EXECUTIVE ORDER NO. 143-2021

AN EXECUTIVE ORDER IMPLEMENTING THE MODIFIED ENHANCED COMMUNITY QUARANTINE


GUIDELINES IN THE ENTIRE CITY OF SAN FERNANDO, LA UNION FROM 12:00 AM OF OCTOBER 1, 2021
TO 11:59 PM OF OCTOBER 14, 2021

WHEREAS, the World Health Organization (WHO) has declared a COVID-19 pandemic;

WHEREAS, President Rodrigo Roa Duterte issued Proclamation No. 922 declaring a State of
Public Health Emergency in the Philippines;

WHEREAS, Section 15, Article II of the 1987 Philippine Constitution states that “the State shall
protect and promote the right to health of the people and instill health consciousness among
them”;

WHEREAS, the General Welfare Clause of the Local Government Code provides that every
local government unit shall exercise the powers expressly granted, those necessarily implied
therefrom, as well as powers necessary, appropriate, or incidental for its efficient and effective
governance, and those which are essential to the promotion of the general welfare;

WHEREAS, the National Inter-Agency Task Force on Emerging Infectious Diseases has issued
Omnibus Guidelines on the Implementation of Community Quarantine with amendments as of
May 20, 2021;

WHEREAS, on September 25, 2021, the first case of COVID-19 B.1.617.2 (Delta Variant) was
recorded in the City;

WHEREAS, on September 26, 2021 the AGASM/City IATF held an emergency meeting and
it was reported that as of September 25, 2021, the City of San Fernando has 1104 active cases
totaling to 4,544 confirmed cases, increased number of health and government workers to 45.77%
of the total active cases, increased number of deaths to 29.51%, and 48 barangays have active
cases comprising of 81.30% of the total number of Barangays,

WHEREAS, there is a need to request for the reclassification of the Community Quarantine
Status in the City of San Fernando to restrict the movement of the people and further control the
transmission of the virus

WHEREAS, on September 29, 2021, Provincial Governor Francisco Emmanuel R. Ortega III
issued Executive Order No. 47 series of 2021 placing the entire City of San Fernando, La Union
under Modified Enhanced Community Quarantine for a period of Fourteen (14) Days from 12:00
AM of October 1, 2021 to 11:59 PM of October 14, 2021.

NOW, THEREFORE, I, HERMENEGILDO A. GUALBERTO, Mayor of the City of San Fernando, La


Union, Philippines, pursuant to Section 455 of the Local Government Code of 1991, do hereby
order, as follows:

Section 1. Declaration. The City of San Fernando, La Union shall be under Modified
Enhanced Community Quarantine starting 12:00 AM of October 1, 2021 to 11:59 PM of October
14, 2021.

Section 2. Specific Guidelines.

I. Minimum Public Health Standards. Strict observance of “APAT DAPAT” rule at all
times.
A - Air circulation and ventilation
P - Physical distancing of one meter or more
A - Always use face mask and face shield
T - Time of interaction should be less than thirty (30) minutes

II. Movement of People.

A. Strict home quarantine shall be observed in all households.


B. The movement of all persons shall be limited to accessing goods and services
from permitted establishments, for work in such establishments, or for such other
activities allowed in this section. (As amended by Paragraph C of IATF
Resolution No. 110, April 15, 2021)
C. Any person below eighteen (18) years old, those who are over sixty-five years
(65) of age, those with immunodeficiency, comorbidity, or other health risks,
and pregnant women shall be required to remain in their residences at all times,
except for obtaining essential goods and services, or for work in industries and
offices or such other activities permitted in this Section. (As amended by
Paragraph A of IATF Resolution No. 79, October 15, 2020)

