AGREEMENT FOR BUILDING LEASE

THIS AGREEMENT is made at ....... this ....... day of ....... in between


Mr……....., residing at ............, hereinafter referred to as 'The Lessor' of
the One Part and Mr……...., residing at ……......., hereinafter referred to as
‘The Lessee' of the Other Part.

WHEREAS the Lessor is absolutely seized and possessed of a vacant piece


of land situate at …........ and more particularly described in the Schedule
hereunder written.

AND WHEREAS the Lessor Is entitled to hold the said land being within
the ceiling limit.

AND WHEREAS the Lessee has requested the Lessor to give the said piece
of land on a long lease for commercial or business activities and not for
unauthorized business activities.

AND WHEREAS the Lessor has agreed to grant a lease of the said plot of
land to the Lessee on the following terms and conditions.

NOW IT IS AGREED BY AND BETWEEN THE PARTIES HERETO


AS FOLLOWS:

1. That the lease period of the said leased premises has been fixed for
____________. That is commencing from ________ to _________
at a monthly rent of Rs. ________ per month excluding water and
electricity charges which shall be paid by the 15 th of each British
calendar month in which it falls.

2. That the said duration shall be further extended with the mutual
consent of the parties and in that event fresh deed wil be executed
between the parties.
3. That the lessee is entirely responsible for any damages if any and will
pay the amount for the same at the time of expiry of tenancy period.

4. That the lessee shall use the said premises for commercial purpose
and not for any other unauthorised business and shall also abide by the
provisions of and the rules framed there under during the lease period.

5. That, the said lessee shall not sublet or part with possession of the said
premises or any portion thereof to anybody else during the lease
period and shall also not make any alteration or additions in the said
premises without the prior written consent of the landlord or his/her
authorised person.

6. That, the water and electricity bills of the said premises shall also be
paid by the lessee directly to the department concerned in time and in
due dates and in case of default the said lessee shall be responsible to
get the restoration of the connections.

7. That, the said landlord shall have the right to inspect the state of
leased premises during the reasonable hours of the day with prior
information to the lessee.

8. That, in case of no-payment of lease amount regularly and on the due


dates and violation of any of the terms and conditions of this deed, the
lessee shall be liable for ejectment from the said premises with a prior
legal notice of one month.

9. That, the lessee and lessor (as the case may be) will give one month
notice in writing for vacation of the tenanted premises in terms of this
rent deed.

10. That the said lessee has paid a sum of Rs. ______________
(Rupees__________________________________________ only) as
interest free security to the lessor, which shall be refundable at the
time of expiry of lease period or termination of lease , after deducting
the arrears, water or electricity charges or loss/damages, if any in
respect of the said leased premises.

11. That in the event of any corporation Tax, if levied by the


Administration/ competent Authority at any later stage in that event
the tenant shall enhance the rent amount accordingly to commensurate
such tax proportionally to the area occupied.

12. All the costs including stamp duty and registration charges of and
Incidental to the Deed of Lease will be borne and paid by the Lessee.
The fees of the Lessor's Advocate will be paid by the Lessor.

13. The Deed of Lease will be executed in duplicate and one original copy
will remain with the Lessee and the other will remain with the Lessor.

14. In the event of any dispute arising between the parties hereto in
respect of this agreement the same will be referred to arbitration of a
common arbitrator If agreed upon, otherwise to two arbitrators one to
be appointed by each party and the arbitration will be governed by the
Arbitration & Conciliation Act, 1996.
