I principi supremi dell’ordinamento sono una categoria enigmatica del diritto costituzionale, che... more I principi supremi dell’ordinamento sono una categoria enigmatica del diritto costituzionale, che ricomprende gli esiti di elaborazioni teoriche eterogenee. Tracce di questa nozione emergono nella giurisprudenza e nella letteratura giuridica sui limiti alla revisione costituzionale, nonché in materia di rapporti tra fonti interne e diritto concordatario, internazionale e dell’Unione Europea. A partire dai fragili frammenti testuali offerti dal diritto positivo, giurisprudenza e dottrina hanno seguito percorsi ricostruttivi non sempre lineari, recentemente culminati in una importante pronuncia (Corte cost. 238/2014). Attorno al concetto rimane tuttavia un alone di incertezza, che già si apprezza a livello terminologico (si parla indistintamente di “principi supremi”, “fondamentali”, “essenziali”, “controlimiti”). L’indagine proposta si è ispirata a un approccio metodologico inedito, privilegiando l’osservazione dinamica dei principi supremi in azione, e basandosi non solo sul materiale offerto dalla giurisprudenza costituzionale, ma anche dalla prassi presidenziale. L’analisi ha quindi recuperato una dimensione teorica della nozione di “principio supremo”, valutandone la tenuta nelle dinamiche del bilanciamento tra principi e collocandola infine nel cuore delle dottrine del costituzionalismo, classicamente inteso come limite giuridico al potere.

The article explores the historical roots of the explicit unamendable clause(s) in the Italian Co... more The article explores the historical roots of the explicit unamendable clause(s) in the Italian Constitution. Following, it explores the scholarly debate over the interpretation of unamendable provisions. The article investigates theories of implicit unamendability of the Italian Constitution, and, in particular, it analyses the crucial role played by the Constitutional Court of Italy (ICC) and the principles that characterize Italian constitutional identity. Furthermore, the article explores the other side of constitutional identity, namely the theory of 'counterlimits.' The ICC specified that constitutional identity not only sets a limit to constitutional amendment powers but also sets 'counterlimits' to the entry of external norms (i.e., supranational and international law) in the domestic legal system. Finally, the article draws some conclusions and argues that the two sides of constitutional identity, although legally and logically independent, mutually reinforce each other and, ultimately, reinforce the counter-majoritarian nature of unamendability.
This article focuses on State-Church relations and on the peculiar implementation of the “idea of... more This article focuses on State-Church relations and on the peculiar implementation of the “idea of secularism” in Italy. The article firstly compares the formal constitutional provisions of the 1848 Constitution. Then, it investigates constitutional provisions entered into force in 1948. Finally, the paper investigates how actors of the living constitution tried to balance and develop the potentially conflicting principles included in the 1948 Constitution in the field of religious freedom, equality, and State-Church relations. The article explores three particularly controversial examples: the teaching of religion in state schools; the display of the crucifix in classrooms; and state funding mechanisms of religious denominations. The article main claim is that, with regard to the regulation of religion in Italy, the proper paradigm shifts did not occur within the formal constitution, but in the “living constitution”.

In the first section, it describes why identity questions matter, particularly in Europe. In the second section, the Article tackles the issue of multiple structural ambiguities affecting the concept of constitutional identity in the European constitutional vocabulary. In the third section, the Article explores trends concerning the use of constitutional identity in the European legal discourse and practice, including the development of alternative interpretations and applications of the notion of constitutional identities in the Member States. The fourth section of the Article combines the analytical accounts outlined in the second section with the trends identified in the third section, contending that different conceptions and applications of constitutional identity have varying effects on the European composite constitutional adjudication system and that the institutional and procedural framework should be calibrated accordingly. The final section of this Article draws some conclusions.

With its decision no. 35 of 2017, the Italian Constitutional Court (hereafter: ‘the Court’ or ‘the Constitutional Court’) struck down significant parts of the electoral law for the Chamber of Deputies, as approved by Parliament in 2015. The transition of the Italian electoral system from a proportional to a majoritarian system of representation has once again been called into question, only a few weeks after a broad proposal for constitutional reform, initiated by the Government and approved by the Parliament, was finally rejected by the electorate with a referendum held on 4 December 2016. In fact, the decision of the Court has a direct precedent in a judgment it issued in 2014 that opened the Court up to adjudicating, striking down and substantially re-rewriting the core of electoral law for the first time in its jurisprudence. This case note consists of three sections. First, it provides a short overview of tumultuous recent developments in the matter of electoral legislation in Italy. Second, it describes the electoral system for the Chamber of Deputies that was introduced by parliamentary majority within the context of a broader project of institutional reform in 2015 and illustrates the Constitutional Court’s decision on it. Finally, the case note explores the meaning of this decision from two broader perspectives: first, it reflects on the decision from a comparative angle. Second, and finally, the case note contextualises the decision within the framework of the incomplete process of transition that seemed to lead the Italian political landscape from a proportional representation system to a majoritarian one.

Secondly, the report contains a narrative exposition of two particularly important controversies that occurred in 2016. In these decisions, the Italian Constitutional Court (ICC) actively engaged as the supranational dimension of constitutional law, showing at the same time a high level of compliance to the principle of openness towards supranational and international law, and a firm stance in upholding the complex substantive and institutional balance of the Italian Constitution. The report then provides an overview of landmark judgments adopted by the ICC in 2016. The last section draws some conclusions.

Il rinvio riguarda una complessa vicenda che aveva già impegnato la Corte di giustizia, ove vi è una tensione tra garanzie processual-penalistiche dell’ordinamento italiano (e in particolare del regime della prescrizione) e interessi finanziari dell’UE. L’articolo analizza l’articolata vicenda, nonché individua alcune criticità dell’ordinanza di rimessione.

Dapprima l’articolo ripercorre la narrazione classica dei controlimiti, esclusivamente focalizzata sulla giurisprudenza delle Corti costituzionali nazionali, e in particolare di alcune di esse. Si argomenta successivamente il motivo per cui questo approccio tradizionale può essere inadeguato ad apprestare una salvaguardia sufficientemente efficace di elementi peculiari dell’identità costituzionale che sono propri soltanto di alcuni Stati membri e non fanno parte di un condiviso patrimonio costituzionale europeo. A partire dal riconoscimento di questa inadeguatezza, si indagheranno quali alternative esistano per tutelare tali peculiarità. Tra queste l’articolo considera la sottrazione di alcune materie dalle competenze dell’Unione europea o comunque dall’applicazione del metodo comunitario, nonché l’applicazione della regola dell’unanimità in procedimenti decisionali riguardanti materie potenzialmente sensibili per l’identità costituzionale nazionale. Quindi l’articolo considera alcune esperienze significative di integrazione differenziata, con l’intento di verificare se gli interessi tutelati da quelle esperienze abbiano una qualche corrispondenza con quelli tutelati dalle Corti, riscontrando ampie zone di sovrapposizione. Infine, si indagheranno alcuni recenti passaggi che sembrano suggerire l’avvio di una nuova fase della storia dell’identità costituzionale nazionale, tanto nel circuito giurisdizionale del c.d. dialogo tra Corti (casi Gauweiler, Signor R. e Taricco), quanto nella gestione politica dei conflitti attorno a interessi nazionali fondamentali (con la vicenda Brexit).

