Stan Privacy Policy
Stan will be updating its Privacy Policy with effect on Monday 2 December 2024 - the updates will make our policy easier to understand and will provide clarity on how we collect, handle and use your personal information. You aren't required to take any action as the changes will automatically come into effect on Monday 2 December 2024, but we encourage you to review the new Privacy Policy, which you can access here.
Your privacy matters to us whether you are new to our Service or are a long time user. Please read this Privacy Policy carefully as it sets out the way we collect, use, handle and disclose information, including your personal information in connection with Stan's subscription video on demand service, as modified by Stan from time to time and which includes any subscription plan, add-on plan, bundled service, or any other offerings of the services provided by Stan (Stan Service).
In this policy, "us", "we" or "our" means Stan Entertainment Pty Ltd (ABN 94 168 856 924) and its subsidiaries (Stan Group).
We are bound by the Australian Privacy Principles contained in the Privacy Act 1988 (Cth) (the Act) and any other applicable privacy laws.
What is personal information?
When used in this policy, the term "personal information" has the meaning given to it in the Act. In general terms, it is any information that can be used to personally identify you. This may include your name, age, gender, postcode and contact details (including phone numbers and email addresses) and possibly financial information, including your credit card information.
Collection and management of information
To provide the Stan Service, we must process information about you. We collect your personal information directly from you unless it is unreasonable or impractical to do so.
We may collect the following types of personal information:
- Things that you do and provide, which includes:
- your name, mailing or street address, email address, telephone number and other contact details, age or your date of birth, and credit card information. We collect the content, personal information, communications and other information you provide when you use our Service, including when you sign up to create a Stan Account, when you enter information while using the Stan Service, any interactions with our customer service team, when you register your interest to access a free trial or to access any Stan Services, or if you participate in any Stan related survey, competition, promotion or other marketing campaigns;
- information obtained from your use of the Stan Service, including selected preferences, information inputted into "Manage Your Account" settings, the types of content that you view or engage with, the actions you take on our Service, any features you use on the Stan Service, and the time, frequency and duration of your activities and the content you engage with. For example, we record when you are using our application and when you last viewed content on our platform;
- information regarding transactions made in connection with our Stan Service. This includes details of the products and services you have purchased from us or those which you have enquired about, together with any additional information necessary to deliver those products and services and to respond to your enquiries;
- any additional information relating to you that you provide to us directly through our websites/apps or indirectly through use of our website/ apps or online presence through our representatives or otherwise, or through other websites or accounts from which you permit us to collect information;
- any other personal information which may be required in order to facilitate your dealings with us.
- Device information. We collect information from and about the computers, tablets, phones, connected TVs and other web-connected devices you use that integrate with our platform or app. This information is typically collected and used to better personalise the content, experience, or features that you see when you use the Stan Service. Some of the information that we obtain from use of your device(s) includes the device's unique identifier, resettable device identifiers, device ID, general geographic location, and information you allow us to receive through device settings you permit/turn on.

Information collected automatically or from our partners, which includes (in addition to what is set out above which may also be collected by partners, third parties, subsidiaries or related bodies corporate and provided to Stan):
- IP address information, browser and standard web server log information, and statistics regarding page views which may relate to an advertisement or marketing promotion connected to Stan, and referral URLs;
- information collected via the use of cookies, web beacons and other technologies, including advertisement data (see the "Cookies and beacons" section below);

- make the Stan Service available on their device;
- provide services to you and collect payment for our Service for distribution to us or provide pre-paid promotions for our Service;
- assist with search queries and requests applicable to us that you may make through a provider who has our Service available on their device;
- information from credit reporting agencies, law enforcement agencies and other government entities;
- payment information relevant to your Account with Stan, which may be provided by third party payment service providers;
- information from data processing and storage providers who Stan may use from time to time;
- information from security providers who assist Stan in securing its systems, preventing fraud and protecting the security of Stan's customer Accounts;
- any information collected from advertisers, mailing lists, recruitment agencies, or contractors who are partnered with Stan;
- any information collected from other providers/third parties where you have registered your interest with them (e.g. subscriptions or memberships with other providers which are also relevant to the Stan Service and offerings from Stan); and
- publicly available information, including from any use of social media platforms, where you consent to us collecting such information from those services, including when you sign up to Stan Services or connect your third party social networking service profile to Stan Services.
