SALE AGREEMENT
This Agreement of Sale is made and executed on this the 4th day of October 2021,
(04.10.2021) at Bangalore by,

Aged about 60 years,

Hereinafter called as the “VENDOR” (which term wherever the context requires shall
mean and include his legal heirs administrators assigns etc) of the One Part, IN
FAVOUR OF :-
Hereinafter called as the “PURCHASERS” (which term wherever the context requires
shall mean and include his/her/their representatives and legal heirs administrators,
assigns etc.,) of the Other Part, WITNESSETH:
Whereas the VENDOR are the sole and absolute owner of the immovable Land
bearing Survey No.32, measuring 4 acres, situated at Chikkasandra Village,
Bidarahalli Hobli, Bangalore East Taluk, formerly Bangalore South Taluk, which is
morefully described in the schedule hereunder and hereinafter referred to as the
SCHEDULE PROPERTY.
Whereas, Originally Sri. H. Mohanlal was the sole and absolute owner of the
Agricultural Land bearing Survey No.14, measuring 4 acres situated at Chikkasandra
Village, Bidarahalli Hobli, Hoskote Taluk, Bangalore District, he having Granted the

Subsequently, the said Sri. H. Mohanlal after having acquired the land in the manner
referred to above have in turn sold the Agricultural Land bearing Sy No.14,
measuring 4 acre situated at Chikkasandra Village, Bidarahalli Hobli, Hoskote Taluk,
Bangalore District, in favour of Sri. C. V. Subramani@C.S.Mani Son of C. R. V
Subbanna, vide Sale Deed bearing Document No.2346/1964-65, Book-1, Volume
No.1103, pages 64 to 65, dated : 22-10-1964, Registered in the office of the Sub
Registrar, Hoskote.
Subsequently, the said Smt. Zubeda Nazar wife of Sri. Ameer Amanulla Khan after
having acquired the Agricultural Land bearing Old Sy No.14, New Sy No.32, along
with other Survey number, measuaring 4 acres situated at Chikkasandra Village,
Bidarahalli Hobli, Hoskote Taluk, Bangalore District, in the manner referred to above
has Gifted the above said property to Smt. Masooda Sultan, wife of Sr. Sultan

Ahmed, herein vide same Hiba (Gift) applied Dated 23/06/2009, bearing No.RRT (D)
CR.14/2011-12, order on Dated : 15/11/2011, passed in the Court of Deputy
Thashildar, Bidrahalli Hobli, Bidrahalli, Bangalore East Taluk, Bangalore, the Katha
is mutated vide Mutation Register No.H8/2011-12, in the name of Smt. Mashooda
Sultan.
Subsequently, the said Smt. Mashooda Sultan, wife of Sr. Sultan Ahmed, after
having acquired the Said Property in the manner referred to above is desirous of
selling all that piece and Parcel of Residentially Converted Land Bearing Sy No.32,
measuring 4 acres Vide Conversation order No.ALN:(E.B.B)S.R07/2013-14, issued by
the Deputy Commissioner, Bangalore District, Bangalore, situated at Chikkasandra
Village, Bidarahalli Hobli, Hoskote Taluk, Bangalore District,

Subsequently, the said Smt. Mashooda Sultan, wife of Sr. Sultan Ahmed, after
having acquired the Land bearing Sy No.32, measuaring 4 acres situated at
Chikkasandra Village, Bidarahalli Hobli, Hoskote Taluk, Bangalore District, in the
manner referred to above have in turn sold to in favour of the Vendor (Sri. P. BABU)
in turn vide Sale deed bearing Document No.BNS-1-04298-2013-14, Stored in CD
No.BNSD279, dated : 04-07-2013, Registered in the office of the Sub Registrar,
Shivajinagar (Bansawadi), Bangalore East Taluk, Bangalore.
Subsequently the Katha and other relevant revenue documents pertaining to the
schedule Property stand in the names of the VENDOR, hence the VENDOR are in
peaceful possession and enjoyment of the schedule A property. And Later the vendor
have intend to develop the schedule “A” Property.

WHEREAS, all the taxes, cesses, etc., have been paid by the Vendor up-to-date
and the Katha in respect of the Schedule Property stands in the name of the Vendor
herein.
Whereas the Vendor agreed to dispose the schedule property to meet their family
financial commitments is ready and willing to sell the schedule mentioned property
and having learnt about the intension of the vendor the PURCHASERS herein offered
to purchase the schedule mentioned premises upon the terms and conditions and at
sale consideration infra.

Whereas the Vendor and PURCHASERS hereto are desirous of reducing into
writing all the orally terms and conditions.
1. The Vendor assures the PURCHASERS that the property enjoys alienable,
dispositions and in absolute possession and enjoyment of the vendor.
2. The Vendor assures the PURCHASERS that the schedule premises has not
been subjected to any acquisition proceedings under any law for the time being
in force and that it is free from attachment of any court or revenue authorities
nor the schedule premises is subject to any encumbrance. Further the
schedule premises are not subject matter of any right of pre-emption. Thus the
Vendor enjoy absolute right, title and interest and possession over the schedule

5. Whereas the PURCHASERSs has agreed to pay the remaining balance amount
of Rs.21,43,000/- (Rupees Twenty One Lakhs Forty Three Thousand Only)

to the Vendor within the period of Two Months from the date of agreement.
6. The Vendor assures that he will always indemnify of the PURCHASERS and his
heirs, against all losses and damages that may sustained or incur in
consequent of any claim being made on account of any defect in title. In case
any disputes or litigations arise over the schedule property due to any defect in
title of the vendor or an account of convents contained herein, the same shall
be set right at the costs and expenses of the Vendor.
7. The Vendor under takes to furnish the up to date encumbrance certificates and
latest tax paid receipt and Katha certificate at the time of registering the
absolute sale deed either in the name of the PURCHASERS or any of his
nominee. The Vendor will hand over the possession of the schedule property to
the PURCHASERSs on this date of agreement.

8. That the vendor further covenants that they shall not enter into any
transaction agreeing to transfer the scheduled property in favour of any third
party or in any manner create charge over the scheduled property in any third
party’s favour, even by deposit of the title deeds, during the subsistence of the
agreement.
9. In the event of breach of any of the terms of this agreement by either of the
parties the aggrieved party shall be entitled to seek specific performance of this
agreement and for recovery of all costs, expenses and losses incurred/caused
to the aggrieved party as a consequence of such breach by the defaulting party.

the Bidrahalli Grama Panchayath limits, and bounded on the :-

West by : Road and Sy No.30,
North by : Portion of Sy No.14, New Sy No.36,
South by : Sy No.33.

Commissioner, Bangalore District, Bangalore, and Measuring East to West : 30
feet, and North to South : (48.9+49)/2 feet in total measuring 1468.5 Sq. feet
and bounded on the :-
In witnesses whereof the vendor and the purchase have signed this agreement of sale