III. Use of Home Quarantine Pass and Special Home Quarantine Pass (HQP &
SHQP).

A. There is an Official Home Quarantine Pass (HQP) or Special Home Quarantine


Pass (SHQP) provided to households through the Barangay Officials. The pass
shall bear the name of the household member. The pass is non-transferable.
Only one Home Quarantine Pass (HQP) shall be given to each household.
B. The HQP shall be used in accessing the City Auxiliary Wet Market, the San
Fernando Shopping Mall, and all establishments allowed to operate. Strict
adherence to the schedule (Monday, Wednesday, and Friday; and for
Tuesday, Thursday, and Saturday) as shown in the pass is enjoined. Medical
Health Workers are exempted from the use of HQP and shall only present their
valid I.D.
C. Those who are below 18 years old and above 65 years old (for fully vaccinated)
if indispensable to obtain essential goods or services shall present a valid Home
Quarantine Pass (HQP) or Special Home Quarantine Pass (SHQP), which they
can secure from their barangay.
D. Individual boarders shall be given HQP.

IV. Establishments Allowed to Operate. The following establishments are allowed


to operate subject to the observance of prescribed health standards.

A. Full On-Site Capacity


1. Public and private hospitals;
2. Health, emergency and frontline services, including those provided by
dialysis centers, chemotherapy centers, chemotherapy centers, HMOs,
health insurance providers, disaster risk reduction management offices,
public safety offices and the like;
3. Manufacturers of medicines, medical products such as PPEs, masks, gloves,
medical supplies, devices and equipment, including suppliers of input,
packaging, and distribution;
4. Industries involved in agriculture (crops, fruits, vegetables, livestock and
poultry), forestry, fishery, and such other components of the food value
chain and their workers, including farmers and fisherfolks;
5. Logistics service providers (delivery and courier services; cargo handling;
warehousing; trucking; freight forwarding; shipping, port and terminal
operators);
6. Essential and priority construction projects, whether public or private, in
accordance with the guidelines issued by the Department of Public Works
and Highways (DPWH);

7. Manufacturing related to food and other essential goods such as but not
limited to soap and detergents, diapers, personal hygiene products, toilet
paper and wet wipes, and disinfectants;
8. Companies that manufacture, distribute and/or supply equipment or
products necessary to perform construction or maintenance works, such
as cement and steel, or spare parts;
9. Essential retail trade and service establishments such as public markets,
supermarkets, grocery stores, convenience stores, pharmacies or drug
stores, hardware, office supplies, bicycle shops, laundry shops, and water-
refilling stations;
10. Food preparation establishments such as kiosks, commissaries, restaurants,
and eateries;
a. Indoor Dine in: Not allowed
b. Al Fresco: 50% Seating Capacity
c. Take out: 100% Operational
11. Public and private financial service providers involved in the distribution of
government grants and amelioration subsidies;
12. Business process outsourcing establishments (BPOs), and export-oriented
businesses, including mining and quarrying activities;
13. Public transport providers and operators subject to the Department of
Transportation (DOTr) guidelines;
14. Media establishments and their total permanent staff complement,
inclusive of reporters and other field employees.
15. Dental, rehabilitation, optometry and other medical clinics for the
treatment of illness or injuries. Provided that there is strict observance of
infection prevention and control protocols. Provided, further, that dental
procedures shall be limited to emergency cases only and that the wearing
of full Personal Protective Equipment (PPEs) by dentists and attendants shall
be mandatory. Provided finally that home service therapy for Persons with
Disabilities (PWDs) shall be allowed;
16. Veterinary clinics;
17. Banks, money transfer services, including pawnshops only insofar as
performing money transfer functions, microfinance institutions, and credit
cooperatives, including their armored vehicle services, if any;
18. Capital markets, including but not limited to the Bangko Sentral ng Pilipinas,
Securities and Exchange Commission, Philippine Stock Exchange,
Philippine Dealing and Exchange Corporation, Philippine Securities
Settlement Corporation, and Philippine Depository and Trust Corporation;
19. Water supply and sanitation services and facilities, including waste disposal
services, as well as property management and building utility services;
20. Energy and power companies (oil, gas, and power companies), including
third-party contractors, across transmission, as well as employees involved
in electric transmission and distribution, electric power plant and line
maintenance, electricity market and retail suppliers, as well as those
involved in the exploration, operations, trading and delivery of coal, oil,
crude or petroleum and by-products (gasoline, diesel, liquefied petroleum
gas, jet oil, kerosene, lubricants), including gasoline stations, refineries and
depots or any kind of fuel used to produce electricity;
21. Telecommunications companies, internet service providers, cable
television providers, including those who perform indirect services such as
the technical, sales, and other support personnel, as well as the employees
of their third-party contractors doing sales, installation, maintenance and
repair works;
22. Airline and aircraft maintenance, pilots and crew, and employees of
aviation schools for purposes of the pilot’s recurrent training for flight
proficiency and type rating using simulator facilities; and ship captains and
crew, including shipyard operations and repair;
23. Funeral and embalming services.
24. Security personnel licensed by the PNP – Supervisory Office for Security and
Investigation Agencies;

