ASSISTANCE PURSUANT TO THE HAGUE CONVENTION ON THE TAKING OF EVIDENCE ABROAD
1 REQUEST FOR INTERNATIONAL JUDICIAL ASSISTANCE

2 UNDER THE HAGUE CONVENTION

3 The undersigned Judge of the United States Superior Court of the State of California,

4 County of Los Angeles, Central District sends greetings to the competent authorities of the French

5 Republic, and respectfully requests international judicial assistance under Article 3 of the Hague

6 Convention of 18 March 1970 on the Taking of Evidence Abroad in Civil or Commercial Matters

7 (the “Convention”), an international treaty to which France acceded in 1964. The Convention

8 came into force between the United States and France in 1988.

9 The purpose of this request is to obtain information relevant to a lawsuit pending in the

10 United States Superior Court of the State of California, County of Los Angeles, Central District in

11 which William B. Pitt and Mondo Bongo, LLC (collectively, “Plaintiffs”) have asserted claims

12 against Angelina Jolie, Nouvel, LLC, Yuri Shefler, Alexey Oliynik, SPI Group Holding Limited,

13 and Tenute del Mondo B.V. (collectively, “Defendants”); and Nouvel, LLC (“Nouvel”) has

14 asserted counterclaims against Plaintiffs, Marc-Olivier Perrin, SAS Miraval Provence, SAS

15 Familles Perrin, Roland Venturini, Gary Bradbury, Warren Grant, SAS Petrichor, Vins et

16 Domaines Perrin SC, SAS Miraval Studios, SAS Le Domaine, SAS Distilleries de la Riviera and

17 Roes 1-10 (collectively, “Cross-Defendants”). In its cross-complaint, Nouvel asserted claims

18 against, among others, the French parties Marc-Olivier Perrin, SAS Familles Perrin, and SAS

19 Miraval Provence (collectively, the “Perrin Cross-Defendants”). Nouvel seeks the information

20 requested herein, and the Perrin Cross-Defendants join Nouvel in this motion seeking the issuance

21 of a letter of request and have agreed to produce the requested documents if this request is granted.

22 The requested information is believed to be in the possession of Cross-Defendants Marc-

23 Olivier Perrin, with a residence at 56 Boulevard du Roi Rene, 13100 Aix-en-Provence, France;

24 SAS Familles Perrin, a French limited liability company whose registered office is at La Ferrière,

25 Route de Jonquières, 84100 Orange, France; and SAS Miraval Provence, a French limited liability

26 company whose registered office is at La Ferrière, Route de Jonquières, 84100 Orange, France.

27 This Court requests that the French Ministry of Justice, in furtherance of justice, by proper

28 and usual process of your honorable Court, cause the Perrin Cross-Defendants to provide the

7 (a). Nature of the Plaintiffs Mr. William B. Pitt and Mondo Bongo, LLC have brought
19 Proceedings:
a civil suit against Ms. Angelina Jolie, Nouvel, LLC, and four non-
20 U.S. defendants, Yuri Shefler, Alexey Oliynik, Tenute del Mondo
(a Netherlands-incorporated business entity), and SPI Group
21 Holding Limited (a private limited company incorporated in
Cyprus) under the laws of the United States, asserting claims for
22 breach of implied-in-fact contract; breach of quasi-contract, pleaded
in the alternative; breach of implied covenant of good faith and fair
23
dealing; abuse of rights under Article 6-1 of the Luxembourg Civil
24 Code; tortious interference with contractual relations, pleaded in the
alternative; tortious interference with contractual relations; tortious
25 interference with prospective business relations; and constructive
trust. Nouvel, LLC has filed counterclaims under the laws of the
26 United States against Mr. William B. Pitt, Mondo Bongo, LLC,
Marc-Olivier Perrin, SAS Miraval Provence, SAS Familles Perrin,

Roland Venturini, Gary Bradbury, Warren Grant, SAS Petrichor,
28 Vins et Domaines Perrin SC, SAS Miraval Studios, SAS Le

1 Domaine, and SAS Distilleries de la Riviera. As against the Perrin
Cross-Defendants, Nouvel has asserted claims for tortious
2
interference with contractual relations; tortious interference with
3 prospective economic advantage; trespass to chattels; abuse of
right; and civil conspiracy to tortiously interfere with prospective
4 economic advantage.
5 7 (b). Summary of This legal dispute began with the filing of a complaint by
the Proceedings and Mr. William B. Pitt and Mondo Bongo, LLC (“Plaintiffs”) in the
6 Facts of the Case: Central District County of Los Angeles Superior Court of the State
of California on February 17, 2022.

