TRADE MARKS
Definition:-
*.”A trademarks is any sigh that individualizes the goods of a given
enterprise and distinguishes them from the goods of its competitors,”
*. A trademark is a type of intellectual property, and typically a name,
word, phrase, logo, symbol, design, image, or a combination of these
elements.
IMPORTANCE OF TRADEMARK
1). It provides legal protection against the fake and fraudulent
products.
2). The customer can easily identify the product because of its name or
logo.
3). It creates an intangible asset for the owner, which has an ability to
be transferred, sold or franchised,
4). Trademark creates trust and goodwill in the minds of the customer
because of which many customers are loyal to the product.
ESSENTIAL FEATURES
1). It should be distinctive
2). Trade mark should preferably be an invented word, Eg:- Zen
3). It should be easy to pronounce and remember if it is word mark.
4). In case of a device mark – should be capable of being described by a single word.
5). It was be easy to spell correctly and write legibly.
6). It should not be descriptive.
7). It should be short.
8).It should not belong to the class of marks prohibited for registration.
9). It should satisfy the requirements of registration.
TYPES OF TRADEMARKS
Types of trademarks include service marks, collective marks, certification marks, ets, Whatever the trademarks
type, the trademark’s purpose is the same. Particularly to distinguish.
1.WORD MARKS :-
Word marks may be words, letters, or numerals. A word mark only gives the proprietor, and no right is sought
concerning the representation of the marks.
2. DEVICE MARKS :-
A device mark uniquely represents a logo, label, or design in the image format and may also contain a word or
a combination of words.
3. SERVICE MARKS :-
A service marks is nothing but a mark that distinguishes one person’s services from another, Service marks do
not represent goods but the services offered by a person / company.
4. COLLECTIVE MARKS :-
Marks being used by a group of companies can now be protected by the group collectively. Collective marks
inform the public about a particular product feature used for the collective mark. The owner of such marks may
be an association, public institution, or cooperative. Collective trademarks are also used to promote particular
products with certain characteristics specific to the producer in a given region.