25. Printing establishments authorized by the Bureau of Internal Revenue and
other government agencies to print accountable forms and other security
documents;
26. Establishments engaged in repair and maintenance of machinery and
equipment, for households and essential permitted establishments;
27. Establishments engaged in repair and maintenance of motorized and non-
motorized vehicles, including the sale of spare parts;
28. Leasing of real and personal properties;
29. Employment activities that involve the recruitment and placement for
permitted sectors;
30. Teachers, professors and other staff for purposes of conducting
online/offline, and flexible classes, completion of grades, and processing
of student credentials, requirements and documents;
31. Lawyers who will provide legal representation necessary to protect the
rights of persons as well as legal services for permitted establishments;
32. All other establishments to the extent necessary for the buying and selling
consumer goods or services via the internet;
33. Private corporations are encouraged to payrolls online. Payroll managers,
and such other employees required for the processing of payroll, and
accounting firms;

B. 50% Operational Capacity. All establishments, persons, or activities not


permitted to operate, work, or be undertaken during the Modified Enhanced
Community Quarantine (MECQ) are allowed to operate, while encouraging
work-from-home and other flexible work arrangements, where applicable.

• Driving Schools, Testing and Tutorial Centers are allowed to operate on


50% Operational Capacity. Face-face classroom type of classes shall
remain prohibited.

C. Safety Seal Exemption. Business establishments awarded with Safety Seal


Certifications (DOLE-DOH-DILG-DOT-DTI Joint Memorandum Circular No. 21-01,
Series of 2021) shall be allowed to operate at an additional ten percentage
points beyond the prescribed on-site operational or venue/seating capacity,
whichever is applicable, regardless of community quarantine classification.

D. DTI Exemptions. Notwithstanding the foregoing, the City Government of San


Fernando shall include the negative list of industries that shall remain prohibited
in areas under MECQ issued by the Department of Trade and Industry (DTI).

E. Operating Hours. The aforementioned business establishments/enterprises shall


operate from 5:30 in the morning to 9:00 in the evening. Except pharmacies
which may be allowed to operate for 24 hours. This is in accordance with
Sangguniang Panlalawigan Ordinance No. 298 – 2021.

F. Hotels and Other Accommodation Establishments. Only hotel or


accommodation establishments with valid Certificate of Authority to Operate
Department of Tourism (DOT) Accreditation shall be allowed to accommodate
the following guests and clients for legitimate purposes under a state of public
health emergency:

1. With existing long-term bookings; Foreign guests who are transiting through
or / are otherwise temporarily staying in the Philippines for a short period
and will leave the country;
2. Long-staying guests;
3. Distressed Overseas Filipino Workers (OFWs) and stranded Filipinos or foreign
nationals;
4. Repatriated OFWs in compliance with approved quarantine protocols;
5. Other Returning Overseas Filipinos (OFs);
6. Locally Stranded Individuals (LSIs);
7. COVID-19-positive individuals who are asymptomatic or those with mild flu
symptoms pursuant to Oplan Kalinga Program;

8. Employees of agencies and instrumentalities of the government, including
government-owned and controlled corporations (GOCCs) and Local
Government Units (LGUs), and emergency frontline, border control, and
other critical services workers; and
9. Health care workers and other employees from establishments that are
allowed to operate during the MECQ pursuant to the IATF omnibus
guidelines; provided, that their place of work is located within the same
MECQ zone;

Hotel operations shall be limited to provision of basic accommodation


services; accommodation establishments may prepare:
a. Packed meals for distribution to guests; and
b. Food orders for take-out and delivery.