Cookies and beacons
We may collect additional information about your interaction with Stan websites/ services/ products. For example, we use website analytics tools on our websites, pixel tags, third-party software development kits and other technologies to retrieve information about your usage of our Services (including information about the pages you view, the links you click and other actions you take on our sites and Services), to measure and facilitate the performance and effectiveness of advertisements and web searches, and for fraud and security prevention purposes.
We also receive certain standard information that your browser sends to every website you visit, such as your IP address, browser type and language, access times, and referring website addresses. We generally use this information to report statistics, analyse trends, administer our Services, diagnose problems, gather demographic and behavioural information, and target and improve the quality of our products and Services. To the extent that this information does not constitute or is not associated with personal information because it does not identify you or anyone else, the Australian Privacy Principles do not apply and we may use this information for any purpose and by any means whatsoever. In respect of the use of cookies, we may collect data which includes personal information. When you access our website, we may send a "cookie" (which is a small summary file containing a unique ID number placed by a web server) to your device. This enables us to recognise your device each time you visit our website or use our application, without bothering you with a request to register or log-in. It also helps us keep track of and personalise products or services you view and your preferences, so that we can send you news about those products or services.
Our websites, products and Services may contain electronic images known as "web beacons" – sometimes called single-pixel gifs – that may be used to assist in delivering cookies on our sites and allow us to count users who have visited. We may include web beacons and other technologies (including software development kits) on all webpages on our website/products/services in order to determine whether messages have been opened and acted upon. We may also employ web beacons or other technologies from third parties in order to help us compile aggregated statistics regarding the operations of our websites. We prohibit web beacons on our websites from being used by third parties to collect or access your personal information.
Essential, performance and functionality cookies must be enabled in your browser or device in order to use Stan Services. If you do not want to enable any other non-essential cookies (including any advertising cookies and resettable device identifiers), you can turn these off at the browser level.
Anonymous data which we collect about your interaction with Stan Services may be used by us for the purposes described in this Privacy Policy or may be sold or otherwise provided by us to third parties including our partners, clients, shareholder and service providers for purposes, including (but not limited to) data-matching, analysis, selling aggregated anonymous data via advertising exchanges, conducting launch surveys and modelling.
When you receive newsletters or promotional e-mails from us, we may use web beacons (described above), customised links or similar technologies to determine whether the e-mail has been opened and which links you click in order to provide you with more focused e-mail communications or other information.
Storage of information
We may hold your personal information in electronic or hard copy format or a combination of both (including by storing your information with relevant data processing and storage providers who Stan may use from time to time). This personal information may be combined or linked with other information held about you, including information we receive from third parties and partners. We have taken a number of physical, electronic and procedural steps to protect your personal information from misuse, interference, loss, unauthorised access, modification or disclosure including by means of firewalls, password access, secure servers and encryption of credit card transactions.
If you suspect any misuse or loss of, or unauthorised access to, your personal information, please let us know immediately.
We store data until it is no longer necessary to provide our Services and/or to manage your Account. This is assessed by Stan on an individual basis and depends on different factors, including the nature of the information and data, the reason for collecting and processing this information, and any relevant legal or operational retention needs.
Use of personal information
We collect, hold, use and disclose the information we have to administer, provide, improve, analyse and personalise our Services and marketing efforts. We use the information we have in the following ways::
- Provide, personalise and improve our Services. We use the information we have to assess your application for Stan Services, to provide products and services to you, to provide you with news, information or advice about our existing and new products and Services, to provide you with more effective customer service, to manage, operate and enhance our products and Services, to personalise and customise your experience, to provide you with access to our Service, to provide your updated personal information to us, our contractors or external service providers, and to conduct competitions or promotions on our behalf and on behalf of selected third parties. We also personalise features and content and make suggestions for you (including by making recommendations for tv shows and movies you may be interested in watching). In order to provide, personalise and improve our Services, we may also determine your general geographic location and your ISP to support network troubleshooting on your behalf.
- Provide and conduct analytics, measurement and other business services. We use the information we have (including your activity on and off our webpage, such as our ads you see online or via social media) to measure the effectiveness and distribution of our ads and Services, and understand the types of people who use our Services and how people interact with our websites, apps and Services. We also use the information we have to conduct targeted advertising, to analyse our audience in order to assist with content selection, to better improve our user interface service, to conduct business processing functions for operation of our website, our Service or our business, and to improve our algorithms and display of content and advertising that are customised to your interests, preferences and experiences.
