Article 1187
The effects of a conditional obligation to give, once the
condition has been fulfilled, shall retro act to the day of the constitution of the obligation. Nevertheless, when the obligation imposes reciprocal prestation upon the parties, the fruits and interest during dependency of the condition shall be deemed to have been mutually compensated. if the obligation is a unilateral, the debtor shall appropriate the fruits and interest receive, unless from the nature and circumstances of the obligation. it should be inferred that the intention of a person constituting the same was different.
In obligation to do and not to do, the court shall determine, in
each case the retroactive effect of a condition that has been complied with.
Own: it supposes na nafulfill na yung suspensive condition, and we
are talking about the effect, and it is retroactive means nagbabaliktanaw or nirerecall mo from the past. Retroactive effects of the fulfillment of suspensive condition.
1. In obligation to give- the obligation to give will not be demandable
until nangyari na yung suspensive condition and kapag nangyari na ang suspensive condition/ it will retroact to the day that the obligation was constituted hindi sa happening ng condition kundi kung kelan mismo napagusapan ang condition or kung kelan ito naconstitute sa contract kasi nakalagay dun yung simulang date kung kelan kayo gumawa ng obligation and condition .
ang condition kasi ay accidental element of the contract.
The provision itself will exist without the condition. Ex: On January 20 si seller nagbenta ng lupa for 100k to the buyer kung matalo si buyer sa case, should the buyer lose a case for recovering another parcel of lang . April 10 binenta ni seller yung lupa kay C, nung dec 04 nangyari ang suspensive condition na natalo nga si Buyer sa case. Entitle si b sa land kung kelan sila nagusap ni seller . Si B has the better right over the land regardless the sale of c nung April 10 , it is required na under property decree must be annotated at the back of the certificate of the title as against c na meron tayo.
Sa double sale dalawa ang napagbentahan buyer ni B ang owner kasi
as if na si B ang owner ng land upon the fulfillment dahil sa retroactive affect.
2. In obligation to do and not to do
Ang rule no fixed rule is provided, hindi lagi na ito ang inaapply dahil may discretion din ang court of what is just fair.

retroactivity and mapply to sticking into consideration the nature and circumstances and the intention of the parties

Di na need magbigay ni S ng fruits galling sa land since before dec 4
naman niya binigay at walang interest din na mangagaling kay B since di din naman siya lumagpas sa oras ng bayaran.
Interest and fruits are hindi kasama sa reciprocal.
2. In unilateral obligations-gratutious, no retroactive effect dahil
wala naman matatanggap si debtor eh at ito ay kusang gawa ng obligation lang so may right siya na di ibigay yung fruits Si debtor idodonate ang lupa kay Creditor so lupa lang ang ibibigay kay debtor padin yung mga fruits and interest na pwedeng matanggap. However dapat ipaalim ni Debtor kay creditor ang accounting information tungkol sa mga bagay bagay sa langd fruits and interest.
