This book shines a light on the still unexplored relationships between federalism and disability rights. It investigates how the UN Convention on the Rights of Persons with Disabilities (CRPD) is implemented by different federal systems around the world.

It analyses the effects that the obligations undertaken under the CRPD have on federal governance and on the constitutional division of powers within 14 federal systems, including those in Germany, Canada, Brazil, India, the UK and Italy. The book also considers the trends and patterns of disability rights governance in federal systems and looks at the future developments of comparative disability federalism.

Offering a fresh view on the EU constitutionalisation process, the new edition of The Tangled Complexity of the EU Constitutional Process presents three main points: the idea of constitutional complexity, the tension between constitutional evolutionism and constitutional constructivism in the process of European integration, and the functional nature of conflicts in the evolution of the EU. Because of its prodigiousness, European law produces consternation among constitutionalists accustomed to traditional patterns of power.

This book argues that while constitutional conflicts have frequently been depicted as elements of disturbance along the path towards legal coherence, they are physiological and might even be functional to the development of the European legal order, which should not be understood in a deterministic manner. The new wave of populism that has emerged over the last five years in Europe and in the US urgently needs to be better understood in a comparative and historical context. Using Italy – including the experiment of a self-styled populist coalition government – as a case study, this book investigates how populists in power borrow, use and manipulate categories of constitutional theory and instruments of constitutional law. Giuseppe Martinico goes beyond treating constitutionalism and populism as purely antithetical to dive deeply into the impact of populism on the activity of some instruments of constitutional democracy, endeavoring to explore their role as possible fora of populist claims and targets of populist attacks. Most importantly, he points to ways in which constitutional democracies can channel populist claims without jeopardizing the legacy of post-World War II constitutionalism. This volume examines the relationship between central government and local institutions, taking Italy as a case study to present a comparative perspective on how the Italian experience has influenced the global developments of federal and regional states.

As the country with the longest standing regional system, Italy has a lot to tell countries that are dealing with similar issues in present times. Adopting a theoretical/analytical approach coupled with comparative analysis, this volume critically reflects on the changes brought to the Italian system of government by the reform of Title V of the Italian constitution, the reasons why further decentralisation has been resisted and offers a comparative overview of the place and contributions that the Italian experience has brought to the global debate on regionalism and federalism. The book is divided into two parts: Part I distils the essence of the evolution of Italian regionalism and the respective debate before and after 2001. While focusing on Italy, the various chapters situate it within the global framework of discussion. Part II reflects on how the Italian regional constitutional architecture contributes to the global debate, particularly focusing on the main innovations brought about by constitutional reform.

The “amorality of secession” is not a thought-provoking title. It rather refers to the approach chosen for this collective volume. According to the Collins dictionary “amoral is often wrongly used where immoral is meant. Immoral is properly used to talk about the breaking of moral rules, amoral about people who have no moral code or about places or situations where moral considerations do not apply”. Building upon the second meaning of amoral which refers to a situation (a secessionist process) where moral considerations do not apply, avoiding this way entering the terrain of the moral foundations of secession. This interdisciplinary book does not deal with the subject of the immorality or morality of secession, trying to go beyond the traditional approach that has characterised this field.

This edited volume explores the relationship between constitutionalism and populism in the Italian context. Italian populism is of interest to comparative lawyers for many reasons. Firstly, the country has a long-lasting tradition of anti-parliamentarism over the course of its history as a unitary state. After the 2018 general election, it has turned into the first European country in which two self-styled populist parties formed a coalition government. Although it collapsed in August 2019, many issues that it had raised remain. Secondly, as Italy is a founding member of the European Communities, the constitutional implications of populist politics have to be considered not only within the national framework but also in a wider context. This book argues that the relationship between populism and constitutionalism should not be seen in terms of mutual exclusion and perfect opposition. Indeed, populism frequently relies on concepts and categories belonging to the language of constitutionalism (majority, democracy, people), offering a kind of constitutional counter-narrative.

This volume purports to explore the legal and political issues triggered by the new wave of secessionism. More specifically, those issues concern the interplay between notions of democracy (and democratic ends and means) and law (and the rule of law and constitutionalism). Against this background, the editors use amorality in order to escape the terrain of the justification of secession by making a distinction between the democratic theory of secession and the theory of democratic secession. In the first section, the theoretical nexus democracy-secession has been approached both from a legal and political theory perspective. The second section of the book examines the instruments that the theory of democratic secession invokes in order to justify secession and presents both legal and political science contributions. The third section focuses on social movements and political actors. The work is divided into seven chapters and represented the outcome of a long research period and last year, Advocate General Colomer made a reference to its pages in his conclusions on the case C-205/08, when recalling how the use of the preliminary reference “shaped the Union’s legal system”. ccording to many scholars, the rejection of the Constitutional Treaty and the disappointment caused by the contents of the Lisbon Treaty –- defined by Somek (2007) as a mere post-Constitutional Treaty – mark the failure of any possible constitutional ambition for the European Union (EU). This book aims at challenging this point both from a theoretical point of view – by describing the EU as an example of “evolutionary constitutionalism” – and a pragmatic one (i.e., looking at the functioning of concrete constitutional experiences). My idea is that the latest attempts at amending the EU treaties – the period of the “Conventions” – can be traced back to the genus of mega-constitutional politics and starting from this parallelism I argue that the so-called constitutional “failure” of the EU is actually a confirmation of the current constitutional nature of the EU rather than the proof of the impossibility of transplanting the constitutional discourse to the EU level.

