This article analyses the migration of the common law doctrine of precedent to civil law constitu... more This article analyses the migration of the common law doctrine of precedent to civil law constitutionalism. Using the case study of Mexico and Colombia, it suggests how this doctrine should be tailored to the civil law context. Historically, the civil law tradition adhered to the doctrine of jurisprudence constante that grants relative persuasiveness to precedents, once they are reiterated. However, the trend is to consider single constitutional precedents as binding. Universalist judges are borrowing common law concepts to interpret precedents joining the global trend while particularists consider such migration a foreign imposition that distorts the civil law theory of sources. This article takes a dialogical approach and occupies a middle ground between universalist and particularist approaches. The doctrine of precedent should be adopted, but it must also be reconfigured considering three distinctive features of the civil law: (a) canonical rationes decidendi; (b) precedent overproduction; and (c) a fragmented judiciary.

This amendment mandates that the “reasons” of Supreme Court rulings will be binding on the lower courts. However, the reform is rooted in a long-standing practice of ‘Tesis’, i.e., abstract statements that the Court itself identifies when deciding a case. Moreover, there is no consensus as to what these reasons are and why they should be binding. The aim of this article is to identify the possible conceptions of reasons to explore the Court’s different judge-made law roles. Different common law conceptions of the ratio decidendi are used as “mirrors” to identify four models of judicial lawmaking in Mexican practice, namely: judicial legislation, implicit rules, moral-political justifications and social categories. Esta enmienda establece que las “razones” de las sentencias de la Suprema Corte serán obligatorias para los tribunales inferiores. Sin embargo, la reforma se enmarca en una arraigada práctica de tesis jurisprudenciales, i. e., enunciados abstractos identificados por la misma Corte al resolver un caso. Además, no hay consenso sobre qué son estas razones y por qué deberían ser vinculantes. El objetivo de este artículo es identificar las posibles concepciones de razones para revelar los distintos roles de la Corte en la creación del derecho judicial. Además, no hay consenso sobre qué son estas razones y por qué deberían ser vinculantes. The ‘new NAFTA’ agreement between Canada, Mexico, and the United States maintained the system for... more The ‘new NAFTA’ agreement between Canada, Mexico, and the United States maintained the system for binational panel judicial review of antidumping and countervailing duty determinations of domestic government agencies. In US–Mexico disputes, this hybrid system brings together Spanish and English-speaking lawyers from the civil and the common law to solve legal disputes applying domestic law. These panels raise issues regarding potential bicultural, bilingual, and bijural (mis)understandings in legal reasoning. Do differences in language, legal traditions, and legal cultures limit the effectiveness of inter-systemic dispute resolution? We analyze all of the decisions of NAFTA panels in US–Mexico disputes regarding Mexican antidumping and countervailing duty determinations and the profiles of the corresponding panelists. This case study tests whether one can actually comprehend the ‘other’. To what extent can a common law, English-speaking lawyer understand and apply Mexican law, expressed in Spanish and rooted in a distinct legal culture?

This paper fills this gap. A conviction is a norm that, according to an individual, ought to be ascribed to a provision. By contrast, a rule is a judicially ascribed norm that controls a case and is protected by the formal principles of competence, certainty, and equality. A revision of a rule is the invalidation or modification such a judicially ascribed norm, provided that the judge meets the burden of argumentation of formal principles. Thus, judges can revise their convictions without changing the law.

This article elaborates the concepts of techno-colonialism and sub-netizenship to explore the ren... more This article elaborates the concepts of techno-colonialism and sub-netizenship to explore the renewal of colonial processes through the digitalization of "democracy." Techno-colonialism is conceived as a frameadopted consciously and unconsciouslythat shapes capitalist social relations and people's political participation. Today, this frame appeals to the idealized netizen, a global, free, equal and networked subject that gains full membership to a political community. Meanwhile, sub-netizenship is the novel political subordination because of race, ethnicity, class, gender, language, temporality, and geography within a global matrix that crosses the analogue-digital dimensions of life. This techno-colonialism/ sub-netizenship dynamic manifested in the experience of Marichuy as an indigenous independent precandidate for the Mexican presidential elections of 2018. In a highly unequal and diverse country, aspirants required a tablet or smartphone to collect citizen support via a monolinguistic app only accessible to Google or Facebook users. Our analysis reveals how some individuals are excluded and disenfranchised by digital innovation but still resist a legal system that seeks to homogenize them and render them into legible and marketable data.

