Michael Ashdown
I am Lecturer in Law at Somerville College, Oxford, and also a practising barrister at Wilberforce Chambers, Lincoln's Inn, London. I was formerly Fellow and Tutor in Law at Somerville College, Oxford (2010-13) and CSET Career Development Fellow in Land Law and Trusts in the Faculty of Law of the University of Oxford (2007-10).
My research interests complement my practice: all aspects of the English law of trusts, including pensions, offshore trusts and tax, but with a particular focus on the powers held by trustees, and the consequences of their improper exercise. I have written particularly on the operation of the so-called 'rule in Re Hastings-Bass' and the related doctrines of mistake and fraud on a power.
I am currently interested in the role of professional advice in trustee and fiduciary decision-making, and the circumstances in which acting in reliance on apparently competent professional advice affords a defence to a breach of trust or other claim.
At Somerville College I give undergraduate tutorials and classes in land law, and am involved in the admissions process. I formerly also taught trusts and Roman law.
