CPLG 02 2023A – Workshop on Recent Challenges to Merger Control and


Anticompetitive Conducts Proceedings in order to Protect the Competition Process

OBJECTIVE

This project will organize a two-day workshop in Lima and its main objectives are the following:
• Exchange experiences and share views and information about remedies and corrective
measures, as a tool to restore the competitive process in APEC Economies, in investigation
of anticompetitive offences as well as in merger proceedings.
• Identify best practices to be assessed by the economies.
• Prepare a framework to improve the application of remedies and corrective measures in
APEC economies.

PROPOSED OUTCOMES

1. Increased awareness of the importance of implementing competition policies to avoid


anticompetitive conducts. This outcome would be measured through the Workshop
evaluation on how the sharing of experience and best practice during the Workshop has
increased participants’ understanding of the correct application of best practices to Pre-
Merger Control proceeding and anticompetitive conducts proceedings.

2. Increased willingness to implement best practices in order to protect the competition


process across the APEC region. The agenda will include presentations by member
economies to share best practices and solutions and will organize small group work to
discuss case studies to identify common challenges, solutions, best practices and
recommendations. This outcome would be measured through the Workshop evaluation by
asking economies how likely it is that they implement the best practices addressed in the
Workshop.

3. Increased capacity to address anticompetitive conducts through competition policy. This


Workshop will include panel discussions and Q&A with experts. This outcome would be
measured through the Workshop evaluation by asking economies whether the knowledge
and experiences gained during the Workshop will help them to improve their competition
process.
