The present article examines the functions played by concordats and other intergovernmental agreements (IGAs) in the United Kingdom, in light of the experience of some multilayered states, notably Canada, Belgium, Australia, Switzerland, Germany, the United States and Spain. The author first explains the role of IGAs in multi-layered states, before addressing their similar function in the UK.

The legal status of IGAs varies greatly between federations, but agreements play at least five common functions. First, they are used for substantive policy coordination or harmonization between orders of government. Second, they govern intergovernmental process and procedure. Third, IGAs play a ‘para-constitutional’ function when they are used to circumvent the formal distribution of powers or to formalise a convention. Fourth, they are instruments of ‘regulation by contract’, using the guise of compromise and consensus as an alternative to a unilateral exercise of power. Fifth, IGAs are instruments of soft law, negotiated, drafted and implemented as if they were binding regardless of their legal status.

UK concordats are essentially designed to ensure efficient information-sharing, early-warning and rules of confidentiality between administrations. As such, their main function is that of ‘procedural cooperation’. However, a closer examination reveals that they also serve some policy-coordination functions. Furthermore, the ‘no surprise’ credo they embody is reminiscent of the principle of federal comity or federal loyalty and points to a para-constitutional function. There is also no doubt that concordats play a soft-law function in the conduct of devolution politics. Finally, time will tell whether in the UK, as in other multi-layered States, concordats will play ‘regulating by contract’ functions, dressing up directions from the centre in consensual terms.

Cet article offre une comparaison entre l’expérience de quatre capitales fédérales (Washington D.C., Ottawa, Canberra et Lagos/Abuja) et celle de Bruxelles-Capitale dans un État (qui était à l’époque) en voie de fédéralisation. L’auteure soutient que le choix d’une capitale et la détermination de son statut dans un État fédéral est plus complexe que dans un État unitaire. En effet, à travers l’analyse historique du choix de la capitale, l’auteure démontre que ce choix est souvent le résultat d’un compromis et de marchandage politique. L’évolution historique des structures administratives des quatre capitales examinées permet de conclure que la capitale, dans un État fédéral, est investie d’un rôle de représentation de toutes les entités fédérées qui peut mener à des conflits avec les intérêts locaux et municipaux au sein de celle-ci. En dernier lieu, le rôle unique de promotion de l’unité nationale imposée à la capitale dans un État fédéral créé des défis supplémentaires. Dans la seconde partie, s’inspirant de ces réflexions, l’auteure examine la situation de Bruxelles-capitale en Belgique. L’auteure soutient que le choix de Bruxelles s’est fait « par défaut », et que le choix de l’emplacement n’est pas le nœud du problème. Ce dernier vient plutôt de la formule à adopter- c’est-à-dire le statut juridique et constitutionnel de la capitale. Bruxelles, étant à la fois région et capitale, s’est vue octroyer des compétences semblables à une Région, avec des mesures pouvant cependant limiter son autonomie de façon importante. De plus, la promotion de l’unité nationale, habituellement réservée aux capitales d’États fédéraux, ne semble pas constituer un objectif du gouvernement national, comme le démontre la quasi-absence d’institutions bruxelloises représentatives des entités fédérées. L’auteure conclut que le processus de fédéralisation par dissociation explique la complexité institutionnelle qui caractérise Bruxelles-capitale,  les multiples rôles qu’elle tente de concilier, ainsi que l’ambigüité qui règne entre le rôle de Bruxelles en tant que capitale d’une part, et son statut d’entité fédérée d’autre part.
This article offers a comparison between four capital cities (Washington D.C., Ottawa, Canberra and Lagos/Abuja) and Brussels, a capital city in a state (that was, at the time of writing) in process of federalization. In the first part, the author contends that the choice of a capital city and the determination of its status in a federal state is much more complex than in a unitary state. Indeed, by analyzing the historical choice of the four aforementioned capital cities, the author argues that this choice is the result of a political compromise. By examining the historical evolution of administrative structures of capitals, the author concludes that capital cities in federal states are invested with a unique role of representation of federal entities that may give rise to potential conflicts between local and national interests. Lastly, the symbolic role of promoting national unity for a capital in a federal state creates additional challenges. In the second part, drawing from these conclusions, the author examines the status, the roles and challenges for Brussels in Belgium. The author contends that Brussels was a “default choice”. The capital city’s location was not the primary issue: rather it was its (future) juridical and constitutional status that generates tensions. Brussels, both a Region and a capital city, has been granted considerable powers, which have, however, been limited by a number of measures restraining its autonomy. Moreover, the promotion of national unity, usually attributed to capital cities in federal states, is not an objective of the national government in Brussels’ case. This is exemplified by the lack of institutions representing, formally or not, the federal entities. The author concludes that Belgium’s federalisation by dissociation explains Brussels’ institutional complexity and the ambiguity regarding its multiple roles and status as a federal entity on the one hand, and as a capital city on the other.

