Koppersmith v. Alabama
742 So. 2d 206 (Ala. 1999)
Concurrences: Judge Long, Judge McMillan, and Judge Fry

Facts:
Koppersmith and his wife Cindy were fighting in their front yard when Cindy tried to go inside. As
she tried to enter the house Koppersmith stopped her and a physical dispute ensued. Cindy fell off the
porch and into the yard. She died from a skull fractures to the back of her head.
In Koppersmith s statement he told police that him and Cindy were arguing on their front porch when

Koppersmith s testimony of his actions portrayed a picture of unintentional events. The judge referred
to the Woods case, there was some evidence that the appellant failed to perceive the risk that the
victim might die as a result of his actions. Because there was evidence that gave a reasonable theory
that would have supported the jury receiving instructions on criminally negligent homicide, there was
error in the trial court not giving the jury the instructions. Therefore the judgment was reversed and
the case was remanded for a new trial.
Case Significance:
The court deciphering between criminal negligence and recklessness. Criminal negligence being a
person failing to perceive a substantial and unjustifiable risk that the result will occur or that the
circumstance exists. The risk must be of such nature and degree that the failure to perceive it
constitutes a gross deviation from the standard of care that a reasonable person would observe in the
situation.
When a defendant is accused of greater offenses, he has the right to have the court charge on lesser
offenses included in the indictment, when there is a reasonable theory from the evidence that supports
the defendant s theory.

As today s communications is hard to imagine without an internet and file transfers. One of the oldest
protocols: File Transfer Protocol (FTP) lies as a foundation in transferring files, as the user interface to
the protocol from remote sites over the internet. The main objective of FTP is sharing of files by
encouraging implicit use of remote computers. The data is been transferred reliably and efficiently
irrelevant to the number of host systems, file sizes and file types. FTP works over the architectures:
the successful file transfer doesn t depend upon the source and destination of the file. To ensure that
there is no loss of data in the transferring; FTP uses reliable Transmission Control Protocol at transport
layer. In recent years, graphical implementation of FTP is introduced to allow users for transferring
the files using mouse clicks instead of commands. The biggest benefit of FTP is it can handle
transferring of large files which cannot be done through E mail systems. Therefore, the security aspect
in the field of FTP has different perspectives from different available security protections that are
present in real world. Similar to the HTTP protocol FTP also uses a single socket for both signaling
and the actual data, but with a separate socket for download FTP uses an out of band control which is
not featured by HTTP. FTP uses open data format, the data ... Show more content on Helpwriting.net

The Latin Artist The Latin experience as a whole encapsulates a world that not many get to
experience. Those who do, brag of its liveliness; those who don t, gawk at it. What isn t known is how
the latin artist, whose culture places values on work and family much higher than creative expression,
survives through such tyranny. Artists such as Gabriel Marquez and Gabriel Mistra use their culture to
inspire their writing. Their work, much like the work of other writers and poets, is depressing to say
the least. With no support from a community, these artists use metaphors, vivid imagery, and other
effective literary devices in order to convey the neglect that they have grown accustomed to. Latin
America and it s people have had a hard time pursuing freedom. While civilized first world countries

6. Analysis Of John Hawthorne s White Whale
Nathaniel Hawthorne is a standout amongst the most productive symbolists in American writing, and
an investigation of his images is important to comprehension his books. As a rule, an image is
something used to remain for something else. In writing, an image is frequently a solid article used to
speak to a thought more theoretical and more extensive in degree and significance regularly an ethical,
religious, or philosophical idea or quality. Images can go from the clearest substitution of one thing for
another, to manifestations as monstrous, complex, and puzzling as Melville s white whale in Moby
Dick. A moral story in writing is a story where characters, articles, and occasions have a shrouded
importance and are utilized to present some widespread lesson. Hawthorne has an immaculate climate
for the images in The Scarlet Letter on the grounds that the Puritans saw the world through moral
story. For them, basic examples, similar to the meteor streaking through the sky, got to be religious or
good understandings for human occasions. Items, for example, the framework, were formal images for
such ideas as sin and contrition. While the Puritans made an interpretation of such customs into good
and severe activities, Hawthorne turns their understandings around in The Scarlet Letter. The Puritan
group sees Hester as a fallen lady, Dimmesdale as a holy person, and would have seen the hidden
Chillingworth as an exploited person a spouse deceived. Rather, Hawthorne

