the Municipality of
Candoni until 11:59 PM of April 16, 2022.

Section 2. TRAVEL GUIDELINES FOR ALL FORMS OF INTERZONAL AND


INTRAZONAL TRAVEL. In conformity to the Provincial Executive Order 22-
13 Series of 2022 and the IATF-EID Guidelines on the Implementation of
Alert Levels System for COVID-19 Response, all forms of Intrazonal and
Interzonal travel shall be allowed subject to the following guidelines:

A. VERIFIABLE VACCINATION CARD/CERTIFICATE FOR
INTERZONAL MOVEMENT OF FULLY VACCINATED
INDIVIDUALS. Fully vaccinated individuals shall be required to
present the Verifiable Vaccination Card/Certificate to enter the
Province of Negros Occidental. Any of the following vaccination
cards or certificates shall be honored by the Province:
a. The Negros Occidental Provincial MIS Vaccination Card or
b. A verifiable COVID-19 domestic vaccination card duly
issued by a legitimate vaccinating establishment or
c. Official Department of Health Vaccination Certificate with
Quick Reference (QR) Code

B. DOCUMENT REQUIREMENTS FOR INTERZONAL MOVEMENT


OF PARTIALLY VACCINATED AND UNVACCINATED
INDIVIDUALS. Partially vaccinated and unvaccinated individuals
shall be required to present the following documents to enter the
Province of Negros Occidental:

I. RAPID ANTIGEN TEST RTESULT TO BE CONDUCTED


FREE OF CHARGE BY THE PROVINCE OF NEGROS
OCCIDENTAL UPON ARRIVAL. The Province of Negros
Occidental shall conduct a rapid antigen test, free of charge,
for arriving passengers for airports and seaports. However,
the Province shall also honor the following:

a. NON-REACTIVE RAPID ANTIGEN TEST RESULT PRIOR


TO TRAVEL.

a. Shall be valid for 48 hours from the date of swab sample


extraction.
b. Must be conducted and issued by a Department of Health
accredited Health Clinic of Laboratory.

C. EXCEPTION. GOVERNMENT OFFICIALS/PERSONNEL ON


OFFICIAL BUSINESS. The provisions of IATF Resolution No. 98-A,
Series of 2021 shall be in full force and effect. Government
officials/personnel on official business shall be allowed unimpeded
travel to their place of destination, provided that they:
1. Present valid IDs issued by their respective government
agency;

2. Present original or certified true copy of travel
authority/order issued by the Department Secretary or
his/her designated official;
3. Pass symptom screening at the port upon arrival, and in
case of public transport, upon boarding; and
4. Strictly comply with the minimum public health
standard.
D. INDIVIDUALS WITH FAKE DOCUMENTS REQUIREMENTS.
Individuals/Travelers apprehended with fake documents
mentioned under this Executive Order shall face criminal sanctions
under existing laws and regulations and shall be subjected to the
following:
1. A ten (10) day quarantine at a Provincial Healing Facility,
and
2. RT-PCR Test, at his expense, on the 5th day from arrival.

Section 3. TERMINATION OF TRANSPORTATION SERVICES FOR


INBOUND TRAVELLERS. The Municipal Government of Candoni
terminates the facilitation of transportation services for inbound travellers
(OFs, OFWs, and Returning Residents). MDRRMO personnel will only
carry out and facilitate the transportation of inbound travelers in
instances that the traveller has a REACTIVE ANTIGEN TEST RESULT upon
arrival from the ports (Bacolod/Silay Airport and seaports) and opted to be
quarantined in the designated Municipal Quarantine Facility.

Section 4. CLOSURE OF ESTABLISHMENTS. The following establishments


shall be closed during the declaration of Alert Level 2 in the Municipality of
Candoni;
a. Face to face or in-person classes for basic education
b. Contact Sports
c. Funfairs/peryas and kid amusement industries such as
playgrounds, playrooms, and kiddie rides
d. Venues with live voice or wind-instrument performers and
audiences such as karaoke bars, clubs, concert halls, and
theaters
e. Gathering in residences with individuals not belonging to
the same household
f. Casinos
g. Horse Racing
h. Cockfighting and Operation of Cockpits
i. Lottery and Betting Shops
j. Other Gaming Establishments

Section 5. LIMITED OPERATION OF ESTABLISHMENT. Pursuant to the
IATF-EID Guidelines on the Implementation of Alert Levels System for
COVID-19 Response, the following establishments shall be allowed limited
operations for the duration of Alert Level 3, subject to the following
guidelines:
a. Venues for meetings, incentives, conferences, and exhibitions
(MICE);
b. Permitted venues for social events such as parties, wedding
receptions, engagement parties, wedding anniversaries,
debut and birthday parties, family reunions, and bridal or
baby showers;
c. Visitor or tourist attractions such as libraries, archives,
museums, galleries, exhibits, parks, plazas, public gardens,
scenic viewpoints or overlooks, and the like;
d. Limited face-to-face or in-person classes for higher
education and for technical-vocational education and
training;
e. In-person religious gatherings; gathering for necrological
services, wakes, inurnment, and funerals for those who died
of causes other than COVID-19 and for the cremains of the
COVID-19 deceased;
f. Licensure or entrance/qualifying examinations
administered by their respective government agency, and
specialty examinations administered by their respective
government agency, and specialty examinations authorized
by the IATF subject to the health and safety guidelines as
approved by the IATF;
g. Dine-in services of food preparation establishments such as
kiosks, commissaries, restaurants, and eateries, subject to
DTI sector-specific protocols;
h. Personal care establishments such as barbershops, hair
spas, hair salons, and nail spas, and those offering
aesthetic/cosmetic services or procedures, make-up
services, salons, spas, reflexology, and other similar
procedures, including home service options, subject to the
sector-specific protocols of the DTI; With Amendments as of
October 13, 2021.
i. Fitness studios, gyms, and venues for individual non-
contact exercise and sports, subject to DTI sector-specific
protocols. Provided that the patrons/clients and
workers/employees wear face masks at all times and that
no group activities are conducted;