Ancillary establishments within their premises such as restaurants, bars, cafes,


gyms, spas, function halls, and the like, shall not be allowed to operate or to
provide room service.

G. Temporary Housing for Non-Resident Employees.

1. Employers of business establishments/enterprises that are allowed to open


are encouraged to provide housing facility for their employees not residing
in the City.
2. Private hospitals and other health facilities are encouraged to provide a
staff house for their health service providers who are not domiciled in the
City.

H. Delivery Service. Only business establishments/enterprises with valid business


permit shall be allowed to conduct delivery services.

V. Establishments, Persons, or Activities NOT Allowed to Operate, Work or be


Undertaken. The following establishments, persons, or activities shall not be
permitted to operate, work, or be undertaken during MECQ:

A. Entertainment venues with live performers such as karaoke bars, bars, clubs,
concert halls, theaters, and cinemas;
B. Recreational venues such as internet cafes, billiard halls, amusement
arcades, bowling alleys, and similar venues;
C. Amusement parks or theme parks, fairs/peryas, kid amusement industries
such as playgrounds, playroom, and kiddie rides;
D. Outdoor sports courts or venues for contact sports, scrimmages, games, or
activities;
E. Indoor sports courts or venues, fitness studios, gyms, spas or other indoor
leisure centers or facilities, and swimming pools;
F. Casinos, horse racing, cockfighting and operation of cockpits, lottery and
betting shops, and other gaming establishments except for the draws
conducted by the Philippine Charity Sweepstakes Office;
G. Indoor visitor or tourist attractions, libraries, archives, museums, galleries,
and cultural shows and exhibits;
H. Outdoor tourist attractions;
I. Venues for meetings, incentives, conferences, and exhibitions;
J. Personal care services which include beauty salons, beauty parlors,
medical aesthetic clinics, cosmetic or derma clinics, make-up salons, nail
spas, reflexology, aesthetics, wellness, and holistic centers, and other similar
establishments; acupuncture and electrocautery establishments, and
massage therapy including sports therapy establishments. It also
includes establishments providing tanning services, body piercings,
tattooing, and similar services. Home service for these activities are likewise
not permitted; and
K. Pet grooming services.

VI. Construction Projects. Essential public and private infrastructure projects are
allowed to operate during MECQ which includes the construction of the following:
1. Health, quarantine, and isolation facilities for COVID-19 patients including
dorms for healthcare workers;
2. Vaccination centers or facilities necessary for supply, distribution, and
administration of vaccines;
3. Facilities for construction personnel of doing emergency works and other
disaster risk reduction and rehabilitation works;
4. Educational facilities and other government structures/offices/buildings.
5. Sewerage and water service projects, and digital works;
6. Priority public infrastructure projects such as roads, bridges, flood-control,
and active transport facilities; and
7. Priority private infrastructure projects to include facilities for food
production, agriculture, fisheries, energy, housing, communication, water
utilities, manufacturing, and business process outsourcing (BPO).

All construction activities shall be coordinated with the barangay for contact
tracing purposes.

VII. Guidelines in the Operation of the Auxiliary Wet Market, San Fernando City
Shopping Mall, Satellite Markets and Sari – Sari Stores

A. City Auxiliary Wet Market and the San Fernando City Shopping Mall.

1. The City Auxiliary Wet Market shall commence operations at 6:00 a.m. to
5:00 p.m. from Monday to Saturday.
2. The San Fernando Shopping Mall shall operate from 8:00 a.m. to 5:00 p.m.
from Monday to Saturday.
3. Entry to the City Auxiliary Wet Market and the San Fernando Shopping Mall
shall be allowed only for residents with HQPs/SHQPs.
4. Non-residents who are owners and employees of enterprises which are
allowed to open and operate in the City may enter the City Auxiliary Wet
Market, from 1:00 p.m. to 5:00 p.m. and should present their Individual Work
Permit, Employee I.D., Certificate of Employment or valid business permit.
5. Those entering the City Auxiliary Wet Market and the San Fernando
Shopping Mall shall go through the triage area for temperature checking
and use of alcohol or hand sanitizer prior to entry.
6. The ‘No Face Mask and No Face Shield No Entry’ policy and social
distancing SHALL BE STRICTLY FOLLOWED.
7. Designated entrance and exit areas shall be strictly followed.
8. Ambulant vendors are strictly prohibited.