Nel lavoro si muove dal presupposto, tratto dalla giurisprudenza costituzionale, per cui non tutti gli istituti nei quali i principi supremi si estrinsecano vanno assunti a rango di “controlimite”. È invece il loro solo nucleo essenziale a non cedere di fronte al primato del diritto dell’UE. Proseguendo lungo tale direttrice, si analizza l’istituto della prescrizione, per capire se la sua disciplina rientri a pieno titolo nel nucleo centrale di tutela offerto dal principio del nullum crimen, nulla poena sine lege di cui all’art. 25, secondo comma, Cost., ovvero se ne rappresenti un aspetto meramente accidentale.
EN The referral orders submitted to the Italian Constitutional Court, aiming at avoiding the application of the Taricco ruling by the Court of Justice of the European Union, trigger challenging questions related to the fundamental principles of the Italian Constitutional order. This contribution is based on the assumption that not all those legal tools that are somehow connected with the fundamental principles of the constitutional order are to be considered as limits to the principle of primacy of EU law. On the contrary, it is only the essential core of these principles that may resist against the principle of primacy of EU law. Moving from this consideration, the contribution analyzes the statute of limitation, exploring the possibility – on the one hand – to include this legal institution under the umbrella of the constitutional principle of nullum crmien sine poena sine lege, enshrined by Article 25 of the Italian Constitution, or – on the other hand – of considering the statute of limitation as a mere accidental manifestation of this principle and thus located out of its essential core.
This article analyses the impact of the economic crisis on the Constitutional Court's role in the... more This article analyses the impact of the economic crisis on the Constitutional Court's role in the Italian legal order, particularly focussing on the paradox of a Court that is at the same time subject to the Rule of Law and guardian of the Rule of Law. This article argues that this paradox emerges in a clear manner when the Court is called to rule on austerity measures. To do this, the article analyses the main, unprecedented developments that affected the 'unwritten constitution' during the times of euro crisis. The article illustrates a first season of the Constitutional Court's case law on the crisis legislation (2011-2014), characterized by a cautious and partly ambiguous approach. Subsequently, the article illustrates the latest developments in the Court's case law. The article goes into the details of three recent and notable judgements, revealing a new approach of the Court to the crisis legislation. This article argues that unlike a wide perception, the economic crisis affected the Constitutional Court' role in a very significant manner. More specifically, this paper argues that the Court's recent decisions to overrule its settled case law with regard to the temporal effects of its judgements raise serious concern with regard to the adherence to the Rule of Law.

Moving from this consideration, the contribution analyzes the statute of limitation, exploring the possibility – on the one hand – to include this legal institution under the umbrella of the constitutional principle of nullum crmien sine poena sine lege, enshrined by Article 25 of the Italian Constitution, or – on the other hand – of considering the statute of limitation as a mere accidental manifestation of this principle and thus located out of its essential core.
This article analyses the impact of the economic crisis on the Constitutional Court's role in the... more This article analyses the impact of the economic crisis on the Constitutional Court's role in the Italian legal order, particularly focussing on the paradox of a Court that is at the same time subject to the Rule of Law and guardian of the Rule of Law. This article argues that this paradox emerges in a clear manner when the Court is called to rule on austerity measures. To do this, the article analyses the main, unprecedented developments that affected the 'unwritten constitution' during the times of euro crisis. The article illustrates a first season of the Constitutional Court's case law on the crisis legislation (2011-2014), characterized by a cautious and partly ambiguous approach. Subsequently, the article illustrates the latest developments in the Court's case law. The article goes into the details of three recent and notable judgements, revealing a new approach of the Court to the crisis legislation. This article argues that unlike a wide perception, the economic crisis affected the Constitutional Court' role in a very significant manner. More specifically, this paper argues that the Court's recent decisions to overrule its settled case law with regard to the temporal effects of its judgements raise serious concern with regard to the adherence to the Rule of Law.
Oggetto del presente contributo sono le disposizioni concernenti il sistema elettorale per il Sen... more Oggetto del presente contributo sono le disposizioni concernenti il sistema elettorale per il Senato della Repubblica contenute nel testo di legge costituzionale approvato dalle Camere in seconda deliberazione il 12 aprile 2016, nella prospettiva del loro impatto (potenziale o verosimile) sull’autonomia politica delle Regioni e delle Province autonome. Preliminarmente all’analisi delle disposizioni concernenti il sistema elettorale del Senato, sembra opportuno sottolineare un profilo che si ritiene assolutamente centrale, sia in senso generale sulla composizione del “nuovo” Senato, sia nello specifico in relazione al suo sistema di elezione: com’è noto, la composizione del “nuovo” Senato prevede la necessarietà del cumulo tra il mandato senatoriale e quello regionale o locale, in quanto sono eleggibili a senatori unicamente – al di là dei cinque senatori di nomina presidenziale e degli ex Presidenti della Repubblica, componenti di diritto – i consiglieri regionali e, nella misura di uno per ciascuna Regione o Provincia autonoma, i sindaci dei comuni dei rispettivi territori. Tale soluzione ha consentito di ricondurre a coerenza due dei punti fermi sulla base dei quali è stata modellata la composizione del nuovo Senato, quali la sua trasformazione in un’Assemblea a elezione indiretta e l’eliminazione delle indennità per i suoi membri. La congiunzione tra questi due aspetti ha costituito il punto di partenza per giungere alla definizione della composizione del Senato riformato: un’Assemblea basata non solo sulla elezione indiretta, ma anzi sul necessario cumulo di mandati rappresentativi o di governo presso le autonomie regionali o comunali (ossia gli unici livelli territoriali nei quali permangono organi eletti direttamente dai cittadini). Il necessario cumulo di mandati ha infatti consentito di giungere contestualmente a due obiettivi annunciati sin dal titolo del disegno di legge governativo, ossia la “riduzione del numero dei parlamentari” (consistente in realtà in una riduzione dei “soli” senatori, posto che i deputati restano 630) e la “riduzione dei costi della politica”, consistente almeno nella eliminazione della indennità per i senatori, come pure dei “rimborsi o analoghi trasferimenti monetari recanti oneri a carico della finanza pubblica in favore dei gruppi politici presenti nei Consigli regionali”, nonché della fissazione del limite agli emolumenti per i consiglieri regionali pari all’importo di quelli attribuiti ai sindaci dei Comuni capoluogo di Regione. Questo punto di osservazione sulle disposizioni che delineano la composizione e il sistema di elezione del Senato non può essere ignorato. La trasformazione della seconda Camera e la specifica opzione relativa alla sua composizione devono essere lette anche alla luce dell’intenzione del legislatore di revisione costituzionale di “portare al centro” soggetti già investiti da un mandato rappresentativo (e, eventualmente, di governo) negli organi degli enti territoriali, e regionali in particolar modo. In questa maniera si è creato, mediante una sorta di “unione personale” dei mandati senatoriale e territoriale, un collegamento diretto e necessario tra rappresentanza “nei” territori e rappresentanza “dei” territori, avendo come obiettivo parallelo la costituzione di premesse per una reciproca convergenza dei fini e dei mezzi, nell’auspicio di ridurre la conflittualità tra livelli di governo. Tuttavia, alla luce di quanto descritto, va valutata sin dal principio la possibilità che da questa scelta di fondo, che informa l’intero impianto della revisione costituzionale, derivi una compressione dell’autonomia politica regionale, e in particolare dell’autonomia legislativa delle Regioni, almeno nel senso di una riduzione della possibilità di autonoma decisione circa i destini del mandato rappresentativo regionale, quantomeno per quei consiglieri che saranno chiamati a ricoprire anche l’incarico senatoriale, nonché del suo intreccio con il regime delle ineleggibilità e incompatibilità.

The Article analyses the role played by the German Federal Constitutional Court (BVerfG) in the European integration process. Building on German positive (constitutional) law, the Article argues that the Grundgesetz should be considered one of the Constitutions of European Member States that are more open to international and EU law. Nonetheless, the BVerfG long played as a reluctant actor in the so-called judicial dialogue. This article focuses on multiple contradictions emerging from the role played by the BVerfG and analyses the ever-changing impact of its " European " case law on the development of the European integration process.

