Nicola Lupo is a constitutional law scholar specialized in parliamentary and legislative studies. He is a Professor of Public Law in the Department of Political Science and Director of the Center for Parliamentary Studies (Centro di studi sul Parlamento) at LUISS Guido Carli University in Rome. PhD from the University of Florence, he has been advisor to the Chamber of Deputies (1997-2005), member of the Simplification Unit (2006-2008), law clerk at the Constitutional Court (2013-2015) and advisor to the Minister of Economy and Finance (2018-2019).From September 2021 to March 2023, he has coordinated - appointed by the Italian Prime Minister Mario Draghi the “Better Regulation Unit ” (Unità per la razionalizzazione e il miglioramento della regolazione), for the purpose of implementing the National Recovery and Resilience Plan (Piano Nazionale di Ripresa e Resilienza, NRRP).He has been the holder of a Jean Monnet Chair on “Understanding European Representative Democracy” (2018-2021) and visiting professor at several universities. He directed the Joint Master Erasmus in Parliamentary Procedures and Legislative Drafting-EUPADRA (2016-2020).He has recently published a book “The Constitution of Italy. A contextual analysis" (with Marta Cartabia, Hart, 2022) and, in Italian, a textbook on parliamentary law “Corso di diritto parlamentare" (with Luigi Gianniti, IV ed., Il Mulino, 2023) and “Il Parlamento europeo. After recalling the main features of the EU representative democracy in Europe as depicted by Art... more After recalling the main features of the EU representative democracy in Europe as depicted by Article 10 TEU and their origins, and noticing that neither the word “democracy” nor the word “parliament” was quoted in the original Treaties, this contribution explores the existing mechanisms of representative democracy to determine whether they are sufficient to effectively channel the different forms of dissensus that emerge in EU policymaking.
The main argument is that the two existing mechanisms of representative democracy –
one based on the European parliament (EP) and the other on national parliaments, which
may be involved in instruments of interparliamentary cooperation – are not always able to channel and transmit the many dissenting voices existing in the EU or give them adequate consideration in policy-making processes.
This is due to the origins of the EU as an international organisation and to its reliance
on institutions that were initially lacking enough democratic and political features. The recent trend towards democratisation and politicisation of EU institutions is thus welcome but incomplete and it reveals many of the ambiguities on which the EU has relied for a long time (e.g., the habit of appointing politicians who have recently been defeated in national elections as leaders of EU institutions). These ambiguities are, of course, often the object of further criticisms and dissenting voices raised towards EU institutions and policies.
In addition, national electoral cycles are usually not synchronised with the EP elections,
making it almost impossible to enforce the principle of political responsibility of the many
executives coexisting in the EU, and increasing the risks of disconnection and arrhythmias in the functioning of the EU representative democracy.

Questo metodo, fondato su un’interpretazione creativa delle basi giuridiche, assegna risorse comuni, sotto forma di sovvenzioni e prestiti, in base ai Piani nazionali per la ripresa e la resilienza (PNRR) proposti dagli Stati membri e approvati dal Consiglio. Il disegno, l’attuazione e la modifica di questi Piani richiedono un intenso e continuo dialogo bilaterale tra la Commissione e il Governo di ciascuno Stato membro.