In the past 30 years, Belgium has been transformed from a unitary and centralized state to one of the most decentralized federal regimes. A combination of self-rule and shared rule permits several cultural communities to share a political space. This article discusses the factors which contributed to the adoption of a federal structure. It explores the co-existence of regional and cultural units within Belgium. The article then examines the complex power sharing and conflict resolution arrangements. Finally, it addresses challenges such as the complexity of its institutions that risk hindering democratic participation, the polarizing effects of accommodation mechanisms, and the lack of accommodation for minorities falling outside the ‘founding nations.’

French Abstract: La typologie dominante relative aux minorités – qui distingue « minorités nationales », « peuples autochtones » et « minorités ethniques » issues de l’immigration – ne permet pas de saisir la spécificité et la complexité des situations des communautés francophones en milieu minoritaire (CFMM) du Canada. L’auteure propose trois pistes de réflexions visant à rendre plus visible le sort des CFMM dans la classification du droit des minorités : remplacer les catégories rigides par un « continuum », introduire de tels « continuum » au sein de chacune des catégories, et, enfin, l’ajout d’une catégorie à ce que l’on pourrait qualifier de « triptyque de Kymlicka ». Mieux situer les CFMM dans les schémas conceptuels relatifs à l’aménagement de la diversité nécessite notamment une clarification des aspirations autonomistes des CFMM, et plus particulièrement de leur positionnement par rapport à l’autonomie politique (dans le sens « d’étatique » ou de « gouvernementale »).

English Abstract: The dominant classification of minorities—which distinguishes between “national minorities”, “aboriginal peoples” and “ethnic minorities”—does not capture the specificity and complexity of the French-speaking communities who do not enjoy territorial autonomy in Canada (basically French-speakers outside Quebec). The author suggests three tentative answers to what could be called “Kymlicka’s blind spot”. These include replacing rigid categories by a continuum, introducing some form of continuum in the current categories or adding a category to the existing typology. Any exploration of alternative conceptual schemes requires notably a clarification of the claims of autonomy made—or which could be made—by these linguistic minorities, including claims of territorial or non-territorial political autonomy.

Since the 1970s, Belgium has transitioned from a centralized unitary state to a highly decentralized federal one. Mixing self-rule and joint-rule, it accommodates several cultural communities. However, institutions of appeasement have also engendered confrontation. This paper offers an institutional analysis of the Belgian federal structure. It examines its emergence, its socio-linguistic characteristics, its institutional makeup, and its cooperation and conflict resolution mechanisms. It then looks at the paradox of its simultaneously pacifying and confrontation-inducing institutions, concluding that Belgium’s institutional complexity is opaque for citizens, and that its divided territories, dual structures, and bipolar power-sharing arrangements reinforce divisions.

While closely related to collective rights, autonomy in a diverse society is about empowerment. It relates to the capacity to adopt one’s own (“auto”) norms or laws (“nomos”). This paper offers a brief reflection on the meaning of autonomy and on the groups which may legitimately and realistically claim forms of institutional autonomy. It then explores how the concept of “autonomy” can be translated into various forms of institutional design in contemporary states “blessed” with the asset of diversity. Advantages and disadvantages of various options are canvassed. The importance of trust-building mechanisms is also emphasised as a counter-balance for the segmentation which can result from otherwise legitimate schemes meant to promote the autonomy of certain culturally distinct groups.