In questi anni (1944-1955) Crisafulli fu il " costituzionalista di riferimento " del Partito comunista. Il suo impegno politico, che fu anche diretto, si espresse attraverso numerosi articoli pubblicati sul quotidiano e sui periodici del partito, ma anche in pareri resi direttamente a Palmiro Togliatti. Tutti gli scritti (e le riproduzioni fotografiche dei pareri inediti) di questo periodo, che sono di grande spessore e talvolta di sorprendente attualità, sono stati per la prima volta raccolti e resi disponibili in questa Antologia e nel sito ad essa collegato.
The special issue firstly explores the relationships between national constitutional judges and s... more The special issue firstly explores the relationships between national constitutional judges and supranational courts, both the ECJ and the European Court of Human Rights, as grounds of cooperation, competition and sometimes of conflict. In the first section of the special issue, Paris deals with this issue from the perspective of EU Member States’ constitutional courts’ case law on the limits to the primacy of EU law. Through a comparative analysis the author shows that important similarities can be detected in this jurisprudence. Moreover, if constitutional review of EU law is performed by constitutional courts in a cooperative manner vis-à-vis the ECJ and within certain boundaries as for the disapplication of EU law, it can even foster the creation of a European legal space where the protection of fundamental rights and of the rule of law across the Member States and in the EU is enhanced while national peculiarities are preserved. Alessia Cozzi’s essay deals with a hypothesis of silent coordination of the fora of constitutional adjudication. Cozzi investigates decisions of national supreme and constitutional courts that implicitly follow a previous European Court on Human Rights (ECtHR) judgment without explicitly referring to it. Her article aims at understanding in which cases this implicit coordination is performed and why national courts are reluctant to make this approach explicit, hiding a successful coordination and turning a battleground into a meeting ground without emphasizing this transformation. Finally, the third essay of the first section deals with the interesting case study of the Belgian Constitutional Court, placed in a comparative perspective. It raises a problem of general and systematic interest for the identification of a system of constitutional adjudication in the EU and the exploration of its procedures and challenges. This case study is extremely promising, as little research has examined whether constitutional courts employ the same strategies applied domestically, when violations of European and international law occur through legislative omissions. Omissions may be an insidious battleground for national and supranational courts, and Verstraelen’s article demonstrates a versatile approach of Member States’ constitutional courts in order to accommodate the potential fragmentation of national judges’ responses with the need to ensure unity and uniformity of EU law. The second section of the special issue is devoted to test the model of the composite European constitutional adjudication under pressure. The Euro-crisis offered an ideal stress test. Whereas legal analysis on the constitutional dimensions of Euro-crisis abounded, some specific aspects of this picture were overlooked also in those jurisdictions where the Euro-crisis had a remarkable impact. A first underestimated aspect concerns the role played by lower courts, often contradicting supreme and European courts. Pavlidou’s article addresses this vastly overlooked aspect, by examining how domestic lowest courts in Greece safeguarded social rights by resorting to alternative constitutional sources and by indirectly enforcing constitutional provisions in order to constitutionalize social rights. Her essay juxtaposes this practice to the opposite interpretation of austerity measures by the European and Supreme Greek courts. In light of this, she analyzes the implications of this contradictory judicial review both in terms of the scope of social rights and conceptions of unity and diversity within the multiple levels of adjudication. Another vastly overlooked aspect in the Euro-crisis scholarship is the absence of preliminary references to the ECJ for the ‘harmonization’ of social rights adjudication stemming from the same supranational instruments. Constitutional courts were eager to solve cases by invoking solely their own constitutional interpretation and standards. Pierdominici’s article tries to fill this gap in the scholarship, questioning constitutional courts’ reluctant approaches toward preliminary references aimed at guaranteeing (European) standards of protection of social rights. Fasone’s essay is devoted to look at the impact of constitutional adjudication on Euro-crisis measures on the role of legislatures, in this critical conjunction, to ascertain whether common challenges to representative democracy have led to unitary or plural (and divergent) judicial responses to the issues of Parliaments’ displacement in Euro-crisis procedures. In particular, the article investigates in this framework how constitutional courts have resorted to the argument of the national constitutional identity showing that, due to several circumstances, the protection of parliamentary powers and, ultimately, of the principle of representative democracy has been of little concern for most constitutional courts in such a critical juncture. After having tested current trends of constitutional adjudication on the battleground of Euro-crisis measures, the third section of the special issue explores possible procedures and remedies to settle emerging conflicts. In this section, Andrea Edenharter claims that in the long run, a legal reconciliation within the EU can only be achieved if national courts enjoy at least some discretion in cases in which EU law allows for the application of national fundamental rights, because otherwise, national constitutional courts might challenge the ECJ’s role as Supreme Court of the EU and thus damage the project of reconciliation as such. Edenharter’s essay deals with the core problem of the possible existence of a system of constitutional adjudication in the area of fundamental rights review. In this respect, her article analyses two possible legal tools that may facilitate the function of such a system of constitutional adjudication. On the one hand, the margin of appreciation doctrine developed by the ECHR should be adopted by the ECJ. On the other hand, the principle of discretion can also be applied in favor of the ECJ, with national constitutional courts reducing the intensity of scrutiny towards the ECJ in accordance with the German Federal Constitutional Court’s position in Honeywell. Zaccaroni’s paper deals with the need of reconciliation of Member States’ constitutional identities and EU law from a different perspective. His article holds this reconciliation as a necessary assumption to make a system of constitutional adjudication workable in the EU. The essay emphasizes the contribution of some recent decisions of the EU for the identification of the concept of EU constitutional identity. Zaccaroni’s aim is to assess how to reconcile the theoretical position of the ECJ with the one of the national constitutional courts, and in particular, the possibility to reconcile the pluralism of national constitutional identities with the (desired) unity of the EU constitutional identity. His essay investigates two possible solutions: a) a clear theorization of an evolutionary interpretation of the principle of conferred powers; b) a real judicial cooperation between EU and national constitutional judges. In the latter perspective, Zaccaroni claims that constitutional courts should openly recognize the existence of an EU constitutional identity. Additionally, his essay claims that a system of constitutional adjudication would benefit from a mechanism of “reverse” preliminary ruling (from the ECJ to national constitutional courts), when identity-related conflicts are at stake. Finally, the last article of the section investigates the legal and practical obstacles to the full affirmation of the ECJ as a constitutional adjudication forum. Starting with the fact that the ECJ is increasingly emerging and self-identifying as a constitutional Court, Carlo Tovo argues that the revision of the ECJ’s rules of procedure, along with the reform of the General Court, may play a major role in strengthening the constitutional adjudication of the Court’s activity. Tovo explores the new centrality of the preliminary ruling proceedings in the revised rules of procedure of the Court of Justice, in connection with the actual and future delimitation of jurisdiction between the ECJ and the General Court. Then, his article focuses on the procedural arrangements introduced by the revised ECJ Rules of procedures and other sources, aimed at balancing the need to ensure the coherence and uniformity of EU law and to strengthen the ‘constitutional authority’ of the Court. Before the special section on “The View from the Bench”, Gábor Halmai presents some conclusive remarks, providing a critical account of the use of the notion of constitutional identity by Member States’ Supreme and Constitutional courts. This is a key element to grasp the tension between unity and pluralism in the composite system of constitutional adjudication. Halmai argues that while a genuine reference to national identity claims is legitimate insofar as a fundamental national constitutional commitment is at stake, the abuse or misuse of constitutional identity by Constitutional courts “is nothing but constitutional parochialism” that can undermine the whole European constitutional construction and subvert the basic principle of sincere cooperation.

We gathered teams from 44 jurisdictions to prepare relatively brief reports on constitutional developments and cases in their own jurisdiction during the 2016 calendar year. Our inaugural edition attracted readers from every part of the world, and their enthusiasm about the project proved infectious as we have grown to 61 jurisdictions in this second edition.
The purpose of the Global Review is the same this year as it was before: to offer readers systemic knowledge that, previously, has been limited mainly to local networks rather than a broader readership.