Nei primi tre anni di attuazione, si stanno così efficacemente coordinando riforme e investimenti nell’Unione, e soprattutto negli Stati membri che hanno presentato PNRR più ambiziosi e impegnativi, tra cui quello italiano. La figura di Gordon Brown è sicuramente tra quelle di maggior rilievo sulla scena politica del Regno Unito nell’ultimo trentennio. Anche al di là del governo da lui presieduto, durato poco meno di tre anni (27 giugno 2007-11 maggio 2010), Brown ha giocato un ruolo importante, spesso decisivo, all’interno del partito laburista, prima nel delineare la piattaforma vincente del New Labour e poi, per oltre un decennio, quale cancelliere dello scacchiere nei governi presieduti dal suo amico-alleato-rivale Tony Blair (2 maggio 1997-27 giugno 2007). Nel complesso, sembra stagliarsi una figura dai contorni per certi aspetti tragici (nel senso alto della parola). In particolare, il rapporto lungo, stretto e controverso con una figura, come quella di Tony Blair, leggermente più giovane, molto più telegenica, della cui eredità politica Brown non è riuscito a liberarsi, si presta facilmente a una rappresentazione in termini tragici. Se poi si aggiunge lo sfortunato intreccio temporale con la crisi economico-finanziaria, il cui scoppio segue di pochi mesi l’inizio del suo agognato mandato da premier, mentre all’indomani dell’avvio del governo Blair si era verificata la scomparsa di Lady Diana, che come è noto il nuovo Premier ben seppe cavalcare di fronte all’opinione pubblica, il quadro diventa ancora più a tinte forti. Forse paragonabile soltanto, nell’immaginario collettivo, alla rivalità tra i due fratelli Miliband, David e Ed – neanche a farlo apposta l’uno special adviser di Blair e l’altro di Brown nel primo governo Blair – che ha contraddistinto la lotta per la leadership del partito laburista, all’indomani dell’abbandono di Brown. Quasi a proseguire, appunto, una fratellanza-rivalità dalla durata ultradecennale.

Per la prima volta al mondo, un’organizzazione internazionale si trasformava in un “ordinamento”, stabilendo un legame immediato con i cittadini elettori. Per troppo tempo, però, le elezioni del Parlamento europeo sono state considerate come un appuntamento di secondaria importanza: una specie di termometro per misurare la temperatura politica “di casa”. Oggi non è più così: il Parlamento dell’Unione è diventato il terreno decisivo di scontro e confronto tra sostenitori e oppositori dell’integrazione europea. L'obiettivo è mostrare in che misura gli equilibri di ciascuno Stato siano influenzati dai processi decisionali che si svolgono nell'Unione. E, reciprocamente, quanto l'indirizzo politico europeo tragga il suo alimento, e, spesso, la sua direzione dalle dinamiche istituzionali che hanno luogo negli Stati membri. Scritti da studiosi di diritto costituzionale italiano, comparato ed europeo, i saggi che lo compongono esaminano l'evoluzione delle forme di governo degli Stati membri in rapporto agli sviluppi del processo di integrazione europea. Al contrario l’abuso della decretazione d’urgenza in Italia non è affatto terminato e l’emergenza continua ad essere «infinita». A dispetto della straordinaria necessità ed urgenza richieste dall’art. 77 della Costituzione, la prassi indica che in Italia, da oltre trent’anni ormai, esiste un tasso di decretazione d’urgenza che rimane sorprendentemente costante (circa quattro decreti al mese) al variare dei periodi storici e dei Governi. Qual è la dimensione attuale dell’abuso? Quali garanzie per la legalità costituzionale e per i cittadini? Ma, soprattutto, a quale funzione strutturale nell’azione di governo oggi risponde il decreto-legge? The contribution examines the evolution of the regulation of parliamentary groups in the Italian ... more The contribution examines the evolution of the regulation of parliamentary groups in the Italian Chamber and Senate. The analysis moves from the very first provisions regulating this matter, that were introduced in 1920 under the Albertine Statute. Then, the contribution explores the reactivation of the regulation of parliamentary groups at the dawn of the Italian Republican experience, investigating its subsequent transformations, till today. Some concluding remarks are devoted to perspectives and recent reform proposals, especially those deriving from the constitutional amendment on symmetric bicameralism approved in 2016 (currently subject to a referendum). This reform aims at introducing a new Senate, that would represent territorial autonomies and exercise, among others, a " connecting function " , thus requiring an appropriate balance of the political cleavage with the territorial and institutional ones.