- Communicate with you. We use the information we have to send you marketing communications, communicate with you about our Services and let you know about our Policies and Terms. We also use your information to respond to you when you contact us.
- Maintain safety, integrity and security. We use the information we have to verify your identity, for credit verification purposes, transactions, fraud and credit worthiness, to prevent fraud, to maintain the integrity of our Service, to investigate suspicious activity, to investigate any complaints about or made by you, to monitor your compliance with, or if we have reason to suspect that you are in breach of, any of our terms and conditions, or if we consider that you are or have been otherwise engaged in any unlawful activity. We may also use the information we have as required or permitted by any law (including in accordance with the Act).
- Administrative and business purposes. We use the information we have for our administrative, marketing (including direct marketing and targeted online advertising), promotional, planning, product/service development, quality control and research purposes, or those of our contractors, partners or external service providers. We may also provide information (including personal information) to our shareholders (e.g. Nine Digital Pty Ltd) and their related bodies corporate or to any of our other partners for the purpose of, for example, reporting, to provide data matching and targeted advertising services, and for any of the purposes disclosed in this Privacy Policy.
We may state a more specific purpose at the point we collect your personal information and we may collect and use the information we have to provide as part of business data to third parties if you have authorised us to do so.
Your personal information will not be shared, sold, rented or disclosed other than as described in this Privacy Policy.
What happens if we cannot collect your personal information
If you do not provide us with the personal information described in this policy, some or all of the following may happen:
- we may not be able to provide you with the products or services you requested, either to the same standard, or at all (for example, if you do not create a Stan Account, you will not be able to access Stan Services); and/or
- we may not be able to provide you with information about products and services that you may want, including information about discounts, sales or special promotions.
Disclosure of information
We may disclose your personal information in the following ways
- Corporate Group. We may disclose the information we have to our employees, related bodies corporate, contractors or external service providers, or to our shareholders (e.g. Nine Digital Pty Ltd) and their related bodies corporate for the operation of our websites or our business, fulfilling requests by you, and otherwise in connection with providing our products and Services to you. We may disclose your personal information to these entities for the purposes disclosed in this Privacy Policy, for example, providing data matching and targeted advertising services and enabling us and these entities to better understand and meet your interests and needs.
- Third party service providers. To maintain the operation of our websites or our business, fulfilling requests by you, and otherwise in connection with providing our products and Services to you, we may disclose the information we have to, without limitation, web hosting providers, IT systems administrators, mailing houses, couriers, payment and other transaction processors, promotions agencies, customer support providers, statistical analysis providers, data entry service providers, marketing, advertising and communications providers, electronic network administrators, debt collectors, and professional advisers such as accountants, solicitors, business advisors and consultants.
- Our business partners. You may have a relationship with one or more of our business partners, who we share certain information with for the above identified uses. We may disclose the information we have with our partners for analytical purposes, to coordinate with them on providing our Service, and for the purpose of providing information about the availability of our Service. Such partners may include, without limitation, existing or potential agents, business partners or joint venture entities or partners (including for clarity as part of a corporate transaction such as a merger or sale of shares or assets).
- Analytics services. We may disclose the information we have to third parties and our partners in order to provide and obtain aggregated statistics, measurement reports, and analytics and insights that help us understand how people are engaging with our content, news, and other information about our existing and new products and Services.
- Promotions. We may disclose the information we have to our sponsors or promoters of any competition we conduct or promote via our Services. This may include disclosing information we have with partners in order to offer joint promotions or bundling initiatives.
- Targeted Advertising. Some of the apps and websites where Stan advertises, and for any advertising technology businesses that we may use to purchase, measure, deliver, enhance, or distribute our advertisements (including Meta, Google, Twitter and Microsoft), may receive certain personal information from us as part of our campaign targeting and measurement.
- Law enforcement or legal requests. We may disclose the information we have to the police, any relevant authority or enforcement body, or your Internet Service Provider or network administrator. This may include, for example, if we have reason to suspect that you have committed a breach of any of our terms and conditions, or have otherwise been engaged in any unlawful activity, and we reasonably believe that disclosure is necessary.