French Abstract: Les différents ordres de gouvernement constituant les espaces politiques multinationaux interviennent dans la détermination des normes de protection sociale. Dans ce contexte, cette contribution vise à répondre à la question qui fait quoi, comment et pourquoi dans ce domaine. La première partie traite de la répartition du pouvoir normatif de légiférer relatif à la protection sociale dans certains États fédéraux et dans l’Union européenne.la seconde examine divers instruments qui permettent d’articuler l’exercice d’un pouvoir partagé. La troisième partie porte sur les fonctions du pouvoir normatif dans le domaine social. Il s’agit en premier lieu d’une fonction redistributive. En deuxième lieu, l’exercice du pouvoir normatif remplit une fonction de légitimation des institutions publiques de tous les paliers impliqués. Enfin, le domaine de la protection sociale joue un rôle de consolidation de la citoyenneté, particulièrement important et complexe dans les espaces politiques multinationaux où la solidarité sociale est le reflet d’un sentiment d’appartenance à la nation, mais peut également servir de moteur à un sentiment d’adhésion à la structure multinationale elle-même. Ceci explique en partie pourquoi État central et unités constituantes aspirent à participer à l’élaboration des normes de protection sociale et se font parfois concurrence pour occuper ce champ d’activité publique. Le pouvoir normatif dans la sphère sociale reflète et contribue aux phénomènes de loyautés multiples et de citoyennetés superposées. La consolidation de la citoyenneté ne peut donc emprunter la voie de l’homogénéisation, mais doit tenir compte de la dimension culturelle de la protection sociale et du droit à la différence.

English Abstract: In multinational polities, different orders of government are involved in determining the norms of social protection. In this context, this article addresses the question of who does what, how and why. The first section deals with the distribution of normative power concerning social protection in federal states and in the European Union. The second section examines a variety of devices enabling the articulation of shared power. Finally, a third section concentrates on the different functions of normative power in the social domain. The first one is obviously redistributive. Secondly, the exercise of normative power legitimises public institutions of all government levels involved. The third function, which is of particular interest in the context of multinational States (or political spaces such as Europe) consists in the consolidation of citizenship. The solidarity inherent in norms of social protection reflects the sense of belonging to a particular social group, and in this context, the nation. It can also serve to strengthen the sense of belonging to the larger political space, the multinational federation. In complex political structures, the power to establish norms of social protection contributes to the phenomenon of multiple loyalties and overlapping citizenship. Centralising citizenship in such a political context cannot success through homogenisation, but must respect the cultural dimension and the right to be different.

Social protection faces a number of specific hurdles and challenges in complex polities, be they multilayered or plurinational, or both. The intersection between social policy-making and institutional design raises issues of effective management, policy preferences, economies of scale and tension between “recognition” and “redistribution”. In this article, the author explores how comparative federalism can shed some light on processes of social protection in the context of European multilevel governance and how public actors in a multi-layered and interdependent set-up can contribute to an inclusive social project. She considers three dimensions of the potential dialogue between social protection in federal contexts and in the EU. First, she outlines why, given the wide diversity between MLG systems, it is illusory to go beyond an embryonic response to the intersection between multi-layered and multinational regimes on the one hand and social policy on the other. She then explains three functions (redistribution, bureaucratic and political legitimation, identity politics) played by social protection in federal regimes, particularly in multinational federations and quasi-federations. Finally, she surveys instruments used by federal partners in the design of social policies. The author concludes by noting that issues related to the intersection of social protection and institutional design raised in multinational federations resonate in the EU, regardless of the nature of the latter.

Belgium has moved from a model to be studied to a counterexample to be avoided. Belgians have superimposed a federal structure on preexisting constitutional compromises between Flemings and French speakers, which has led to a deeply polarized political and social landscape. The combined effect of consociative and federal institutions, along with Belgium’s key role in the European Union, provide much of the context for the Belgian drama. This article examines Belgium’s divisive institutions, such as its linguistically divided political parties, its purely proportional electoral system and its consequential need for coalition governments, its polarized and reductive political debates, its weak federal government, and its divided civil society. It then explores the possibility of Belgium’s units gaining independence within the European context. Finally, it closes with lessons for other divided societies.