j. Film, music and television production subject to the point
guidelines as may be issued by the DTI, DOLE, and the
DOH;
k. Recreational venues such as internet cafes, billiard halls,
swimming pools, and similar venues will be allowed from
8:00 AM to 5:00 PM. Computer shops operator/owner
should impose no face mask no entry to clients;
l. All kinds of refreshments, fast food, carenderias shall cater
to costumers in a take-out only manner;
m. Delivery riders of J&T, Ninja Van, JRS, LBC and the like,
shall be allowed to conduct door to door delivery services
provided that the minimum health protocols defined by the
LIATF are complied.

Section 6. GUIDELINES FOR THE LIMITED OPERATION OF


ESTABLISHMENTS. Pursuant to the Provincial Executive Order No. 22-13
Series of 2022 and IATF-EID Guidelines on the Implementation of Alert
Levels System for COVID-19 Response, these are the guidelines for the
aforementioned establishments allowed limited operations during the Alert
Level 2:

1. EMPLOYEES FULLY VACCINATED. All workers/employees


of the establishments allowed to operate under this
Executive Order must be fully vaccinated against COVID-19;
2. STRICT OBSERVANCE OF DOH MINIMUM PUBLIC
HEALTH STANDARDS. Department of Health Minimum
Public Health Standards shall be strictly maintained at the
establishment;
3. OUTDOOR VENUE CAPACITY LIMIT. All limited operation
establishments shall be allowed up to 70% outdoor venue
capacity to cater to individuals, regardless of vaccination
status;
4. INDOOR VENUE CAPACITY LIMIT TO CATER TO FULLY
VACCINATED INDIVIDUALS AND MINORS. All limited
operation establishments shall be allowed up to 50% indoor
venue capacity but must cater to fully vaccinated individuals
only.
5. NO OBJECTION FROM BARANGAYS WHERE ACTIVITIES
MAY TAKE PLACE. There must be no objection from the
barangays where the activities of these limited operation
establishments will take place.

Section 7. PROTOCOL FOR HOME QUARANTINE AND ISOLATION OF
COVID-19 CASES WITH NO SYMPTOMS, MILD SYMPTOMS, OR
MODERATE SYMPTOMS. The Municipal Government of Candoni hereby
adopts and gives full force and effect the provisions of the Provincial
Executive Order No. 22-13 Series of 2022 and of Department of Health
Circular No. 2022-0002, Series of 2022 as the protocol for the home
quarantine and isolation of probable and confirmed COVID-19 cases with no
symptoms, mild symptoms, or moderate symptoms.

Section 8. STRENGTHENING THE ROLE OF THE BARANGAY HEALTH


EMERGENCY TEAM (BHERT). Each barangay, through their BHERTs must
be proactive in monitoring the traveler/s, especially traveler/s whose LGU of
origin is/are outside the Province Negros Occidental. Further, BHERT must
report immediately to LIATF if COVID-19 symptoms are observed with the
traveler/s to ensure proper prevention, mitigation, and containment of
possible local transmission of COVID-19.

Section 9. MARKET DAY. During Market Day/Sunday, an ambulant


vendor of essential goods shall only be allowed to sell. The same shall
adhere to the health and safety measures implemented by the LIATF.
Further, anybody caught violating the health protocols shall be subject to
penalties appropriate to their violations.

Section 10. TOURISM-RELATED ACTIVITIES. Tourist Spots at Barangay


Gatuslao such as Tigmaya, PacoView, Edcilles View Deck and other Tourist
Destination and Recreation Center in the municipality shall be open to both
local and transient tourists provided that these are followed:
1. Tourism-related establishments are mandated to comply with the
health and safety protocols upon receiving tourists/customers.
2. Establishment owners should secure Thermal Scanner,
Disinfectant (Alcohol and/or sanitizers), Logbook containing client
details (date, name, temperature upon entry, place of origin and
contact number), and/or updated Stay Safe Application.

Section 11. CURFEW HOURS. The provisions of Provincial Executive Order


No. 21-50, Series of 2021 entitled “An Executive Order Implementing the
Curfew Hours to be Observed in the Province of Negros Occidental in Order
to Prevent the Spread of COVID-19” shall be in full force and effect.

Section 12. PENALTIES. Violations of this Order shall be punishable in


accordance with the applicable penalties provided under Section 10 of RA
No. 11332 and other applicable laws.

Section 13. REPEALING CLAUSE. All existing orders, rules, and
regulations or other issuances or parts thereof that are inconsistent with
this Order are hereby revoked, modified or amended accordingly.

Section 14. EFFECTIVITY.

This Executive Order shall take effect on April 01, 2022.
