MOTOR VEHICLE ACT

Objectives of the Motor Vehicle Act, 1988

• Sticking to strict procedures for granting licences and


calculating the validity period of such licences.
• To maintain road safety requirements, dangerous and
explosive material transportation rules, and pollution
control measures.
• To maintain the country’s rapidly growing quantity of
personal and commercial cars.
• To raise the amount of compensation available to hit-
and-run cases.
• To eliminate the time limit for traffic accident victims to
file a compensation claim.
NECESSITY FOR DRIVING LICENSE
• Without driving license no person shall drive the
vehicle in the public places.

AGE LIMIT IN CONNECTION WITH DRIVING


OF MOTOR VEHICLES

• Without completion of 18 years no person shall


drive a motor vehicle in public places.
• Person under the age of 20 years should not
drive a transport vehicle in public place.
LIMITS OF SPEED
• No person shall exceed the speed limit beyond
the fixed speed for the vehicle under this act.
• The officials for fixing the speed limit is the
Central Government and State Government of
the particular state.
DUTY TO OBEY TRAFFIC SIGNS
• Every driver of a motor vehicle shall drive the
vehicle in conformity with any indication given
by mandatory traffic sign and in conformity
with the driving regulations made by the
Central Government, and shall comply with all
directions given to him by any police officer
for the time being engaged in the regulation
of traffic in any public place.
Punishment
• Driving without licence – 3 months imprisonment or
fine of Rs.500/- or both
• Driving dangerously – 6 months imprisonment or
fine of Rs. 1000/- or both and on the second time - 2
years imprisonment or fine of Rs.2000/- or both
• Drunk and drive – 6 months imprisonment or fine of
Rs. 2000/- or both
• Racing and trial of speed – without permission from
state government – 1 month imprisonment or fine
of Rs. 500/- or both
• Prohibition against travelling without pass or
ticket – no person shall enter or remainin any
stage carriage for the purposes of travelling
there in unless he has with him a proper pass
ticket – infringing the law – 3 month
imprisonment or fine of Rs. 500 or both.
THE TAMILNADU MOTOR VEHICLE
(AMENDMENT) ACT, 2019 – w.e.f 2022
• Without a proper document on driving a vehicle –
fine increased to Rs. 5000/-
• Using mobile while driving – fine increased from
Rs. 1000/- to Rs. 10,000/-
• Below 18 years – driving a vehicle – fine increased
to Rs. 25000/- and 3 years imprisonment.
• Dangerous or rash driving - first attempt – fine of
Rs. 5000 – Second attempt Rs. 10000/-
• Drunk and drive – fine of Rs. 10,000/-
