A RESOLUTION AUTHORIZING HON. ERLINDA D. LIM, MUNICIPAL MAYOR, TO


ENTER INTO AND SIGN FOR AND IN BEHALF OF THE MUNICIPAL GOVERNMENT
OF LUPON, DAVAO ORIENTAL THE MEMORANDUM OF AGREEMENT (MOA)
WITH THE PROVINCIAL GOVERNMENT OF DAVAO ORIENTAL, REPRESENTED
BY HON. GOVERNOR NIÑO SOTERO L. UY, JR., FOR THE REFORMATORY
REHABILITATION TREATMENT IN BALAY SILANGAN DRUG REFORMATION
CENTER OF DRUG REFORMISTS/PROBATIONERS IN THE MUNICIPALITY OF
LUPON.

WHEREAS, pursuant to Section 2 of RA 9165 or the Comprehensive Dangerous


Drugs Act of 2002, as amended, provides that it is declared as policy of the State to
provide effective mechanisms or measures to re-integrate into society individuals who
have been affected by drug use and drug dependence and their families through
sustainable programs of treatment and rehabilitations;

WHEREAS, the Local Government Unit (LGU) of Lupon in its reconstitution of


the Municipal Anti-Drug Abuse Council (MADAC) is hereby mandated to appropriate
substantial amount of funds from their annual budget to be utilized in assisting the
enforcement of RA 9165, giving priority to rehabilitation and treatment to drug
dependents, drug users and drug surrenderees pursuant to DILG-DDB Joint
Memorandum Circular No. 2018-01 dated May 21, 2018;

WHEREAS, Peace and Order and Public Safety Plan 2020-2022 of this LGU
aims to neutralize drug personalities in the municipality through reintegrating them to
the community;

WHEREAS, LGU of Lupon has been providing financial assistance to drug


dependents seeking interventions to treatment and rehabilitation facilities;

WHEREAS, to ensure more effective and efficient system of implementation of


the financial assistance to drug dependents, inclusive of systematic transferring and
reimbursement process for LGU-managed rehabilitation centers;

WHEREAS, the Joint Committee on Budget, Finance and Appropriation, and the
Committee on Justice, Human Rights, Public Safety and Order, thru its Chairpersons
Hon. John Erwin G. Montojo and Hon. Cenen A. Angsinco, respectively, was tackled the
above subject matter, and corresponding Committee Report No. 2023-08 was adopted
on June 19, 2023, recommending for the passage of the said resolution;
WHEREAS, a copy of the subject MOA, with its terms and conditions, shall be
made part and parcel of this resolution;

WHEREFORE, premises considered the author prays for the approval of this
resolution.
