fraternity. The All India Moot Court Competition of University Law College is a flagship
event, and a landmark in its consistency, integrity and fairness. At the pinnacle of our
academic calendar, this event promises to be a platform where theoretical knowledge
meets practical application, shaping the future of legal advocacy.

This year, we are proud to present a meticulously crafted case that delves into
contemporary legal issues, challenging the participants to navigate through intricate
legal principles and present compelling arguments. Whether a seasoned mooter or a
novice, this competition offers an inclusive platform for all to showcase their talent,
passion, and dedication to the legal field.

It is with immense pride that University Law College, Bangalore University,


announces the 28th edition of the All India Moot Court Competition, 2024, to be held
from 31/05/2024 to 02/06/2024, which aims to be bigger and more diversified than
ever before. We extend our sincere and warm welcome to all the esteemed participants
of this competition and convey our best wishes for their endeavours ahead. 1
BANGALORE UNIVERSITY
Bangalore University was established in July 1964 as a branch of the University of Mysore.
It is located in Bangalore which is known as the Garden City of India. The University expanded in
1973, relocating to a sprawling 1100-acre campus called 'Jnana Bharathi’. It offers education across
six faculties: Arts, Science, Law, Engineering, Commerce & Management.

The Vice Chancellor of Bangalore University Prof. Dr. Jayakara Shetty M, a highly
experienced dental professional with diverse qualifications, serves as the Dean of the Faculty of
Dentistry at Rajiv Gandhi University of Health Sciences Bengaluru. The Registrar of Bangalore
University is Mr. Sheik Latheef, K.A.S. He is a Fellow Member of the Institute of Company
Secretaries of India, New Delhi (FCS). Dr. Sunitha M is currently serving as the Finance Officer of
Bangalore University.

The University earned its first accreditation in 2002, receiving a prestigious Five Star Status
from NAAC. The subsequent reaccreditations in 2008 and 2016, maintaining its 'A' Grade status,
solidify its academic quality. Particularly noteworthy is the latest accreditation by NAAC with an
esteemed grade A++ in 2023, under the new grading system.

History

University Law College, initially established as Government Law College (GLC) in


1948 by the Government of Mysore, became part a of Bangalore University's Faculty of
Law in 1964, adopting its current name. It played a pioneering role in legal education by
introducing the 5-year BA. LL. B integrated degree program in 1986-87, under the
leadership of Prof. V. B. Coutinho, aiming for higher standards in legal education. Situated
initially in the Central College Campus of Bangalore University, close to important legal
institutions like Vidhan Soudha & High Court of Karnataka, it relocated to a modern
facility within the Jnana Bharathi campus in 2006-07.

With a forward-looking approach, ULC introduced the B.A.LL. B (Hons) program


in 2019-20, reflecting its commitment to keeping pace with contemporary legal education
trends globally. Recognized for its academic excellence, research endeavors, and
community outreach, ULC regularly hosts national and international seminars,
conferences, moot courts, legal aid programs, and cultural events.

SEMINAR HALLS
On February 10, 2024, the renovated seminar halls at Prof. V.B. Coutinho's
alma mater, ULC, were inaugurated amidst great enthusiasm and honor. A
heartfelt gratitude was expressed towards the alumni, whose donation of around
1 crore helped complete the hall.

The ceremony, graced by esteemed dignitaries, was presided over by the


Hon’ble Mrs. Justice Prathiba M. Singh, Judge of the Delhi High Court, along with
Hon’ble Mr. Justice Krishna S. Dixit, Hon’ble Mr. Justice S.R. Krishna Kumar,
and Hon’ble Mr. Justice Rangaswamy Nataraj, Judges of the High Court of
Karnataka. Felicitations were extended to esteemed legal luminaries, including
Hon’ble Mr. Justice C.M. Poonacha, Hon’ble Mr. Justice K.V. Aravind, and senior
advocates from both the High Court of Karnataka and the Supreme Court of India.

The occasion also marked the inauguration of a ladies' common room,


constructed under CSR funding by NABFINS Ltd., Bengaluru, and an open-air
auditorium. The ceremony was further enriched by the presence of Prof. Dr.
Jayakara Shetty S.M., the Hon’ble Vice-Chancellor of Bangalore University, who
shared special insights, along with family members of the late Prof. V.B. Coutinho.