French Abstract: Dans cet article, l’auteure contextualise le recours aux accords de coopération dans le processus de réformes constitutionnelles, en invoquant brièvement l’expérience d’autres fédérations et en effectuant un retour sur l’origine de cette institution dans l’ordre juridique belge en 1988-1989 et sur les fonctions qu’elle a remplies depuis. Après l’examen des diverses fonctions des accords de coopération dans les régimes fédéraux, dont celles d’ingénierie constitutionnelle, l’auteure traite de trois questions relatives au rôle réservé aux accords dans le cadre des réformes de 2001. Elle demande d’abord si les renvois par le législateur spécial à ces accords s’inscrivent dans la continuité ou constituent un saut qualitatif notable, et conclut que leurs fonctions constitutionnelles ne sont pas inédites (I). Ensuite, l’auteure demande si ces accords sont l’illustration d’une « dérive confédérale » ou constituent des outils incontournables de l’expérience fédérale, déterminant qu’ils s’inscrivent généralement dans la logique du fédéralisme belge (II). Finalement, elle considère les potentiels problèmes de constitutionnalité posés par le recours aux accords de coopération dans le cadre de réforme de l’État (III). Bien que le recours à ces instruments ne constitue pas une ingénierie constitutionnelle inédite, une dérive confédérale ou une violation constitutionnelle généralisée, il permet néanmoins de maintenir des normes élaborées au cours de négociations politiques à l’abri des juges et de l’assentiment parlementaire.

English Abstract: In this article, the author contextualizes the recourse to cooperation agreements in constitutional reform, by briefly discussing the experience of other federations and by exploring the origin of this institution in the Belgian juridical order in 1989-1990 and the role it has played since then. After an examination of the many functions of cooperation agreements in federal systems, the author studies three questions about the role of these agreements in the 2001 reforms. She first finds that the referral to these agreements by the special legislator is consistent with their historical role rather than a major shift in their conceptualization (I). She then asks if they demonstrate a confederal move or if they are inescapable instruments of federalism, concluding that cooperation agreements are coherent with Belgian federalism’s internal logic (II). Finally, the author discusses the potential constitutional problems caused by the use of cooperation agreements in state reform (III). Although the use of these instruments is neither a constitutional engineering, a confederal shift nor a generalized violation of the constitution, it nonetheless allows norms developed during political negotiations to be outside the scope of the judiciary and of the legislature.

French Abstract: Cet article propose une brève comparaison entre les systèmes fédéraux belge et canadien. Son but est de comparer la façon dont les fédérations belge et canadienne résolvent la tension entre la dualité culturelle/linguistique (bipolarité) et les institutions plus éclatées (multipolarité). L’auteure offre un bref rappel des réalités géographiques et démographiques de deux États. Malgré leurs apparentes diversités, les « pactes fédéraux » de ces deux fédérations ont été élaborés entre les deux groupes linguistiques/culturels considérés, alors, comme principaux. Cependant, le rapport de force entre les deux groupes principaux n’est pas le même dans les deux pays. Dans les deux fédérations, la minorité francophone jouit d’un degré de protection certain, notamment par le biais de la reconnaissance de leur langue comme langue officielle, et de la représentation au sein des instances fédérales. Ces garanties sont toutefois davantage « bétonnées » et ont plus de force juridique en Belgique - puisqu’elles façonnent les institutions-mêmes - que ce n’est le cas au Canada. En dernier lieu, l’auteure offre une revue des structures favorisant la multipolarité dans les deux pays. Malgré une multiplicité d’entités fédérées, le régime fédéral belge est foncièrement bipolaire, avec des tendances de confédéralisme. Les enjeux, tensions et pôles d’intérêt au Canada sont plus variés. Le droit canadien offre des garanties non-négligeables aux minorités francophones et anglophones, mais n’a pas traduit ces préoccupations dans l’édifice fédéral. La tension entre « bipolarité » et « multipolarité » se résout donc de manière distincte au Canada et en Belgique. L’auteure conclut en notant que malgré l’échec des réformes constitutionnelles au Canada, l’exemple belge démontre que les institutions ne sont pas sacrées et qu’elles sont susceptibles de transformations. Paradoxalement, toutefois, l’expérience belge illustre également que les institutions peuvent fossiliser les identités et générer des tensions, en polarisant les positions politiques.


