SITUATION

Most project are awarded on a


competitive bidding basis. Supposing
you had been the designated engineer
of one of the bidder that was not
awarded the letter of intent by the
client and you are then approached by
the winner to join the consultant team,
should you accept the second
appointment?
DECISION
Yes, we shall accept the second appointments because
Rival company offers more much benefits and gives very
good salary than the current company.
Rival company uses different technology or new
technology than the current company .
heard that the rival company is the best company in this
country because this company win many award and got
many projects.
Can get a lot of idea when working with rival company
and can have a lot of perk such as have a wages and get
better compensation than the current companies.
The compensation for the rival company is much better,
and so are the benefits
CONFLICTS 1
A registered engineer shall not accept
compensation, financial or otherwise, from more
than one party for services on the same project, or
for services pertaining to the same project, unless
the circumstances are fully disclosed and agreed to
by all interested parties.
Situation:
He accepts the offer without informing to his current
company that may cause major conflict between the
company. Thus, if this happen he will be suing by
the company and the engineer license might be
revoke.
CONFLICTS 2
A registered engineer shall not reveal facts, data or information
without the prior consent of the client or employer except as
authorized or required by law or when withholding of such information
is contrary to the safety of the public to the safety of the public.

Situation:
This situation happened when the engineer accept the competition
offer in joining his company. The engineer maybe in dilemma whether
or not to disclose the previous company secret. If the engineer
discloses the secret, it will become breach in ethic. This dilemma will
make harder for the engineer in decision making. In addition, he also
already bound by this ethic that is:

A registered engineer shall disclose all known or potential conflicts of


interest that could influence or appear to influence his judgement or
the quality of his services.
CONFLICTS 3
Based on offer letter agreement given
by the company, the employee will be
bound when he accepts the job offer.
Thus, if he quit his job without notice to
the company, the company can penalty
the employee by deducting employee
salary.
CONCLUSION

To be a professional engineer, we need


to follow the ethic of Board of Engineer
Malaysia (BOM) to prevent the
unexpected situation.