One theory of how emotion affects the cognitive process of memory is by a process known as a
Flashbulb Memory. The theory is that these Flashbulb Memories will not only enhance the memory
itself, but will make certain aspects of the memory more vivid and detailed. First, the Flashbulb
Memory should be defined. Flashbulb memories are emotional memories that are remembered with
great vivid detail and are almost photo like. For example, if someone were to experience a horrid
natural disaster, they would most likely remember the situation more vividly than people not actually
there. This instance is exactly what Brown and Kulik were trying to show in 1977, and what Conway

Like the experiment done by Conway et al, Neisser and Harsch investigated people s memory
accuracy of the incident 24 hours after the explosion and then again two years after. The results were:
one day after the disaster, 215 of the participants said that they heard about the disaster on television.
Two and a half years later 45% of the participants claimed to have heard of the event on the television.
Their memories of how they learned the news about the challenger disaster changed over time and
was a huge loophole in the studies in favor of flashbulb memory. Through this study it can be
concluded that flashbulb memories are not reliable and may in fact just be ordinary memories.
From Brown and Kulik to Neisser and Harsch we arrive at completely different conclusions. There are
many strengths to these studies, as they were all with real events that would have affected people
emotionally, but some of the studies were lacking in validity. The studies that recorded before and
after seemed to be more compelling than the ones that just assumed a certain answer. However, the
longer the duration of time between the before and after results most likely produced more variables
being tested, rather than just one. Based on the studies outlined it only seems accurate that these
flashbulb memories actually exist and affect our memory. The real analysis of these findings are how
they actually influence behavior. Emotion can affect memory, and ultimately behavior in someone s
life.

16. Three Religious Paintings
In this project I will compare the setting of three religious paintings. One set involves the interior of
fifteenth century architect, another located in a natural landscape, and one with a heavenly backdrop.
This expository paper will reveal how these different locations affect a viewer s spiritual experience,
and decipher whether or not these environments are generic, symbolic, or specific. The artwork titled
Painting of Ghent Altarpiece in Chapel, located in Rijksmuseum, Amsterdam, was created by Jan van
Eyck (Davies et al. 482). The scale and setting of this painting is unmistakably impressive. The
purpose of the altarpiece is to clarify the ceremony performed before it (482). Jan work is big in scale
and thorough with detail and color that glows (482). This environment is a generic place, although it is
a holy place, it is also very common as chapels can be found in virtually every church. The fifteenth
century landscape calendar page Tres Riches Heures du Duc de Berry was created by the Limbourg
Brothers in France (Davies et al. 474). In this panel, the month of July is illustrated, as is the passage

The short story is about a Sunday walk in the country taken by a young boy and his father. Written in

author. In his story, Father and I , Paar Lagerqvist uses imagery and symbolism to say that although as
children we have unwavering faith in our parents and that our world basically revolves around them,
at some point as we grow, we realize that there is more to life than this sheltered world. The story
begins on a perfect, bright Sunday afternoon. A father and son wave goodbye to the mother who is
preparing supper, and they head into the woods to enjoy the sounds of the birds and adventure by the
railroad tracks. As the young boy and his father are admiring the beautiful songs of the finches and
warblers, a train comes rushing along the tracks. Although the train came buzzing by quickly enough
to startle the little boy, his father saluted the familiar conductor and re established the peacefulness of
the Sunday afternoon. As dusk begins to fall, the child begins to feel uneasy about being in the
darkening woods. The young boy s fear grows, but his father remains calm and collected. Then out of
nowhere a mighty roar of a black train tore through the abyss awakening the two out of their quiet
state. The black train pierced through the night at a frantic speed and the father tells his son that he did