This is the inaugural edition of the I·CONnect-Clough Center Global Review of Constitutional Law ... more This is the inaugural edition of the I·CONnect-Clough Center Global Review of Constitutional Law (ISBN: 978-0-692-92516-4). The 2016 Global Review assembles detailed but relatively brief reports on constitutional developments and cases in 44 jurisdictions during the past calendar year. The reports are are authored by academic and/or judicial experts, and often the reports are co-authored by judges and scholars. The reports in this first-of-its-kind volume offer readers systematic knowledge that, previously, has been limited mainly to local networks rather than a broader readership. By making this information available to the larger field of public law in an easily digestible format, we aim to increase the base of knowledge upon which scholars and judges can draw. We expect to repeat the project every year with new annual reports, and we hope over time that coverage will grow to an even wider range of countries. We invite scholars and jurists from the presently non-covered jurisdictions to contact us about contributing a report in next year’s Global Review.

Il contributo si sofferma sulle difficoltà di delimitare in via teoria il profilo oggettivo dell’indagine, e predilige perciò un approccio concreto, andando a setacciare la presenza on-line del Presidente della Repubblica, innanzitutto mediante un’analisi dei contenuti del sito istituzionale, e quindi tramite l’analisi della presenza del Quirinale sui social media. Nel capitolo ci si interroga dunque su quali siano i contorni delle sfide disegnate dall’intreccio tra nuovi media e Quirinale che abbiano un potenziale impatto sul diritto costituzionale, esplorando in particolare come i nuovi media possano facilitare una torsione della forma di governo contra constitutionem. Infine, accertati i rischi in questione, si proveranno a comporre alcuni ipotetici scenari nel cui quadro le sfide in questione potrebbero essere affrontate, valutandone la percorribilità e la compatibilità con il quadro costituzionale.
Il contributo analizza lo spazio che il principio di apertura dell’ordinamento costituzionale al ... more Il contributo analizza lo spazio che il principio di apertura dell’ordinamento costituzionale al diritto internazionale e sovranazionale ha trovato nei lavori dell’Assemblea Costituente. L’analisi muove innanzitutto dal testo, e perciò dalla genesi delle disposizioni internazionalistiche della Costituzione, illustrando quale e quanto spazio la Costituzione repubblicana dedica alla dimensione internazionale latamente intesa. Successivamente ci si sofferma sul contesto di quelle disposizioni, e in particolare di quelle caratterizzate da un maggiore grado di innovatività, nella misura in cui dispongono un generale principio di apertura dell’ordinamento. Nell’analizzare il contesto della redazione di quelle disposizioni (e in particolare dell’articolo 11 della Costituzione), ci si sofferma su quale fosse la collocazione di questo tema nell’attualità politica del tempo e nelle posizioni dei maggior partiti rappresentati in Assemblea Costituente.
Una costituzione è animata, nel corso di tutta la sua vigenza, da fattori politici, sociali, econ... more Una costituzione è animata, nel corso di tutta la sua vigenza, da fattori politici, sociali, economici, tecnico-giuridici e culturali. Lo è tanto più all’atto della sua fondazione. Il mutare di quei fattori, però, comporta spesso la trasformazione del senso delle prescrizioni che una comunità intendeva darsi innanzitutto per il futuro. Talvolta queste trasformazioni confliggono con l’intenzione originaria, talaltra ne amplificano l’effettività. Quale equilibrio può esistere tra la scrittura del testo costituzionale e la sua interpretazione?
Quanto è forte la suggestione dei valori e dei principi che hanno guidato i protagonisti storici dell’esperienza costituente? Per i settant’anni della Costituzione italiana, un gruppo di studiosi si è posto queste domande, interrogandosi sui metodi e sugli indirizzi inaugurati con la nascita della Repubblica, al fine di isolarne i momenti concettualmente più significativi e i perduranti insegnamenti. L’analisi intreccia il ricordo dei lavori dell’Assemblea Costituente ad un ragionamento plurale sulle ricadute odierne delle riflessioni svolte in quella sede (dal discorso sulle riforme alla tutela dei diritti inviolabili, dal rapporto tra ordinamento interno e diritto sovranazionale al governo dell’economia, dalla forma di governo alla garanzia dell’autonomia territoriale, dall’assetto della giurisdizione alla funzione del controllo di costituzionalità).

In federal states, constitutional identity is the glue that holds together the Union. On the cont... more In federal states, constitutional identity is the glue that holds together the Union. On the contrary, in the European Union – not a fully-fledged federation yet – each Member state has its own constitutional identity. On the one hand, the Union may benefit from the particular knowledge, innovation, history, diversity and culture of its individual states. On the other hand, identity-related claims may have a disintegrating effect. Constitutional diversity needs to come to terms with risks of disintegration. The Treaty on the European Union seeks a balance, providing the obligation to respect the constitutional identities of its Member states. Drawing from the European experience, this article compares judicial and non-judicial means of accommodation of divergent constitutional values. In the category of non-judicial means, political negotiated exemptions and opt-outs in favor of certain Member states have been considered. In the category of judicial means of accommodation, this article analyzes how national and supranational Courts approach the concept of constitutional identity. This article finds that non-judicial means of accommodation of identity-related conflicts are a crucial complement to judicial ones and – under certain circumstances – a superior alternative.

In the first section the paper describes why identity questions matter and why they matter particularly in Europe. In the second section (" ambiguities ") the paper tackles the issue of multiple structural ambiguities affecting the concept of 'constitutional identity' in the European constitutional vocabulary. The exploration of these multiple ambiguities aims at developing a theoretical map, where different conceptions of the same concept will be clarified, moving from a constitutional law perspective. In this section, the paper claims that constitutional identity in the European legal debate may refer to the constitutional nature of the EU (" European constitutional identity ") or to the national constitutional identities of the Member States (" national constitutional identities "). Additionally, this section explores a further ambiguity of the concept, by making a distinction between constitutional identity as a reference to those characters that make one constitution different from another constitution (" constitutional identity as difference ") and those characters that are not subject to modification, neither by constitutional amendments nor by interpretative transformations (" constitutional identity despite difference "). In the third section (" trends "), the paper explores some trends concerning the use of constitutional identity in the European legal discourse and practice. This section will focus on the development of two main uses that national constitutional courts have made of the concept of constitutional identities of the member states. First, the concept has been used as a shield: national constitutional courts aimed at protecting constitutional identities against future and potential transformation of the European Union potentially violating their constitutional identities. On this front, national constitutional courts referred both to distinctive elements of their constitutions (" constitutional identity as difference ") and to fundamental principles of constitutionalism, that are part of their national constitutional unamendable cores (" constitutional identity despite difference ") and are largely shared in the common constitutional traditions. On a second front, national constitutional courts have been using constitutional identities as " swords ". In these cases, national courts did not use constitutional identities as limits to further and future integration, but as operative clauses needed to solve an existing conflict between EU law and national constitutional law. The fourth section of the paper investigates challenges and dilemmas that emerge by the application of the analytical categories outlined in the second section to the trends described in the third one. The paper claims that different conceptions and uses of constitutional identity have a different impact on the European composite constitutional adjudication and that the institutional and procedural framework should be calibrated accordingly. Finally, a specific case study will be explored (the so-called Taricco saga involving the Italian Constitutional Court and the ECJ), with the purpose of emphasizing the importance of taking judicial dialogue on constitutional identity seriously, so to avoid threating dangers pending on the future of the European integration process. The fifth and final section draws some conclusions.