English Abstract: This article intends to offer a comparison between the Belgian and Canadian federations. It aims to compare the way both federations resolve tensions between linguistic/cultural duality (i.e. bipolarity) and more “scattered institutions” (i.e. multi-polarity). The author starts her analysis by reviewing the different geographic realities of both federal systems. Despite their diversity, both countries’ “federal pacts” were elaborated between the “main” cultural/linguistic groups. However, the power struggles between these groups is not the same in both contexts. In both federations, the Francophone minority is protected through the recognition of French as an official language and mechanisms of representation in federal institutions. These guarantees are more permanent and “set in stone” in Belgium than in Canada, therefore having a binding effect. Moreover, they have considerably shaped Belgian institutions. In the last part, the author reviews the institutions and structures that have favored multi-polarity in both federal systems. Despite a multiplicity of federal entities, the Belgian federation is strongly bipolar, with some tendencies towards confederalism. In the Canadian case, issues and tensions are more diverse. Canadian law offers non-negligible guaranties to Francophone and Anglophone minorities, but has not translated these realities into federal institutions. In sum, the bipolarity/multi-polarity tension is resolved differently in Canada and in Belgium. Despite the failure of any constitutional reforms in Canada since 1982, the Belgian case demonstrates that institutions are malleable and should not be considered “sacred”. Ironically however, the Belgian case also illustrates how institutions may fossilize identities and generate tensions by additionally polarizing political positions.

French Abstract: Le système fédéral belge est à la fois original, extrêmement complexe et en constante évolution. Cet article tente d’en décoder les subtilités en les « transposant » au Canada : à quoi ressemblerait la fédération canadienne si elle était non seulement divisées en unités territoriales (provinces et territoires) mais également en « communautés » semi-territorialisées? Une telle fédération serait-elle mieux en mesure de promouvoir l’autonomie culturelle et politique au sein de cette fédération multinationale? Les « communautés » pourraient-elle fournir une « voix constitutionnelle » en reconnaissant des formes de pouvoirs politiques (en sus de droits linguistiques) à la minorité francophone hors Québec?

English Abstract: The “Belgian federal model” is original, highly complex and in constant evolution. This paper seeks to explain the intricacies of the Belgian federation by “transposing” its key elements to the Canadian context. This heuristic and pedagogical exercise allows the author to reflect on the (in)adequacy of having different types of constitutive units (territorial regions and semi-personal “communities”) as a means of promoting cultural autonomy in a multinational state. In particular, the author seeks to foster discussion on various adaptations of the “communities” model as a means of giving a “constitutional voice” in the form of institutionalised power (as opposed to constitutionalised rights) to the francophone minority living outside Québec.

French Abstract: Le rôle de la capitale d’un état unitaire se limite à accueillir le siège du gouvernement, à contribuer au rayonnement international de l’État et à susciter la fierté nationale de la population. Si la localisation de la capitale et le statut de celle-ci font parfois l’objet de négociations et de dissensions, la situation est encore plus délicate dans les États fédéraux. En effet, un État fédéral, surtout lorsqu’il s’agit d’un État multilingue ou multinational, impose souvent à sa capitale le mandat d’éveiller et de soutenir un sentiment d’appartenance à l’État central chez les citoyens des diverses entités fédérées. L’Importance de cette mission s’accroît avec la force des tendances centrifuges que connaît éventuellement la fédération.

La présente contribution traite, sous l’angle comparatif, du choix de la localisation d’une capitale, du statut de celle-ci et de la maison particulière dont elle est investie au sein d’un État fédéral. Pour ce faire, cette analyse portera surtout sur les cas d’Ottawa et de Washington, et d’autres exemples, tels Canberra ou Abuja, seront également invoqués.

L’on constate en premier lieu que le choix de la localisation de la capitale résulte généralement d’un compromis au sein de la fédération naissante. Elle sera par ailleurs souvent située en territoire « neutre » sur le plan politique.

En second lieu, il appert que le statut juridique des capitales fédérales doit assurer un équilibre entre l’autonomie locale de la population qui y réside et la préservation des intérêts de la fédération, dont la capitale est l’un des principaux symboles. Sauf de très rares exceptions (Vienne, Berlin, Canberra), situées dans des États ne faisant pas face à des tendances centrifuges, les capitales ne possèdent pas en même le temps le statut d’entités fédérées. Enfin, idéalement, la capitale d’une fédération devrait refléter la complexité de cet État. Elle devrait invoquer à la fois l’idée de l’unité et de diversité inhérente au principe fédéral. Les États fédéraux aux prises avec de sérieux problèmes d’unité (le Canada, le Nigéria) voient en leur ville-capitale un symbole rassembleur. La rhétorique entourant leur capitale est souvent sentimentale, voire naïve, mais elle dénote un désir d’utiliser ce symbole à des fins de promotion de l’unité nationale. Cette rhétorique s’apparente davantage à celle des États unitaires dans le cas de fédérations qui ne sont pas confrontées à des forces centrifuges importantes.