In today’s world mooting is of
great importance in legal studies as it
offers students a platform to develop

student of IV Year, Navodita K.M won the ‘Best Orator’ award in the 1st National Moot
Court Competition hosted by Kristu Jayanthi Law College, Bangalore.
A team comprising of speakers Dhruva P Gowda and Vinutha B S, students of IV
Year, achieved the ‘Runner-up’ position in the 6th Surana and Surana and KLE Law
College National Moot Court Competition 2023-24. Mohammed Raqim, Mohammed
Abdul Rehman and Yashaswini, students of ULC, won the ‘2nd Best Memorial Award’ in
the 5th Wildlife Moot Court Competition organised by the Government Law College,
Mumbai.

NATIONAL SERVICE SCHEME

The National Service


Scheme (NSS) of ULC has been
actively involved in conducting
numerous activities aimed at
community welfare. These
activities include organizing
cleanliness drives in rural areas,
hosting health awareness camps,
raising awareness about socially
important issues, and facilitating a
national integration camp that
saw the participation of around
150 student volunteers.

In the academic year 2023-24 the NSS of University


Law College successfully organized various events, such as
celebration of Constitution and Human Rights Day,
Women's Day, Voluntary Blood Donation Camps and other
significant occasions. Ms. Deeksha Manjunath, of III year
B.A.LL.B.(Hons.) has proudly represented Karnataka NSS
unit, taking part in the 75th Republic Day Parade, held in
New Delhi.

SPORTS ACTIVITES
ULC is committed to providing a vibrant sports culture that fosters
teamwork, resilience, and a passion for excellence. Each year, we organize a
highly anticipated sports day and host competitive tournaments in football,
basketball, and cricket for both boys and girls. Our college has consistently
demonstrated outstanding performance in these events and has achieved
remarkable success in various inter-college sports tournaments. Furthermore,
our students have proudly represented our college in prestigious national and
international competitions, showcasing their talent and dedication.

LEGAL SERVICE CLINIC
The University Law College places
great importance on its pro bono mission
within the LL.B. programme and the Legal
Services Clinic serves as a crucial
embodiment of this philosophy. As a part
of their curriculum, law students embark
on visits to villages, where they conduct
legal awareness programs and identify the
socio-legal issues prevalent in the
community. By utilizing a scientific
questionnaire, they assess day-to-day
problems, levels of literacy, and the lack
of legal knowledge.With the support of the faculty, students offer legal advice to address
routine, social, and economic challenges. This outreach initiative has been an
unwavering practice since the introduction of the five-year LLB programme in 1985-86.

ALTERNATIVE DISPUTE RESOLUTION COMMITTEE

The establishment of the ADRC


(Alternative Dispute Resolution Committee) at
University Law College on 31st May 2023 is a
momentous occasion for both students and
faculty. The ADRC is faculty mentored and the
student run body is entrusted with the
responsibility to plan and organize ADR
activities. It provides students with an
excellent opportunity to hone their skills in
different forms of ADR like Negotiation,
Mediation and Arbitration. The committee
functions to conduct training sessions,
workshops and special lectures for the
students to impart both theoretical knowledge
as well as practical experience to students.

ULC DEBATING SOCIETY

The University Law College


Debating Society (ULC DEBSOC)
serves as a cornerstone for fostering
quality discussions and intellectual
stimulation through variety of
activities including parliamentary
debates, Model United Nations
simulations, crisis committees,
devil's advocate rounds, elocution-
based debates, and pick & speak
sessions. The society's contributions
to the college's participation in Model United Nations conferences have been significant,
buoyed by the support and encouragement from the faculty.

CAMPUS PLACEMENT CELL


The Campus Placement Cell is a student-run group at University Law College in
Bengaluru that works within the college structure to assist students with placement and
internship possibilities. Throughout the academic year, the placement cell operates
independently under the supervision of the college-appointed faculty adviser.
Companies such as L&T, HPE and Wipro have been involved in this process.

ULC SPECIAL LECTURE SERIES

The program, which was initiated in 2020, has emerged as an invaluable


resource for students, providing them with the opportunity to engage and interact with
distinguished Judges and Advocates from the High Courts and Supreme Court, along
with esteemed academicians. This is facilitated through the regular organization of
special lectures that address pertinent legal issues of the present time. As of now, over
75 special lectures have been successfully conducted.

REPORT OF THE XVII ALL INDIA


MOOT COURT COMPETETION (2023)

University Law College is a premier institute that strives towards imparting


quality legal education and fosters the growth of young legal minds. The 27th edition
of the All India Moot Court Competition and the previous editions too have enjoyed
enormous success. The 27th All India Moot Court Competition received an
overwhelming registration of 76 teams from all over India. The Final Round of the
27th All India Moot Court Competition was held on 11th June, 2023 at the Prof. K
Venkatagiri Gowda Memorial Hall and was judged by the full bench consisting of
Hon’ble Justice Ravi Venkappa Hosmani, Judge, High Court of Karnataka, Hon’ble
Justice Anant Ramnath Hegde, Judge, High Court of Karnataka and Hon’ble
Justice C M Poonacha, Additional Judge, High Court of Karnataka.

