BOUNDARY OR HULOG SYSTEM / RENT-TO-OWN AGREEMENT
KNOW ALL MEN BY THIS PRESENTS:
This BOUNDARY HULOG SYSTEM / RENT-TO-OWN AGREEMENT, made

and entered into this 18th day of April 2023 at the City of Tabaco, Province of
Albay by and between:
JERICO N. BURCER, filipino citizen, of legal age, widower and a

resident of Zone 1, Brgy. San Lorezo, Tabaco City, Albay,
hereinafter referred to as the “FIRST PARTY / FRANCHISE
HOLDER”.
and
DOMINGO B. BALOLOY JR., of legal age, Filipino, married and

with residence at Zone 4, Brgy. San Lorenzo, Tabaco City, Albay,
hereinafter referred to as the “SECOND PARTY”
WITNESSETH that
WHEREAS, the FIRST PARTY is the owner of a Motorcycle with

Sidecar particularly described as:

WHEREAS, the same unit was issued franchise by the Local

Government of Tabaco through SP Resolution no. 212-A-2022 dated February
11, 2022 until December 31, 2024. Details of Certificate of Franchise for MCH
Service is set forth below:

WHEREAS, the SECOND PARTY is the bearer of a Professional

Driver’s License and has signify his willingness to use /rent-to-own the subject
motorcycle for hire unit, subject to payment of daily boundary / Hulog to the
FIRST PARTY / FRACHISE HOLDER.
NOW, THEREFORE, for and in consideration of fix daily Rent /

Boundary / Hulog and the covenants herein after set forth the parties agree to
enter into BOUNDARY HULOG SYSTEM/RENT-TO-OWN AGREEMENT subject
to the following terms and conditions:

1. That the amount of BOUNDARY / HULOG shall be TWO HUNDRED
(200) PESOS per day, to be paid immediately by the SECOND PARTY
to the FIRST PARTY / FRANCHISE HOLDER after completion daily
trip;
2. That the BOUNDARY / HULOG shall commence on April 18, 2023

and shall automatically ceased on April 30, 2024; and
3. That upon the termination of this agreement, the FIRST PARTY /

FRANCHISE HOLDER shall turn-over to the SECOND PARTY the:
a. Subject Tricycle for hire unit; and

b. Franchise
4. Upon fulfillment of the agreement, the FIRST PARTY hereby

undertake to execute a Deed of Absolute Sale or whatever instrument
deemed necessary to convey ownership of the above subject Tricycle
for Hire in favor of the SECOND PARTY;
5. The capital gain tax and other incidental taxes shall be for the
account of the SECOND PARTY;
6. All expenses, fees, and charges necessary to transfer franchise in the

name of the SECOND PARTY, including notarial and processing fees
shall be for the account of the SECOND PARTY;
7. In case of litigation, the proper and competent court of Tabaco City

shall have jurisdiction, to the exclusion of other courts. In which
event, the guilty party, agrees to pay the innocent party attorneys fees
of a reasonable amount, which in no case be less than 20,000.00,
damages and cost of litigation; and
8. If any provision contained in this contract should be declared invalid,

illegal or unenforceable in any respect by the court of law or
government agency, the validity, legality, and enforceability of the
remaining provisions herein shall not in any way be affected or
impaired and shall be in full force and effect and enforceable in such
manner as maybe provided by law.

hands this 18th day of April 2023, at Tabaco City, Albay, Philippines.