Bruxelles, comme la fédération dont elle est la capitale, ne suit aucun modèle préexistant. Elle multiplie les rôles : capitale de L’Europe, de la Flandre, de la Communauté française, et de la Belgique. Si la localisation de la capitale s’imposait, son statut combiné d’entité fédérée et de capitale fédérale engendre des ambiguïtés que d’autres fédérations ont choisi d’éviter. Enfin, le rôle de Bruxelles comme capitale fédérale semble souvent occulté. Le discours rassembleur associé à d’autres capitales fédérales en est largement absent. Ceci n’est guère étonnant étant donné la marginalité d’un tel discours au sein de la Belgique fédérale.

English Abstract: The capital of a unitary state’s role is limited to hosting the government’s seat, contributing to international recognition and promoting national pride. The localization and status of this capital often leads to negotiations and dissentions but the situation is even more sensitive in federal states. Indeed, a federal state, especially if multilingual or multinational, requires its capital to evoke and support a sense of belonging to the State from all its citizens. The importance of this mandate increases with the centrifugal tendencies that the federation eventually faces.

This article discusses, from a comparative angle, the choice of the localization of a capital, its status and the particular mission it plays within a federal state. It focuses on Ottawa, Washington, Canberra and Abuja. It makes several findings.

First, the choice of capital’s emplacement is generally the result of a compromise within the burgeoning federation. It will often be situated on politically “neutral” territory. Second, the legal status of federal capitals must ensure a balance between the autonomy of the local population and the preservation of the interests of the federation, as the capital is one of its main symbols. Except in rare cases (Vienna, Berlin, Canberra) where states do not face centrifugal tendencies, capitals do not concurrently hold the status of federal entities. Finally, the capital of a federation should ideally reflect the complexity of the state, invoking at once the idea of unity and of diversity inherent to federalism. Federal states with serious unity problems (Canada, Nigeria) see their capital-city as a unifying symbol. The rhetoric surrounding their capital is often sentimental, if not naïve, but demonstrates a desire to use this symbol for the promotion of national unity. It resembles the rhetoric of unitary states for federations that do not face important centrifugal forces.

Brussels, as the Belgian federation, does not follow a pre-existing model. It fulfills several roles: capital of Europe, of Flanders, of the French community, and of Belgium. Even if the localization of the capital was inevitable, its combined status as federal entity and federal capital creates ambiguities that other federations chose to avoid. Finally, Brussels’ role as federal capital is often ignored, as the unifying rhetoric associated with other federal capitals is patently absent in Belgium. This is unsurprising as this discourse is absent from the Belgian federation itself.

This chapter is the introduction of Intergovernmental Relations in Federal Systems: Comparative Structures and Dynamics, a volume that identifies and compares mechanisms of intergovernmental relations (IGR) in thirteen federal systems from around the world. Although IGR are an integral and significant part of every federal system, they are often opaque. This comparative study – both descriptive and analytical – thus aims to identify and contrast IGR mechanisms in a systematic manner, as well as to assess their impact on federalism and outline the common trends and challenges they raise. The authors then comment on the methodology used throughout the study to facilitate transnational and transdisciplinary dialogue before outlining the structure of the volume.

This chapter concludes Intergovernmental Relations in Federal Systems: Comparative Structures and Dynamics, a volume that identifies and compares mechanisms of intergovernmental relations (IGR) in thirteen federal systems. It draws together the findings of the volume, loosely following the template provided to the authors and the structure of the various chapters. Part I identifies points of difference and convergence in the history, design, and system of government of the federations under study in order to highlight the ways in which these factors affect IGR. Part II compares the forms and processes of IGR of the thirteen case studies, dealing with legislative and executive involvement, joint and specialized agencies, intergovernmental agreements and fiscal federalism, among other things. Part III then identifies a range of emerging trends and common challenges in IGR across the thirteen case studies. Finally, the chapter concludes with reflections on the impact of IGR on federalism itself, underlining the competing tensions between centralising trends through formal or informal IGR on one hand, and resistance to this pressure by CUs and other actors, on the other.

