Available H1B Cap H1B type Cap H1B Regular Cap 58,200 + unused H1B1* from last year. H1B Advanced Degree Cap 20,000 Cap- Exempt H1B Unlimited * 6,800 visas are set aside for Chile and Singapore under Free Trade Agreements. Question 1: H1B Visa 2015 Start Date when applying from outside USA  I’m applying for H1B from India. If My H1B visa 2015 is approved on June 10, 2014, when can I come to USA and start working?  Your H1B Visa start date on I-797 should be October 1, 2014.You can enter USA upto 10 days before the start date. You can being working for your employer from Oct 1, 2014 ( not before that) www.HappySchools.com
Question 2: Start Date for OPT Student  I’m in OPT and working. OPT is valid till May of 2015. My employer will file H1B this April, 2014. When does my status change from OPT to H1B?  Your employer will file H1B petition with Change of Status. Even if your H1B is approved say July 10, 2014, your status will change from OPT (F1) to H1B only from October 1, 2014 ( if that’s the date listed in your I-797) www.HappySchools.com
