Almost a decade has passed since the outbreak of the economic crisis; from its original nucleus, ... more Almost a decade has passed since the outbreak of the economic crisis; from its original nucleus, its effects have quickly affected the social and geopolitical fields. Such wide impact and its complex implications make the crisis an object susceptible of multiple readings. The particular aim of the studies collected in this volume is to explore the impact of the crisis on law, culture and society, in order to test the depth of the problem, by comparing the analytical perspectives obtainable from legal and human sciences. The book focuses on three main issues: the crisis as a social object, in order to consider the crisis in terms of its attributing force; the problem of democracy, which is becoming an increasingly central question now, as the changes imposed by the crisis have begun to settle down; the interdisciplinary challenge that, in time of crisis, questions paradigms of knowledge, competences and methods, in order to enable an heuristic dialogue between human, social and legal sciences.
The paper discusses critically the way democracy is changing due to the transformation of the Int... more The paper discusses critically the way democracy is changing due to the transformation of the Internet. In the first part, it analyses from a so- cial science point of view the disruption made by big data and algorithms. It focuses on the consequences that personalized communication can pro- duce leading to information cocoons or filter bubbles. As a result, users may encounter only a limited range of political ideas. The paper synthe- sizes research on the extent and effects of «deep personalization», namely that where algorithms personalize content for users without any deliberate user choice. In the second part, the paper briefly discusses the threats to democracy and liberty produced by closed online spaces in which people of similar opinions can congregate – echo chambers. It concludes that at the present moment there are no strong legal cures to these technological «diseases».

This article emphasizes that the protection of the right to interpretation and translation in cri... more This article emphasizes that the protection of the right to interpretation and translation in criminal proceedings represents a big achievement for the guarantee of the constitutional due process of law in Italy. It is argued that the right to an interpreter constitutes a good standpoint to see the evolution of the rights of suspected or accused persons in criminal proceedings. After a brief introduction on the relevance of the use language in the Italian legal system, the article analyses the actions undertaken by the Italian Parliament in implementing the EU Roadmap for strengthening procedural rights of suspected or accused persons in criminal proceedings. The first result of this gradual action is the Directive 2010/64/EU on the right to interpretation and translation. The Directive confirms the determination of the EU to follow a very prudent approach on the issues concerning procedural rights, characterized by a cautious gradualness and a strong link with the decision of the ECHR. However, the introduction of harmonization in this field is surely a strengthening of the basic rights protected by the Court of Strasbourg. The article, then, discusses the implementation of the Directive 2010/64/EU in Italy with the legislative decree n. 32 of 2014, which modifies a few articles of the Italian Code of Criminal Procedure. Finally, the article deals with the problems concerning real efficacy of these initiatives and their adequacy to respond to the need of guarantees in criminal proceedings, especially in the preliminary inquiry stage.

"In the next few months the General Court of the European Union will rule on the issue of th... more "In the next few months the General Court of the European Union will rule on the issue of the admissibility of an European Citizens’ Initiative (hereinafter ECI) rejected on 6th September 2012 by the European Commission. This judgment is expected as one of the first assessment of the brand new instrument for participatory democracy introduced in the Lisbon Treaty (Article 11 of TUE). ECI is designed to allow the citizens to take an active role within the lawmaking process of the EU. One million citizens who fulfil a petition to call on the Commission have the right to propose a legal act on a specific issue. This innovation represents an unprecedented means of transnational democracy insofar it establishes the conditions for increased public engagement within the EU. The ECI is viewed as significant institutional response to the EU’s perceived democratic deficit. In light of these circumstances, this article investigates the problems related to the power of the European Commission to refuse an initiative. It considers first the origins of the ECI, the main elements of the new mechanism and its legal background. It then describes the power of the Commission to refuse an initiative and the first case before the General Court. Finally the article analyses the main problems that are emerging in this first phase of implementation of the ECI."

L'articolo aderisce alle conclusioni della sentenza commentata, attraverso la qu... more L'articolo aderisce alle conclusioni della sentenza commentata, attraverso la quale cui la Consulta dichiara non fondata la questione di legittimità costituzionale dell'art. 6, comma 2, della legge 13 dicembre 1989 n. 401, laddove nel disciplinare la misura restrittiva della libertà personale applicabile dall'Autorità di pubblica sicurezza, non ne subordina l'adozione alla sussistenza dei presupposti dell'eccezionale necessità ed urgenza di cui all'art. 13, comma 3, Cost.. Secondo la Corte, il presupposto dell'eccezionale necessità ed urgenza, affinché l'autorità di pubblica sicurezza possa temporaneamente adottare provvedimenti incidenti sulla libertà personale, è vigente nell'ordinamento giuridico, rappresentando sia un presupposto dell'azione amministrativa, sia un criterio per il relativo giudizio di convalida. L'A. dà un quadro sintetico della normativa in materia e conclude affermando che la Corte sembra servirsi dello schema decisorio della Drittwirkung, cioè dell'applicazione diretta della Costituzione, istituto spesso utilizzato dalla Consulta, e che in questa circostanza, viene invocato per ricostruire una disciplina in cui è particolarmente delicato il rapporto tra garanzia della libertà personale e interesse pubblico a prevenire la commissione di particolari reati.

"Italy has long been known for its complex bureaucracy, however many steps are b... more "Italy has long been known for its complex bureaucracy, however many steps are being taken to improve the current situation. During the last twenty years, new measures have been put in place to simplify numerous administrative processes in order to reduce costs and improving government services for business and individuals. In this framework the article introduces one of the most important strategies for better regulation implemented by the Italian government during the past legislature, the MOA, a method for measuring the administrative burdens imposed by regulation on business. In the first part the authors describe recent improvements introduced for reducing burdens imposed by regulation, such as the introduction of estimation of burdens during the phase of Regulatory Impact Assessment (RIA) when new regulation has been proposed. In the second part the article discusses both limits of new measures and difficulties that public administrations may face in its application. A further critical point and a challenge is the case law of the Italian Constitutional Court. Indeed, the most recent decisions taken by the Constitutional Court confirm the constitutional nature of the simplification process."

Le democrazie parlamentari stanno vivendo una crisi di rappresentanza di fronte a nuove istanze d... more Le democrazie parlamentari stanno vivendo una crisi di rappresentanza di fronte a nuove istanze di democrazia diretta e a una maggiore centralità del governo: basta tutto questo per assestare un colpo mortale al Parlamento? Possono le nuove tecnologie, i soli governi e gli esperti colmare il vuoto delle assemblee rappresentative?
Sono queste alcune delle domande cui proveremo a dare risposta, venerdì 14 dicembre al Campus Luigi Einaudi, in dialogo con alcuni dei più autorevoli studiosi di diritto costituzionale e con rappresentati apicali delle istituzioni italiane.
L’iniziativa, dal titolo “Ripensare il Parlamento”, rappresenta la III edizione della giornata di studi sull’ordinamento costituzionale promossa dal CEST, dopo quelle del 2016 e del 2017 sulle riforme della Costituzione e delle istituzioni.
Dopo la lectio di apertura, due focus tematici, uno al mattino, sulle trasformazioni dell'attività legislativa e il bicameralismo, e uno nel primo pomeriggio, sulle potenzialità e sui limiti della funzione di controllo politico. L'appuntamento si concluderà con una tavola rotonda.
