Depuis plusieurs décennies maintenant, les ressources de l’archéologie et de l’anthropologie ont ... more Depuis plusieurs décennies maintenant, les ressources de l’archéologie et de l’anthropologie ont amené à considérablement relativiser le transfert en Normandie des usages et coutumes scandinaves. Hors quelques domaines plus ou moins réservés (comme le droit maritime), il semble désormais bien acquis que les coutumes nordiques n’ont guère fait souche en terre normande, et que celles qui ont été importées se sont étiolées tout au long du Xe siècle pour ne laisser que quelques rares substrats aux siècles suivants. Pour autant, le XIXe siècle a été fécond en postulats prétendant trouver dans les anciens droits scandinaves (norvégiens, danois et islandais) la « moëlle substantielle » de la coutume de Normandie, quitte pour ce faire à envisager de périlleuses chirurgies fondées sur des greffes plus ou moins compatibles. Dans cette optique, les « fiers barbares du Nord » ne pouvaient qu’avoir imposé leurs lois à l’ancien royaume de Neustrie, destiné à devenir « la plus florissante des provinces de France ». De là découlaient non seulement un esprit propre aux populations normandes (qui perdurerait jusqu’aux abords du XXe siècle) mais aussi un droit original, antichambre juridique de la formidable expansion qu’ont connue les Normands aux XIe et XIIe siècles. Par-delà les rêves historiographiques, les fantasmes juridiques et les aspirations régionalistes, quels sont les ressorts de cette greffe dont les sources semblent pourtant attester le rejet ?

Notamment celui qui défend l’idée selon laquelle le droit révolutionnaire et plus encore le Code civil auraient aboli en France les vieilles coutumes provinciales. Magistrats et doctrinaires se seraient donc évertués, tout au long du XIXe siècle, à consacrer l’écroulement brutal de cet édifice pluriséculaire. La réalité est bien plus nuancée, on le sait. En Normandie notamment, là où l’identité coutumière a été peut-être plus profonde qu’ailleurs, en tout cas certainement plus précoce, la coutume subsiste en dépit des critiques et du mouvement d’unification du droit. Elle résiste à la fois dans la mémoire d’un grand nombre de doctrinaires mais aussi au sein même de la jurisprudence. Cette étude s’attache donc à aborder les manifestations de cette résilience coutumière, ses enjeux, et elle envisage comment le phénomène a pu persister sous des formes variées au cours du XIXe siècle.

S’inspirant largement des arguments jadis développés par Montesquieu, il se propose de défendre un schéma politique campé sur la combinaison de l’aristocratie et de la monarchie et, ainsi, de restaurer la noblesse dans ses droits historiques. Ainsi, De La Foy étaie une vaste réflexion sur la réforme de l’État royal à l’aune d’une approche primitiviste de la constitution normande qu’il présente en modèle d’organisation politique et sociale. De cette façon, il espère limiter l’emprise que le Tiers État pourrait, le cas échéant, avoir sur les états généraux qui doivent se réunir au mois de mai suivant à Versailles.

Elles ne se laissent pas aisément saisir cependant, tant elles se situent à la charnière du droit et du mythe. Probablement inventées au cours de la première moitié du XI e siècle pour accompagner la légende du saint roi, elles sont devenues, à compter du milieu du siècle suivant, la pierre angulaire du droit norvégien, jusqu'à nourrir l'émergence des lois fondamentales du Royaume de Norvège. Cette étude se propose donc de cerner l'origine et la portée de ce mythe juridique, à l'aube d'un constitutionnalisme naissant.