Despite the rejection of the EU Constitutional Treaty eventually leading to the adoption of the Lisbon Treaty, the debates concerning the European Union’s constitutional framework continue. This book builds on the discourse in European Union constitutionalism in order to offer a novel analysis of the EU’s constitutional developments.

Giuseppe Martinico sets out a unique account of EU constitutionalism which argues that the EU legal order is a complex entity which shares some features with natural systems. The book is soundly anchored in the theory and methodology of legal science and based on a deep knowledge of judicial practices. The author contends that Europe is still suffering from the failure of the Constitutional Treaty and is practicing the new institutional equilibrium afforded by the coming into force of the Reform Treaty. The book goes on to explore the methodological implications of such constitutional complexity for the study of EU law. The process of fragmentation of the international legal order and the absence of constitutional devices governing the connections between the various legal regimes can be reduced to a rational picture only through the activity of the judges. Against this background, the judges play a crucial role in creating connections between legal regimes and proceedings. The metaphor of dialogue has been vastly used by the literature and this concept was variously understood in different meanings: vehicle for transplants, informal way of communication between judicial and political bodies, new paradigm of judicial relations between actors not belonging to the same legal order. In this article, I shall focus on the legal consequences of one of the most obvious features of populisms: identity politics. In particular, I shall explore how populists in power use constitutional law to identify and fight the alleged enemy, thus confirming their Schmittian flavour. In Schmitt, public law becomes part of a constitutional narrative that represents the people as forged by a static identity that goes back to the mythological origin of the legal system. This reconstruction is based on an organicistic reading of the concept of the people. This identitarian public law makes instrumental use of the moral argument, the historical argument and the religious argument. Populists in government tend to militarise constitutional law in many ways and in this article I will focus on two strategies: one that looks backwards, consisting of the instrumentalisation of the argument of constituent power; and one that looks forward and leverages the use of constitutional amendment.

Constitutional conflicts can be defined as conflicts between the primacy of EU law and national constitutional supremacy, to quote the Spanish Constitutional Court. They have always played a central role in the development of European constitutional law, although mainstream EU constitutional theories have treated them as irrational elements, obstacles on the road to system coherence, except for some recent rethinking by constitutional pluralists. In our view constitutional conflicts are increasingly judicial and process-oriented in nature. In this Chapter, we analyse the implications of the principle of judicial review in EU law for constitutional conflicts and its impact on the theory of (process-oriented) federalism with a broad spectrum since we look at both the judicial review of EU legislation and States’ legislation falling within the scope of EU law.

In this essay I shall analyse the question of dual preliminarity in five legal experiences: France, Austria, Belgium, Germany, and Spain. The priority granted to one of the two preliminary questions, as we shall see, can have different origins. In the French and Belgian cases, the priority criterion is established by the legislative formant (to be understood in a broad sense, as it can also refer to super-primary legislation), while in the Austrian, German and Spanish cases the formant to be considered is the judicial one. After clarifying what is meant by dual preliminarity and analysing the case studies I shall offer some brief final reflections on the trends offered by comparative law.

In both these movies, John Calhoun’s character had very few but significant scenes that portrayed him as one of those having moral responsibility for the forthcoming Civil War. This representation is in line with the traditional treatment reserved for Calhoun in American history and literature. In this work I will try to analyse the latest trends of the European integration process in light of the notion of complexity, conceived as a bilaterally active relationship between diversities.This notion of complexity comes from a comparison among the different meanings of this word as used in several disciplines (law, physics, mathematics, psychology, philosophy) and recovers the etymological sense of this concept (complexity from Latin complexus= interlaced). The effort to find a common linguistic core could cause ambiguity but I would like to take the risk because only a multidisciplinary approach can “catch” the hidden dimension of the European process I argue that the European Union legal order is a “complex” entity that shares some features with complex systems in natural sciences: non-reducibility, unpredictability, non-reversibility and non-determinability.

