Kritische Anmerkungen zu einer Studie von Amrei Koch zur Autoritätsbegründung im biblischen Recht... more Kritische Anmerkungen zu einer Studie von Amrei Koch zur Autoritätsbegründung im biblischen Recht des Bundesbuches; to be publ. in: Zeitschrift für Altorientalische und Biblische Rechtsgeschichte 30, 2024. Die Verf.in stellt sich darin die Frage, wie Recht im Pentateuch generell autorisiert und legitimiert wurde und welches "Weltbild" die Normativität des biblischen Rechts gestützt habe. Als Ergebnis eines den Auftakt bildenden Resümees der Forschungsgeschichte, in der die Verf.in zwischen Forschungsarbeiten zu Gattungen in biblischer Rechtsgeschichte beginnend mit A. Alt 2 , ihren Begründungsklauseln beginnend mit B. Gemser 3 , der Korrelierung von Recht und Erzählung beginnend mit D. Daube 4 und Forschungen zum Bundesbuch mit der These der Theologisierung beginnend mit dem Rezensenten 5 differenziert, kommt die Verf.in zu dem Ergebnis, dass der gottesrechtliche Bezug hervorstechend aber nicht einzig prägend für die Begründung der jeweiligen Rechtssätze sei, vielmehr den Rechtssätzen vielfältige Begründungen nicht nur in Begründungsklauseln, sondern auch durch die Verflechtungen der Gesetze mit Paränesen und Erzählungen eingeschrieben worden seien, wobei zwischen Rechtssatz und Erzählung eine sinntragende Verbindung zu unterstellen sei, die von der Verf.in als Anlass genommen wird, die literarische Analyse von Rechtstexten im Masoretischen Text des Pentateuchs auf eine Methodik synchroner Lesart zu begrenzen. Damit will die Verf.in auch "weitreichende forschungsgeschichtlich geprägte Prämissen" von der rechtshistorischen Analyse biblischen Rechts fernhalten. This paper traces the history of the negative theology of YHWH from the beginning of the integrat... more This paper traces the history of the negative theology of YHWH from the beginning of the integration of YHWH into the Canaanite pantheon to the post-exilic period in the Torah through the interpretation of the Sh e ma' Israel from its mono-Yahwistic understanding to monotheism as an expression of God's freedom. Doch ist die Forschungsgeschichte zur biblischen Bundestheologie und ihren Ursprüngen ein signifikantes Beispiel dafür, dass sich Forschungsperspektiven und-thesen in der Abfolge von Pendel-und Kreisbewegungen befinden, sodass sich, folgt man diesen Bewegungen, die Frage stellt, welche Gestalt eines Mehrwerts in der Forschungsgeschichte bei diesen Pendel-und Kreisbewegungen jeweils erzielt wurde 2. Eine Spätdatierung der Bundestheologie verhalf J. Wellhausen mit der Beobachtung eines "Bundesschweigens" der Propheten des 8. Jh. zum Durchbruch. Als Konsequenz aus der Datierung bzw. Spätdatierung von Deuteronomium und Priesterschrift widersprach er der Verbindung der Bundestheologie mit einer frühen mosaischen Theokratie. Vielmehr sei das Gottesverhältnis in Israels Frühzeit vor den Propheten "von Haus aus ein natürliches; kein zum Nachdenken geeignetes Zwischen trennte ihn (sc. JHWH) von seinem Volk" 3. Erst die Propheten des 8. Jh. sollen das "natürliche Band" zerschnitten haben. "(z)u oberst war ihnen (sc. den Propheten) Jahve der Gott der Gerechtigkeit, Gott Israels erst in zweiter Linie und nur insofern, als Israel seinen Gerechtigkeitsansprüchen entsprach, die er ihm aus Gnade offenbart hatte" 4. Damit sei eine Umkehrung der Funktion von Tora verbunden, "die ursprünglich wie all sein Tun unter den Begriff des Helfens, nämlich des Rechtschaffens, des Wegzeigens, der Lösung verwickelter Fragen, gefallen war" und die "jetzt aufgefasst (wurde) als der Inbegriff seiner Forderung, von deren Erfüllung seine Beziehung zu Israel alleine abhing" 5. Wenn man das Funktionieren indigener Stammesgesellschaften wie in Papua-Neuguinea kennengelernt