Poiché la tempesta si verificò senza gli avvertimenti che solitamente anticipano gli uragani, i pescatori e le piccole imbarcazioni già in mare dovettero fronteggiare alla sprovvista condizioni simili a quelle di un uragano. Ne seguirono diversi morti tra i pescatori e 200 milioni di dollari di danni. Per tutte queste caratteristiche il Nor'easter di Halloween è conosciuto anche come la "tempesta perfetta", da cui ha tratto origine un libro e un noto film. Il 14 gennaio 2014 il Bundesverfassungsgerichtshof, promuovendo il primo rinvio pregiudiziale nella storia della sua giurisprudenza, sembrava poter innescare le condizioni del nor'eastern di Halloween: la tempesta perfetta. Non sembrava trattarsi della tradizionale piccola tempesta scatenata dal BVerfG in occasioni precedenti (Solange, Maastricht, Lissabon), perché a quelle condizioni si aggiungeva la crisi economica che in Europa era (e tuttora è) tutt'altro che risolta e il clima di euro-scetticismo misto a deriva populista che si aggirava (e si aggira tutt'ora) per l'Europa come uno spettro. Il rinvio non veniva peraltro promosso per sollecitare un chiarimento interpretativo sulla normativa europea sulle dimensioni delle maglie delle reti da pesca (per restare in tema), bensì aveva a oggetto una delle misure più contestate e straordinarie tra quelle che le istituzioni dell'Unione avevano posto in essere per fronteggiare l'eurocrisi. L'oggetto del contendere era il programma conosciuto con l'acronimo di OMT " outright monetary transactions " , che la BCE aveva annunciato nel settembre del 2012 e che prevedeva acquisti di titoli di Stato sul mercato secondario a determinate condizioni, ma senza stabilire un limite quantitativo ex ante. Il programma annunciato dalla BCE nel settembre del 2012 dava seguito alle parole con cui il Governatore Draghi, nel luglio dello stesso anno, aveva affermato l'irreversibilità dell'euro, pronunciando quelle parole che anche nel seminario di ieri Marco Goldoni ha brevemente richiamato: " the ECB will do whatever it takes to preserve the Euro ". C'erano peraltro altre parole che seguivano e precedevano il passaggio più citato. Dopo le citate parole, il Governatore Draghi, affermava infatti, ancora più perentoriamente: " believe me: it will be enough ". Ma soprattutto, prima di dire che " the ECB will do whatever it takes to preserve the Euro " , Draghi diceva non una, ma due volte, " within our mandate ". " Within our mandate, the ECB will do whatever it takes to preserve the Euro ". Come giuristi non faremmo il nostro lavoro se incorressimo nella tentazione di dare troppo peso alle parole pronunciate nel contesto di una conferenza dal Governatore Draghi. Eppure in quella tensione tra " within our mandate " e " whatever it takes " credo stia la sintesi e il nodo di tutta la saga OMT: quanto è " qualunque cosa, ma nell'ambito delle competenza attribuite " ? Secondo la BCE questo quanto era abbastanza da giustificare il programma OMT: un programma di acquisto di titoli di Stato che aveva il dichiarato intento di consentire la trasmissione unitaria della politica

La presentazione ripercorre dapprima le tappe del “sospettoso” cammino comunitario del BVerfG, a ... more La presentazione ripercorre dapprima le tappe del “sospettoso” cammino comunitario del BVerfG, a partire dalla molto nota saga Solange, fino alle ultimissime battute di un dialogo che si è fatto sempre più complicato negli anni dell’eurocrisi e che ha trovato nella nuova (e non ancora conclusa) saga MT/Gauweiler il più recente sviluppo. La presentazione si sofferma quindi sul significato della sfasatura tra le coordinate costituzionali, contraddistinte da un’ampia apertura al diritto europeo e internazionale, e il ruolo interpretato dal BVerfG nel così detto dialogo tra le Corti. Mettendo in evidenza le diverse linee di resistenza aperte e tutt’ora difese dal BVerfG, la presentazione si concentra su alcune contraddizioni insite nel ruolo interpretato dal giudice costituzionale di Karlsruhe, istanza anti-maggioritaria per eccellenza, la cui legittimazione è strutturalmente antitetica rispetto a quella di un Parlamento che è sembrato assai meno preoccupato di tutelare le proprie prerogative di quanto non lo fossero i giudici costituzionali.

In my paper I will argue that Art. 4(2) TEU is a versatile provision which can be interpreted as a legal duty of differentiated integration, imposing the use of opt-outs or other derogations whenever these would avoid the infringement of a Member State’s constitutional identity. My research places neglected tools for the protection of constitutional identities center stage, and provides a critical comparison with the judicial mechanisms of European integration to which—in my view—they provide a crucial complement, and perhaps a superior alternative.

The judgment came one year after the ICC had ordered the Italian Parliament to legislate on the matter-which it did not do. The entire story is indicative of the inability of Parliaments to respond to social demands as well as the current trend of high courts to act as shepherds of parliaments rather than as guardians of the constitution.

Secondly, the report contains a narrative exposition of two particularly important controversies from 2016 (section III). In these decisions, the ICC actively engaged as the supranational dimension of constitutional law, showing at the same time a high level of compliance to the principle of openness towards supranational and international law, and a firm stance in upholding the complex substantive and institutional balance of the Italian Constitution. In section IV, the report provides an overview of landmark judgments adopted by the ICC in 2016. The last section draws some conclusions.

Le frontiere tra Stati sono oggi quasi un migliaio: alcune, come quelle marittime, sono ben tracc... more Le frontiere tra Stati sono oggi quasi un migliaio: alcune, come quelle marittime, sono ben tracciate, ma invisibili; altre frontiere sono invece fortificate; altre ancora sono aperte e permeabili. La globalizzazione e la formazione di uno spazio giuridico oltre lo Stato, d'altra parte, producono numerose ambiguità: se, da un lato, crescono le organizzazioni, le regole e le decisioni internazionali, dall'altro lato, sono aumentati il numero degli Stati e i conflitti interni a questi ultimi. Altre ambiguità riguardano la stessa funzione delle frontiere. Queste ultime per i richiedenti asilo, oltre che per i migranti, tornano a fungere da sbarramento fisico insuperabile, come quando si costruiscono muri o si cerca di bloccare l'accesso. In molti altri casi, all'opposto, le frontiere sono " aggirate " dalla tecnologia e, quindi, continua ad avverarsi una delle premesse del processo di globalizzazione. La costruzione di muri, nell'epoca di Internet, configura una nuova evidente contraddizione del nostro tempo anche in termini giuridici. Dentro i confini nazionali, le istanze nazionaliste e separatiste, portate avanti da comunità o territori, sono sempre più intense. Vi sono rivendicazioni degli Stati nei confronti di organismi internazionali e sovranazionali, ma anche richieste autonomiste di regioni e comunità locali contro il livello centrale. I conflitti tra i diversi livelli di governo, perciò, si moltiplicano e si presentano secondo modalità differenti, più o meno formalizzate. Tutto ciò, peraltro, non nasce necessariamente e sempre da un contrasto che oppone la dimensione nazionale a quella sovranazionale, ma trovano spesso origine in un conflitto interno alle comunità nazionali, che si riflette oltre le frontiere statali. La stessa Brexit ha tra le sue cause principali il risentimento delle comunità rurali e periferiche, che si sentono sempre più marginali, nei confronti delle città e delle élites cosmopolite che hanno tratto i maggiori vantaggi dalla globalizzazione. Lo stesso fenomeno si sta sviluppando negli Stati Uniti ove, ad esempio, nelle città l'immigrazione non viene sentita come un problema, nonostante la forte presenza di immigrati, mentre nelle regioni economicamente in declino cresce l'ostilità verso gli immigrati anche se non sono presenti. Quali sono gli effetti di queste dinamiche sull'assetto dei poteri costituzionali? Qual è il ruolo degli organi politici e di quelli amministrativi? Qual è il ruolo degli organi di garanzia e delle corti, nazionali e internazionali? Quali sono gli strumenti di raccordo e quali le tecniche di decisione adottate? In che modo il rapporto tra unità e frammentazione dentro e oltre lo Stato condiziona la tutela dei diritti fondamentali, come nei settori dell'istruzione e della salute? Quali politiche economiche e di welfare sono necessarie per assicurare la coesione e superare la divisione entro le comunità nazionali? Nel contesto delle organizzazioni internazionali, inoltre, anche in quelle a forte vocazione sovranazionale come l'Unione europea, si registra di recente in alcuni Stati membri una spinta verso la frammentazione di tipo ordinamentale, con letture diverse di regole comuni presentate talora anche come strumenti di tutela delle identità