In this article, the author explores the labels applied to state structures, more specifically the distinction between federalism and confederalism. Building on John Loughlin and Jan Velaers’ work, she argues that the terms “federation” and “confederalism” have both been instrumentalized by Belgian politicians, contributing to the confusion and conceptual murkiness that surrounds these terms.

The first part of the paper stresses the importance of reassessing our conceptual vocabulary to account for the “messiness” of Belgian institutions. The author suggests a distinction between (con)federal-ISM as a political ideology and (con)federat-IONs as concrete institutional design. She also reviews the interwoven federal and confederal character of Belgium’s institutional design. The second part of the article seeks to decipher the nature of the Fédération Wallonie-Bruxelles (FWB), a public (but not legal) entity of the French Community. The FWB combines elements of a constitutive unit of the Belgian federation with federal and confederal traits. The “re-branding” of this entity with a misleading name illustrates that Flemish parties who promote “confederal” solutions for Belgium do not hold a monopoly on strategic semantic confusion.

French Abstract: Depuis plusieurs années, le principe du fédéralisme coopératif a rempli deux fonctions dans la jurisprudence de la Cour suprême du Canada. D’une part, il a favorisé une reconnaissance, de facto ou de jure, de chevauchements de compétences. D’autre part, il a permis aux juges d’écarter des obstacles à la normativité en réseau. Cette conception d’un fédéralisme « souple » ou « moderne » tranche avec la structure officiellement « dualiste » du fédéralisme canadien et invite les pouvoirs législatifs et exécutifs de divers ordres de gouvernement à coopérer. L’arrêt de 2015 relatif à l’abolition du registre des armes d’épaule offre un terreau fertile pour analyser une troisième fonction du fédéralisme coopératif, qui émerge lorsque les autorités publiques de divers ordres de gouvernement ne coopèrent pas, ou plus, ou souhaitent agir de manière unilatérale en dépit d’arrangements coordonnés préexistants. Dans cette affaire, la Cour suprême a refusé de revoir sa vision maximaliste du principe la souveraineté parlementaire - l’un des piliers du fédéralisme « dualiste » - à la lumière du fédéralisme coopératif. Elle a ainsi implicitement refusé de reconnaître aux divers législateurs une quelconque obligation d’agir de bonne foi, en raison du contexte fédéral dans lequel ils évoluent. Bien qu’une dissidence robuste réitère son engouement pour le fédéralisme coopératif, elle le fait en procédant à une réévaluation particulièrement contextualisée des compétences législatives en l’instance, plutôt que par la reconnaissance d’une quelconque forme de « loyauté fédérale ». Il en résulte une coexistence malaisée des conceptions « dualiste » et « coopérative » du fédéralisme dans la jurisprudence constitutionnelle canadienne.

English Abstract: Over the years, the Supreme Court of Canada has evoked the principle of cooperative federalism to promote a de facto or de jure legislative overlap. It has also used cooperative federalism as a justification for removing (or ignoring) technical obstacles to the normative networks on which cooperative arrangements rest, and which belie the profound dualist nature of the official Canadian federal architecture. The Court’s 2015 ruling on the abolition of the Long-gun registry by federal authorities offers a fertile ground for reflecting on a third dimension of cooperative federalism, which arises when federal partners do not - or no longer - wish to collaborate. In that decision, the Court refused to revisit its maximalist understanding of Parliamentary sovereignty - one of the pillars of the “dualist” conception of federalism - in light of cooperative federalism. It thus implicitly refused to infuse constitutional law with any obligation on the part of federal partners to act in good faith in their dealings with one another. While a robust dissenting opinion reasserts a commitment to cooperative federalism, it does so through a strongly contextualised assessment of the distribution of competences, rather than by any recognition of some form of “federal loyalty”. The end-result is an uneasy co-existence of two distinct - and contradictory - conceptions of federalism in Canadian constitutional law.