8 In relevant part, Plaintiffs asserted that Ms. Angelina Jolie, Nouvel,


LLC (“Nouvel”), and Yuri Shefler, Alexey Oliynik, Tenute del
9 Mondo B.V., and SPI Group Holding Limited (the “SPI
Defendants”) breached or interfered with certain contractual rights
10 between Jolie and/or Nouvel on the one hand and Pitt and/or his
limited liability company Mondo Bongo LLC on the other when
11 Jolie sold Nouvel to Tenute del Mondo. Ms. Jolie, Nouvel and
12 Tenute del Mondo B.V. demurred to Plaintiffs’ complaint on the
basis that it fails to state a claim on which relief can be granted, and
13 Yuri Shefler, Alexey Oliynik and SPI Group Holding Limited
moved to quash service of summons for lack of personal
14 jurisdiction. Mr. Shefler and SPI Group Holding Limited’s motions
have been granted and Mr. Oliynik’s motion is still pending.

16 Nouvel has brought counterclaims against Plaintiffs and Marc-


Olivier Perrin, SAS Miraval Provence, SAS Familles Perrin, Roland
17 Venturini, Gary Bradbury, Warren Grant, Petrichor, Vins et
Domaines Perrin SC, SAS Miraval Studios, SAS Le Domaine and
18 SAS Distilleries de la Riviera (collectively, “Cross-Defendants”).
Nouvel alleges that Cross-Defendants misappropriated Chateau
19
Miraval funds; imposed a shareholder deadlock that prevented
20 Quimicum (which owns 100% of Chateau Miraval) from effectively
supervising Chateau Miraval; and misappropriated Chateau
21 Miraval’s intellectual property assets. Plaintiffs demurred to
Nouvel’s complaint on the basis that it fails to state a claim on
22 which relief can be granted. On March 18, 2024, Plaintiffs’
demurrer was overruled in part and sustained in part. The
23
remaining Cross-Defendants (Venturini, Bradbury, the Perrin
24 Cross-Defendants, SAS Petrichor, Vins et Domaines Perrin SC,
SAS Miraval Studios, SAS Le Domaine and SAS Distilleries de la
25 Riviera) moved to quash service of summons for lack of personal
jurisdiction.

After the Perrin Cross-Defendants specially appeared to challenge
27
personal jurisdiction, Nouvel served them with requests for the
28 production of documents concerning jurisdiction. On the basis of

1 French Law No. 68-678 of July 26, 1968, the Perrin Cross-
Defendants stated to Nouvel that they can only produce documents
2
in response to a letter of request under the Convention of 18 March
3 1970 on the Taking of Evidence Abroad in Civil or Commercial
Matters, and that the French agency charged with supervising
4 enforcement of the French Blocking Statute had determined that
Nouvel’s RFPs were subject to the French Blocking Statute. The
5 requests concern the Perrin Cross-Defendants’ trips to California,
their communications with California residents, and the effects of
6
their alleged tortious conduct on Nouvel or Ms. Jolie in the state of
7 California, in each case insofar as they relate to the allegation of
tortious conduct in Nouvel’s First Amended Cross-Complaint. The
8 Perrin Cross-Defendants have agreed to produce documents
responsive to the requests attached hereto as Schedule A through

Court’s jurisdiction, and Nouvel contends that the requested
11 discovery is fundamendal and important to the litigation.

2 DEFINITIONS

3 Unless otherwise specified, the relevant time period for these requests is September 1,
4 2016 through September 6, 2022.

5 “Chateau Miraval” shall refer to SA Chateau Miraval, a company established and having
6 its registered office in F-83570 Correns, Domaine de Miraval, France.

7 “Chateau Miraval Estate” or “Estate” shall refer to the 1300-acre country estate in the
8 south of France consisting of a manor house, vineyards, and numerous other buildings that is

9 owned by Chateau Miraval.

10 “Communications” means any act or instance of transferring, transmitting, passing,


11 delivering, or giving information by oral, written, or electronic means, including, but not limited

12 to, by notes, letter, telegram, facsimile, electronic mail, electronic message (including text

13 message), or voicemail.

14 “Document(s)” means the full and broadest scope of documents and things discoverable
15 under California law and includes, without limitation, all writings (as defined in Section 250 of the

16 California Evidence Code) and any written material, whether typed, handwritten, printed or

17 otherwise, and whether in draft or final form, of any kind or nature, or any photograph, photostat,

18 microfilm or other reproduction thereof, including, without limitation, each note, memorandum,