Estos organismos no son completa ni igualmente independientes del resto de poderes del Estado. Al contrario, se caracterizan por tener una variedad de diseños que les dan diferentes niveles de autonomía. Entender esta variedad de diseños es el primer paso para identificar las causas, reales o percibidas, sobre los defectos del sistema actual de equilibrio institucional, así como las consecuencias que un régimen bien diseñado podría generar. Hasta este momento, la discusión generalmente se ha limitado a si deben existir o no este tipo de organismos. A partir de este trabajo, los debates podrían abordar nuevos cuestionamientos sobre cómo deben diseñarse y cuánta autonomía habría que otorgarles.

En este artículo se discute la derrotabilidad del precedente constitucional desde una perspectiv... more En este artículo se discute la derrotabilidad del precedente constitucional desde una perspectiva analítica y normativa. Analíticamente, se sostiene que la derrotabilidad es una propiedad contingente de los precedentes que se manifiesta cuando nuevas normas adscritas reducen o eliminan el campo de aplicación del precedente original. Normativamente, se propone que la derrotabilidad es una colisión entre los principio formales de igualdad y seguridad jurídica y principios de justicia sustantiva. Una norma se derrota cuando circunstancias o fuentes constitucionalmente relevantes ausentes en el precedente, pero presentes en el caso posterior, justifican emitir una nueva norma que funciona como excepción o invalidación de la norma anterior. De manera más práctica, se proponen cuatro técnicas argumentativas que hacen manifiesta la derrotabilidad de los precedentes. Estas técnicas son la distinción de casos, la circunscripción, la inaplicación y la desaplicación del precedente. Así, el artículo busca contribuir al debate teórico y práctico que ha surgido a partir de que el Pleno de la Suprema Corte resolviera la C.T. 299/2013.

In this piece, I focus on equality over the other values. In the rest of this paper, first I am going to provide a brief overview of the book. Then, I will point out what I consider to be the most significant contributions of the book regarding the connection between Law’s abstract judgment and equality. Later, I will ask three questions so we can illustrate further points of the book and engage in a critical discussion of LJ.

En medio de una crisis democrática en México, surgen las candidaturas independientes como manera ... more En medio de una crisis democrática en México, surgen las candidaturas independientes como manera de ampliar la participación política. Sin embargo, para lograr el registro en las elecciones de 2018, el Instituto Nacional Electoral (INE) implementó una app sin considerar las diferencias de clase, étnicas/raciales, lingüísticas, temporales, geográficas y de habilidades digitales. Estas exclusiones se visibilizaron en las impugnaciones en torno a la candidatura de Marichuy, una mujer indígena nahua que buscó su registro como independiente a la presidencia. En este capítulo analizamos este uso vertical y mono-cultural de las tecnologías de la información y la comunicación (TIC), justificado en el discurso de "modernidad", como una expresión de tecno-colonialismo. Contribuimos así a entender la formación de una sub-ciudadanía digital manifiesta en la subordinación y estigmatización jurídica, participativa y política en la que se priorizan valores tecnocráticos en lugar de la ampliación de los canales democráticos.

interpretativo y la pasividad de estudiantes se aceleró con la crisis de COVID-19. Al rol estudiantil tradicional se le agregaron distintas problemáticas para transitar a la educación en línea. Al docente se le presentaron nuevos retos, que van desde el cómo evaluar y fomentar la adquisición de conocimiento a distancia, hasta el cómo contribuir en el bienestar y la salud mental estudiantil.
Con el objetivo de vencer los retos presentados, hemos desarrollado una metodología de simulación de juicios que combina herramientas de aprendizaje y las mejores prácticas docentes en el contexto de la pandemia. La propuesta consiste en promover el papel activo de las y los estudiantes, mediante su participación en la interpretación de distintos roles en una simulación de juicios orales. A veces actúan como parte en un juicio y a veces como jueces. A lo largo de cuatro semestres en pandemia, esta metodología ha sido probada como eficiente en la solución de las problemáticas planteadas, y con ella hemos aprendido lecciones acerca de la posibilidad de evaluar la adquisición del conocimiento a distancia, incentivar la creatividad de estudiantes y generar lazos humanos en medio de una crisis social y sanitaria.
El resto del comentario se articula en cuatro secciones. La sección B describe los hechos del caso y la solución que dio la Primera Sala; ésta consideró que la terminación de la relación laboral de un trabajador que tenía un tatuaje de una suástica no le causó daño moral. Después, en la sección C se examina si, a la luz de los hechos, el juicio de proporcionalidad era el método adecuado para resolver un caso de discriminación sobre discurso de odio. Si el discurso de odio está prohibido, y no se probaron hechos constitutivos de daño moral en perjuicio del exempleado, entonces, no hay necesidad de ponderar. La sección D cuestiona la ponderación en abstracto que realizó la Primera Sala, pues no tomó en cuenta especificidades del caso y del contexto constitucional mexicano. Finalmente, la sección E concluye con tres lecciones que deja este caso para el uso del juicio de proporcionalidad.