MOOT PROPOSITION

1. Devanala1, one of the largest Country in Asia has a rich history in time with a
Democratic Federal System of Government. The policies of Federal
Government promised to make Devanala, one of the most developed Countries
in the World by 2028 as well as one of the most prominent tourist destinations.
The abundant flora and fauna, the eco-system in the islands privy to the Union
of Devanala was astounding and one of its kind, attracting lakhs of tourists
every year. One of the Islands of Devanala was Dvipa which had been rated
to be the most beautiful destination in the World having pink sand beaches.
Kutira was a luxury resort in Dvipa which attracted numerous tourists
including lone female travellers who considered the island as a safe haven.

2. Raktasura, a member of an ethnic group in Dvipa, a minor then in January


2019, along with three adults committed offenses under sections 354 and 376
of the Devanala Penal Code, 1860. Despite Raktasura being the accused who
committed the most heinous acts to the victim, he was remanded to the detention
center as he was 16 years at the time of commission of crime. While in
detention, he underwent psychiatric evaluation and was diagnosed with a
Multi Personality Disorder having shades of being violent and a threat to
others with or without provocations, more so towards women with sadism
and perversion.

3. In response to rising crime rates, particularly against tourists, the police


Commissioner of Dvipa introduced ‘ankle bracelets’ equipped with GPS
tracking for individuals with criminal antecedents and perceived to be a threat
to society. Raktasura, now employed as a pool attendant at the Kutira Luxury
Resort, was identified by the police as a candidate for wearing the ankle
bracelet due to his criminal history and tendencies as per his psychiatric
evaluation.

protect the Data in accordance of the Digital Personal Data Protection Act 2023 2.

5. Mr. Joshi being the National Editor for the ‘Verdict Times’ a prominent news
channel, was fond of uncovering and disseminating new information. Mr. Joshi
was shocked by Raktasura’s identity and criminal conviction and hence
published the information on media. Subsequently, Raktasura was
unceremoniously terminated from his e m p l o y m e n t at Kutira, as he was
seemed to be a threat to the guests. The media, sensing the whereabouts of
Raktasura started hounding him in order to interview about his story pertaining
to wearing ankle bracelet and breach of his privacy.

6. Raktasura moved the Supreme Court of Devanala by filing Writ Petition alleging
violation of his fundamental rights as guaranteed under Constitution of
Devanala, 1950, including Right to Privacy and Right to be left alone. He also
claimed for compensation jointly and severally for damage to his reputation and
regulation of AI in terms of Digital Personal Data Protection Act, 2023 and violation
of “Right to be Forgotten” by arraying the Commissioner of Police along with Union
of Devanala as Respondents.

7. The Commissioner of Police and the Union of Devanala, anticipating


Raktasura's legal action, had filed a caveat to the court. At the time of admission
of the above, Raktasura’s lawyers espoused Right to Privacy, Right to be Left
alone and Right to be Forgotten, and alleged that antecedent bad character or
conviction cannot be used to vex Raktasura and asserted the importance of
individual’s right.

2. For the Purpose of this Moot Proposition, the Digital Personal Data Protection Act, 1993 stands
notified by the Union Government of Devanala and the said Act shall be used for adjudication of
the moot proposition.
8. In contrast, the Commissioner of Police of Dvipa along with Union of Devanala
argued that the said Writ Petition espousing interest of society is required to be
protected. In accordance to the peculiar facts of the case and the restriction of
Article 19 of the Constitution of Devanala, free movement of certain persons is
required to be arrested if they are a threat to the society and also pressed into
argument of Right to Life of the citizens of Devanala.

9. The Supreme Court of Devanala recognizing the need to balance individual


rights with societal interests, issued notice to all parties involved and listed the
case for final arguments.

ISSUES

i. Whether the Hon’ble Supreme Court has the jurisdiction to address the
issues raised by Raktasura in Writ Petition as under the Constitution of
Devanala, 1950?

ii. Whether Dvipa has violated any fundamental right of Raktasura and is it
justified to introduce a system of Ankle Bracelets to be worn by the
convicts?

iii. Whether the State failed to take necessary steps to protect the Data as per
Digital Personal Data Protection Act, 2023?

iv. Whether Dvipa can be held liable to compensate Raktasura for the acts of
Mr. Joshi in publishing his personal information in Media?