B. Satellite Markets/Talipapas and Sari-Sari Stores.

1. Entry to the Satellite markets or talipapas shall be allowed only for residents
with HQPs/SHQPs and resident vendors.
2. Triage areas shall be located at the entrance of the satellite
market/talipapas for temperature check and use of alcohol or sanitizer
prior to entry.
3. Designated entrance and exit areas shall be strictly followed.
4. The ‘No Face Mask and Face Shield, No Entry’ policy and social distancing
shall be strictly followed.
5. Operation of satellite markets/talipapas shall be from 7:00 a.m. to 12:00 nn,
Monday to Saturday.
6. Sari-sari stores and consumer goods trading shall be allowed to operate
from 5:00 a.m. to 6:00 p.m.
7. Commodities to be sold at Satellite market/talipapas shall be limited to
food products and essential commodities. Liquor and cigarettes shall not
be sold therein.
8. Ambulant vendors are prohibited.
9. Selling of meat, fish, and vegetables outside the designated satellite
markets/talipapas is prohibited.

Section 3. Curfew. As per Provincial Ordinance No. 298-2021 of the Provincial Government
of La Union, the following curfew shall be implemented:

1. Establishments are allowed to operate until 9:00PM. Except pharmacies which


may be allowed to operate for 24 hours.
2. Curfew for individuals shall be from 9:00 PM – 5:00 AM.

Section 4. Liquor Ban. Sale and purchase of liquor is strictly prohibited. Grocery stores, sari-
sari stores and all other business establishments/enterprises which are allowed to operate at this
time shall sell only basic and prime essential commodities. Consumption of liquor and cigarette in
public places is prohibited.

Section 5. Gatherings and Coastal Activities.

I. Wake/Burial/Cemeteries. When the cause of death is not COVID-19, the following


shall be observed:
1. Wakes can be held for a maximum of three (3) days provided that it shall be
limited to immediate family members, upon satisfactory proof of their
relationship with the deceased and with full compliance with the prescribed
minimum public health standards.
2. Usual activities such as playing cards, bingo, and other related games and
during wakes are prohibited. Drinking of liquor and smoking of cigarette are
likewise prohibited.
3. Processions and harana services of funeral parlors are also prohibited.
4. Coordination with the Barangay and the Philippine National Police for
monitoring of health protocol compliance.
5. Barangay officials and owners of funeral parlors shall ensure that the minimum
public health protocols and “Apat Dapat” rule are strictly observed.

II. Gatherings. Gatherings outside of residences shall be prohibited. Gatherings at


residences with any person outside of one’s immediate household shall likewise
be prohibited. However, gatherings that are essential for the provision of health
services, government services, or humanitarian activities authorized by the
appropriate government agency or instrumentality shall be allowed. Provided,
that these should be duly approved by the Local Chief Executive and with proper
prior coordination with the barangay where the gathering is to be held.

III. Religious gatherings. This shall be allowed, provided, however that the capacity
will be up to ten percent (10%) of the venue.

IV. Outdoor non-contact sports and other forms of exercise. Activities such as but not
limited to walking, jogging, running, biking, golf, swimming, surfing, tennis,
badminton, equestrian, range shooting, diving, and skateboarding are allowed
within the general area of their residence (barangay, purok, subdivision, or
village). Provided, that minimum health standards are observed. Sharing of
equipment, where applicable, shall not be allowed. Those with
immunodeficiency, co-morbidities, or other health risks, and pregnant women,
are discouraged to perform strenuous activities.