The one great preacher...is the Church. I agree vehemently with this statement. This is why when I

In the article SOX Context and Theory: Market Failure, Information Asymmetry The case for
regulation ...volume 9(3), Professor Jasso argued that Sarbanes Oxley Act is a principle that be used
only for the ethical and moral boardroom in the public corporation , however, it is intensely more than
that (Jasso, 1). In other words, Professor Jasso had many reasons to proof that the act itself had made a
positive impact to the financial and managerial accounting since the July 30, 2002 (Jasso, 1). He

As Professor Jasso mentioned the Glass Steagall case in which fulfilled the requirement of market
failure, it is important that investors understands how to make best decision before they ended up in
bankrupt (Jasso, 7). In this case, there is nothing perfect because the case of Steagall had proof how
policy needs to be improved from time to time. People will always make mistake and in order to be
right, they need to have a good policy. However, a good policy did not determine how well a person
will behave in their society.
By saying this, I reminded everyone to be an ethical individuals. Not only in their home, but also in
their companies. In the connection to this article, the best time to apply this knowledge is right now
because as Aristotle said in previous article a good character will make a good society . In other

Battles come and go but for Henry it seems he is in a war everyday of his life. It has been three years
now since his last battle but not a second passed when he doesn t think about what happened three
years ago. Thesis He is in good shape and he is working everyday to keep it that way. Henry has
settled down in a small house that is just right for him. It is early May and news have just came in that
the U.S can be going into another against a rebellion army that hatted the way the U.S was ruled. The
government said that they assembling the same army as the last war but with different General leading
it. That one lucky General is Henry. He has been chosen to lead the army which is very surprising to
him when he got the news. Henry ... Show more content on Helpwriting.net ...

hours they practice which formation to get to during a certain situation they practice how to aim and
shoot well and how they will march into battle. For the rest of the week they did the same thing until it
was drilled into their heads. The following week it was all about working as a team to have each other
back and how we can win the war but protect our army at the same time. It was like a perfection after
2 weeks. It has been three weeks and there is 2 weeks until the battle and they got for information on
the rebellion army they are planning to separate into 4 groups and surround the U.S army. So after this
Henry started to think that we can set a trap on them. He finally came up with the idea and told his
army. The idea was that we will tell one of the spies that they spotted us in a certain area and we will
hope and take their position but then we won t be there and in a minute we would have to attack them
from behind. It was a good idea but they had to time it perfectly so the rebellions don t get time to
think and realize what was happening. They had week to prepare for this and Henry took every minute
seriously if anyone would screw up he would make them step out of the group and give him a
punishment. He started to act like a real General now. He wasn t thinking negative anymore it was all