Conference subject-matter Constitutional adjudication has expanded almost throughout the globe an... more Conference subject-matter Constitutional adjudication has expanded almost throughout the globe and taken a transnational dimension and yet it has come into increased scrutiny and attacks. There have been some traditional boundaries controversies, involving the relationship between the constitution and politics, that have become more acute due to several challenges, including populism and illiberal ideologies. In addition, social movements have always interacted with the perception of constitutional norms and their adjudication. In the United States, for example, culture wars started in the 1970's and 1980's intensified popular focus on key constitutional decisions. With globalization the same culture wars have become virtually worldwide and the judicial fora where they are litigated have also expanded on a transnational scale. In the face of such challenges, constitutional adjudication has adopted a common standard nearly worldwide, namely the principle of proportionality. Is this development sufficient for the constitutional adjudicator to accommodate or tame these proliferating conflicts? Preferential topics to be addressed Within the frame of the conference subject-matter, we particularly welcome proposals addressing the role of constitutional adjudication in striking a balance between unity and pluralism. One of constitutional adjudication's main tasks within a legal order is to provide a unifying effect. On the other hand, constitutional adjudication plays a pivotal role in the protection of fundamental rights. In today's predicament, which is characterized by pluralistic societies, the reconciliation between unity of the legal order and equal rights for all constitutes a major challenge. Il Convegno che ripercorre, attraverso relazioni di studiosi del diritto pubblico, il lavoro svol... more Il Convegno che ripercorre, attraverso relazioni di studiosi del diritto pubblico, il lavoro svolto in Assemblea costituente, si propone di superare una lettura meramente apologetica dei lavori preparatori, radicando il discorso giuridico nella realtà storica e politica dell'epoca. I costituenti erano, infatti, uomini perfettamente calati nel loro tempo, per questo la nostra Costituzione è stata, anzitutto, una Costituzione dei partiti, ed ha rappresentato, come molte delle costituzioni novecentesche, un compromesso politico figlio dell’incontro di diverse visioni del mondo, di particolari concezioni politico-istituzionali, della complessiva cultura dei costituenti. Troppo spesso, infatti, le ricerche che hanno ripercorso la nascita della nostra Costituzione si sono concentrate sul contributo che singole figure hanno offerto alla redazione della Carta fondamentale, perdendo di vista il contesto storico e il dibattito politico entro cui le singole proposte si collocavano. Senonché, le costituzioni - men che meno le costituzioni novecentesche - non nascono come Minerva dalla testa di Giove, ma sono prodotti umani figli di compromessi politici in circostanze storicamente date. L'obiettivo che il Convegno intende raggiungere è quello di sviluppare ragionamenti non solo dall'angolo visuale dei giuristi, immersi nel mondo delle pure forme, ma anche degli storici delle istituzioni e delle dottrine politiche, per provare a sottoporre a revisione critica il mito (spesso abusato a fini di politica contingente) del patto fondativo. Si vuole quindi adottare una prospettiva laica e storicamente situata che potrebbe consentire di analizzare, oggi, il punto di arrivo in chiave evolutiva di istituzioni, principi e strumenti iscritti nella ns. Carta fondamentale (dai diritti della persona sino alla Corte costituzionale), provando, in conclusione, a tratteggiarne una ricostruzione in termini di (alta) politica costituzionale.
This chapter examines the concept of constitutional identity of the EU from the perspective of pu... more This chapter examines the concept of constitutional identity of the EU from the perspective of public law. As the term appears in the TEU and, in the last 15 years, has been used by different apex courts, it draws on the trend of using constitutional identity as a legal argument against EU obligations or creating constitutional law arguments for this purpose. Thus, the chapter claims that the mandate to respect constitutional identities, as stated in Article 4(2) TEU, finds a limit in the respect for EU constitutional identity. The chapter argues that the EU constitutional identity could be identified in the same manner most Member States identify constitutional identity. Therefore, it argues that constitutional identity is a concept both applicable to the EU and the EU Member States, and to make these concepts compatible, Member States’ constitutional identities are to be respected as long as they are not incompatible with EU constitutional identity, consisting of fundamental principles of constitutionalism.

This chapter explores the relations between populism and constitutional amendment. First, it prov... more This chapter explores the relations between populism and constitutional amendment. First, it provides a conceptual map of this unruly relationship, by analysing the use, misuse and abuse of constitutional amendment by populists. The chapter claims that populists tend to reject any distinction between “constitutional” and “day-to-day” politics. Therefore, if the notion of constitutional amendment is correctly understood, populists in power usually stay at large from constitutional amendments in a strict sense: they rather prefer constitutional replacement or constitutional sabotage. Subsequently, the chapter explores possible constitutional remedies against populist (ab)use of constitutional change. Finally, the designed conceptual map will be tested on constitutional developments in the last 30 years of the never-ending debate on constitutional change in Italy. The chapter argues that there are some disturbing methodological resemblances between the populist ab(use) of constitutional change and the Italian debate on constitutional reforms. Nevertheless, the constitutional amendment procedure provided for by the Italian Constitution successfully tamed most of the populist impulses.

In EU law, the concept underwent a process of legalization: it emerged as a political clause in the Treaty of Maastricht and gained constitutional meaning after the Treaty of Lisbon. The article traces this process of legalization, arguing that even though the constitutionalization of the identity clause in EU law was primarily addressed to the Court of Justice of the EU, a major role in this process has been played by national courts. The article, however, claims that the process of transformation of the identity clause is not over, and that currently the concept is being subject to abusive and dangerous manipulations. The article supports a comprehensive reading of the identity clause in EU law within the broader context of EU fundamental principles. In particular, the article claims that a tight connection of the identity clause should be kept with the democratic mandate of the EU. This connection emerge...

Lo scritto esamina la recente sentenza della Corte costituzionale tedesca del 5 maggio 2020 che h... more Lo scritto esamina la recente sentenza della Corte costituzionale tedesca del 5 maggio 2020 che ha dichiarato ultra vires alcuni atti di istituzioni dell'Unione europea. Si tratta delle decisioni della Banca centrale europea relative al recente programma di acquisti del settore pubblico adottato per contrastare le spinte deflazionistiche in atto, nonch\ue9 della sentenza della Grande Sezione della Corte di Giustizia della UE dell'11 dicembre 2018, che aveva considerato tali decisioni in linea con i Trattati. La pronuncia viene inquadrata nel contesto della giurisprudenza costituzionale tedesca relativa ai rapporti tra ordinamento dell'Unione europea e ordinamento interno. Dopo avere ripercorso l'evoluzione di tale giurisprudenza e illustrato come la decisione in commento si ponga in continuit\ue0 con alcune sue linee di sviluppo, si vagliano le reazioni critiche provenienti dal mondo istituzionale e accademico. The article explores the recent judgment of the German Constitutional Court, issued on 5 May 2020, declaring certain acts of the EU institutions ultra vires. Specifically, these acts consisted of the decision of the European Central Bank on the recent public sector purchase programme (PSPP), aimed at addressing the low inflation rate and resulting deflation risks, and the connected decision of the Court of Justice, finding the PSPP of the ECB compatible with the European Treaties. The article locates this decision of the German Constitutional Court within the broader context of its \u201cEuropean\u201d case law. After an overview of the main milestones of this stream of case law, the article claims that the latest decision of the German Constitutional Court is in continuity with some of the main pillars of its jurisprudence. Then, the article focuses on the mostly hostile reactions to the German Constitutional Court's judgment both in the academic and political arena. These reactions notwithstanding, the article claims that a closer analysis of the follow-up of the decision indicates that the potentially dramatic rupture generated by the decision has been largely neutralized and accommodated within a physiological interplay of technical and political institutions

Il contributo si sofferma sulle difficoltà di delimitare in via teoria il profilo oggettivo dell’indagine, e predilige perciò un approccio concreto, andando a setacciare la presenza on-line del Presidente della Repubblica, innanzitutto mediante un’analisi dei contenuti del sito istituzionale, e quindi tramite l’analisi della presenza del Quirinale sui social media. This chapter examines the concept of constitutional identity of the EU from the perspective of pu... more This chapter examines the concept of constitutional identity of the EU from the perspective of public law. As the term appears in the TEU and, in the last 15 years, has been used by different apex courts, it draws on the trend of using constitutional identity as a legal argument against EU obligations or creating constitutional law arguments for this purpose. Thus, the chapter claims that the mandate to respect constitutional identities, as stated in Article 4(2) TEU, finds a limit in the respect for EU constitutional identity. The chapter argues that the EU constitutional identity could be identified in the same manner most Member States identify constitutional identity. Therefore, it argues that constitutional identity is a concept both applicable to the EU and the EU Member States, and to make these concepts compatible, Member States’ constitutional identities are to be respected as long as they are not incompatible with EU constitutional identity, consisting of fundamental principles of constitutionalism.