V. Spectators. Spectators in all non-contact sports and exercises shall be prohibited.

VI. Education/School. Face-to-face or in-person classes at all levels shall be


suspended. The education sector shall operate in accordance with the guidelines
of the CHED for higher education, TESDA for technical vocational education and
training, DepEd for basic education.

VII. Coastal Activities.


1. Fishing is allowed subject to applicable laws, ordinances, and national
guidelines. Passengers of the motorboat or banca shall be limited to two, or
half of its allowable maximum capacity to ensure social distancing.
2. Beach cottages/sheds shall be non-operational.
3. Mass gathering or any social activity along the coast is not allowed.
4. Use of face mask and face shield must always be observed.

Section 6. Work in Government Agencies and Other Instrumentalities.

A. On-Site Capacity

1. Agencies and instrumentalities of the government shall be fully operational, with


a skeleton workforce on-site and the remainder under alternative work
arrangements as approved by the head of agency unless a greater on-site
capacity is required in agencies providing health and emergency frontline
services, laboratory and testing services, border control, or other critical services,
in accordance with the relevant rules and regulations issued by the CSC.
2. The independent authority of the Supreme Court to implement any alternative
work arrangements or to suspend the operation of Regional Trial Courts or
Municipal Trial Courts located within the City is recognized.

B. Alternative Work Arrangement. All government and private offices as well as


business enterprises located in the city are strongly encouraged to provide and
adopt alternative work arrangements that they may deem appropriate to lessen
exposure of their employees to COVID- 19.

All Second Generation Contacts are recommended to work from home and limit
their movement until the First Generation Contacts have been found to be COVID-
19 negative or cleared.

Section 7. Guidelines in the Entry and Exit in the City of San Fernando.

I. ENTRY TO THE CITY


General Guidelines for Residents / Non-Residents / Travelers entering the City:
The following should be observed by anyone entering the city regardless of
his/her purpose:

1. Any resident coming from any place with patients found positive for
COVID-19, where he/she stayed for more than 14 days, even if he/she
does not manifest any symptom/s, shall be required to report to the
Barangay for strict 14-day quarantine. If the person refuses to undergo
the required quarantine, he/she shall be denied entry.
2. Any person who is allowed entry shall strictly follow the protocol on
triage, isolation, contact tracing, transfer and other related protocols
pursuant to national guidelines and those being implemented by the
City Government and the Provincial Government of La Union.
3. Law enforcement agencies shall recognize valid IDs or other pertinent
documentations issued by accrediting organizations or establishments
allowed under MECQ.
4. No other IDs or passes specifically exempting persons from community
quarantine shall be required of workers from permitted establishments
and/or offices without prejudice to requiring presentation of other
documents related to the nature of their work.

A. Quarantine Control Points. All the Barangays shall set up their Quarantine
Control Points.

B. Entry of Non-Residents for Essential Purposes. The following non-residents


shall be allowed entry into the city:

1. Those who will seek medical attention in any hospital/health facility


within the city upon presentation of a medical certificate or referral duly
signed by a licensed physician;
2. Those who will access banks or remittance centers not located in their
place of origin;
3. Health service providers, other emergency frontliners, owners and
employees of the enterprises which are allowed to open and operate
in the City of San Fernando and all others who are exempted by virtue
of the national guidelines upon presentation of their employee ID, valid
ID, certificate of employment or valid business permit, whichever is
applicable; government employees being required to serve as skeletal

force in their respective offices upon presentation of valid employee ID
or Office Order to that effect; and
4. Vendors at the City Auxiliary Wet Market upon presentation of their
Individual Working Permit issued by the City Government and
NAPANAM QR Code.
5. Non-residents may enter the city to access essential goods and other
services on Sundays, provided that they will be presenting their
Napanam QR Code or any valid ID indicating their address.

C. Entry of Non-Residents for Non Essential Purposes. Non-Residents who are


travelling for leisure purposes shall be denied entry.

D. Overseas Filipino Workers. Regardless of their purpose, they are allowed to


enter the city provided, that the OFW shall present his or her negative
RTPCR Test and Bureau of Quarantine (BOQ) Certificate.