La redécouverte de la culture islandaise a peu à peu focalisé cette attention sur l'Edda, les sagas et la Grágás. À compter du début du XIX e siècle, les historiens du droit s'en sont emparés en nombre et ont tenté d'exploiter ce corpus pour remonter à la source du droit français. Quitte à faire naître une sorte d'école nordique au sein des facultés de droit. Mais largement nourrie de fantasmes, cette démarche, prégnante jusqu'au début du XX e siècle, s'essouffle progressivement à la veille de la Première guerre mondiale.
Abstract.-Since the 17 th Century, Scandinavia has exerted an attractiveness on french letters which nourish the mythological and poetic quest for the origins of European laws. The rediscovery of Icelandic culture gradually focused this attention on Edda, the sagas and the Grágás. From the beginning of the 19 th Century, legal historians seized on it and attempted to explore this corpus to go back to the source of French law. But largely nourished by fantasies, this approach, which held sway until the beginning of the 20 th Century, gradually ran out of steam on the eve of the First World War. Pro tutela regni: revisiting a royal diploma from 918 on the birth of Normandy and the first 'duc... more Pro tutela regni: revisiting a royal diploma from 918 on the birth of Normandy and the first 'ducal' laws GILDUIN DAVY The Treaty of Saint-Clair-sur-Epte (911) and the cession of Normandy to Rollo have long been considered as evidence of a decline in Carolingian power during the reign of Charles III the Simple. If, during the twentieth century, this view has undergone gradual revision, the role that the king could have played in the process of the Normans' installation on the Seine remains obscure. A review of the relevant royal diplomas, in particular that of 14 March 918, suggests, however, active participation by the king in the emergence of a Norman march in Neustria: that is to say, a political and legal programme intended to reaffirm royal authority over this part of the regnum Francorum. This rereading, based on Frankish texts, on Christian ideology and on the Roman heritage, suggests a new interpretation of the settlement of Scandinavians in Normandy, the emergence of a Norman principality, and the genesis of the famous 'laws of Rollo'.

Son Historia om de nordiska folken amorce en effet une nouvelle perception des peuples scandinaves (principalement les Suédois) dans laquelle est mis en lumière tout un faisceau de valeurs primaires qui configurent leur identité à la fois politique et juridique commune. En tout état de cause, sa description des moeurs et des caractères des anciens nordiques, s'appuyant sur les ressorts propres à l'Humanisme (redécouverte de la théorie des climats, nouvelle approche de l'altérité et de la barbarie notamment), participe à leur intégration au vaste oekoumène européen et, nonobstant les avancées de la Réforme, préfigure les projections idéologiques que Montesquieu, Mallet, Herder et tant d'autres esquisseront deux siècles plus tard. In any case, his description of the customs and characters of the ancient Nordics, based on the springs of Humanism (rediscovery of the theory of climates, new approach of otherness and barbarism in particular), participates to their integration into the vast European oekoumene and, notwithstanding the advances of the Reformation, prefigures the ideological projections that Montesquieu, Mallet, Herder and many others will sketch two centuries later.

Dans l’Islande médiévale, la foi et l’honneur esquissent un « code » de valeurs dont les grandes ... more Dans l’Islande médiévale, la foi et l’honneur esquissent un « code » de valeurs dont les grandes tendances sont la loyauté et la rigueur morale nécessaires tout à la fois au respect d’accords fondés sur la confiance mutuelle et à la cohésion de la société. Fides et honor participent alors d’un système juridique ancien appuyé sur des valeurs primaires de sociabilité qui, dans une Islande si pauvre en institutions exécutives, s’attachent à constamment garantir l’ordre et le tissu social. A la fin du XIIe siècle cependant, l’ère des Sturlungar révèle les carences de ce système primaire et annonce la soumission de l’Islande à la couronne norvégienne.

La question migratoire constitue aujourd’hui un défi pour l’Europe. Réflexe sécuritaire, poussée ... more La question migratoire constitue aujourd’hui un défi pour l’Europe. Réflexe sécuritaire, poussée des nationalismes, les migrants, bien malgré eux, perturbent l’équilibre politique et interrogent l’équilibre juridique. D’autant que les projections effectuées sur les prochaines décennies laissent croire à une amplification des phénomènes migratoires, principalement causés par les déséquilibres géopolitiques et les menaces climatiques et/ou frumentaires. En d’autres termes, le migrant n’a pas fini de quitter le devant de la scène qu’il occupe depuis quelques décennies. Pour autant, peut-être convient-il d’adopter un regard rétrospectif sur l’ambiguïté d’un phénomène plurimillénaire. Migrare, migratio sont en effet des mots largement usités depuis l’Antiquité latine pour nommer les mouvements de population. Mais « migrant » est un mot nouveau, que l’on voit apparaître dans la littérature anglo-saxonne décrivant les phénomènes d’émigration depuis l’Europe (The American Geography, or a view of the present situation of the United States of America, éd. J. Morse, Londres, 1794). Il est cependant ignoré par les dictionnaires francophones jusqu’à l’orée du XIXe siècle, et est par ailleurs absent de textes majeurs tels que la Convention de Genève relative au statut des réfugiés (1951). Ce ne serait alors que sous la pression d’une réalité globale que le mot « migrant » serait progressivement entré, à compter de la fin du XXe siècle, dans les grands textes normatifs internes, internationaux ou européens (par exemple : Règlement no 656/2014 du Parlement européen et du Conseil du 15 mai 2014 relatif à la surveillance des frontières maritimes extérieures). Souvent utilisé à titre de qualificatif (« travailleurs migrants »), le mot se dote progressivement d’une identité substantive pour désigner une catégorie englobante de « personnes migrantes ». Pour autant, le terme « migrant(s) » ne révèle-t-il pas une spécificité juridique particulière ? Un questionnement pluriel et pluridisciplinaire sur le rôle du langage dans la construction des réalités sociales et juridiques nous aidera peut-être à comprendre l’apparition de ce mot dans le vocabulaire du droit. De nos jours, l’histoire est parfois prise à partie et sert d’alibi à des positions outrancières. A en croire certains politiques, le migrant d’aujourd’hui marcherait dans les pas du barbare d’antan et les vagues migratoires mettraient en péril la civilisation occidentale. L’histoire fantasmée est souvent utilisée par les partisans d’une mythologie nationale et ces utilisations erratiques de l’histoire rajoutent à la difficulté qu’éprouve l’historien à franchir les barrières du temps pour déborder son champ disciplinaire. Le comparatisme est-il même de bonne méthode ? Que peut apporter l’historien à la connaissance des pratiques actuelles de l’Europe des nations ? Nicole Loraux a déjà posé la question et défendu, à travers l’anachronisme des concepts, un comparatisme contrôlé qui sollicite le présent pour interroger le passé et qui réciproquement se sert du passé pour comprendre le présent. Le vocabulaire de la norme, à l' émergence du premier Moyen Âge, révèle un champ d' étude immense. Les lois sont désignées à Rome par une terminologie-leges, constitutiones, decreta, man-data, edicta – qui est de moins en moins maîtrisée non seulement par les praticiens mais également par les législateurs eux-mêmes. La difficulté ne vient pas du seul phénomène de désuétude du droit, liée à la méconnaissance de concepts juridiques et à un personnel de moins en moins qualifié. C' est avant tout la preuve d'un bouleversement des sources du droit (ius/leges) et de l'adaptation du système juridique romain, déjà commencée avant la fin de l' empire. Ce mouvement est cependant accentué par la confrontation à d'autres systèmes normatifs, issus des pays anglo-saxons et des traditions germaniques. La terminologie normative issue de ces traditions non romaines (telles que les notions très riches et protéiformes de ae(w) ou lagu par exemple) parait incompatible avec le lexique juridique, finalement rassurant, de la lex romana. La « loi » est donc nécessairement perçue de manière très diverse selon l' époque et la géographie données. Il serait bien prétentieux d' établir un tableau définitif et complet de cette notion en Europe Occidentale pour les IV e – VIII e siècle. Pour se confronter à « l' esprit des lois » de cette période charnière de l'histoire du droit, plusieurs approches seront proposées. La première, objet de cette première journée d' étude, sera consacrée à « l'interprétation qui se fait loi ». L'intention du projet n' est pas de se conformer systématique-ment au cadre proposé par les théoriciens du droit. D'autres approches seront les bienvenues, car elles permettront par leur complémentarité d'appréhender au mieux les normes altimédiévales. L'affirmation de Justinien, extraite d'une constitution (C.J. 1, 14, 12, 3) et devenue depuis un adage: Eius est interpretari legum cuius est condere (« A celui qui a le pouvoir de faire la loi, le pouvoir de l'interpréter »), cache une réalité plus complexe. Le rapport à la loi n' est pas autant sacralisé que dans nos sociétés, notamment depuis le XIX e siècle et l'autorité des législateurs altimédiévaux n'a aucune mesure avec le modèle romain. Quelle est finalement la place accordée à l'auteur de l'interprétation ? Et quel est-t-il ? L'interprétation peut-elle devenir loi, une norme à part entière, sans nécessairement une volonté du législateur ou d'une autorité suprême ? L'interprétation peut-elle être autonome et créatrice de norme sans la volonté de son auteur (l'interprétation peut-elle se faire elle-même loi) ? Peut-on alors encore parler de loi si ces critères initiaux n' existent plus ou deviennent secondaires ? Les interpretationes du bréviaire, les actes de la pratique et les recueils semi-officiels (épitomés) sont des exemples parmi d'autres de l'appropriation de ce rôle d'interprète dont les législateurs depuis le Haut Empire affirment en conserver l' exclusivité.

