انطلقت في موضوع البيئة من التأصيل للمفهوم ومواءمته للجهاز المفاهيمي الشرعي، إلى التنظير للمقاصد المتعلقة به وإلى تنزيلها وفق الغايات التنموية والسياق العلومي المعاصر، فتحصل من ذلك ثلاثة أنواع من المقاصد: أولها المقاصد التكوينية التسخيرية، وهي المؤطرة لتصورات فقهاء المسلمين في النظر إلى العناصر البيئية بوصفها هبة إلهية إلى البشر لإقامة عمرانهم على الأرض، وثانيها المقاصد التكليفية الأصلية: وهي مرتبة على سابقتها ذلك أنه يتوجب الحفاظ على النظام البيئي إقامة وإبقاء من أجل ضمان استمرار النظام الإنساني، وثالثها: المقاصد التكليفية التنموية ومحورها الأساس هو تنمية الإنسان وتربيته على القيم الإنسانية البيئية في أفق "عدالة بيئية" وتحقيق تضامن إنساني عالمي من أجل حماية النظام البيئي من الانهيار، والحفاظ على السلم العالمي المبني عليه.
I set out on the subject of the environment from the rooting of the concept and its compatibility with the legal conceptual apparatus, to theorizing the purposes related to it and downloading them in accordance with the developmental goals and the contemporary scientific context. Three types of purposes were obtained: the first of which is formative purposes, which frame the perceptions of Muslim jurists in looking at environmental elements as A divine gift to humans to establish their civilization on earth, and the second is the original mandated purposes: they are arranged on the previous one in that the environmental system must be established and maintained in order to ensure the continuity of the human system, and the third: the developmental mandated purposes whose main focus is human development and education on environmental human values in The horizon of "environmental justice" and achieving global human solidarity in order to protect the ecosystem from collapse, and to preserve the global peace that is built on it.

قصد هذا المقال الكشف عن بعض أسرار الفهوم المسيئة للإسلام محاولا معالجة الإشكال بتحديد سببين رئيسين -عن طريق الاستقراء- يرجع إليهما أغلب الانحرافات الفكرية والعملية الواقعة في المجتمعات الإسلامية، أحدهما مترتب عن الآخر:
الأول: هو الخلل في منهج الفهم والتأويل.
والثاني: هو التعسف في تنزيل مقتضيات النص الشرعي.

كتاب ميسر موزع على أربعة فصول: أولها في تاريخ التشريع الإسلامي عموما ومراحله منذ عصر النزول إلى عصر الأئمة المجتهدين، والفصل الثاني تطرقنا فيه لنبذة عن تاريخ المذهب المالكي معرفين بالمذهب وبمؤسسه وبأسباب انتشاره، والفصل الثالث كان هو قطب الكتاب بتضمنه لأصول المذهب المالكي مع التعريف بها وبحجيتها وأمثلتها، والفصل الرابع أوردت فيه القواعد الفقهية الكبرى التي بني عليها الفقه عموما والفقه المالكي خصوصا، وختمت الكتاب بخاتمة ولائحة بأهم المصادر والمراجع المعتمدة في البحث.

من المعلوم عند علماء الحضارات أن العمران هو الوجه المادي لأية حضارة لذلك نجدهم يرجعون في دراسة الحضارات القديمة إلى آثارها العمرانية، فما تبقى من المدن العتيقة يعتبر تجسيدا ولاشك للمنظومة الثقافية –الحضارية التي أنتجتها، وعليه فلا يقل التراث الثقافي أهمية عن التراث العمراني في فهم طبيعة الحضارات الإنسانية، بل يعتبر الأول مفتاحا أساسيا لفهم الثاني لأنه هو الذي أنتجه ونظمه عبر مراحل التاريخ، حتى ترسخ عندهم أن "البنيان من شعار الأمصار"

يتطرق المقال لموقف فقهاء المذهب المالكي من النزعة الظاهرية المتطرفة التي تأخذ بالتأويل الظاهري للنصوص الدينية، وتعارض بها مقاصد وقيم الدين الكبرى، فهذا الاتجاه كان مرافقا للمدارس القانونية منذ النشأة الأولى ، ويعد من أسباب نشوء التطرف في العالم الإسلامي، لذلك تنبه له فقهاء المذهب المالكي في وقت مبكر وحاربوه بحجج علمية قوية، وبتبني المنهج المقاصدي الوسطي.

La escuela Māleki es una de ellas, que se expande en el mundo islámico y tiene una importante influencia sobre el mundo jurídico en los países del occidente islámico (norte y oeste de África) y ha obtenido un lugar considerable en el ámbito de la
organización de la sociedad. Sin embargo, por otro lado, la mayoría de sus fuentes o sus instrumentos del iŷtihad no se conocen bien entre los estudiosos de las ciencias jurídicas modernas, por lo que quisiera aclarar cuáles son las fuentes fundamentales de esta escuela jurídica y elegir algunos ejemplos de su influencia en el actual Código de la familia marroquí (CFM), en el que puede apreciarse con facilidad la aplicación clara de las fuentes Mālekies en el mundo jurídico marroquí moderno. Para ello, parece adecuado –metodológicamente hablando- abordar el tema según los ejes siguientes: en primer lugar, la escuela Māleki: visión histórica, fuentes, y características; y, en segundo extremo, la influencia del Derecho Máliki en el CFM.