23. Factor Analysis Magimid
Magidson et. al (2016) s purpose was to make the Factor Analysis more straightforward and accessible
to clinicians of varying perspectives. Factor Analysis aims to understand the aspects of certain
problem behavior. In order to move forward, the problem behavior must be identified. Then the focus
moves on to the triggers and figuring out the context of what happened right before the behavior
occurred. This is known as the proximal trigger and is what is typically focused on. However,
Magidson et. al. (2016) states that in order to better understand the cause of the behavior it is also
important to look at the recent and distal triggers, which are the ongoing stressors and past situations.
Once the triggers are established the patient is ... Show more content on Helpwriting.net ...
al. (2016) provides a straightforward guide to implementing Factor Analysis. However, while reading
a few questions and criticisms did arise. First, is how Factor Analysis would help assess potentially
dangerous behavior such as severe self injury. It can be hard to evaluate this kind of behavior if it is
not allowed to occur frequently. Magidson et. al. (2016) states that Factor Analysis is used to pinpoint
reliable relationships between the patient s natural environment and behavior. So even though Factor
Analysis examines naturally occurring behavior, such a severe problem behavior might cause
redirection which can cause interpretation to be bias. Thus, while conducting Factor Analysis it can be
challenging to have conditions in which problem behavior may increase but at the same time have the
risk minimized. Another critique is the possibility of limited assessment time. If the contact with the
client is limited whether it be because they are an outpatient or some other factor then it can be very
difficult to assess change over time and see if Factor analysis is actually effective. It can also be
difficult to make progress if time is cut short before the patient has time to reflect upon the causes of
their behavior. Lastly, Factor Analysis might not be so effective if the patient keeps avoiding the main
problem behavior. Magidson et. al. (2016) states that it is important to acknowledge that the patient
may not want to do a difficult Factor Analysis so they should warm up with a smaller problem
behavior. However, it is possible that the patient will be reluctant and unwilling to face the behavior
that is truly problematic. It is not possible to force someone who does not want to change a certain
behavior to sit there and genuinely reflect upon it. Another reason for avoidance could possibly be fear
of bringing up a traumatic event. When looking for the triggers it is possible for a distal trigger to
bring up strong emotions and traumatic memories.

24. William Shakespeare s A Midsummer Night s Dream Essay
Generally, the relationship between the sun and the moon is a metaphorical construct of the male and
female gender. However, in William Shakespeare s, A Midsummer Night s Dream, the author develops
the traditional representation of a gendered sun and moon further, in order to symbolize the two
celestial bodies, now, as masculine and feminine oppositions. More specifically, Shakespeare expands
on the traditional idea of the sun and moon as a gender concept by identifying both as a union, and the
relationships that solidify these bonds, in which he delineates the opposition of romance to the
opposition of the sun and moon; in its destructive and regenerative aspect, the moon accompanies the
resolution of the conflicts, that is, the infidelity between lovers, and shed its light over a return to
individual and social order.
As a result, the function of moon imagery shift according to the lunar cycle (old and new phases),
which subsequently, creates the play s themes of dreamscape, female bodily change and chastity, and
most importantly, the romance and infidelities experienced in a relationship. Psychologically, A
Midsummer Night s Dream, starts in the light of day, symbolizing consciousness, and descends into
the depths of the unconscious, moonless night. Similarly, Shakespeare s use of moon imagery assumes
a new, or invisible, phase laying the foundation for the texts theme of dreamscape; consequently, the
dreamscape theme and the imagery of the moon are reduced to

Introduction
Programming is a skill that is widely specialised in the growing technological environment/market.
There are many programming languages available to the programmer to use. Some of these are event
driven programming and oriented programming language. Within the programming there are also data
types available to the developer which benefits them and the end user.
This report will embrace why different programming languages have been developed. It will also
compare and contrast event driven programming and object oriented programming languages.
Furthermore it will explain the benefit of having data type s available to the programmer.
Why different types of programming languages have been developed
Different programming languages have been developed for many different reasons. A programming
language is a language designed to designate a set of actions to be executed by a computer. A
programming language is therefore a practical way of giving instructions to a computer to operate.
Programs are created to control the behavior of a machine.
27. Examples Of Asian Stereotypes
I played piano and violin in middle school. I had a 4.0 GPA in high school. My childhood job dream,
is to be a doctor. My favorite subject is Calculus. It probably did not take long for you to assume that I
have described most of the Asian stereotypes known to man. However, Asian stereotypes show that
Asians are hardworking, smart, and successful. With all these being such positive feature why do
Asians care to be stereotyped as the model minorities? It s because even these positive stereotypes
have negative connotations that strip people of their individuality and alienate them for not being able
reach the standards set for them. I am a personal victim of these stereotypes and for the longest I was
afraid to ask teachers for help, because I thought that I was not suppose to need help. Not only am I
afraid of others commenting BUT YOU RE ASIAN but basically you re just admitting to failure.
YOURE ASIAN ; I do not understand this phrase, just because of our race were already presumed to
be intelligent, without even proving our self worth. The Asian race often takes all the credit for the
accomplishment and efforts performed by the individual. What makes the color of your skin or the
way you look, differ from the person next to you. It is because Asians study more or is it the pressure
of the parents, to achieve nothing but perfect grades. I am not afraid to admit that sometimes I treat B+
as F and strive for nothing less than a A. Asian parents enforce strict rules, tiger mom , not only so
they can know that their child will not have to struggle when they retire, but the main reason is due to
the competitive atmosphere created so parents can boast about their child s intelligence. Most of my
Asian friends feel the same, not having perfect grades could mean that your family does not accept
you. The pressure of being alienate and not having anyone to lean on or go to for help, can cause
suicidal thought in Asian Americans.
Its hard to just ignore the fact that I M ASIAN , that s something you cannot change, it s part of who
you are. Yes, although I am Asian, I am also an individual and I do not want my individuality to be
taken away by these stereotypes. Once I had a friend that even came up to me and

