THIS DEED OF LEASE is made and executed on this the 01 Day of February 2019.
BETWEEN:
Sudhindra Gundachar, aged about 72 years, son of Late Sri. D.S. Gundachar
residing at “No.391, Flat No. G2, 5th Cross, Wilson Garden, Bangalore-560027,
hereinafter referred to as the LESSOR which expression unless excluded by or
repugnant to the context mean and include her heirs, legal representatives,
executors, administrators, successors-in-interest and assigns of the FIRST PART.
AND:
1) Nitesh Dangi, aged about 42, son of Shri Gouthamchand Dangi &
2) Indra Kanwar Dangi aged about 41, wife of Nitesh Dangi, both residing at 3A
Ormes Villa Apts, No 49 Ormes Road, Kilpauk, Chennai - 600010, hereinafter
referred to as the LESSEES, which term shall mean and include his successors and
assigns of the SECOND PART.
WITNESSETH AS FOLLOWS:
1. WHEREAS the terms LESSOR & LESSEES wherever the context so admits
shall mean and include their respective legal heirs, legal representatives,
administrators, successors and assigns.
2. AND WHEREAS the LESSOR is the owner of the immovable property, No.391,
Flat No. G1, Wilson Garden, Bangalore-560027, which is more fully and

particularly described in the schedule hereto and for convenience hereinafter to as
the DEEMED PREMISES.
3. AND WHEREAS the LESSOR has offered to lease aforesaid property in favor of
the LESSEES, which is more fully described in the schedule hereunder and
hereinafter referred to as the SCHEDULE PROPERTY.
4. AND WHEREAS both parties have deemed it fit that the terms and conditions
so agreed to upon between them be reduced into writing to avoid any future
ambiguity.
1. RATE OF RENT:
(a) The LESSEES jointly shall pay a rent of Rs. 36,000/- (Rupees Thirty-
Six Thousand Only) (18000*2) per month to the LESSOR. The LESSEES shall remit
the rents on or before the Fourth (4th) Day of every following calendar month by way
of cheque or by NEFT/RTGS.
(b) The LESSEES jointly has remitted a sum of Rs. 4,00000/- (Rupees Four
Lakhs Only) by cheques:
1) Nitesh Dangi: Amount: Rs. 2,00,000/-
2) Indra Kanwar Dangi: Amount: Rs. 2,00,000/-
3. PERIOD OF TENANCY:
The period of tenancy is initially for a period of Eleven Months. Extension of
the period of tenancy is by mutual consent by entering into a fresh lease
deed/renewal deed.
4. ENHANCEMENT OF RENT:

The lease shall be renewed on the mutual agreement of the parties under the
same terms and conditions with an enhancement of rent by 5% every 11 months on
the prevailing rent.
7. PURPOSE OF LEASE:
The LESSEES shall use the Schedule Premises for residential purpose only.
8. OBLIGATIONS OF LESSEES:
a) The LESSEES shall not use the Schedule Premises so as to cause damage to
the building and indemnify the LESSOR against the loss, direct or indirect on
this account. The LESSEES shall at all times keep the LESSOR informed about
the general condition and upkeep of the Schedule Premises.
b) The LESSEES shall ensure that if any damage is caused to the Schedule
Premises by any third party, the same shall be brought to the notice of the
LESSOR within three days from the date of such damage. Failure to do so the
same shall make the LESSEES absolutely liable to indemnify the LESSOR the
cost of the said damage irrespective of the reasons for such damage. However,
this clause shall not in any way exclude the liability of the LESSEES if the
LESSEES has also contributed to the said damage.
c) The LESSEES shall maintain the fixtures and fittings whatever is existing in
good and working condition. All repairs during the period of tenancy shall be
borne by the LESSEES.
d) The LESSEES shall keep the Schedule Premises always in good condition
subject to normal wear and tear and shall not cause or suffer any damage
thereto.
e) If the LESSEES fails to maintain the Schedule Premises in a good and
tenantable condition as mentioned in clause (c) and (d) above, the LESSOR

has entitled to restore the Schedule Premises to its original condition
from the funds remitted as security deposit by the LESSEES. The said
expenditure shall not be reimbursed to the LESSEES.
f) The LESSEES should not assign, sub-let or underlet or otherwise part in any
way with the possession or any part thereof of the Schedule Premises to any
third party during the subsistence of the lease. Such any act would amount to
breach of the terms of the lease and the lease becomes entitled for eviction
from the Schedule Premises.
g) To carry out at its own costs the day-to-day minor repairs and maintenance of
the electrical fittings provided in the SCHEDULE PROPERTY and shall not
make any structural alterations or additions to the SCHEDULE PROPERTY.
h) The LESSEES shall not use the SCHEDULE PROPERTY or permit the same to
be used for any purpose which may or is likely to cause nuisance or annoyance
to the neighbors/ public nor for any illegal or immoral purposes and shall
observe all statutory laws, regulations, etc.,
i) The LESSEES shall not store in the SCHEDULE PROPERTY any goods of
hazardous, explosive or combustible nature that may cause risk by fire,
explosion or goods/material, which on account of their weight or nature may
cause damage to or endanger the safety of the building.
j) The LESSEES shall not carry out any structural alterations, repairs, etc.,
without prior consent of the LESSOR. The LESSEES shall not at any time
demolish or cause to be demolish and/or modify or alter in any manner
whatsoever, the SCHEDULE PROPERTY or any part thereof without prior
consent of the LESSOR.
k) In the event of LESSEES having long term guests for more than a month,
then they shall inform the same to the LESSOR though Whatsapp or e-mail
communication or phone.
l) The furniture, fixtures, and fittings available in the DEEMED PREMISES are to
be maintained or if damaged, replaced with the identical replacements of the
same quality at the time of vacating delivering possession of the DEEMED
PREMISES.

11. UNDERTAKING TO PAY RENT:
The LESSEES covenant with the LESSOR that the LESSEES will pay the
rent/s regularly and duly fulfill the LESSEES’S obligation as per the terms of the
Lease created by the document.
12. PAINTING CHARGES:
At the time of vacating the premises, the tenant shall pay one month of rent
as painting charges.
14. TERMINATION:
Both the LESSOR and LESSEES are entitled to terminate this agreement
within the agreement period by giving two months advance notice in writing.
SCHEDULE PROPERTY
All that piece and parcel of the Flat No. G2 G1, 391, 5th Cross, Wilson Garden,
Bangalore-560027, together with fixtures and fittings, consisting of three bedrooms,
three balconies, three bathrooms, living room, kitchen with dining area, pooja room,
and utility area with balcony at the side and car parking.
1. Fans : 4 Nos.
2. Tubelight (LED) : 5 Nos.
3. Geyser : 2 Nos (3 Nos)
4. Exhaust Fan : 3 Nos.
5. Chimney : 1 No.
6. Bathroom Mirror Storage : 3 Nos.
IN WITNESS WHEREOF, the parties to this Deed have affixed their respective
signatures to this agreement at Bangalore, on the day, month and year first above
mentioned in presence of the following witnesses:
