 1 Plaintiffs and Cross-Defendants William B. Pitt and Mondo Bongo, LLC, Cross-Defendant

2 Warren Grant, and Defendant and Cross-Complainant Nouvel, LLC (“Nouvel”) (collectively, the
3 “Parties”) by and through their counsel of record, hereby respectfully submit the following
4 Stipulation and Proposed Order for the Court’s consideration:
5 WHEREAS, on January 18, 2024, the Honorable Lia Martin continued the hearings on

6 Plaintiffs and Cross-Defendants William B. Pitt and Mondo Bongo, LLC’s demurrer to Cross-
7 Complainant Nouvel’s First Amended Cross-Complaint (Reservation No. 824939118437), and
8 Cross-Defendant Warren Grant’s Notice of Joinder thereto (Reservation No. 008760327176),
9 previously scheduled for January 19, 2024, at 9:00 A.M., to March 13, 2024, at 9:00 A.M.;
10 WHEREAS, Cross-Defendant Warren Grant’s demurrer to Cross-Complainant Nouvel’s

11 First Amended Cross-Complaint (Reservation No. 900048070166) is currently scheduled for

12 January 24, 2024, at 9:00 A.M.;
13 WHEREAS, the Pitt and Mondo Bongo demurrer and the Grant demurrer are interrelated

14 and address many of the same legal arguments;

15 WHEREAS, the Parties agree that it would promote judicial economy for the Court to

16 consider the Grant demurrer following its consideration of the Pitt and Mondo Bongo demurrer;
17 WHEREAS, the Parties have met and conferred and identified March 14, 2024 as a

18 mutually agreeable date for the hearing of the Grant demurrer to proceed, to the extent that date is
19 amenable to the Court;
20 NOW, THEREFORE, IT IS HEREBY STIPULATED AND AGREED between the

21 undersigned Parties, by and through their counsel of record, that, with the Court’s approval:
22 1. The hearing of the Grant demurrer previously scheduled for January 24, 2024 is

23 hereby continued to March 14, 2024 at 9:00 A.M., or the earliest date thereafter that

24 is convenient for the Court.