28. Wipro Case
Are Two CEOs Better Than One? The case of WIPRO
Take an organization with business divisions that overlap, add rapid growth, and flavour with
problems arising from an uncertain environment. What you have, potentially, is a recipe for confusion.
At Wipro, India s largest software services firm, however, little evidence of confusion has appeared
despite the turbulent winds that have buffeted the company for the past few years. When former CEO
Vivek Paul left to join Texas Pacific Group, a private equity firm, Wipro has had no CEO since Paul s
departure, with Chairman Azim Premji who owns more than 80% of this Mumbai and New York listed
company combining the roles of both chairman and CEO.
Wipro was established in 1947. It was a ... Show more content on Helpwriting.net ...
We do believe that the power of two will help us so far as we are concerned, given our environment.
Adds Paranjpe: Given the enormity of the opportunity and the task at hand, we felt it was worthwhile
to have two of us trying to drive this rather than leave it to one individual to try and do [everything].
And from a personal perspective, it can get very lonely at the top. So, having two people helps.
The business environment in India gives an impetus to this model of collegial and collective
leadership. The premium aspect for companies doing business in India is the combination of access to
a highly skilled labour pool and attractive wage levels. The penalties are the uncertainties in the
business environment with respect to infrastructure, power availability, urban transportation and
stability in policy regimes.
Companies like Wipro need two CEOs because of the complexity of doing business in India. On the
one hand, you have to manage offshore client relationships and business development by staying
really closely tuned to what is happening in international markets. On the other, you have to be
embedded in India to manage the country specific challenges. Sometimes these two faces of
complexity are quite divorced from each other; they are different sets of challenges. It may be difficult
for the same CEO to handle both ends.
Another reason such a

29. The Scream
In this essay I will be analyzing two works of art using aesthetics as a basis of judgment. Also I will be
examining and critiquing these two great works of art. Furthermore, I will be using the four part
process of the method in critiquing artwork which is understood to be describing, analyzing,
interpreting, and evaluating. The works of art I have chosen to like is The Scream by Edvard Munch.
According to Khan Academy Munch created four forms of this art work, the first was created in 1893
painting in oil, tempera and pastel on cardboard. The second and third in 1893 and 1895 both in
pastels and last 1910 was done in tempera. The piece I will be writing about is located at The National
Gallery, Oslo, New York and is 36 x 28 7/8 . Also the ... Show more content on Helpwriting.net ...
The shapes and forms are unnatural and the whole painting is filled with disturbing images of
deformed women. Moreover, the uncomfortable feeling the painting makes you feel as the three
images in the center stares directly back at you. His use of that psychic line is uncanny and very
disturbing and I can t help but to feel I hate this painting. Picasso uses sharp angular shapes and forms
with the neutral color black as it appears he painted the head of the woman s image located on the top
right hand corner of the canvas where it seems he blotted and smeared paint on the canvas to represent
his meaning of deformity. Every other image is defined with geometric shape and this effect in my
view causes the painting to be unbalanced. His use of the elements and principles were ignored or not
present, he used shading that was irregular on his forms which caused the effect of confusion on where
the direction of light was coming from. Patrick Frank writes, in Artforms, Although some art
historians decry this work s negative depiction of women, viewers are challenged by the paintings
hacked out shapes and overall intensity (401). This makes my point of if a painting has no meaning or
a painting without a clear meaning to it will mostly lead to confusion and more time than not it will
lead the viewer to a feeling of