II. EXIT FROM THE CITY

1. All persons who are from critical zones/affected barangays that are under
granular lockdowns with confirmed COVID-19 active case/s; except
healthcare workers and emergency frontliners, shall not be allowed exit
from the City until the heightened localized community quarantine in the
critical zone/affected barangay has been lifted.
2. If travelling from the City to an international port for the purpose of an
international travel, proof of international travel and travel itinerary with
departure scheduled within twenty-four (24) hours from time of leaving
residence or accommodation must be presented. All departing passengers
may be accompanied by not more than one (1) person when travelling to
any international port.

Section 8. Transportation in the City of San Fernando.

I. Operation of Tricycles. Tricycles for Hire shall be allowed to operate on set


schedules. Below is the schedule to be followed (As per Executive Order No.
124 – 2021)

1. Tricycles must not exceed one passenger. Back riding is not allowed.
2. A plastic acetate barrier shall be installed between the driver and the
passenger.
3. A money box shall be provided where fares will be placed to minimize
contact. Paying with exact amount of fare is encouraged.
4. Tricycle drivers shall charge fares in accordance with the Fare Matrix as
provided for under City Ordinance No. 2020-09 entitled, AN ORDINANCE
PRESCRIBING THE FARE MATRIX FOR TRICYCLES FOR HIRE FOR THE
DURATION OF THE GENERAL COMMUNITY QUARANTINE IN THE CITY OF
SAN FERNANDO, LA UNION.
5. There shall be designated pick-up points for tricycles where a queuing
system will be put in place for commuters.

II. Public Utility Vehicles (PUV). Buses, Vans, Taxis and Public Utility Jeepneys
(PUJs)
1. Passenger Load for Public Utility Buses (PUBs) and Public Utility Jeepneys
(PUJs) should not exceed 50% or half of the vehicle’s capacity, excluding
driver and conductor.
2. PUVs and PUJs shall load and unload passengers at designated
loading/unloading areas.
3. All Inter PUV’s shall unload their passengers at their designated Terminal
for triage and checking of requirements. For those non-residents with
incomplete requirements shall be denied entry.
4. PUVs and PUJs with LTFRB-issued special permits to operators shall be
allowed to ply the identified routes in the City of San Fernando.
5. PUVs with higher passenger capacity such as buses will be prioritized
consistent with Department Order 2017- 011.
6. For UV Express and taxi, passenger load should not exceed two
passengers per row, except for the driver’s row where only one
passenger is allowed.

III. Private Motorcycles, Vehicles and Non-Motorized Transportation. Private cars,


motorcycles, bicycles are subject to the following:

a. Private cars, tricycles and motorcycles will be allowed to operate for the
purpose of essential travels as defined by the Inter-Agency Task Force
(IATF).
b. Private cars will only be allowed one passenger to occupy the front
passenger seat, while front-facing seats shall not exceed two
passengers per row.
c. Motorcycles that are being used for private transport are allowed from
having backride passengers.
d. Cycling and other modes of non-motorized transportation and other
personal mobility devices in going to work for establishments that are
allowed to operate shall be highly encouraged. Provided, that wearing
of protective gears is mandatory.

IV. Operation of San Fernando on the Go. San Fernando On the Go shall remain
operational.

V. Operation of Urban Food Park. Urban Food Park will be open from 10:00 a.m.
to 6:00 p.m., Monday to Saturday, and will only be available for take-out.

VI. Unhampered Movement of Cargoes and Other Vehicles involved in Essential
Services.

a. The movement of all types of cargoes by land, air, or sea within and
across areas placed under any form of community quarantine shall be
unhampered. Workers in the logistics sector, such as cargo, trucking,
courier delivery and port operations shall likewise be allowed to transit
across areas placed under any form of community quarantine.
Provided, that only a maximum of five (5) personnel may operate cargo
and delivery vehicles by land, with or without load.
b. Cargo vehicles as well as vehicles used by public utility companies,
BPOs, and export-oriented establishments shall not be subject to an ID
system.