Les questions sont nombreuses, qui interrogent notamment leur place dans l’arsenal judiciaire existant, leur capacité à s’imposer comme véritable alternative et le danger qu’il y aurait à laisser prospérer de telles justices « à l’ombre de l’Etat ». La critique est ici pleine de sens, et rejoint une de celles qui s’expriment peut-être le plus fortement en terre de civil law. Là où les Anglo-Saxons évoquent et s’emploient à pratiquer une “restorative justice”, le vocabulaire français s’en tient à une prudente médiation envisagée dans le sillage de l’Etat. Les MARC nourrissent donc souvent la critique de la justice, critique encore formulée en leur temps par Villon, d’Aubigné ou Voltaire. Le déploiement des modes dits alternatifs entre aussi en conjonction avec le phénomène d'engorgement de la justice étatique, voire du tout étatique. D'où une dérive du concept. L’objectif du colloque international organisé par l’Université Paris Ouest Nanterre La Défense les 23 et 24 mars 2017, sans renoncer à une analyse technique, sera de privilégier une approche interdisciplinaire en déployant la problématique des MARC dans le temps et l’espace. Son but est de revenir sur ces justices atypiques, souvent décrites comme sans État, de montrer comment les cultures envisagent la résolution de leurs litiges. Il s’agira aussi de restituer le contexte idéologique dans lequel se sont épanouies les Alternative Dispute Resolution, les liens qu’elles entretiennent avec le mouvement critique qui s’est développé de part et d’autre de la Manche. Que penser, dès lors, de la survie des modes traditionnels de règlement des conflits une fois la communauté mise en contact avec un ordre juridique institutionnalisé ? Même dans les pays de common law, n’y a-t-il pas une certaine utopie à croire à la possibilité d’une justice alternative ? L’histoire et l’anthropologie – à l’aune des précédents romains, médiévaux ou modernes (essentiellement coloniaux) – seront ici sollicitées comme exemples capables de répondre à la difficile question de savoir si des pratiques proprement alternatives ont pu exister, si d’autres façons de traiter la litigiosité ont pu se développer à l’écart des institutions.