- Other disclosures. We may disclose the information we have as required or permitted by any law (including as required under the Act), and to specific third parties authorised by you to receive information held by us. In addition, based on your settings or choices, information may be disclosed via social plugins and similar technologies, or our Service may contain the ability or tool which provides you with the option to share information or content externally (e.g. via text, email, or across other web and social media applications).
You acknowledge and agree that any identified third parties in this Privacy Policy are solely responsible for their own terms of use, and privacy policies and practices.
We may disclose the information we have to our external service providers located overseas for some of the purposes listed above. We take reasonable steps to ensure that the overseas recipients of your information do not breach the privacy obligations relating to your personal information. We may disclose your information to entities located outside of Australia, including, without limitation, our data hosting and Cloud-based IT service providers, other external technology and billing partners and service providers located in the United States and the European Union, and other third parties or partners operating in international jurisdictions (e.g. United States and European Union) where you have authorised us to do so.
Direct marketing materials
We may send you direct marketing communications and information about products and services that we consider may be of interest to you. These communications may be sent to both active subscribers and individuals who have cancelled their subscription with Stan, and may be sent in various forms, including mail, SMS or email, in accordance with applicable laws, including the Spam Act 2003 (Cth). If you indicate a preference for a method of communication, we will endeavour to use that method whenever practical to do so.
In addition, at any time, you may opt-out of receiving marketing communications from us by contacting us (details below), by using the opt-out facilities provided (e.g. an unsubscribe link), or by changing your settings in "Manage Your Account" on the Service. We will then ensure that your name is removed from our mailing list within a reasonable period. We do not provide your personal information to other organisations for the purposes of direct marketing unless expressly authorised by you.
If you receive communications from us that you believe have been sent to you other than in accordance with this policy, or in breach of any law, please contact us using the details provided below.
Managing your personal information
You may request access to any personal information we hold about you at any time by contacting us (details below). Where we hold information that you are entitled to access, we will try to provide you with suitable means of accessing it (for example, by mailing or emailing it to you). We will not charge for simply making a request and will not charge for making any corrections to your personal information. If you make an access request, we will ask you to verify your identity. There may be instances where we cannot grant you access to the personal information we hold. For example, we may need to refuse access if granting access would interfere with the privacy of others, or if it would result in a breach of confidentiality. If that happens, we will give you written reasons for any refusal.
If you believe any personal information we hold about you is incorrect, incomplete or inaccurate, then you may request us to amend it. We will consider if the information requires amendment. If we do not agree that there are grounds for amendment, then we will add a note to the personal information stating that you disagree with it.
We request that you keep your information as current as possible so we may continue to improve our Service to you.
We may reject requests to access, correct or delete personal information that are not required by law (including by the Act) or are unreasonable, including any requests that would be unrealistic, impracticable, could require disproportionate technical work, are frivolous/ vexatious, jeopardise the privacy of others, or could expose us to operational risks (including instances of free trial fraud). We may also decline aspects of deletion or access requests if we believe doing so would undermine our legitimate use of data for safety, integrity and security purposes as described earlier.
We may retain information as required or permitted by applicable laws and regulations (e.g. in accordance with the Act), including for our billing or records purposes, to comply with your choices under your Account settings, and to fulfil the purposes described in this Privacy Policy. We take reasonable measures to destroy or de-identify personal information in a secure manner when it is no longer required.
Access to your Account information and profile
If you provide your login information or otherwise provide access to others to have access to your Account on our Service, those individuals will have access to information regarding the content you have watched, any ratings or favourites you have saved in "My List", your Account information (including your name, email address, date of birth, gender, postcode or other information in the "Manage Your Account" section of our website), and device information. Anyone with access to your Account can also view the profiles you have available, where such individuals can navigate to and use, edit or delete profiles associated with your Account.
If you use any features that enable you to remain logged in to your Stan Account (such features which may be available on smart TVs, gaming devices, set top boxes, mobile devices, or other devices connected to a Wi-Fi network), those devices will remain logged in to your Account unless you later log out of those devices. If you fail to log-out of your Account, others may subsequently have access to your Account and information if they use the same device or network.

Our website or apps may be accessed via smart TVs, mobile devices, set top boxes, laser projectors, gaming systems, and a number of other internet connected devices, which may contain links to other websites operated by third parties. We make no representations or warranties in relation to the terms or privacy practices of any third party websites/apps and we are not responsible for the terms or privacy policies or the content of any third party websites. Third party websites are responsible for informing you about their own terms and privacy practices.