Section 9. Adoption of PITO-PITO Barangay Strategy. This strategy shall be adopted as the
City Government’s COVID-19 Barangay Emergency Response Strategy regardless of quarantine
status.

Seven (7) cases are the average daily attack rate per 100,000 population. This strategy
aims to contain the number of COVID-19 cases in the city by maintaining below seven (7) cases
per day in the city level and maintaining below 7 active cases per day in the barangay level, in
order for the city not to be classified as high-risk.

Under this strategy, every barangay that has 7 active cases will automatically establish a
BARANGAY QUARANTINE CONTROL POINT to check and monitor their constituents in their
respective territorial jurisdictions to ensure strict compliance with this Order and other IATF
guidelines and protocols.

The quarantine control point shall only be removed when the barangay no longer has an
active COVID-19 case. However, if the barangay reaches 7 active cases again, the quarantine
control point shall be re-activated.

Section 10. Enforcement and Monitoring of National Guidelines / IATF Issuances / Provincial
and City Ordinances in relation to COVID-19.

I. Strict Enforcement and Monitoring of Compliance to Minimum Public Health


Protocols and other National and Local IATF Guidelines. The Philippine National
Police, Office for Public Safety, Bureau of Fire Protection, Barangay Officials and
Barangay Workers shall ensure strict compliance of minimum public health
protocols and all the National and Local Guidelines; and the strict enforcement of
their corresponding penalties.
II. Strict Enforcement of Mandatory Face Shield Ordinance. Any person caught in
violation of this Ordinance shall pay a fine in the amount of Five Hundred pesos
(PhP500.00)
III. Strict Enforcement of Mandatory Facemask, Physical Distancing and PPE
Ordinance. Any person caught in violation of this ordinance shall be liable to a fine
of One Thousand Pesos (PhP1,000.00) for every offense.
IV. Strict Enforcement of Anti-COVID-19 Discrimination Ordinance. Any violation/s of
the City Ordinance No. 2020-05 also known as “AN ORDINANCE PROHIBITING
DISCRIMINATION AGAINST PERSONS INFECTED, UNDER MONITORING OR
INVESTIGATION DUE TO THE CORONAVIRUS DISEASE (COVID-19) INCLUDING
HEALTH WORKERS AND FRONTLINERS” shall be penalized with a fine of Five
Thousand Pesos (Php. 5,000.00) or imprisonment not exceeding six (6) months or
both at the discretion of the Court.

Section 11. Postponement/Cancellation of All Public and Private Gatherings. All public
gatherings are hereby postponed or cancelled.

Section 12. Donations and Free Services. All donations and free services, such as, but not
limited to free shuttle or ride from private individuals or groups, giving of relief packs, shall be
coursed through and coordinated with the City Government through a written request addressed
to the Local Chief Executive.

The City Incident Management Team shall coordinate all approved requests and the
proper and safe release/distribution of donations/assistance to the concerned recipients.

Distribution of food and non-food items that are not related to a disaster or emergency
event should be distributed house to house or in a distribution system where no mass gathering is
conducted.

Section 13. Dissemination. All barangay officials are directed to disseminate this Order
within their territorial jurisdiction. The City Government of San Fernando will likewise post
information in related media platforms for wider dissemination.

Section 14. Penalties. All existing laws and ordinances shall be enforced against those who
fail to follow the provisions of this Executive Order.

Any violation of the foregoing prohibitions shall constitute non-cooperation of the person
or entities punishable under Section 9 par. (d) or (e), as the case may be, of Republic Act No.
11332, otherwise known as the Mandatory Reporting of Notifiable Diseases and Health Events of
Public Health Concern Act, and its Implementing Rules and Regulations and other appropriate
laws, provincial or city ordinances, rules and regulations.

Section 15. Separability Clause. If any provision of this Executive Order is declared invalid
or unconstitutional, the other provisions not affected thereby shall remain valid and subsisting.

Section 16. Repealing Clause. All Orders or parts thereof which are inconsistent with the
provisions of this Executive Order are hereby repealed or modified accordingly.

Section 17. Effectivity. This Order shall take effect immediately upon signing.