French Abstract: Dans cet article, un spécialiste flamand de la sécurité sociale belge et européenne, et une constitutionnaliste québécoise, tracent le portrait de la sécurité sociale en Belgique afin de situer le débat sur son éventuelle « communautarisation ». Ils commencent par camper un contexte juridique et historique général, en examinant la notion même de sécurité sociale, son histoire en Belgique, ses modes d’organisation et de financement. Ils se penchent ensuite sur l’impact que les diverses étapes de réforme de l’État depuis les trente dernières années ont eu sur la sécurité sociale. Puis, ils passent en revue les principaux arguments invoqués à l’appui d’un projet de dévolution vers les communautés des compétences en cette matière, de même que des principales objections auxquelles ce projet donne lieu. L’analyse est alors transposée dans un contexte comparé, et les auteurs examinent l’organisation de la sécurité sociale dans cinq autres États fédéraux, afin de voir si un modèle particulier de répartition des compétences en matière sociale émerge de l’expérience étrangère. L’impact de l’Union européenne sur l’organisation de la sécurité sociale des États membres est également analysée. Enfin, les auteurs s’interrogent sur la symbolique que représente la sécurité sociale dans des États complexes, particulièrement les États multinationaux, aux prises avec des mouvements centrifuges importants.

English Abstract: This paper, published in 2000, remains to this day one of the “standard” analysis of the controversies surrounding the maintenance – or not – of social security under the federal umbrella in Belgium, the arch-typical federation “by dissociation”. The authors address the intersection between federalism, nationalism and social protection. They first review the legal norms and historical context grounding social security in Belgium, including its organization and funding. They then analyse the impact which various rounds of decentralising state reforms have had, since the 1970s, on social security. They review the main arguments in favour of, and against, the devolution of social security to constitutive units. The authors then undertake a comparative exercise and explore the organization of social security in five different federations in order to assess whether a particular and common model of division of powers applies to social security. The impact of the European Union on the organization of social security in member states is also analyzed. Finally, the authors reflect on the symbolism of social security in complex states, particularly multinational federations struggling with important centrifugal movements.

French Abstract: La présente contribution s’interroge sur le pluralisme juridique dans le contexte des ententes intergouvernementales. Le droit positif classique pose une condition de pedigree au droit « officiel » : il naît de l’action officielle des organes de l’État. Seules les normes que l’État édicte constitueraient ainsi du « droit » digne de ce nom. Le pluralisme juridique, quant à lui, pose comme constat – ou postulat, selon l’approche – que l’État n’est pas l’unique, voire la principale source de normativité juridique. La présente note aborde la question sous un autre angle : les organes de l’État peuvent-ils se placer « hors du droit (positif) », tout en restant dans un registre normatif fortement contraignant, formalisé, au point qu’il en constituerait un réel ordre « juridique », parallèle au droit étatique « officiel » ? Autrement dit, l’État peut-il lui-même créer un registre de normativité qui fasse concurrence – ou du moins qui se place en réelle alternative – au droit positif. Le pluralisme juridique peut-il expliquer non seulement le phénomène de normativités plurielles hors de l’État, mais au sein de l’État ? La première partie identifie des symptômes, ceux d’un droit en marge du droit, un « non-droit qui ferait la loi ». Pour le droit public, il s’agit assurément d’une drôle de maladie (I). Dans la seconde partie, l’auteure tente un diagnostic. Pourrait-il s’agir d’une forme de pluralisme juridique ? (II). Enfin, la conclusion abordera le caractère de l’affliction (maladie infantile, contagieuse, chronique ?) et des éventuels remèdes susceptibles de la traiter (médecine traditionnelle (droit positif?) ou alternative (ordre juridique bis ?).

English Abstract: This article is concerned with legal pluralism in the context of intergovernmental agreements. The classical and positive approach to law considers “law” only what emanates from the State and its official actions. Only the norms dictated by the state can claim to be called “law”. Legal pluralism, however, posits that the State is not the sole source of legal normativity. The present article is concerned with another question: can the state’s organizations place themselves “outside” of the realm of positive/state law, even if these institutions stay in a binding normative register which does not represent another parallel legal order? In other terms, can the State, by itself, create another normative level that competes with the official legal order? Can legal pluralism, therefore, explain multiple normative orders that emerge outside of the realm of the State, but also within the State? The first part identifies the symptoms of this type of law, which can be an amusing disease for public law (I), which can be found on the “edges” of law. In the second part, the author offers a diagnostic. Could this phenomenon be characterized as legal pluralism? (II). In the last part, the author concludes by examining the nature of the affliction (childhood, contagious, chronic?), and possible “prescriptions” to treat the disease (traditional (positive law) or alternative medicine (parallel legal order?)).