This case note consists of three sections. First, it provides a short overview of tumultuous recent developments in the matter of electoral legislation in Italy. Second, it describes the electoral system for the Chamber of Deputies that was introduced by parliamentary majority within the context of a broader project of institutional reform in 2015 and illustrates the Constitutional Court’s decision on it. Finally, the case note explores the meaning of this decision from two broader perspectives: first, it reflects on the decision from a comparative angle. Second, and finally, the case note contextualises the decision within the framework of the incomplete process of transition that seemed to lead the Italian political landscape from a proportional representation system to a majoritarian one.
In these decisions, the Italian Constitutional Court (ICC) actively engaged as the supranational dimension of constitutional law, showing at the same time a high level of compliance to the principle of openness towards supranational and international law, and a firm stance in upholding the complex substantive and institutional balance of the Italian Constitution. The report then provides an overview of landmark judgments adopted by the ICC in 2016. The last section draws some conclusions.
Infine, si indagheranno alcuni recenti passaggi che sembrano suggerire l’avvio di una nuova fase della storia dell’identità costituzionale nazionale, tanto nel circuito giurisdizionale del c.d. dialogo tra Corti (casi Gauweiler, Signor R. e Taricco), quanto nella gestione politica dei conflitti attorno a interessi nazionali fondamentali (con la vicenda Brexit).
L’ordinanza con la quale la Corte d’appello di Milano ha richiesto l’intervento dei giudici di Palazzo della Consulta affinché impediscano l’ingresso del dictum stabilito dalla Corte di giustizia nella pronuncia Taricco offre uno spunto per una riflessione sulla delicata materia dei principi supremi dell’ordinamento. Nel lavoro si muove dal presupposto, tratto dalla giurisprudenza costituzionale, per cui non tutti gli istituti nei quali i principi supremi si estrinsecano vanno assunti a rango di “controlimite”. È invece il loro solo nucleo essenziale a non cedere di fronte al primato del diritto dell’UE. Proseguendo lungo tale direttrice, si analizza l’istituto della prescrizione, per capire se la sua disciplina rientri a pieno titolo nel nucleo centrale di tutela offerto dal principio del nullum crimen, nulla poena sine lege di cui all’art. 25, secondo comma, Cost., ovvero se ne rappresenti un aspetto meramente accidentale.