hat und dabei auch das Phänomen von tribal-fights, wird man kaum auf den Gedanken kommen, dass es sich um paradiesischgewaltfreie Gesellschaften handelt. Vielmehr wird man begreifen, dass sie ganz eigene Mechanismen entwickelt haben, um Gewalt einzugrenzen und einen Zustand des Rechtsgleichgewichts herzustellen, der das Überleben in Gemeinschaft sichert. Wenn aber diese Rechtssysteme indigener Gesellschaften mit westlich-kolonialen Rechtssystemen konfrontiert werden und diese wie in Papua-Neuguinea in Gestalt des britischen und australischen Rechts durchgesetzt werden, so zieht das für die indigene Bevölkerung recht dramatische Leidenserfahrungen nach sich, die über die mit Umbruchszeiten verbundenen Leidenserfahrungen hinausgehen. In den Konflikten zwischen indigenen und westlichen Rechtssystemen und ihren unterschiedlichen Wertvorstellungen ist eine Amalgamierung von juristischen Argumentationsgängen mit solchen der Wirkungsgeschichte biblischer Motivik zu beobachten. 2 Um derartige Relationen zwischen juristischen und biblischen Argumenten geht es in der hier vorzustellenden Studie von Mark G. Der Monographie von Julia Rhyder (Verf.) liegt ihre Dissertation zugrunde, die von C. Nihan betreut 2018 von der Theologischen Fakultät der Universität Lausanne angenommen wurde und aufgrund ihrer außergewöhnlichen Qualität eine intensive Diskussion ihrer Thesen verdient. Die Verf. wendet sich gegen die These einer "linearen" Rekonstruktion der Geschichte der Kultzentralisationsdiskurse im Pentateuch, die seit Julius Wellhausen bis heute so interpretiert werde, dass sie ihren Ausgang beim Deuteronomium (Dtn 12) nehmen sollen und die priesterlichen Zentralisationsdiskurse in Priesterschrift (P) und Heiligkeitsgesetzgebung in Lev 17-26 (H) als literarische Ergänzung von P als Erbe des Deuteronomiums gesehen werden, ohne dass die priesterlichen Diskurse eine eigene Theorie der Zentralisierung des Kultes entwickelt haben sollen. Diese ihrer Meinung nach durch die bisherige Forschung nicht geschlossene Lücke will die Verf. durch die Rekonstruktion eines vom Deuteronomium literarisch und in der Sache unabhängigen Zentralisationsdiskurses und seiner Ideologie in Priesterschrift und Heiligkeitsgesetz schließen. Dazu orientiert sie sich an der Ideologiekritik von Antonio Gramsci und Michel Foucault als hermeneutische Wegmarken, wenn sie als Intention der priesterlichen Zentralisationsdiskurse die Begründung und Durchsetzung von Ansprüchen von Priestern auf Hegemonie und materielle Ressourcen, also auf Macht und Geld, mittels priesterlicher Texte in P und H sieht. Der Zentralisationsdiskurs in der Priesterschrift sei nicht auf die Frage der räumlichen Lozierung des Zentralheiligtums in Gestalt eines Wüstenheiligtums beschränkt, sondern umfasse auch die Begründung des Hegemonieanspruchs einer Priesterfamilie, die sich auf einen nur fiktiven Aaron zurückführe. Diesem Ziel, Herrschaft und ihre Akzeptanz zu generieren, sollen auch rituelle Normierungen bis in das Alltagleben der Menschen mit Speiseregeln (Lev 11) und Regeln der Unterscheidung von Rein und Unrein mittels eines idealisierten Kultes dienen. Dieser Zentralisierungsdiskurs in der Priesterschrift sei strategisches Mittel Jerusalemer Priester, nach Verlust des Königtums dessen Funktionen zu übernehmen, das Volk an der Finanzierung des Tempels zu beteiligen und den Judäern bei aller gesamtisraelitischen Ausrichtung Privilegien zu sichern. Die Verf. hebt wiederholt die Distanz zwischen priesterlicher Ideologie in der Priesterschrift und der kultischen Realität in Juda und später auch in Samaria in persischer Zeit hervor, was sich auch an der Mehrzahl der Heiligtümer in der Diaspora zeige. Entsprechend rekonstruiert sie die Priesterideologie der Zentralisierung als