VIOLATIONS OF

REPUBLIC ACT 9275


The Philippine Clean Water Act of 2004
PROBLEM
The waters of the Philippines are not exempt from
the effects of human modernization. It has been
threatened by contamination, degradation and
pollution for so long.
THE CLEAN WATER ACT
The Philippine Clean Water Act of 2004, officially known as
Republic Act No. 9275, is a comprehensive environmental law
enacted by the Philippine government to protect and preserve
the country's water resources. The law aims to promote the
sustainable use and management of water, particularly in
rivers, lakes, streams, and other bodies of water.
DESPITE THE LAW…
BORACAY SEWAGE
POLLUTION
In 2018, the island of Boracay faced issues with sewage
pollution due to unregulated discharge of wastewater. The
government ordered the closure of several establishments for
non-compliance with environmental laws, including the
Philippine Clean Water Act.
VIOLATIONS & PENALTIES
72 establishments were fined a total of ₱2 MILLION
for operating facilities that discharge regulated
water pollutants without a valid discharge permit.

the permit was revoked for any violation of any condition
therein;

VIOLATIONS & PENALTIES
Five establishments were fined a sum of ₱39 MILLION for
discharging untreated wastewater and exceedance of
effluent standards under the clean water law.

the naturally occurring level of such pollutant in the area:

MAYNILAD WATER
SERVICES DISPUTE
In 2019, the Department of Environment and Natural
Resources (DENR) issued a notice of violation to Maynilad
Water Services for failing to provide a proper wastewater and
sewage treatment facility. It was a clear violation of the clean
water act, and the respondent, the Secretary of DENR
stressed this as the responsibility of Maynilad Water Services
as a water resource provider for various
Establishments.
VIOLATIONS & PENALTIES
Maynilad Water Services suffered the full
consequences of their due negligence. Their
mistake caused widespread inconvenience.

Section 8 Domestic Sewage Collection, Treatment and


Disposal. Within (5) years following the effectivity of this Act,
the agency vested to provide water supply and sewerage
facilities… shall be required to connect the existing sewage lines

Quoted from Case No. G.R. 202897, Maynilad Water Services, shall pay a fine of
Php29,400,000.00 within ten days.

Thereafter, a fine of Php200,000.00 per day shall be collected until apt compliance
of the provisions pursuant of Section 8 of RA 9275 has been fulfilled.
DELA MERCED & SONS, INC.
WASTEWATER DISCHARGE
On July 13, 2006, the Guadalupe Commercial Complex owned
and operated by Dela Merced & Sons, Inc. is situated along
the Pasig River. Upon inspection of the Environmental
Management Bureau National Capital Region (EMB NCR)
of the DENR, determined that the facility is
illegally dumping wastewater.
VIOLATIONS & PENALTIES
Section 27 (i). Discharging regulated water pollutants without
the valid required discharge permit pursuant to this Act or after
the permit was revoked or any violation of any condition therein;

Dela Merced & Sons, Inc. was fined a total of PHP 3.98
MILLION for operating facilities that discharge regulated
water pollutants without a valid discharge permit. Their
petitions and prayers were also denied by the court.
JUSTICE IMPOSED ON
WASTEWATER DUMPERS
In 2011, the Department of Environment and Natural
Resources was victorious over three negligent men that
violated the RA 9275 by illegally dumping wastewater caught
red handed by officials of Barangay Silang in Caloocan City.
Allan Lumanog , Ariel Olage , and Arwin Reyes
dumped liquid waste contained in 46 carbuoy
containers saturated with copper and zinc.
On a nearby canal, a foul smell spread in
the area causing uproar among
the residents.
VIOLATIONS & PENALTIES
Section 27 (f). Transport dumping, or discharge of
prohibited chemicals, substances, or pollutants listed
under Republic Act No. 6969 (Toxic Substances and
Hazardous and Nuclear Waste Control Act of 1990).

Lumanog, Olaje and Reyes were sentenced to 6 YEARS


AND A DAY TO 10 YEARS OF IMPRISONMENT for illegally
discharging harmful chemicals and substances in the
local canals.
CONCLUSION
Majority of the issues and cases that violate the Clean Water
Act of 2004 have something to do with dangerous chemicals
and wastewater. Aside from pollution and negligence towards
the environment, these issues also stem from poor
implementation and due transgression of the populace on
Philippine Laws. Before it is too late, mankind should learn
that clean water is the only thing that can satiate thirst and
pave the way for all basic needs. In the absence of clean
water, comes the annihilation of all life.