30. Wto As An International Institution
However, WTO as an international institution is still a good idea. WTO seems to be important for
developing economies in some reasons. First, as the weaker part in organizations, developing
countries benefited from unilateral trade actions of United States and Europe. Second, WTO help
developing countries to advance agriculture liberalization. As we know that agriculture is the most
important thing for developing economies to raise its economy and reach more gain from trade. Third,
the new open sectors in specific sectors like tourism also help developing countries to create more job
opportunities. This means that developing countries still gain from joining the WTO as long as they
perceived differentiated treatment to implement new trade disciplines due to their level of
development.
If there was no WTO, disputes or even cold war would be come up. As we cannot imagine the world
without WTO or rules of free trade, I suggest that global economy is much worse than todays. The
hopes from international trade is provision of such unavailable products in home economies. To fix
this matters, taking consideration on reforming the WTO is a must, the problems lies on WTO
frameworks, its role/mandates also its power.

31. The s Call For Individual s Responsibility Of Privacy Essay
However, Abram s call for individual s responsibility of privacy by limiting access to certain
information is impossible due to the very nature of social media. In Alice E Marwick and danah boyd
s 2014 article, Networked Privacy: How Teenagers Negotiate Context in Social Media, they argue that
because social media is, as previously discussed by Werbin and Fuchs, a networked environment that
thrives on sharing user generated data (Marwick boyd 1054). Furthermore, Marwick and boyd explain
this argument through a paraphrased statement from new media studies scholar Jenny Sunden (2003),
which states, to exist online, people must type themselves into being (Marwick boyd 1054). In other
words, each like , post, and comment all contribute to our existence online; to use social media we
must put ourselves and our information online. Moreover, rather than focusing on Abram s individual
responsibility model which Marwick boyd call access control list , Marwick boyd suggest that their
networked privacy model where privacy becomes the responsibility of each member of the social
media network fits our social media platforms better (1064 1065). In other words, through their study
of how American teenagers manage privacy online, Marwick boyd conclude that it is incredibly
difficult to maintain privacy on social media, because one shared photo to a few friends on Facebook
means the responsibility to keep this information private transfers to these friends (1064). To

33. Observation Of A Piglet
On September 10th 2017 Mr. Striker placed out 10 dead baby piglets in the body farm at Wabash
Heartland Career Center. The piglets all had different factors and the piglets where all still born.
Before the body farm even started we wrote theories on questions that we were given and what we
would think would happen to each piglet in different factors. We started observing these piglets on
September 11th 2017. We observed these piglets for three weeks until mostly all of the piglets where
decomposed all the way to bones. The piglet that was burned (piglet 2) was the one to decompose the
fastest out of the natural state piglet in the grass (piglet 1) and a buried piglet (piglet 10). My initial
thought was correct that piglet 2 would decompose fastest due to less skin for the bugs to get through
the skin and get inside of the piglet. Piglet 2 decomposed on day 9 it was completely bones with no
skin or flesh left on the bones due to maggots and other insects. Piglet 1 still had maggots on its legs
on day 9 and was decomposed on day 11 with only bones left. The piglet 10 still has not been
completely decomposed on day 15. The speed of decomposition is different when the piglet is naked
on the black top (piglet6) or a clothed piglet on black top (piglet 7). My initial thought was that piglet
6 would decompose faster because there would be one less layer to get through than on piglet 7. I was
correct that the piglet 6 did decompose faster than piglet 7. However the clothes