Diskurs, der auf die Durchsetzung von Hegemonialansprüchen einer Familie der Jerusalemer Priesterschaft ziele: "Thus, to draw on Foucault's terminology, the description of the wilderness cult and its leaders is a practice of 'normalizing judgment', in that it provides the mechanism through which certain groups-in this case, the Judeans associated with the temple in Jerusalem-are imagined as having the right to greater authority, resources, privilege and centrality". Das alles soll durch Texte einer idealisierten Organisationsform geleistet werden, in denen sich das Verhältnis Israels als "Klient" zu JHWH als sein "Patron" widerspiegeln soll. In dieser theologisch eingeschränkten Perspektive geht die Theologie des priesterschriftlichen Zentralisationsdiskurses in der Sinaiperikope aber keineswegs auf. Vielmehr ist er in der Sinaiperikope mit der Schöpfungsmotivik in der Urgeschichte der Genesis verknüpft, sodass das literarische und sachliche Gegenüber keineswegs nur auf 1 Kön 5-8 beschränkt zu sehen ist, von dem, das sei angemerkt, Dtn 12 nicht zu lösen ist. The theologization of biblical law as a prerequisite for its reception in the writings of the Hebrew Bible The lecture aims to clarify two related questions that are of central importance for any understanding of the history of religion and literature, namely the question of localization and the question of the influence of prophecy on the theologization of law or the influence of theologized law on prophecy. Thus, the lecture shows that the theologization of law in the Hebrew Bible had its origin in the Covenant Code Exodus 20-23* in the 8th century in Judah and especially in Jerusalem, which continued in Deuteronomy. This gives rise to a number of points of reference in the prophecy of Isaiah in Jerusalem and vice versa, which contradicts the thesis that the theologization of law in the Book of Covenant was the result of the influence of 8th century prophecy in the northern kingdom of Israel.

Jürgen Habermas has spent a lifetime criticising this concept and referred to Jewish concepts of Political Theology which, alongside Martin Buber, go back above all to Hermann Cohen, who drew on the sources of Plato's philosophy and the Hebrew Bible. This amalgamation of sources of ancient philosophy and the Bible was continued by Hannah Arendt's Political Theology of human rights, which developed into a critical theory of human rights in termes of dicourse ethics with Alexander Honneth, RahelJäggi and Daniel Loick, again with references to Jewish legal traditions, which has to be evaluated critically.

He located Junder Solomon and coined the idea of a Solomonic Enlightenment. Contrary to Wellhausen, Gunkel and many others, von Rad transforms the Yahwist into a personality who just had at his disposal what von Rad called the 'small theological credo' out of which he built the narrative of the Hexateuch (von Rad 1965). These two volumes complete the massive commentary on Deuteronomy by Eckart Otto, whose many publi... more These two volumes complete the massive commentary on Deuteronomy by Eckart Otto, whose many publications on that key biblical book have shaped the field and promise to do so for generations to come. The sheer length and complexity of the commentary mark it off as an Olympian achievement. As Nathan McDonald pointed out in his masterful RBL review of the first two volumes (RBL 2016, 109-15), the commentary builds a strong cummulative case, so unlike many others, it is not simply a compendium of more or less independent booklets on individual pericopes. On the other hand, for each pericope the synchronic and diachronic readings are well developed and independent enough to be read on their own, so the commentary can be digested in more than one way .