Conference subject-matter Constitutional adjudication has expanded almost throughout the globe an... more Conference subject-matter Constitutional adjudication has expanded almost throughout the globe and taken a transnational dimension and yet it has come into increased scrutiny and attacks. There have been some traditional boundaries controversies, involving the relationship between the constitution and politics, that have become more acute due to several challenges, including populism and illiberal ideologies. In addition, social movements have always interacted with the perception of constitutional norms and their adjudication. In the United States, for example, culture wars started in the 1970's and 1980's intensified popular focus on key constitutional decisions. With globalization the same culture wars have become virtually worldwide and the judicial fora where they are litigated have also expanded on a transnational scale. In the face of such challenges, constitutional adjudication has adopted a common standard nearly worldwide, namely the principle of proportionality. Is this development sufficient for the constitutional adjudicator to accommodate or tame these proliferating conflicts? Preferential topics to be addressed Within the frame of the conference subject-matter, we particularly welcome proposals addressing the role of constitutional adjudication in striking a balance between unity and pluralism. One of constitutional adjudication's main tasks within a legal order is to provide a unifying effect. On the other hand, constitutional adjudication plays a pivotal role in the protection of fundamental rights. In today's predicament, which is characterized by pluralistic societies, the reconciliation between unity of the legal order and equal rights for all constitutes a major challenge. Le democrazie parlamentari stanno vivendo una crisi di rappresentanza di fronte a nuove istanze d... more Le democrazie parlamentari stanno vivendo una crisi di rappresentanza di fronte a nuove istanze di democrazia diretta e a una maggiore centralità del governo: basta tutto questo per assestare un colpo mortale al Parlamento? Possono le nuove tecnologie, i soli governi e gli esperti colmare il vuoto delle assemblee rappresentative?
Sono queste alcune delle domande cui proveremo a dare risposta, venerdì 14 dicembre al Campus Luigi Einaudi, in dialogo con alcuni dei più autorevoli studiosi di diritto costituzionale e con rappresentati apicali delle istituzioni italiane.
L’iniziativa, dal titolo “Ripensare il Parlamento”, rappresenta la III edizione della giornata di studi sull’ordinamento costituzionale promossa dal CEST, dopo quelle del 2016 e del 2017 sulle riforme della Costituzione e delle istituzioni.

The bilingual Special issue on national parliaments and European challenges (Les parlements des E... more The bilingual Special issue on national parliaments and European challenges (Les parlements des Etats membres face au(x) défi(s) européen(s)) Kolja Raube and I have co-edited - which also includes articles by Pierre Schmitt Cristina Fasone Tacea Angela Yoav Shemer Kunz Jan Wouters Nicola Lupo - is now online. It addresses issues such as the participation of MEPs in national parliaments, the role of committees post-crisis, parliamentary activity in the JHA domain and the potential of upper chambers as vectors of participation in the EWS for regional parliaments. The questions of national parliaments' nature as European actors, and interparliamentary cooperation in CFSP are also touched upon. The main argument is that the two existing mechanisms of representative democracy –
one based on the European parliament (EP) and the other on national parliaments, which
may be involved in instruments of interparliamentary cooperation – are not always able to channel and transmit the many dissenting voices existing in the EU or give them adequate consideration in policy-making processes.
This is due to the origins of the EU as an international organisation and to its reliance
on institutions that were initially lacking enough democratic and political features. The recent trend towards democratisation and politicisation of EU institutions is thus welcome but incomplete and it reveals many of the ambiguities on which the EU has relied for a long time (e.g., the habit of appointing politicians who have recently been defeated in national elections as leaders of EU institutions). These ambiguities are, of course, often the object of further criticisms and dissenting voices raised towards EU institutions and policies.
In addition, national electoral cycles are usually not synchronised with the EP elections,
making it almost impossible to enforce the principle of political responsibility of the many
executives coexisting in the EU, and increasing the risks of disconnection and arrhythmias in the functioning of the EU representative democracy.
Nei primi tre anni di attuazione, si stanno così efficacemente coordinando riforme e investimenti nell’Unione, e soprattutto negli Stati membri che hanno presentato PNRR più ambiziosi e impegnativi, tra cui quello italiano. L'attuazione del PNRR italiano si è inoltre strettamente intrecciata con le dinamiche politiche, e in particolare con il passaggio dal Governo Draghi al governo Meloni, a seguito delle elezioni del settembre 2022, e offre perciò un test particolarmente indicativo sui caratteri di questo nuovo “metodo di governo”.