The referral orders submitted to the Italian Constitutional Court, aiming at avoiding the application of the Taricco ruling by the Court of Justice of the European Union, trigger challenging questions related to the fundamental principles of the Italian Constitutional order. This contribution is based on the assumption that not all those legal tools that are somehow connected with the fundamental principles of the constitutional order are to be considered as limits to the principle of primacy of EU law. On the contrary, it is only the essential core of these principles that may resist against the principle of primacy of EU law. Preliminarmente all’analisi delle disposizioni concernenti il sistema elettorale del Senato, sembra opportuno sottolineare un profilo che si ritiene assolutamente centrale, sia in senso generale sulla composizione del “nuovo” Senato, sia nello specifico in relazione al suo sistema di elezione: com’è noto, la composizione del “nuovo” Senato prevede la necessarietà del cumulo tra il mandato senatoriale e quello regionale o locale, in quanto sono eleggibili a senatori unicamente – al di là dei cinque senatori di nomina presidenziale e degli ex Presidenti della Repubblica, componenti di diritto – i consiglieri regionali e, nella misura di uno per ciascuna Regione o Provincia autonoma, i sindaci dei comuni dei rispettivi territori. Tale soluzione ha consentito di ricondurre a coerenza due dei punti fermi sulla base dei quali è stata modellata la composizione del nuovo Senato, quali la sua trasformazione in un’Assemblea a elezione indiretta e l’eliminazione delle indennità per i suoi membri. La congiunzione tra questi due aspetti ha costituito il punto di partenza per giungere alla definizione della composizione del Senato riformato: un’Assemblea basata non solo sulla elezione indiretta, ma anzi sul necessario cumulo di mandati rappresentativi o di governo presso le autonomie regionali o comunali (ossia gli unici livelli territoriali nei quali permangono organi eletti direttamente dai cittadini). Il necessario cumulo di mandati ha infatti consentito di giungere contestualmente a due obiettivi annunciati sin dal titolo del disegno di legge governativo, ossia la “riduzione del numero dei parlamentari” (consistente in realtà in una riduzione dei “soli” senatori, posto che i deputati restano 630) e la “riduzione dei costi della politica”, consistente almeno nella eliminazione della indennità per i senatori, come pure dei “rimborsi o analoghi trasferimenti monetari recanti oneri a carico della finanza pubblica in favore dei gruppi politici presenti nei Consigli regionali”, nonché della fissazione del limite agli emolumenti per i consiglieri regionali pari all’importo di quelli attribuiti ai sindaci dei Comuni capoluogo di Regione.
Questo punto di osservazione sulle disposizioni che delineano la composizione e il sistema di elezione del Senato non può essere ignorato. La trasformazione della seconda Camera e la specifica opzione relativa alla sua composizione devono essere lette anche alla luce dell’intenzione del legislatore di revisione costituzionale di “portare al centro” soggetti già investiti da un mandato rappresentativo (e, eventualmente, di governo) negli organi degli enti territoriali, e regionali in particolar modo. In questa maniera si è creato, mediante una sorta di “unione personale” dei mandati senatoriale e territoriale, un collegamento diretto e necessario tra rappresentanza “nei” territori e rappresentanza “dei” territori, avendo come obiettivo parallelo la costituzione di premesse per una reciproca convergenza dei fini e dei mezzi, nell’auspicio di ridurre la conflittualità tra livelli di governo.
Tuttavia, alla luce di quanto descritto, va valutata sin dal principio la possibilità che da questa scelta di fondo, che informa l’intero impianto della revisione costituzionale, derivi una compressione dell’autonomia politica regionale, e in particolare dell’autonomia legislativa delle Regioni, almeno nel senso di una riduzione della possibilità di autonoma decisione circa i destini del mandato rappresentativo regionale, quantomeno per quei consiglieri che saranno chiamati a ricoprire anche l’incarico senatoriale, nonché del suo intreccio con il regime delle ineleggibilità e incompatibilità.
Alessia Cozzi’s essay deals with a hypothesis of silent coordination of the fora of constitutional adjudication. Cozzi investigates decisions of national supreme and constitutional courts that implicitly follow a previous European Court on Human Rights (ECtHR) judgment without explicitly referring to it. Her article aims at understanding in which cases this implicit coordination is performed and why national courts are reluctant to make this approach explicit, hiding a successful coordination and turning a battleground into a meeting ground without emphasizing this transformation. Finally, the third essay of the first section deals with the interesting case study of the Belgian Constitutional Court, placed in a comparative perspective. It raises a problem of general and systematic interest for the identification of a system of constitutional adjudication in the EU and the exploration of its procedures and challenges. This case study is extremely promising, as little research has examined whether constitutional courts employ the same strategies applied domestically, when violations of European and international law occur through legislative omissions. Omissions may be an insidious battleground for national and supranational courts, and Verstraelen’s article demonstrates a versatile approach of Member States’ constitutional courts in order to accommodate the potential fragmentation of national judges’ responses with the need to ensure unity and uniformity of EU law.
The second section of the special issue is devoted to test the model of the composite European constitutional adjudication under pressure. The Euro-crisis offered an ideal stress test. Whereas legal analysis on the constitutional dimensions of Euro-crisis abounded, some specific aspects of this picture were overlooked also in those jurisdictions where the Euro-crisis had a remarkable impact. A first underestimated aspect concerns the role played by lower courts, often contradicting supreme and European courts. Pavlidou’s article addresses this vastly overlooked aspect, by examining how domestic lowest courts in Greece safeguarded social rights by resorting to alternative constitutional sources and by indirectly enforcing constitutional provisions in order to constitutionalize social rights. Her essay juxtaposes this practice to the opposite interpretation of austerity measures by the European and Supreme Greek courts. In light of this, she analyzes the implications of this contradictory judicial review both in terms of the scope of social rights and conceptions of unity and diversity within the multiple levels of adjudication. Another vastly overlooked aspect in the Euro-crisis scholarship is the absence of preliminary references to the ECJ for the ‘harmonization’ of social rights adjudication stemming from the same supranational instruments. Constitutional courts were eager to solve cases by invoking solely their own constitutional interpretation and standards. Pierdominici’s article tries to fill this gap in the scholarship, questioning constitutional courts’ reluctant approaches toward preliminary references aimed at guaranteeing (European) standards of protection of social rights. Fasone’s essay is devoted to look at the impact of constitutional adjudication on Euro-crisis measures on the role of legislatures, in this critical conjunction, to ascertain whether common challenges to representative democracy have led to unitary or plural (and divergent) judicial responses to the issues of Parliaments’ displacement in Euro-crisis procedures. In particular, the article investigates in this framework how constitutional courts have resorted to the argument of the national constitutional identity showing that, due to several circumstances, the protection of parliamentary powers and, ultimately, of the principle of representative democracy has been of little concern for most constitutional courts in such a critical juncture.
After having tested current trends of constitutional adjudication on the battleground of Euro-crisis measures, the third section of the special issue explores possible procedures and remedies to settle emerging conflicts. In this section, Andrea Edenharter claims that in the long run, a legal reconciliation within the EU can only be achieved if national courts enjoy at least some discretion in cases in which EU law allows for the application of national fundamental rights, because otherwise, national constitutional courts might challenge the ECJ’s role as Supreme Court of the EU and thus damage the project of reconciliation as such. Edenharter’s essay deals with the core problem of the possible existence of a system of constitutional adjudication in the area of fundamental rights review. In this respect, her article analyses two possible legal tools that may facilitate the function of such a system of constitutional adjudication. On the one hand, the margin of appreciation doctrine developed by the ECHR should be adopted by the ECJ. On the other hand, the principle of discretion can also be applied in favor of the ECJ, with national constitutional courts reducing the intensity of scrutiny towards the ECJ in accordance with the German Federal Constitutional Court’s position in Honeywell.
Zaccaroni’s paper deals with the need of reconciliation of Member States’ constitutional identities and EU law from a different perspective. His article holds this reconciliation as a necessary assumption to make a system of constitutional adjudication workable in the EU. The essay emphasizes the contribution of some recent decisions of the EU for the identification of the concept of EU constitutional identity. Zaccaroni’s aim is to assess how to reconcile the theoretical position of the ECJ with the one of the national constitutional courts, and in particular, the possibility to reconcile the pluralism of national constitutional identities with the (desired) unity of the EU constitutional identity. His essay investigates two possible solutions: a) a clear theorization of an evolutionary interpretation of the principle of conferred powers; b) a real judicial cooperation between EU and national constitutional judges. In the latter perspective, Zaccaroni claims that constitutional courts should openly recognize the existence of an EU constitutional identity. Additionally, his essay claims that a system of constitutional adjudication would benefit from a mechanism of “reverse” preliminary ruling (from the ECJ to national constitutional courts), when identity-related conflicts are at stake. Finally, the last article of the section investigates the legal and practical obstacles to the full affirmation of the ECJ as a constitutional adjudication forum. Starting with the fact that the ECJ is increasingly emerging and self-identifying as a constitutional Court, Carlo Tovo argues that the revision of the ECJ’s rules of procedure, along with the reform of the General Court, may play a major role in strengthening the constitutional adjudication of the Court’s activity. Tovo explores the new centrality of the preliminary ruling proceedings in the revised rules of procedure of the Court of Justice, in connection with the actual and future delimitation of jurisdiction between the ECJ and the General Court. Then, his article focuses on the procedural arrangements introduced by the revised ECJ Rules of procedures and other sources, aimed at balancing the need to ensure the coherence and uniformity of EU law and to strengthen the ‘constitutional authority’ of the Court.
Before the special section on “The View from the Bench”, Gábor Halmai presents some conclusive remarks, providing a critical account of the use of the notion of constitutional identity by Member States’ Supreme and Constitutional courts. This is a key element to grasp the tension between unity and pluralism in the composite system of constitutional adjudication. Halmai argues that while a genuine reference to national identity claims is legitimate insofar as a fundamental national constitutional commitment is at stake, the abuse or misuse of constitutional identity by Constitutional courts “is nothing but constitutional parochialism” that can undermine the whole European constitutional construction and subvert the basic principle of sincere cooperation.
The purpose of the Global Review is the same this year as it was before: to offer readers systemic knowledge that, previously, has been limited mainly to local networks rather than a broader readership.
Quanto è forte la suggestione dei valori e dei principi che hanno guidato i protagonisti storici dell’esperienza costituente? Per i settant’anni della Costituzione italiana, un gruppo di studiosi si è posto queste domande, interrogandosi sui metodi e sugli indirizzi inaugurati con la nascita della Repubblica, al fine di isolarne i momenti concettualmente più significativi e i perduranti insegnamenti. L’analisi intreccia il ricordo dei lavori dell’Assemblea Costituente ad un ragionamento plurale sulle ricadute odierne delle riflessioni svolte in quella sede (dal discorso sulle riforme alla tutela dei diritti inviolabili, dal rapporto tra ordinamento interno e diritto sovranazionale al governo dell’economia, dalla forma di governo alla garanzia dell’autonomia territoriale, dall’assetto della giurisdizione alla funzione del controllo di costituzionalità).

This report is offered a first-aid resource for public lawyers are interested in an overview of the Italian Constitutional Court’s case law. Hopefully, this research tool will help facilitate the ongoing development, beyond the so-called judicial dialogue, of a dialogue within the “community of constitutional interpreters” in the Häberlian sense.

Troppo spesso, infatti, le ricerche che hanno ripercorso la nascita della nostra Costituzione si sono concentrate sul contributo che singole figure hanno offerto alla redazione della Carta fondamentale, perdendo di vista il contesto storico e il dibattito politico entro cui le singole proposte si collocavano. Senonché, le costituzioni - men che meno le costituzioni novecentesche - non nascono come Minerva dalla testa di Giove, ma sono prodotti umani figli di compromessi politici in circostanze storicamente date. L'obiettivo che il Convegno intende raggiungere è quello di sviluppare ragionamenti non solo dall'angolo visuale dei giuristi, immersi nel mondo delle pure forme, ma anche degli storici delle istituzioni e delle dottrine politiche, per provare a sottoporre a revisione critica il mito (spesso abusato a fini di politica contingente) del patto fondativo.
Si vuole quindi adottare una prospettiva laica e storicamente situata che potrebbe consentire di analizzare, oggi, il punto di arrivo in chiave evolutiva di istituzioni, principi e strumenti iscritti nella ns. Carta fondamentale (dai diritti della persona sino alla Corte costituzionale), provando, in conclusione, a tratteggiarne una ricostruzione in termini di (alta) politica costituzionale.