In recent decades Eckart Otto has been one of the leading and most prolific contributors to schol... more In recent decades Eckart Otto has been one of the leading and most prolific contributors to scholarship on Deuteronomy, as well as a leading figure in the study of biblical law; consequently the publication of the first volumes of his commentary is a major landmark in the study of Deuteronomy. The first two volumes cover only the opening eleven chapters of the book, with the rest of the commentary scheduled to appear in 2016. The scope of the commentary is staggering. The introduction alone runs to over two hundred pages, most of which is an exhaustive account of research on Deuteronomy from Richard Simon to the present; the remaining eight hundred pages of these first two volumes is devoted to just the first eleven chapters of Deuteronomy. If Otto gives the same amount of attention to the rest of the book, the final commentary will run to about 2,500 pages.

Der vierte Teilband des Deuteronomium-Kommentars von Eckart Otto knüpft nahtlos an den dritten Teilband an, den ich für die AfeT-Rezensionen bereits rezensiert habe, und führt zunächst die Auslegung des Deuteronomischen Gesetzes (Dtn 12-26) zu einem Abschluss. Die Qualitäten des Kommentars bleiben dieselben, wobei beeindruckend ist, dass sich bis zum Schluss des Kommentars keine Ermüdungserscheinungen des Verfassers wahrnehmen lassen, sondern das Deuteronomium in voller Frische und Gründlichkeit bis zum Tod des Mose kommentiert wird. Da die Anlage des Kommentars schon in der Rezension des vorausgehenden Teilbandes besprochen wurde, sollen hier exemplarisch einige Fragestellungen herausgegriffen werden. Besonders hilfreich sind immer wieder die forschungsgeschichtlichen Überblicke zur Auslegung einzelner Perikopen. Der Tod des Mose (Dtn 34) dient nach Otto in synchroner Lektüre des Pentateuchs als hermeneutischer Schlüssel zur Tora. Er bringt es auf der letzten Seite des Kommentars auf die Kurzformel "Mose muss sterben, damit die Tora leben kann" (2286). In der diachronen Analyse folgt Otto der These von L. Perlitt, in Dtn 34 keine Priesterschrift zu sehen. Stattdessen hält er das ganze Kapitel für nachpriesterschriftlich, wobei er Dtn 34,1-6.8 einer Hexateuchredaktion zuschreibt, an die das Josuabuch nahtlos anknüpfen kann, während 7.10-12 dann von einer Pentateuchredaktion stamme, die mit dem Tod des Mose den Pentateuch aus der Taufe hebt. Das Amt der Vermittlung des Gotteswillens wird also nicht von Josua weitergeführt, der gerade kein Prophet wie Mose ist, sondern von der verschrifteten Tora. Josua dagegen führt die Toraauslegung weiter, was das Amt der Schriftgelehrten in der nachexilischen Zeit begründet. Den forschungsgeschichtlichen Überblick zum Moselied (Dtn 32) leitet Otto mit der Bemerkung ein, dass in keinem anderen Kapitel des Deuteronomiums die Wege der Forschung so weit auseinandergehen, von mosaischer bis zu hellenistischer Datierung. Ein ironischer Unterton in der darauf folgenden Darstellung der Forschungsgeschichte ist wohl nicht von der Hand zu weisen. Otto selbst möchte die Datierung des Moseliedes in Dtn 32,8-9 verankern: Die Verteilung der Völker auf Mitglieder des himmlischen Hofstaates entspreche der Organisationsform des achämenidischen Großreiches; da das Moselied ohne diese Verse nicht