MINUTES OF THE MONTHLY MEETING

Meeting : Lupon Monthly Meeting

Date : May 31, 2022, 2:40pm (Tuesday)

Venue : Lupong Tagapamayapa Office

 The meeting commenced at 2:40PM starting with the opening prayer by Lupon Auditor Luzviminda
Fajardo.

 Lupon Chairman Esposo called to order the regular meeting of the Lupong Tagapamayapa at
2:40pm on May 31, 2022 at Lupong Tagapamayapa Office.

 Roll call Raquel Bulaong, Barangay Secretary/Lupon Secretary conducted a roll call. Attendees’
name attached.

 Approval of minutes from last meeting. Raquel Bulaong, Barangay Secretary read the minutes
from the last meeting. The minutes was approved as read with corrections.
1. OBSERVATIONS:
o Lupon Chairman Esposo asked the body if anything else was observed on the previous
minutes of the meeting.

o Lupon Secretary Bulaong requested to complete or clarify the middle initial of both
complainant and respondent to avoid errors in the requested certifications.

o Lupon Chairman Esposo informed the body that starting this June, 2022 he will attend the
hearing on Mediation.

3. REVIEW ON OTHER MATTERS ARISED:


A. JUSTIFIED CYBER LIBEL ON POSTING ON SOCIAL MEDIA
 Good or bad faith is a defense, counter case to determine

  B. CYBER LIBEL JURISDICTION


 Complainant can file the case to the barangay where the respondent reside, if no
settlement in the barangay then the complainant will file directly to the local court
where the complainant resides.

C. COLLECTION OF SUM OF MONEY VENUE ON HEARING JURISDICTION


 Case will be filed on the barangay where the respondent resides. Filing the case
directly to court is an option for the complainant

D. PRESCRIPTED PERIOD OF THE FOLLOWING


 Period of Imprisonment
1. Unjust vexation – thirty (30) days or 1 month
2. Simple Slander – two (2) months
3. Grave Slander – six (6) months
4. Libel – one (1) year
5. Cyber Libel – twelve (12) to fifteen (15) years

E. UNCONSCIONABLE/EXCESSIVE INTEREST ON LOAN


 Interest must be written and agreed upon by both parties.
 excessive interest to resolve in court.
 unconscionable interest – interest will be considered illegal if it exceed the 6%
per annum or 0.50% per month.

F. CONJUGAL/EXCLUSIVE PROPERTY OF NO MARRIAGE SETTLEMENT


 husband or a man – Capital marriage
 wife or a woman – paraphernal
 Before August 3, 1988 – conjugal property on gains the exclusive property (mana) for
husband and wife
 After August 3, 1988 – absolute community property 50/50 for husband and wife
(mana)

G. ALIENATION OF AFFECTION
 Wife to kabit on harassment or unjust vexation is civil liability only and the ground of
the case applies the damage to compensate on mental and emotional suffering.

H. MEDICAL CERTIFICATE/MEDICO LEGAL CERTIFICATE


 Private Physician or Hospital required a notary while in public does not required the
notary.

I. FATHER SUPPORT TO CHIDREN ABOVE 18 YEARS OLD


 Applicable or advisable whether the child is above 18 years old.

J. REPUBLIC ACT ON LAWS.


 .Whether civil or criminal laws on cases recognized by congress and senate.

K. TRESPASSING ON NATURAL AND UNNATURAL WAYS


 Natural – if house is broken into or entering private property by forced
 Unnatural – entering the house through an unlock entry

L. OTSHP (ON THE SPOT HEARING PROCEDURE)


 Complainant/Respondent must be present with blotter report only disregard the
complaint sheet but need the KP Case number to provide with complainant signature
to establish and one (1) time payment receipt to required but if 1 st payment not
required the receipt only to put in Katitikan that the payment done to save and
preserved paper works.

M. CHILD ABUSE CATEGORY COMPLAINT


 Physical Injury – rape, human trafficking, seduction
 Verbal abuse – directed to the minor
N. ADULTERY/CONCUBINAGE/BIGAMY
 Both for Lupon jurisdiction
Adultery – wife cheating
Concubinage – husband cheating
 Bigamy – one (1) or two (2) spouse

O. COMPLAINTS ON RESPONDENTS HIGH EMOTIONS ON HEARING


 Let them voice out their grievances, at first no interruption, after which the Lupon will
initiate the discussion. Let the complainant to decide to have another hearing just to
give lesson on the respondent action.

P. USURY LAW ON CONTRACT OF LOAN


 Before June 1, 1983 – usury law applied
 After June 1, 1983 – suspended by the central bank circular #805-82.
 Both parties to decide on the interest of the loan.
 Before July 1, 2013 – interest is 12% per year or 1% per month
 After July 1, 2013 interest is 6% per year or 0.50%

Q. BARANGAY KASUNDUAN ON LEGAL SEPARATION


 Legal separation can only be done in court. If done anywhere other than the court of
law separation will be invalid.

R. COLLECTION OF SUM OF MONEY CLASSIFICATION ON DEBTS


 1. with contract (written) possible with collateral
2. 5/6 verbal no written
3. Rediscount – post dated cheque, collateral
4. Credit card – interest and written

S. EVICTION ON LAND WITH WRITTEN DOCUMENT TO CONSTRUCT A HOUSE


 If the landlord and tenant are at odds with each other, and the landlord wants to evict
the tenant however the tenant had construction made during their time of stay which
they paid, either the landlord will pay for the construction or to get it demolished.