Colleagues have already commented upon the response of the EU institutions to the outcome of the referendum held on 23 June, stressing the rushed and populist attitude shown by the Commission and the EU Parliament, referring, for instance, to the exclusion of the UK from the " informal " meeting of the European Council held on 29 June and to the way in which Juncker made a joke of Nigel Farage , asking why he was in the European Parliament after the UK vote. However, there is another episode which is very telling, about the respect shown by the " political class " towards Art. 50 of the TEU and, in general, other relevant norms to be taken into account independently from the activation of the exit procedure, like, for instance Art. 4.2 TEU demanding equal treatment of the Members States and respect of their national identity and constitutional structure. On 28 June 2016, the European Parliament adopted a short resolution on the consequences of the UK referendum held on 23 June. There is a passage which is based on an evident mistake therein: " …Warns that in order to prevent damaging uncertainty for everyone and to protect the Union's integrity, the notification stipulated in Article 50 TEU must take place as soon as possible; expects the UK Prime Minister to notify the outcome of the referendum to the European Council of 28-29 June 2016; this notification will launch the withdrawal procedure. " As Elliott pointed out this is deeply wrong. The notification will be (if carried out) represented by a further act, whose form is still unclear as the debate among our British colleagues and experts in Constitutional law demonstrates (is it a prerogative of the Prime Minister, will a vote of the Westminster Parliament be necessary? Is it a decision for the Government but under parliamentary scrutiny? Could Scotland pose a veto on that?). One could correct me by saying that de facto the UK has already made its choice, that the EU has the right to protect itself against what is sometimes perceived as a sort of tactical delay. It would not be a mistake then, but simply a linguistic choice of the EP which leaves no margin to the UK. A confirmation of this could be found in the EP resolution itself reporting that EP " will enact changes in its internal organisation to reflect the will of a majority of the citizens of the United Kingdom to withdraw from the European Union ". What does this mean? Are these lines referring to the possibility of removing UK Members of the EP from some senior roles (for instance chairmanship of committees)? And above all, is this, technically speaking, legal? In spite of the fact that from a formal point of view the UK referendum is not binding, in spite of the fact that the UK has not activated the procedure ex Art. 50 TEU and that the supranational institution may not oblige the UK to launch it, almost everybody is sure that the exit will almost certainly happen. Of course, from a political point of view it is quite clear that the chances of the UK remaining in the EU are quite low, especially for the political meaning of the vote expressed on 23 June. At the same time, in my capacity as a professor of law, I still think that this scenario is quite deplorable and also emblematic of a certain understanding of law. To curate this symposium on a recent piece of Professor Paolo Carrozza is a pleasure and a challenge. Professor Carrozza’s thinking is dense with suggestions: it is not a coincidence that it took us more than 100 pages to comment his 20-page article. Like holy texts and badly drafted law, his writing elicits endless commentary.

Besides being an exquisite thinker and an academic titan, Professor Carrozza is an amiable friend and a loyal mentor to us all. The colleagues and friends who joined this symposium have worked with Professor Carrozza, and we owe him a great deal of learning. This is a motley crew: the authors include comparative constitutional lawyers, public international lawyers, European Union lawyers, and several other subdivisions not worth listing. This is not a coincidence: the variety of our backgrounds (foregrounds?) is a confirmation of the extraordinary curiosity, intelligence, leadership and eclectic nature of our mentor, who guided us especially in the early years of our education, encouraging us to explore areas going beyond his vast comfort zone (not to mention ours).

Canada is and will for the foreseeable future be a peaceful and prosperous liberal democracy whose Constitution Act, 1867, now 150 years old as of 2017, has become a model for the modern world. The Constitution of Canada has exerted considerable influence on other countries, particularly since the coming into force of its Constitution Act, 1982, which included the celebrated Canadian Charter of Rights and Freedoms. Just as Canada drew from foreign and international experiences in drafting its Charter, the world has learned a great deal from Canada, not only as to rights protections but also as to the separation of powers, the judicial function, and the structure of government. In light of these impressive achievements, an international symposium on the Canadian Constitution was held in Pisa at the Scuola Sant’Anna under the auspices of the Sant’Anna Legal Studies project and with the support of the DIRPOLIS (Law, Politics and Development) Institute at the Scuola Sant’Anna, the Canadian Embassy in Italy, and the

The recent campaign for the constitutional referendum was perceived as highly divisive even in the academic world. The aim of this paper is to 'map' the academic debate concerning the Renzi-Boschi constitutional reform rejected by Italian people in the referendum held on 4 December 2016. This survey does not look at the contents of the reform, rather it focuses on the arguments employed by Italian academics either to support or question the reform. Special attention is paid to the initiatives and attitudes of the Italian Association of Constitutional Lawyers (AIC).

The combination of populism and sovereignism represents a terrible challenge for the European integration process. The aim of this panel is to explore the nature of these two concepts and the way in which they affect one of the pillars of post-WWII constitutionalism: the principle of constitutional openness. Contrary to what populists claim, the EU does not represent a threat to national constitutional law, but an added value to protect fundamental rights protected by national constitutional charters.