funktioniere, sei eine Abfassung vor dem 4. Der Herder Verlag bewirbt Eckart Ottos auf vier Bänden angelegten Kommentar zum Deuteronomium folgendermaßen: "Dieser Deuteronomium-Kommentar vereinigt erstmals in der Geschichte der Auslegung des Buches diachrone, an der Entstehung des Textes, und synchrone, an der Interpretation des Endtextes orientierte Auslegung". Schon nach den ersten beiden Bänden, die Dtn 1-11 auslegen, ist deutlich, dass es sich um einen epochemachenden Kommentar handelt, der auf lange Zeit hinaus neue Maßstäbe für die Kommentierung des Deuteronomiums setzt. Gerade das Bemühen darum, synchrone und diachrone Auslegung miteinander ins Gespräch zu bringen, ist ein Verdienst Eckart Ottos, das den Kommentar auch zu einem gewinnbringenden Werk für Leser macht, die den literar-und redaktionskritischen Operationen rein diachroner Kommentare mit Skepsis begegnen. Die Seitenzählung geht fortlaufend durch alle vier Bände. Der dritte Teilband zu Dtn 12,1-23,15 wendet sich dem Deuteronomischen Gesetz zu und enthält entsprechend, bevor es an den eigentlichen Kommentar geht, eine "Forschungsgeschichtliche Standortbestimmung der Literatur-und Rechtsgeschichte der Gebotspromulgation Dtn 12-26 in der Zweiten Moserede" (1082-1116). Darin skizziert Otto sein Modell zur Entstehung der Pentateuchgesetze: Die im 9./8. Jhd. verortete erste Redaktion des Bundesbuches diente als Paradigma für die Redaktion des im 7. Jhd. entstandenen "vordeuteronomistischen Deuteronomiums", wobei dieser erste Entwurf des Deuteronomiums als Revision des Bundesbuches konzipiert ist, freilich nicht, um dieses zu ersetzen, sondern um mit ihm zusammen gelesen zu werden und als Schlüssel für die rechte Auslegung des Bundesbuches zu dienen. Erst in einer weiteren, deuteronomistischen Redaktion kommt der ebenfalls deuteronomistische Dekalog zum Deuteronomium hinzu und mit wenigen Einfügungen konnte die dtr Redaktion das Deuteronomische Gesetz dann dem Dekalog (der in der Gestalt von Dtn 5,6-21 nach Otto ein Pentalog ist) entsprechend gliedern. Dieses deuteronomistische Deuteronomium wurde nach Otto dann (zusammen mit dem Bundesbuch) im Heiligkeitsgesetz (Lev 17-26) rezipiert, wiederum nicht mit einer Ersetzungsabsicht, das Heiligkeitsgesetz soll dann seinerseits in nachexilischen Fortschreibungen auch wieder auf das Deuteronomium eingewirkt haben (was Otto allerdings kaum ausführt). Leider fehlt analog zu dieser diachronen Einführung eine synchrone Heranführung an die Gesetzespromulgation in Dtn 12-26. Was heißt es für die synchrone Lektüre des Deuteronomischen Gesetzes, dass nach Dtn 1,5 Mose im Deuteronomium die Tora auslegt? Ist damit nur das Bundesbuch gemeint? Oder soll man für eine synchrone Lektüre von Dtn 12-26 die ganze Priestertora und das Heiligkeitsgesetz mit berücksichtigen? Soll man beispielsweise Lev 25 als Verstehenshintergrund von Dtn 15 lesen? Spielt Num 35 für eine synchrone Auslegung von Dtn 19 eine Rolle? Diese Anfragen deuten bereits an, dass in der Auslegung letztlich doch noch die diachrone Interpretation überwiegt und dass die synchrone Lektüre von Ottos diachronen Modellen bestimmt wird. Dies lässt sich exemplarisch an Dtn 12 zeigen: Otto schichtet Dtn 12 diachron auf, wobei er in 12,8-12.20-28 eine nachexilische Fortschreibung ausmacht, die das Altargesetz aus Lev 17 rezipiert.