5. La sconfitta alle elezioni del 2010 e le posizioni più recenti.
La figura di Gordon Brown è sicuramente tra quelle di maggior rilievo sulla scena politica del Regno Unito nell’ultimo trentennio. Anche al di là del governo da lui presieduto, durato poco meno di tre anni (27 giugno 2007-11 maggio 2010), Brown ha giocato un ruolo importante, spesso decisivo, all’interno del partito laburista, prima nel delineare la piattaforma vincente del New Labour e poi, per oltre un decennio, quale cancelliere dello scacchiere nei governi presieduti dal suo amico-alleato-rivale Tony Blair (2 maggio 1997-27 giugno 2007).
Nel complesso, sembra stagliarsi una figura dai contorni per certi aspetti tragici (nel senso alto della parola). In particolare, il rapporto lungo, stretto e controverso con una figura, come quella di Tony Blair, leggermente più giovane, molto più telegenica, della cui eredità politica Brown non è riuscito a liberarsi, si presta facilmente a una rappresentazione in termini tragici. Se poi si aggiunge lo sfortunato intreccio temporale con la crisi economico-finanziaria, il cui scoppio segue di pochi mesi l’inizio del suo agognato mandato da premier, mentre all’indomani dell’avvio del governo Blair si era verificata la scomparsa di Lady Diana, che come è noto il nuovo Premier ben seppe cavalcare di fronte all’opinione pubblica, il quadro diventa ancora più a tinte forti. Forse paragonabile soltanto, nell’immaginario collettivo, alla rivalità tra i due fratelli Miliband, David e Ed – neanche a farlo apposta l’uno special adviser di Blair e l’altro di Brown nel primo governo Blair – che ha contraddistinto la lotta per la leadership del partito laburista, all’indomani dell’abbandono di Brown. Quasi a proseguire, appunto, una fratellanza-rivalità dalla durata ultradecennale.

It illustrates how parliamentary interactions within the European Union are highly systematic, with integrated procedures and mutual interdependence between the various institutions and stakeholders. The book argues that this dynamic is vital for both the functioning and the future equilibrium of democracy in the EU. This is significant, particularly given the challenges posed to democracy within the EU institutions and the Member States. Notwithstanding its peculiarities (a symmetrical bicameral system in which both Houses are directly elected, hold the same powers and are linked through a confidence relationship with the government), the Italian Parliament deserves specific attention as a lively active player of the European polity. The grid for its analysis proposed by this collection may also be applied to other national parliaments, so contributing to the development of comparative research in this field.
Notwithstanding its peculiarities (a symmetrical bicameral system in which both Houses are directly elected, hold the same powers and are linked through a confi dence relationship with the government), the Italian Parliament deserves specifi c attention as a lively active player of the European polity. Da questi interrogativi nasce il presente volume che raccoglie le osservazioni di alcuni tra i maggiori studiosi di diritto costituzionale. L’introduzione del giudice della Corte costituzionale Ugo De Siervo e la postfazione del giudice emerito della stessa Enzo Cheli uniscono i contributi di Andrea Simoncini, Cesare Pinelli, Giovanni Pitruzzella, Alfonso Celotto, Roberto Romboli, Filippo Vari, Andrea Pugiotto, Nicola Lupo, Laura Lorello, Alessandra Concaro, Giovanni Di Cosimo e Ana Maria Carmona Contreras, ai quali si aggiunge un’appendice di aggiornamento di dati e statistiche sull’utilizzo della fonte del decreto-legge.
Sono queste alcune delle domande cui proveremo a dare risposta, venerdì 14 dicembre al Campus Luigi Einaudi, in dialogo con alcuni dei più autorevoli studiosi di diritto costituzionale e con rappresentati apicali delle istituzioni italiane.
L’iniziativa, dal titolo “Ripensare il Parlamento”, rappresenta la III edizione della giornata di studi sull’ordinamento costituzionale promossa dal CEST, dopo quelle del 2016 e del 2017 sulle riforme della Costituzione e delle istituzioni.