Le duché de Normandie, dirigé par de fortes personnalités, depuis le chef viking Rollon jusqu’au roi Guillaume, connaît durant cette période un rayonnement sans commune mesure à travers l’Occident chrétien. Au cœur de cette construction, la place de la loi est fondamentale. Elle puise en grande partie dans le legs des traditions carolingiennes, scandinaves et anglo-saxonnes que recueillent les ducs et leur entourage. Sur la base de cet héritage pluriculturel, les textes en provenance du duché soutiennent une idéologie active qui, dès les alentours de l’an Mil, inscrit la dynastie ducale dans une dimension spirituelle prédestinée. Titulaire d’un ministère d’essence divine, le duc de Normandie doit, à l’instar des monarques du IXe siècle, conserver les lois et les coutumes. Il est le garant de la sauvegarde de l’ordre juridique. Dès la fin du Xe siècle, les récits normands étayent les prétentions ducales à révéler, à faire ou à abroger les lois. C’est là toute l’originalité d’une réussite qui annonce, autour de l’an Mil, le renouveau du pouvoir législatif au cœur de la France féodale. En se préservant des ambitions des pontifes grégoriens, mais aussi en se détachant progressivement de l’obédience capétienne, le pouvoir normatif ducal illustre donc l’édification d’une puissance prépondérante qui, forte de la maîtrise de la féodalité et de l’étroite collaboration des dignitaires laïques et ecclésiastiques, assure aux descendants de Rollon une place essentielle au sein des organes édictaux. A cela s’ajoute une influence plus ou moins directe des concepts juridiques antiques, laissant apprécier l’ambiance de romanité qui demeure persistante dans la France du Nord au XIe siècle. Par une association de leurs prérogatives normatives, de leurs ambitions politiques et de leurs succès militaires, par la mise en œuvre d’un ordre public d’une efficacité redoutable, les ducs de Normandie ont jeté les bases de ce que sera, au XIIe siècle, l’Empire anglo-normand. Ils ont aussi, durant les deux siècles qui jalonnent cette étude, contribué à la renaissance de l’idée d’Etat.

Pour autant, peut-être convient-il d’adopter un regard rétrospectif sur l’ambiguïté d’un phénomène plurimillénaire. Migrare, migratio sont en effet des mots largement usités depuis l’Antiquité latine pour nommer les mouvements de population. Mais « migrant » est un mot nouveau, que l’on voit apparaître dans la littérature anglo-saxonne décrivant les phénomènes d’émigration depuis l’Europe (The American Geography, or a view of the present situation of the United States of America, éd. J. Morse, Londres, 1794). Il est cependant ignoré par les dictionnaires francophones jusqu’à l’orée du XIXe siècle, et est par ailleurs absent de textes majeurs tels que la Convention de Genève relative au statut des réfugiés (1951). Ce ne serait alors que sous la pression d’une réalité globale que le mot « migrant » serait progressivement entré, à compter de la fin du XXe siècle, dans les grands textes normatifs internes, internationaux ou européens (par exemple : Règlement no 656/2014 du Parlement européen et du Conseil du 15 mai 2014 relatif à la surveillance des frontières maritimes extérieures). Souvent utilisé à titre de qualificatif (« travailleurs migrants »), le mot se dote progressivement d’une identité substantive pour désigner une catégorie englobante de « personnes migrantes ». Pour autant, le terme « migrant(s) » ne révèle-t-il pas une spécificité juridique particulière ? Un questionnement pluriel et pluridisciplinaire sur le rôle du langage dans la construction des réalités sociales et juridiques nous aidera peut-être à comprendre l’apparition de ce mot dans le vocabulaire du droit.
De nos jours, l’histoire est parfois prise à partie et sert d’alibi à des positions outrancières. A en croire certains politiques, le migrant d’aujourd’hui marcherait dans les pas du barbare d’antan et les vagues migratoires mettraient en péril la civilisation occidentale. L’histoire fantasmée est souvent utilisée par les partisans d’une mythologie nationale et ces utilisations erratiques de l’histoire rajoutent à la difficulté qu’éprouve l’historien à franchir les barrières du temps pour déborder son champ disciplinaire. Le comparatisme est-il même de bonne méthode ? Que peut apporter l’historien à la connaissance des pratiques actuelles de l’Europe des nations ?
