THIS AGREEMENT made as of the 21st day of October, 2020, between ELLAINE TOLENTINO-ETHAN AND JOY EXPRESS a
corporation incorporated under the laws of the Province of Batangas, and having its principal place of business at #386
Poblacion, Malvar (the "Employer"); and MICHAEL TOLENTINO of the City of Tanauan in the Province of Batangas (the
"Employee").
WHEREAS the Employer desires to obtain the benefit of the services of the Employee, and the Employee desires to
render such services on the terms and conditions set forth.
IN CONSIDERATION of the promises and other good and valuable consideration (the sufficiency and receipt of which are
hereby acknowledged) the parties agree as follows:
I. Employment
1. The Employee agrees that he will at all times faithfully, industriously, and to the best of his skill, ability,
experience and talents, perform all of the duties required of his position.
2. In carrying out these duties and responsibilities, the Employee must comply with all Employer policies,
procedures, rules and regulations, both written and oral, as are announced by the Employer from time to time.
3. It is also understood and agreed to by the Employee that his assignment, duties and responsibilities and
reporting arrangements may be changed by the Employer in its sole discretion without causing termination of
this agreement.
4. From time to time, the Employer may also assign other duties within the reasonable scope of the Employee’s
work.
5. The Employer or the Employee may terminate the working relationship at any time, for any reason permitted by
law, without cause and without notice to the other party.
6. During the term of this Agreement and upon termination of Employee's employment hereunder, and for a
period of one (1) year from the date thereof, Employee shall not directly or indirectly engage in any business or
other activity where the employee will engage in the same or substantially similar activities to those which he
engaged in for the Company, if such activity or business is in competition with Company. However, Employee
may use information obtained during his past, current or future work.
II. Salary/Compensation
1. As full compensation for all services provided the employee must be paid at the rate of P550.00. Such
payments shall be subject to such normal statutory deductions by the Employer.
2. The Employee have to work for 8 hours a day and may work overtime to earn an overtime pay.
3. The Employer may deduct and withhold sums for federal income taxes, Social Security taxes, and other
taxes required by law.
4. Employer may wish to include bonus calculations or omit in order to exercise discretion.
This Agreement may be revised, amended or modified only through a written instrument duly executed and signed by
the Employer/Company.
IN WITNESS WHEREOF the Employer has caused this agreement to be executed by its duly authorized officers and the
Employee has set his hand as of the date first above written.
