SOCIAL SECURITY

9. 1.0 LIFE COVER SCHEME

Thc existing Lifc Cover Schenrc will continuc except that the amount
to be paid in addition r() thc normal gratuity shall be Rs.20,000 and
thal the Life Cover Schemc shall bc delinked fiom gratuity. It will be

effective from 1.7.1995. However, those died before 1.7.95 and if their
dependents have not becn paid till date will also be paid at the above
ratc.

9.2.0 WORKMEN'S COMPENSATION BDNEFITS

It is agreed that -

9.2. I The employees covered by this Agreement shall be entitled to the


benefits admissible under the Workmen's Compensation Act, 1923.

9.2.2 The benefits under the Workmen's Compensation Act will not be
affected adversely on account of the revision of wages by this
Aqreement.

9 2.6 In respect of those employees who are not currently covered by thr'
definition of 'workmen' under the Workmen's Compensation Act, that
is to say, such of the employees whose wages are more than Rs. 2000i-
per month if the Worknren's Compensation Commissioner refuses to

accept the compensation n'loney. the same will be disbursed to the legal

heirs of the deceased on satisfactory production of proof and on


execution of Agreernent/lndemnity Bonds etc., so that there may not be

any future clainr in tlris regard.

9.2. 7 In addition to the compensation payable under the Wotkmens'

Compensation Act an Ex-gratia amount ofRs.15,000/- in case of death

or perrnanent total disablement resulting on account of accident arising


out of and in course of employment will be paid. It will be effective
from 1.7.1995. However, pending cases of those employees who died
before 1.7.95 and their dependents who have not been paid the benefit
till date will also be paid at the above rate.

9.3.0 Provision of employment to dependants.

9.3. I Employment would be provided to one dependant of workers who are


disabled permanently and also those who die while in service. The
orovision will be implemented as follows :

In so far as female dependants are concemed. their employment./


paymerit of nronetary compensation would be govemed by para 9.5.0.

9.3. 1 'I'hc dependant for this purpose means the wilelhusband


as the casc
may be. unmarried daughter , son and legally adopted son. If uo such
direct dependant is available for employment, younger brother,
widowed daughter/widowed daughter-in-law or son-inJaw residing
with the deceased and almost wholly dependent on the eamings of the
deceased may be considered to be the dependants ofthe deceased.

9.3.4 The dependants to be considered for employment should be physically

fit and suitable for employment and aged not more than 35 years
provided that the age limit in case of employment of female spouse
would be 45 years as given in Clause 9.5.0. In so far as male spouie is
concerned, there would be no age limit regarding provision of
employment.

9.4. O Employment to one dependant of a worker who is permanently


disabled in his olace.

(i) The disablement of the u'orker concerned should arise from injury or
disease, be of a permanent nature resulting into loss of emlrloyment
and it should be so certified by the Coal Company concemed.

(ii) In case of disablement arising out of general physical debility so


certified by the Coal Company, the employee concemed will be
eligible for the benefit under this clause if he/she is upto the age of 58
years.

A joint committee will be constituted by the JBCCI for considering as
to what constitutes general physical dehility refened to hereinabove.
This Committee will submit its report by 3 I -03- I 996. In case of
difference of opinion the matter will be refened to JBCCI which may
appoint an Umpire to decide the issue. The decision of the Umpire
shall be binding on the panics.

(iii) The dependant for this purpose means the wife/husband as the case
may be, unmarried daughter, son and legally adopted son. lf no such

direct dependant is available for employment younger brother,


widowed daughter/widowed daughter-in-law or son-in-law residing
with the employee and almost wholly dependent on the earning of thc
employees may be considered.

In so far as female dependants are concemed, their employment would


be govemed by the provisions ofClause 9.5.0'

(iv) The dependants to be considered for employment should be physically

fit and suitable fol employment and aged not more than 35 years
provided that the age limit in case of employment of female spouse
would be 45 years as given in Clause 9.5.0. In so far as male spouse is
concemed, there would be no age limit regarding provision of
employment.

9. 5. 0 Employment/Monetary iompensation tiifemale dependant

Provision of employment/monetary compensation to female

dependants of workmen who die while in service and who are declared

medically unfit as per Clause 9.4.0 above would be regulated as

under:-

(i) In case of death due to mine accident, the female dependent would
have' the option 10 eilher accept the monetar_r, compensation of
Rs.30001- per month or employment irrespective ofhcr age.

(ii) ln casc of deatl/total pennanent disablement due to causes other than

nrinc accident and medical unfitness under clause 9.4.0 if the female
dependanl is below the age ol45 years she will have the option either
to accept the monetary contpensation of Rs.2000/- per month or
employmenl.

In case the female dependant is above 45 years of age she will be
entitled only to monetary compensation and not to employment.

(iiD In case of death either in mine accident or for other reasons or medical
unfitness under clause 9.4.0, if no employment has been oft'ered and
thc male dependant of the concemed worker is 15 years and above in
age lre will be kept on a live roster and would be provided employment

commensurate with his skill and qualitications when he attains the age
o1'18 years. During the period the male dependant is on live roster, the

female dependant will be paid monetary compensation as per rates at


paras (i) & (ii) above.

(iv) Monetary compensation, wherever applicable, would be paid till the


tbmale dependant attains the age qf f;O years.

(v)
Rs.30001 per month as mentioned above would be reviewed w.e.f.,
0l-07-1996.

(vi) The rale ol' monelary compensation will be reviewed as and when
new wage agreeinents are finalised.

instructions issued on the subject in so far as tbc issues are

9.6.0 Pension

Thc central trade unions who are members of the Joint Bipartite
Committee for Coal Insdustry. during negotiation of NCWAJII
demanded that an ahernate scheme be formulated by the Management
which would provide for comparatively better benelits both on
retirement and death than what is provided for under the Family
Pension Scheme. Accordungly, a scheme was drawn and submitted to

Golt.of India for consideration.

Govt.of India after considering the Scheme promulgated an Ordinance


with regard to Coal Mines Provident Fund And Miscellanious

Provision (Amendment)Ordinance, 1996 i.e.. Ordinance No. 5 of 1996


with regard to pension in place of family pension.This scheme will be
applicable to all the employees covered under the Pension

Scheme/Ordinance.This would be effective from | .4.1994.

_ As regards firnding of the Scheme. it is agreed that the_eAlp!Lq*9flhg_=--


fund will be formed out of the entire surplus lying in the existing
Family Pension fund (i.e. Rs.880 Crores as on 3 1 .12.93 and Rs.l 75

Crores as on 31.12.93 being the employee's contribution @ 2o/o of


emoluments per month from I .4. 1989). Besides the corpus as
mentioned above the regular funding will be on the following basis :-

and will start functioning. These Medical Boards would examine the
cases of pneumoconiosis within 7 days of receipt of the report of
detection of pneumoconiosis.
